HomeMy WebLinkAboutcc min 1966/08/23Held Tuesday MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA August 23, 1966 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chambers on the above date at 7:00 P.M. with the following Councilmen present: Councilmen Sylvester, Anderson, Sparling Absent: Councilmen McCorquodale, McAllister Also present: City Engineer Cole, City Attorney Lindberg, Assistant Admini- strative Officer Stenberg, Associate Planner Manganelli In tho absence of Mayor McAllister, Mayor pro-rem Sylvester presided, leading in the pledge of allegiance to the Flag and asking for a moment of silent prayer. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Anderson, seconded by Councilman Sparling, and carried that the minutes for the meeting of August 16, be approved, copies having been sent to each Councilman. PUBLIC HEARING (continued) - Proposed rezoning of property along south side of Bonita Road and east of Sandalwood Drive from R-3-D to C-1-D and front setback from 25' to 15' This being the time and place, as designated, for the continuation of the hearing on the proposed rezoning of property along the south side of Bonita Road and east of Sandalwood Drive from R-3-D to C-1-D and front set- back change from 25' to 15', Mayor pro-tem Sylvester declared the hearing open. ~7:05 P.M. - Mayor McAllister took his seat at the council table at this time, Mr. Frank Ferreira asked that the hearing be continued for an addi- tional 10 dayg, as well as Item 13, which pertained to a conditional use permit to Shell Oil Company for a service station on the south side of Bonita Road, east of Sandalwood Drive. It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried, that the hearing be continued until September 13, 1966 at 7:00 P.M. and also that Item 13 be hold over until the same meeting. At this point Mayor pro-tem Sylvester relinquished the Mayor's chair to Mayor McAllister who proceeded to conduct the meeting. ~/ PUBLIC HEARING - Consideration of an amendment to the City Code relating to procedures for adoption of interim zoning and prezoning ordinances This being the time and place, as advertised, for a hearing on the proposed amendment to the Code relating to procedures for adoption of interim zoning and prezoning ordinances, Mayor McAllister declared the hearing open. No one wishing to be heard either for or against the proposed ordinance and the Clerk having received no written communications, the Mayor declared the hearing closed. ORDINANCE NO. 1010 - Amending Code relating to procedures for the adoption of interim zoning and prezoning ordinances - First reading It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried, that Ordinance No. 1010 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister Noes: None Absent: Councilman McCorquodale ~/PUBLIC HEARING - Considering change of setbacks on south side of "J" Street and west of Third Avenue This being the time and place, as advertised, for a hearing on a change of setbacks on the south side of "J" Street, west of Third Avenue, Mayor McAllister declared the hearing open. No one wishing to be heard either for or against the proposed setbacks and the Clerk having received no written communications, the Mayor declared the hearing closed. ORDINANCE NO, 1011 - Changing setbacks on south side of "J" Street and west of Third Avenue - First reading It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried, that Ordinance No. 1011 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, mylvester, Anderson, McAllister Noes: None Absent: Councilman McCorquodale ORDINANCE NO. 1012 - Levying taxes on all taxable property in the City for 1966-67 fiscal year - First reading and adoption It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried, that Ordinance No. 1012 be placed on its first reading, that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister Noes: None Absent: Councilman McCorquodale ORDINANCE NO. 1008 - Amending Chapter 17 of the City Code relating to the regulation of pawnbrokers, junk and second-hand dealers - Second reading It was moved by Councilman Anderson, seconded by Councilman Sylvester, and carried, that Ordinance No. 1008 be placed on its second reading, that reading of the text be waived and the ~rdinance adopted. The motion darried by the following vote, to-wit: AYES: Councilmen Anderson, McAllister, Sparling, Sylvester · Noes: None Absent: Councilman McCorquodale RESOLUTION NO. 4174 - Accepting grant of easement for sidewalk purposes on Casselman Street - Mr. Ferreira Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McAllister, Sparling, Sylvester Noes: None Absent: Councilman McCorquodale RESOLUTION NO, 4175 - Giving notice of intention to annex "C" Street Annexa- tion - September 6th set as time for hearing Offered by Councilman Sparling, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister Noes: None Absent: Councilman McCorquodale ~/~REQUEST FOR USE OF STREET FORM ARCHING PRACTICE Assistant Administrative Officer Stenberg stated that a request has been received from the Hilltop Band Boosters Club and from Mr. Gerald Kirk, Band Director for Hilltop High School, requesting that the Hilltop marching groups be allowed to use the full width of Claire Avenue between Shasta Drive and "I" Streets for practice purposes. A petition containing 110 names accom- panied the request and endorsed use of the street. Mr. Stenberg stated that the Traffic Engineer and Chief of Police have recommended that the request be denied. It was moved by Councilman Sparling and seconded by Councilman Ander- son, that due to the reports and recommendations of the Traffic Engineer and Chief of Police, the request be denied. The motion failed to carry by the following vote, to-wit: AYES: Councilman Sparling Noes: Councilmen Sylvester, Anderson, McAllister Absent: Councilman McCorquodale It was moved by Councilman Sylvester, seconded by Councilman Anderson, and carried, that the staff be directed to work with the school administrations of the various schools in an attempt to work out a pattern of marching routes as satisfactory as possible to both parties. REPORT ON SERRA REGIONAL LIBRARY SYSTEM Assistant Administrative Officer Stenberg reviewed, for the audience, the report on the Serra Regional Library System, as presented to the Council at the Council Conference held on Monday, August 22, 1966. It was moved by Councilman Sylvester, seconded by Councilman Anderson, and carried, that the City Attorney be directed to prepare for the next meeting the necessary resolution indicating the desire of the Council to participate in the Serra System. Councilman Sparling requested that copies of the Assembly Bill 114, Chapter 97 which is an amendment to the Serra Plan, be distributed to the Council for study prior to the next meeting. /~OMMERCIAL ARTIST AUTHORIZED FOR DESIGNING NEW CITY SEAL Assistant Administrative Officer Stenberg reported on the status of the study made to date on the proposed new City insignia or seal and stated that it would be desirable at this point to retain the services of a commer- cial artist to assist in the preparation of final sketches for Council con- sideration. Estimated cost was $750.00. It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried, that the Administrative Officer be instructed to secure the services of a commercial artist to prepare final sketches for the seal and ~that a resolution appropriating the necessary funds be prepared for presen- tation at a later date. EXPRESSION OF APPRECIATION Mrs. Frances Reeves, speaking for the League of Women Voters, thanked the Council for the action they have taken on the Serra ~egional Library Sy- stem. ~ INVITATION EXTENDED TO TECATE FIESTA Mayor McAllister extended a general invitation to all citizens to attend the Fiesta at Tecate which is currently being staged and will run until August 29th. ~ERVICE PLAQUE AND RESOLUTION AUTHORIZED FOR JOHN BATE Mayor McAllister stated that the Division of the League of California Cities has, to date, taken no action to recognize Mr. John Bate, former Port Director. The Mayor was of the opinion the City should take action, if it intends to, prior to the testimonial luncheon to be held in Mr. Bate's honor, September 1st. It was moved by Councilmen Sparling, seconded by Councilmen Sylvester, and carried, that the Administrative Officer be authorized to spend a maximum of $25.00 for preparation of a suitable plaque for Mr. Bate. RESOLUTION NO. 4176 - In recognition of Mr. John Bate for service to the Community Offered by Councilman Sparling, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister Noes: None Absent: Councilman McCorquodale COUNCIL CONFERENCE SET Mayor McAllister set Monday, August 29, 1966 at 3:30 P.M. as the time for a Council Conference to discuss the proposed code of ethics ordi- nance. ADJOURNMENT Mayor McAllister adjourned the meeting at 7:55 P.M., sine die.
