HomeMy WebLinkAboutcc min 1957/04/09 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday April 9v 1957 The Council met in the Council Chambers at 7:00 P.M. in the City Hall on the above date, with the following Councilmen present: Councilmen Ruder, Smith, DeGraaf, Dillon Absent: Councilman DeWolfe Also present: City Administrator Wade, City Attorney ¥o Campbell City Engineer Floyd~ Planning Secretary Stench*use, Sectyo-Clerk Saunders Mayor DeGraaf led the salute to the Flag APPROVAL OF COUNCIL MINUTES It was moved by Councilman Smith, seconded by Councilman Dillon and carried, that the Minutes for meetings of March 12, 18, 19, 20, and April 2nd be approved, copies having been sent to each Councilman. ORDINANCE No. 562- Approving ~hittington Annexation No. 1-second reading It was moved by Councilman Ruder, seconded by Councilman Smith and carried, that Ordinance No. 562 be placed on its second reading; that the reading of the text be waived and the Ordinance adopted. The ~otion carried by the following vote, to-wit: AYES: Councilmen Rader~ S~ith, DeGraaf~ Dillon Noes: None AbSent: Councilman DeWolfe Councilman DeWolfe arrived at this time - 7:10 P,M ORDINANCE No. 563 - Approving Telegraph Enolls Annexation- second reading It was moved by Councilman Raders seconded by Councilman Dillon and carried, that Ordinance No, 563 be placed on its second reading; that the reading of the text be waived and the Ordinance adopted. CItAMBER OF COMI/ERCE REQUEST FOR METHOD OF COLLECTING CHRISTMAS DECORATIONS Councilman S~ith suggested a committee be appointed to study the request and report to the Council. City Ad~iuistrator Wade requested that City Finance Officer Grant .be.on the coamitteeo Mayor DeGraaf indicated he would appoint such s committee. RESOLUTION - Establishing through highway (H. Street overpass) City Attorney Mo Campbell suggested this resolution be held over until the May 14th meeting, at which time Ordinance No. 561 would be in effect. RESOLUTION -Accepting Deed from School District for street purposes Mayor DeGraaf appointed Councilman Rader and Councilman DeWolfe to look into this matter and report at the meeting of April 23rdo RESOLUTION -No. 1941- Dedication of Lot A-Kile Morgan Terrace Subdivision Offered by Councilman Raderl read in full~ passed~ adopted and approved by the following votel to-wit: AYES: Councilmen Rader~ -q~ithe DeGraaf~ Dillon~ DeWolfe Noes: None Absent: None RESOLUTION No, 1942 -Accepting deed to parking lot Offered by Councilman 8mith~ read in full~ paseed~ adopted and approved by the following vote~ to-wit: AYES: Councilman Smith~ DeGraaf~ Dillon, DeWolfe, Rader Noes: None Absent: None ~/~CIVIL DEFENSE OPERATIONAL AREA COORDINATOR A letter was read from W, L, Roberta~ Coordinator~ California Disaster Officel stating the County PlanninE Board had reco~uaended the Chief Administrative Officer of the County to be the Civil Defense Operational Area Coordinator~ and requested that the Council approve t~ recom~endation and inform the Board of Supervisors accordingly, It was moved by Councilman DeWolfe~ seconded by Councilman Dillon, and carried~ that a letter be written to the Board of Supervisors approving the recomendation of the County Planning Board, ~QUEST FOR PURCHASE OF PARKING METERS FOR NEW LOT City Administrator Wade reported the cost of twenty parking meters requested by the City Finance Officer for the new parking lot would be $1116. Nayor DeGrasf appointed Councilman Dillon to make a study of the need for the meters at this time, together with a financial report covering the parking meter fund~ and report at the April 23rd meeting. ~INTERSECTION AT FOURTH AND C. STREET City Engineer Floyd read the letter from the County Road Comis- sioner againv outlining general conditions as a basis of an agreement for County-City development and maintenance of the intersection at Fourth Avenue and C, Street, Approximate cost to the City would be $7000. It was suggested that the matter be held until plans and specifications are before the Council before entering into an agreement with the County. City Engineer Floyd stated that Mr. Sam Shapov had been granted a zone variance at Fourth Avenue and C. Streets~ subject to his providing a drainage culvert at the lntersection~ and to date n~o~hinE had been done about the culvert. It was moved by Councilman /DeWolfe~ seconded by Councilman ~lth, and carried, that City Engineer v Floyd be instructed to write Mr. Shaper informing him of the proposed develolxaent of the intersection at Fourth Avenue and C. Xtreet, and that he fulfill his part of the agreement cited in his zone variance, r~questing that he reply within ten days as to his intentions~ otherwise ~he City would be obligated to install the culvert and hill him for the installation. / CIVIL SERVICE RECOMMENDATIONS - Civil Defense Director A letter was read from the Civil Service Comission recom~ending that~ if the Council so desires~ the Civil Defense Dtrector~ due to his irregular hours, be paid a monthly sum for defraying expenses rather than being classified and put on a salary, It was moved by Councilman Smith seconded by Councilman De~olfe~ and carried~ that Purchaser-Analyst Ross make a survey of other cities of comparable size to determine what they are doing in the way of compensating their Civil Defense Directorsl and report back to the Council, -2- ~I~CK INSURANCE EXCHANGE LETTER A letter was read from Farmers Truck Insurance Exchange suggest- ing that the City surface existing unpaved street shoulders as a safety factor. The letter was filed. ~UEST TO EXCHANGE ACCOUNTING EACHINE A letter was read from City Finance