Campbell, planning Co~nnissl~n Secretary Stonehouse, Secretary Saunders-Purchaser-Analyst Ross Mayor DeGraaf led the salute to the Flag APPROYAL OF COUNCIL MINUTES It was moved by Councilman Rader, seconded by Councilman Smith, and carried, that the Minutes for the meetings of April 9, 23, and lay grd be approved, with a correction in the linutes of April 23rd under "Report On Broadway Tree R~moval" to read shoulders, curbs and gutters rather than sidewalks, curbs and gutters. PUBLIC HEARING - Protest hearing on Castle Park No. 1 Annexation This being the time and place, as advertised, for the public hearing on Castle Park Annexation No. l, Mayor DeGraaf called the hearing open, and called for protests from the audience. There were no oral protests. The Clerk reported a lengthy petition hsd been received, protesting the annexa- tion, and stated it would take some time to ascertain the total assessed valuation of the lands owned by those protesting. It was moved by Councilman Smith, seconded by Councilman Dillon, and carried, that the hearing be continued to Lay 28th, at 7:00 P.M. to give the Clerk time to determine the assessed valuation of the lands owned by those protesting. l~/,, PUBLIC BRARING - Whittington Annexation No. 2 This being the time and place, as advertised, for the public hearing on Whittington Annexation No. 2, Mayor l)earaaf called the hearing open and called for protests from the audience. There being no protests either oral Qr written from property owners within the territory proposed to be annexed or otherwise, the Mayor declared the public hearing closed. ORDINANCE No. 565 - Approving ~hittington Annexation No. 2- First reading It wac ~oved by Councilman Smith, seconded by Councilman Rader, and carried, that Ordinance No. 565 be placed on its first reading.The motion carried by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Dillon, DeWolfe, Rader Noes: None Absent: None The Ordinance was thereupon read in full. ; ,PUBLIC BEARING - Appeal on action of planning Couission in denying Petition to rezone E0 Street This being the time and place, ss advertised, for the public hearing on an appeal to action of the Planning Co,mission in denying a petition to rezone E. Street from Fourth Avenue to Broadway, ~ayo~ DeGraaf called the hearing open, and called upon those in the audience w~ishing to be heard. Ray Gustafson, Gus Schwing, Evelyn Weninger, C. C. Reynolds, W. L. Brach, Cliff Jones, and Ruth Vanderpool spoke in favor of rezoning So Street to commercial, and Wm. O0 Ramage and Mrs. Burns spoke against the rezoningo A written protest was received from the Pilgrim Lutheran Church and petitions signed by 90 property owners were received in favor of the rezoningo A letter was read from the Planning Commission requesting that the matter be held in abeyance ~ntil the services of a trained Planner are obtained, and a study and report ma~e on the contemplated rezoningo There being no others wishing to be heard, the Mayor closed the hearing. It was moved by Councilman Radar, seconded by Councilman DeWolfe, and carried, that E. Street be rezoned from Fourth Avenue to Broadway to a C-2 zone, and that the City Attorney be directed to prepare the necessary ordinance. The motion carried by the following vote, to-wit: AYES: Councilmen Radar, Smith, DeGraaf, Dillon, DeWolfe Noes: None Absent: None It was ~oved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that the rezoning be referred to the Planning Contaission for establisluaent of sons depths and set-back. ~HITTINGTON SUBDIVISION No, 5 - Approval of final map It was moved by Councilman Radar, seconded by Councilman Dillon, and carried, that the final map and improvement plans of Whittington Subdivision No. 5 be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond or the deposit of cash guaranteeing the performance thereof, which contract and guaranty shall be first approved by the City Attorney as to form and legality. RESOLUTION No. 1946 - Approving improvement agreement - Whittington Subdivision No. 5 Offered by Councilman Radar, read in full, passed, adopted, and approved by the following vote-to-wit: ~ES: Councilmen Radar, S~ith, DeGraaf, Dillon, DeWolfe Noes: None Absent: None ~/CAIi~S MAI(OR SUBDIVISION - Approval of final map It was moved by Councllm~n Smith, seconded by Councilman DeWolfe, and carried, that the final map and improvement plans of Cairns Manor Subdivision be accepted upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond, or the deposit of cash, guaranteeing the performance thereof, which contra~t and fuaranty shall be first approved by the City Attorney as to form and la,silty. A letter was read from R. E. Schuller for permission to move a house from 727 Cerro Gordo