HomeMy WebLinkAboutcc min 1958/02/11 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, California Held Tuesday February 11, 19S8 The Council met in the Council Chambers at City Hall on the above date at 7:00 P.M. with the following Councilman present: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Absent: None Also present: Ciiy Engineer Floyd, City Administrator Fulwiler, City Finance Officer Grant, City Attorney Boyer, Planning Secretary Stonehouse, City Attorney Kugler Mayor DeGraaf led the salute to the Flag APPROVAL OF COUNCIL MINUTES It was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that the Minutes of the Council meetings for January 14th and 28th, 1958 be approved, copies having been sent to each Councilman. BLIC HEARING - Amending zoning ordinance No. 398 This being the time and place as advertised for a public hearing on a proposed amendment to zoning ordinance No. 398, as advertised, Mayor DeGraaf declared the hearing open. There being no one in the audience wishing to be heard either for or against the amendment and no written communications, the Mayor declared the hearing closed. ORDINANCE NCo 577 - Amending zoning ordinance No. 398 - First reading It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that Ordinance No. 577 be placed on its first reading. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Menzel, DeWolfe, Rader Noes: None Absent: None The ordinance was thereupon read in full, RESOLUTION No. 2030- Authorizing Registrar of Voters to address Sample Ballots Offered by Councilman Rader, read in full, passed, adopted, and approved by the following vote, to-wit: AYES: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Noes: None Absent: None RESOLUTION NCo 2031-Appointing officers and consolidating polling places for Municipal Election. Offered by Councilman Smith, read in full, passed, adopted, and approved by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Menzel, DeWolfe, Rader Noes: None cESent: None NSUS TP~ACT COMMITTEE City Administrator Fulwiler submitted a request from the San Diego Chamber of Commerce, and recommendations from the City Planning Conunission that Chula Vista participate in a proposed Census Tract program. The matter was held over until the nexf meeting with the request that a half page summary of the entire program be submitted. RESOLUTION No. 2032 - Dedicating portion of property for Vance Street Offered by Councilman Rader, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Noes: None Absent: None R_~ESgLpT~0~ ~0~ 2033- Accepting Deed for "L" Street right-of-way (Rocle) Offered by Councilman Menzel, read in full, passed, adopted and approved by the following vote-to-wit: AYES: Councilmen Menzel, DeWolfe, Rader, Smith, DeGraaf Noes: None Absent: None ~/~" STREET RIGHT-of-WAY - Whittington property City Administrator Fulwiler outlined a tentative plan whereby the City could acquire the property offered by Mr. Whittington and Mr. Farmer for the extension of "L" Street. It was moved by Councilman Smith, seconded by Councilman Rader, and carried, that the City Administrator and City Engineer be directed to negotiate with Mr. Whittington on the plan as tentatively outlined. ADDITIONAL FUNDS APPROPRIATED FOR GAS AND OIL - Police Dept. A letter was submitted by Police Chief Quinn, requesting an appropria- tion of $3115.08 to repleni~sh the depleted C-10 account (Gas, oil and lubricants), said amount to include an appropriation of $100. to supply a proposed jeep patrol with gas, oil and lubricants. It was moved by Councilman Rader, seconded by Councilman Smith, and carried, that the request be granted and the $3115.08 be appropriated from the unappropriated surplus of the General Fund. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Noes: None /Absent: None ADDITIONAL FUNDS APPROPRIATED FOR PATROL CAR EQUIPMENT A letter was submitted by Police Chief Quinn requesting an appropria- tion of $1,065.83 for the purchase of special equipment for five new patrol cars heretofore authorized. It was moved by Councilman DeWolfe, seconded by Councilman Smith, and carried, that the request be granted and the $1,065.83 appropriated from the unappropriated surplus of the General Fund. The motion carried by the following vote, to-wit: AYES: Councilmen DeWolfe, Rader, Smith, DeGraaf, Menzel, Noes: None /R~bsent: None EQLFEST FOR VARIANCE ON DRIVEWAY WIDTH A letter was read from Edwin Hayward, representing Mr. Cody Isbell requesting that he be permitted to install a forty-five foot wide driveway in front of his apartments at 590 Casselman Street, in order to provide off-street parking for his tenants. ~ ~ It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that the matter be referred to the City Engineer for ~commendation and report at the next meeting. ~JSAFETY COUNCIL RECO~9~ENDATIONS - Curbs, gutters and sidewalks Mr. C. C. Alley, Chairman of the Safety Council, recommended that the Council take the necessary action to install curbs, sidewalks, gutters and shoulders in any given area where fifty-one percent of the improvements are now existing, and that immediate action be taken to alleviate the hazardous condition on K. Street between Third and Fourth Avenues where school children are required tp walk in the street. -2- City Administrator Fulwiler was instructed to look into the situation on K. Street. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that owners of property on the Northwest corner of Second Avenue and E. Street, Third Avenue between E. Street and D. Street on the West side, and the intersection of First Avenue and I. Street to J. Street on the East side, be informed that they must install their curbs, gutters, sidewalks, and shoulders, or the City will be forced to do so un~ler the 1911 Act° }~ASE TERMINATION APPROVED A letter was read from Mrs. Eloise M. Smith requesting permission to terminate her lease on City property at 286 Davidson Street on March 15,1958. It was moved by Councilman DeWolfe, seconded by Councilman Smith, and carried, that Mrs. Smith be notified that her request is approved, providing the lease is reviewed and contains a thirty day notice of cancellation. ~/~UBLIC LAW 874 Councilman DeWolfe brought to the attention of the Council that he had received a letter from the Realty Board showing concern over the loss to the School District of $282,000. if the reduction in the budget of One Hundred Million Dollars pertaining to Public Law 874 was allowed to stand. It was moved by Councilman Smith, seconded by Council- man DeWolfe, and carried, that the City Administrator be directed to wire all authorities involved urging that money be reqppropriated to continue Public Law 874. ARLEY COOK CASE City Attorney Boyer stated that Judge Monroe, of the Superior Court, had declared a mistrial in the Harley Cook Case, and the case must be retried. It was moved by Councilman Smith, seconded by Councilman DeWolfe and carried, that Attorney Boyer be directed to file an answer to the supplemental petition on file, and be retained to represent the City in Court on the case at the prevailing minimum fees. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Menzel, DeWolfe, Rader No~s: None ~sent: None ~/CHULA VISTA vs SAN DIEGO ANNEXATION APPEAL Attorney Boyer inquired if the Council wished to prosecute the San Diego Annexation appeal further, now that Attorney General Brown had given his opinion, or abandon proceedings. City Attorney Kugler was directed to study the matter, and give his opinion at the March llth meeting, as to what chance he feels the City has if the case is pursued. ADJOURNMENT Mayor DeGraaf adjourned the meeting at 10:55 P.M. until February 18, 1958 at 7:00 P.M. City- C~k- - Y - --
