HomeMy WebLinkAboutcc min 1966/03/08Held Tuesday MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA March 8, 1966 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chambers on the above date at 7:00 P.M. with the follow- ing Councilmen present: Councilmen McMains, McAllister, McCorquodale, Sparling Absent: Councilman Anderson Also present: City Engineer Cole, City Attorney Lindberg~ Adminis- trative Officer Ross, Director of Planning Warren, Assistant Administrative Officer Stenberg~ In the absence of Mayor Anderson, Mayor pro tem McCorquodale presided. He led the pledge of allegiance to the Flag, followed by a moment of silent prayer. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sparling, seconded by Councilman McAllister, and carried that the minutes for the Council meeting of March 1, be approved, copies having been sent to each Councilman. PUBLIC HEARING - Appeal of Simon and Rose Aardema to Planning Commission action denying rezoning from R-1 to R-3 for property located at the northwest corner of Second Avenue and Palomar Street This being the time and place, as advertised, for a public hearing on the appeal of Simon and Rose Aardema to Planning Commission action denying rezoning of their property at the northwest corner of Second Avenue and Palo- mar Street from R-1 to R-3, Mayor pro tem McCorquodale declared the hearing open. A letter was submitted from Mr. Aardema requesting that the hearing be continued for thirty days. No one wishing to be heard, it was moved by Councilman McAllister, seconded by Councilman Sparling, and carried that the hearing be continued to April 12, 1966, at 7:00 P.M. RESOLUTION NO. Offered vote, to-wit: AYES: Noes: Absent: 4012 - Modifying Code Section 27.19 for excess driveway - 783 First Avenue on Millan Court by Councilman Sparling, passed and adopted by the following Councilmen Sparling, McMains, McAllister, McCorquodale None Councilman Anderson RESOLUTION NO. 4013 - Granting sewer service charge variance - The Broadway Store Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling Noes: Councilman McCorquodale Absent: Councilman Anderson Mr. Paul Yeager was of the opinion the Broadway Store should be re- quired to pay at least the minimum rate of $1.60 per meter even though the water does not run into the sewer because in his opinion, he is being dis- criminated against because he has to pay and his water does not run into the sewer. Mr. Yeager suggested that the ordinance be amended. ~/zAPRIL 5, 1966 set as time for hearing on political sign ordinance A letter having been suh~itted from the Planning Commission recom- mending that the Council amend the City Code regulating the display, of polit- ical signs, it was moved by Councilman Sparling, seconded by Councilman Mc- Allister, and carried that April 5, 1966 at 7:00 P.M. be set as the time for a public hearing on the matter and that the City. Attorney be directed to pre- pare the necessary ordinance. ~/zl{BQUEST FOR OVERNIGHT CAMPING ON SILVER STRAND AND ROADSIDE STOPS A letter was read from the Parks and Recreation Commission suggesting that the Council consider contacting the proper State authorities and encour- age the establishment of overnight camping facilities at the Silver Strand State Park and also that roadside rest areas on State and Federal highways be considered for the Chula Vista area. It was moved by Councilman McAllister, seconded by Councilman McMains, and carried that the Administrative Office be authorized to contact the proper authorities for their views and report back to the Council. REPORT ON TOWING SERVICES Administrative Officer Ross reported a request has been received from Mr. Tony Charlton for the City to include him on the police call list for towing services. Mr. Ross stated that to date three companies are scheduled to handle the City's towing requirements for two-week periods. The Chief of Police, in his written report, stated that he could see no justification for adding another tow company to the three that are already being used. It w~s the recommendation of Mr. Ross that the status of police call towing service be maintained as it is presently and that the staff be directed to prepare an ordinance establishing Council policy on towing service. It was moved by Councilman Sparling, seconded by Councilman McMains, and carried that the City Attorney be directed to prepare an ordinance estab- lishing a Council policy on towing service. Mr. Anthony Charlton urged the Council to permit him to be on call with the other three tow companies until the ordinance is enacted. Mr. Ralph Paxton, owner of Paxton's Garage, was of the opinion it would not be feasible to have more tow companies on police call at this time but was in favor of the Council adopting an ordinance of policy. Lt. Dowell of the Police Department informed the Council of the prob- lems created when too many tow companies are involved in police calls. The matter of the status of police call towing service was left to the discretion of Administrative Officer Ross until the policy ordinance is adopted. REPORT ON REQUEST FOR SETBACK ORDINANCE ENFORCEMENT ON "F" Street, west of Broadway Administrative Officer Ross, reporting on the petition filed by Mr. Samuel Sosna, Jr., requesting that the Home Lumber Company be directed to comply with the setback ordinance and be made to remove their buildings that are on the City right-of-way, stated that the report of the City Attorney indicated that the City could order the buildings removed. It was the recom- mendation of the Administrative Officer that the