St. San Diego to 551 Third Avenue, Chula Vista. It was ~oved by Councilman DeWolfe, seconded by Councilman Dillon, and carried, that the matter be held over until the meeting of May 21st in order that Councilmen can look at the house before taking action. ILE~OLUTI~ No. 1947 -Establishing through highway (H. Street-west of Freeway) Offered by Councilman Radar, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Radar, S~lth, DeGraaf, Dillon, DeWolfe Noes: None Absent: None ~/BID AWARDED ON FIILK STATION RKMODKLING The City Engineer reported three bids had been received on the Hilltop Fire Station remodeling job, the low bid being that of Walt Selph in the amount of $5,273.00. It was moved by Councilman FAder, seconded by Council- man Dillon, and carried, that the City Achainistrator enter into a contract with the low bidder, and that $5,273. be allocated from the building fund -~Y~ml) to cover the cost. The motion carried by the following vote to:wit: /][Y~:councilmen FAder, Smith, beGrmaf,Dlllon,DeWolfe-Noes:none Absent-None ~REPORTON SEPARATION OF ~NGIN~ERING a PUBLIC WORKS DEPT, Mayor DeGraaf stated the Report on Organiaational Plan of the Public Works Depts. by Purchaser Analyst Ross had been received and studied by the Council, and asked if they cared to take action at this time. After discussion it was moved by Councilman Smith that the Organizational Plan be adopted as submitted. The motion died for lack of a second. Councilman Dillon requested that the Plan be held over for further study. The Council concurred. -2- ~/REQUEST FOR TRANSFER OF FUNDS A letter was read from Police Chief Taylor requesting that $75. be transferred from account 1-22-C.12, Office Supplies to 1-23-C.5, Clothing to purchase coveralls and rubber boots for Trustees in the City Jail. It was moved by Councilman Rader, seconded by Councilman DeWolfe, and carried, that the request be granted. ~I(EQUEST FOR FULL TIME CITY PLANNER A letter was read from the Planning Commission requesting that a full time Planner be hired and until such time as he is hired, the City avail themselves of the services of a Planning Consultant. The Councilmen generally were not in favor of hiring a Consultant, but suggested advancing the salary range for Director of Planning in order to attract applicants for the position. It was moved by Councilman msder, seconded by Counil- man DeWolfe, and carried, that the salary range for Director of Planning ~ changed from 28 to 31, and recommended that the Civil Service Commission recruit at step D ($647° per month) The motion carried by the following vote, to-wit: AYES: Councilmen Eader, DeGraaf, Dillon, DeWolfe Noes: Councilman Smith ~bsent: None ~T I~)RREZONING PORTION OF FOURTH AYNNUN A letter was read from the Planning Commission recommending that the portion of the East side of Fourth Avenue north of "D" Street be rezoned to R-3. It was moved by Councilman DeWolfe, seconded by Councilman Dillon and carried that June llth at 7:00 P.M. be set as the time for a public hearing on the recommended rezoning. RESOLUTION No. 1948 -Ascertaining the general prevailing rate of per diem wages (Gas Tax Project No. 31) Offered by Councilm~n Smith, read in full, passed, adopted and approved by the followins vote-to-wit: AYES: Councilmen Smith, DeGraaf, Dillon, DeWolfe, Rader Noes: None Absent: None ~/~I~OsiTION TO ASSEMBLY BILL No. 682 A letter was read from the Planning Commission recommending that the Council oppose Assembly Bill No. 682 which would prohibit any change of land use or zoning within 500 feet of any school, without the consent of the school district. It was moved by Councilman DeWolfe, seconded by Councilman Rader, and carried, that the Nayor send a wire to Sacramento tn op~ition of the bill. ~DATE SRTFORMEETING ON ~OHR PLAN A letter was read from the Planning Commission proposing that representatives of the Council, Planning Commission, Harbor Commission, Chamber of Commerce, and Mohr-Adamm-Plourde Co. meet at Bob's Coffee Shop at 7:30 A°M. on May 2lEt for a panel discussion on the Mohr report. Mayor DeGraaf appointed CouncilMn Dillon to attend the meetini. ~,~MPLOYEE ASSOCIATION H~QUEST FOR MEETING A letter was read from the Smployess' Association suggesting that representatives of the Council, Employees' Association, and Civil Service Commission meet to discuss a number of items the Association plans on bringing before the Council. The Council was of the opinion it might be best to meet firmt with the Civil Service Commission, and then appoint two Councilmen to mmet with the A~nociationo It was suggested that the Association mail detailed reports of its suggestions to the Civil Service Commiszion, so that they can bs thoroughly familiar with them. -3- ~//~LOSING OF