HomeMy WebLinkAboutcc min 1957/11/20 MINUTES OF A SPECIAL MEETING OF THE CI~I COUNCIL OF THE CITY OF CHULA VISTA, California Held Wednesday November 20, 1957 The Council of the City of Chula Vista met at 4:15 P.M. in the Council Chambers of the City Hall on the above date pursuant to notice of consent to hold a Special Meeting, with the following Councilmen present: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Absent: None Also present: City Attorney Boyer, City Administrator Fulwiler, Principal Civil Engineer Rarshman ~ACTION ON CASEY CASE AUTHORIZED City Attorney Boyer outlined the present status of the Casey Case pertaining to quieting title to a portion of Moss Street adjacent to his property at the intersection of Alpine and Naples Streets, and asked the Council how they wished to proceed. It was moved by Councilman Smith, seconded by Councilmen DeWolfe, and carried, that the City Attorney be directed to file an answer to the Quiet Title action brought by the Casey Construction Company against the City of Chula Vista, and not to file a dis- claimer, for the reason that the City claims the property in question to be a public street. ~,J~GAL SERVICES AUTHORIZED FOR COOK CASE /~ A letter addressed to City Administrator Fulwiler from Attorney James B. Abbey setting forth terms under which he would continue to represent the City in the Harley Cook Case, was presented to the Council for study. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that Attorney Abbey be retained to represent all defendants in the matter of Harley Cook versus the City of Chula Vista, et al in the District Court of Appeals under the terms set out in his letter to City Administrator Fulwiler dated November 14, 1957. Councilman Rader voted "no". ADJOURNMENT Mayor DeGraaf adjourned the meeting until November 26, 1957 at 7:00 ~oM.