City Attorney be directed to prepare a notice to the Home Lumber Company asking them to remove the buildings encroaching on the City right-of-way within one year. It was moved by Councilman Sparling, seconded by Councilman McAllis- ter, and carried that the City Attorney be directed to notify the Home Lumber Company to remove their buildings in the City right-of-way within one year, as recommended. RESOLUTION NO. 4014 - Appointing a canvass board for General Municipal Election It having been moved by Councilman Sparling, seconded by Councilman McMains, and unanimously carried that this item be placed on the agenda for action, the resolution was offered by Councilman Sparling, passed and adopted by the following vote, to-wit: AYES: Councilmen Sperling, McMains, McAllister, McCorquodale Noes: None Absent: Councilman Anderson REPORT ON MEETING OF CHULA VISTA-NATIONAL CITY REPRESENTATIVES ON CITY BOUNDARIES It was moved by Councilman McMains, seconded by Councilman Sparling, and unanimously carried that this item be placed on the agenda. Administrative Officer Ross reported that a meeting has been held with representatives of both National City and Chula Vista pertaining to future annexation boundaries of both cities as they relate to good planning and to the recommendations of the Local Agency Formation Commission. The representative group moved that each City appoint two members from their respective Planning Commissions to serve on a joint advisory committee with Planning Directors of both cities to review all future annexations in which both cities might have an interest and to make recommendations to their respective Planning Commissions for recommendation to the respective City Councils relative to the advisability of each such proposed annexation. Other action taken at the meeting by the group was that the proposed future flood control channel from San Diego Bay to Sweetwater Road and from Sweetwater Road easterly would serve as the tentative dividing line for plan- ning purposes for future annexations by both cities. It was moved by Councilman McMains, seconded by Councilman McAllister, and carried that the City AtDorney be directed to draw up for the next meet- ing a resolution approving the recon~nendations of this committee. ~APPLICATION FOR ALCOHOLIC BEVERAGE LICENSE It was moved by Councilman Sparling, seconded by Councilman McAllister, and carried unanimously that this item be placed on the agenda. Administrative Officer Ross stated a copy of an application for an alcoholic beverage license has been received from the Alcoholic Beverage Control Board for the Mona Lisa Pizza Inn~ 13 Naples Street. The applica- tion being for a restricted on-sale beer and wine license~ it was the recom- mendation of the Police Department that the license be granted only on the condition that the closing hours conform with the hours of the shopping cen- ter, with a maximum of 11 o'clock P.M., that the operation remain basically a restaurant and that the furnishings and lighting in the building conform to appearance of a bona fide eating place. It was moved by Councilman McMains, seconded by Councilman McAllister, and carried that the City Attorney be directed to inform the Alcoholic Bever- age Control Board of the Council's wishes based on the recommendations of the Chief of Police. 8:10 P.M. Mayor Anderson took her seat at the Council table at this time. ~-'~DISCUSSION ON TRANSIT DISTRICT After lengthy discussion on the proposed Transit District, Mayor Ander- son requested that if any Councilman has an amendment or idea to the Schrade- Mills Transit Bill that would make the legislation more palatable to many, that it be prepared and ready for discussion at a meeting to be held with Senator Schrade and Assemblyman Mills within the next two weeks. It was moved by Councilman McAllister~ seconded by Councilman Sparling, and carried that the City Attorney be directed to review the Schrade-Mills Bill and recommend to the Council any amendments, if in his opinion any amend- ments are needed, which should be asked for~ with the benefit of Chula Vista uppermost in his mind. REQUEST THAT TRAFFIC HAZAllD BE INVESTIGATED A letter was read from Harry E. Miller, 834 Dale Court, suggesting that the City Engineer investigate the need for warning signals or guard rails on sections of the "S" curve on "J" Street extension just west of Halecrest Elementary School. Referred to Administrative Officer Ross. ~,zVERIFIED CLAIM FOR DAMAGES DENIED A claim was read for damages in the amount of $72.18 by Virginia D. Ramirez for alleged damages to her car when an unmarked police car struck her car. It was moved by Councilman McMains, seconded by Councilman Sparling, and carried that the claim be denied. ~/REQUEST FOR BUS SERVICE A letter was read from Mrs. E. O. Olmsted, 392 Inkopah Street, request- ing bus service in that area of the City. NOTICE ON INSTITUTE ON GOVERNMENT A letter was read from Rudolph J. Massman, Chairman, 18th Annual In- stitute on Government, urging that the Council take action to authorize City employees to participate in this year's institute, to be held on June 23 at San Diego State College. Referred to Administrative Officer Ross. ~,/~REQUEST FOR REPORT ON GOLF COURSE Councilman McMains suggested that a report be forthcoming within three or four months on the operation of the Municipal Golf Course. SPACE NEEDS SURVEY PRAISED Councilman Sparling congratulated the Administration on the excellent report on the City's space needs and requested that his feelings be conveyed to Planning Director Warren.