VISTA SQUARE RECOMMENDED A letter was read from the National City- Chula Vista Board of Realtors recommending that the Vista Square Housing be closed as of O~tober, 1957. Mayor DeGraaf suggested that a mixed committee be appointed to study liquidation of the Housing Project, and that Councilmen submit names of persons they would like to serve on the committee at the first meeting in June, for appointment. LETTER OF APPl~ECIATION A letter was read from DeWitt Higgs in appreciation of services rendered by members of the Police and Fire Departments when his brother recently suffered a heart attack. /~UEST OF INDUSTRIAL DEVELOPMENT COMMISSION FOR pLACE ON AGENDA A letter was read from B. Coggan, Chatr~n of the Industrial Development Comission requesting time for appearance before the Council for presentation of the Industrial Coordinators' Report on industrial development on an area- wide basis within the County. The Clerk was instructed to write a letter informing him that if his presentation was not too long, the first meeting in July would be agreeable with the Council; otherwise it might be best to appear at the second meeting in Julys ,~4tEQUEST TO QUIET TITLE ON OLD LIBRARY SITE A letter was read from the Chamber of Commerce requesting that the City commence action to Quiet Title on the old library site. It was the opinion of the Council that if a committee approached the School Board, something might be worked out without a suit. Mayor DeGraaf appointed Councilmen Smith and DeWolfe to the coanittee, and named Councilman DeWolfe as Chairman. ~-~CI¥IL SER¥ICE RULE CHANGE - Central Stores Clerk A letter was read from the Civil Service Commixsion requesting that Section 12 of Rule 2 of the Civil Service Rules be amended by changing the title of Stock Control & Maintenance Clerk to Central Stores Clerk, and adjust the salary range from 16 to 18. It was moved by Councilman Rader, seconded by Councilman DeVolfe, and carried, that Section 12 of itule 2 of the Civil Service Rules be ~aended as recommended. T,.~FINDINGS OF CI¥IL SEI~ICE COMMISSION The decision of the Civil Service Commission sustaining the action of the Chief of Police in the Harley Cook case, and requesting that Mr. Cook be removed from the Classified Service effective November 2, 1956, was read to the Council. The paper was filed. ~'OPPOSITION TO ASSEMBLY BILL No. 1236 It was moved by Councilman DeWolfe, seconded by Councilman Smith, and carried, that the Mayor send telegrams to all those concerned in Sacramento, in opposition te Assembly Bill No. 1236. /MASS TRANSPORTATION SERVICES A letter was read from Mayor Charles Dail of San Diego, asking that Mayor DeGraaf appoint three persons to serve on a fact finding committee to conduct a complete study of mass transit. No action was taken. /~QUEST FOR USE OF COPPER PLUIBING A letter was read from Coast Plumbing & Heating asking that they be allowed to use copper plumbing on their job at 185 Glover Avenue, even though the Code does not authorize the use of copper. The City Attorney ruled that the Council had no jurisdiction to grant the request other than to change the ordinance. It .was suggested that the Building Inspector prepare a new ordinance and that the City Administrator and Building Inspector work out a solution to the company's problem with the firm. ./ SCHOOL DISTRICT TO DEDICATE One Foot strip City Administrator Wade informed the Council that the School Board was willing to dedicate the one foot strip on the North side of the center line of Naples Street adjacent to Dr. liar1 H. Kellogg School, but the City would have to pay for the required advertising° -4- ~R~SgNTATION OF BUDGgT - 1957-1958 City Administrator Wade presented his budget for the fiscal year 1957-1958 and suggested the following calendar: Advertise the budget May 30th Post with the City Clerk May 31st Public Hearing June llth Adoption June 25th It was moved by Councilman Dillon, seconded by Councilman Smith, and carried, that the calendar for the budget be adopted as recommended. ~COMMITT~M ON BUD~gT SgSSIONS Mayor DeGraaf stated it had been suggested to him that a committee of citizens be appointed to meet with the Council durlng the budget sessions. It was thought this would eerve no purpose, as there was a public hearing on the budget at which time anyone could appear and be heard. ~J~ItOOL DISTRICT IN LIgU TA~S Councilman Mader was of the opinion the Clty should pay the School District in lieu tazee on the Vista Square Housing Project, and suggested raising rentals in the Project $5.00 per unit, half of which could go to the Gramr School District and half to the High School Dietrict. No action was taken. ADJOURNMENT Mayor DeGraaf adjourned the meeting to 6:00 P.M. May 21, 1957.