Officer Grant requesting the exchange of our present Burroughs Accounting lachine Series 300 for a Series 500 machine. It was moved by Councilman Smith, seconded by Councilman l~tder, and carried, that Mr. Grant be authorized to exchange our present model 300 Burroughs Accounting Machine for a model 500~ as requested, at a price not to exceed $2400. This amount to be paid and budgeted in the next fiscal year. f~BRARY GIFT In regard to the $100. gift received by the Library Board~ and acted upon at the last meeting~ Councilman I)eWolfe a~ended his motion to read: that a letter be written to the Library Board explaining that in conformance with the City Charter they sust deposit the gift through the finance department into the Library Fund, after which they may then expend the monies by City Warrant for any purpose except building alterations. The motion was seconded by Councilman Dillon and unanimous- ly carried. ~PETITION FOR ELIiINATION OF TRAFFIC HAZARD City Engineer Floyd presented a petition signed by twenty-four property owners requesting the elimination of pedestrian and traffic hazards at the intersection of Second Avenue and G. Street by grading the Southeast corner of G. Street through to Second Avenue. It was moved by Councilman Smith, seconded by Councilman Rader~ and carried, that the City Engineer be directed to inform the property owners to give slope rights on the North and South side of G. Street East of Second Avenue and install curb, sidewalk and gutter on G. Street~ or inform them the City will have to do it under the 1911 Improvement Act; also to request slope rights on the two lots South of G, Street on the East side of Second Avenue and grade to sidewalk level, but not to insist upon sidewalks, curbs & gutters. A letter was read from ~. Neumeyer, Executive Secretary, acknowledging receipt of the Mayor*s telegram to the President of the United St~ates reco~uaending that Brown Field be selected as the municipal airport site for San Diego. c//CHURCH DIRECTIONAL SIGNS City Administrator Wade reported he had contacted the Ministerial Assn. and the President stated the Association wa~ not in favor of additional directional signs, and would favor ramoval of those now installed on public property. It was moved by Councilman Smith, seconded by Councilman Dillon, and carried~ that the request of St. Mark*s Lutheran Church to erect directional signs be denied. The City Engineer was directed to contact representatives of the Churches now having signs on public property in order that they could take down their signs or have us do it for them. FURTHER STREET IMPROVEMENTS REQUESTED Peter Schnor, 730 First Avenue, stated he thought there was room for improvement in the sidewalk, cur~ and gutter program in the City~ and asked that the Council push the program a little harder. ~IRE STATION FURNITURE AUTHORIZED City ld~inistrator Wade stated the furniture for the new Fire Station at Hilltop ¥illage~ including phone installation would cost $1700. and recommended it be purchased out of the Civic Center building fund. It was moved by Councilman DeWolfe~ seconded by Councilman Dillon, and carried, that the purchase be authorized and $1700. be allocated from the building fund (1-18-dl) to cover the cost. The motion carried by the following vote, to=wit; -3- AYES: Councilmen DeWolfe, Radar, Smith, DeGraaf, Dillon Noes: None Absent: None City Administrator Wade was directed to check into the cost of the telephone installation and service. C/RR~UEST FOR REMOVAL OF RAILROAD TRACES ON THIRD A¥~NUI Councilman S~lth stated that it was his opinion official action should be t~ken to have the tracks on Third Avenue removed on the basis they create a safety hazard now that the City has grown to its present size. It was moved by Councilman Smith, seconded by Councilman DeWolfe and carried, that the matter be referred to the City Attorney to investilate prospects of reaoval of the railroad tracks on Third Avenue and that a traffic count be taken on Third Avenue between Parkway and G. Streets. ~SOUTH BAY ANNEXATION It was moved by Councilman Smith, seconded by Councilman DeGraaf and carrieds that the City Attorney be directed to take legal action to restrain petitioners in the ~outh Bay area from circulating petitions in the ~outh Bay area for annexation to Ran Diego until after fifty days. The motion carried by the following vote, to-wit: AYES: Councilmen Smiths DeGraafs Radar Noes: Councilman DeWolfe Absent: None C Councilman Dillon abstained from voting. It was moved by Councilman Rader~ seconded by Councilman Smith, and carrieds that the City Attorney work with the Imperial Beach attorney in an attempt to determine the legality of the Bay Corrldor~ and that an amount not to exceed $150. be appropriated from unappropriated surplus of the General Fund for use of the Attorney in case a trip to Ran Francisco or Racra~ento is necessary. The motion carried by the following votes to-wit: AYES: Councilmen ~ader~ Smith beGraaf~ Dillon Noes: None Absent: None Councilman DeVolfe abstained from voting ~D~ITIONAL CO[PEN~ATION FOR CITY ATTORN~ RECOIMENDED Councilman S~ith stated that in his opinion additional compensation for the City Attorney for special cases should be considered in the coming budget sessions, ~/~PgNS~ OF COOK CASE DISCUSRED Councilman Radar stated that in his opinion continuation of the Harley Cook case was a waste of the tax payers money~ and that it was time the Council took some action to stop the unnecessary spending of the taxpayers money, No action taken, ADJOURNMENT ~ayor DeGraaf adjourned the meeting at 9:45 P,~o until April 23, 1957 at 7:00 P~.
