HomeMy WebLinkAboutcc min 1958/02/18 MINUTES OF AN ADJOURNED REGULAR EEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday February 18, 1958 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.E. with the following Councilmen present: Councilmen Rader, Smith, DeGraaf, Menzel, DeWolfe Absent: None Also Present: City Administrator Fulwiler, City Engineer Floyd, City Finance Officer Grant, Planning Secretary Stonehouse, Attorney Albert Boyer, City Attorney Kugler Mayor DeGraaf led the salute to the Flag. L~'CENSUS TRACT PROGRAM DISCUSSED Mr. Frank Porath, Chairman of the San Diego Chamber of Commerce, outlined the purpose of the census tract program of the Census Bureau and stated all that was necessary from the City was to provide, at each census, a map dividing the City into tracts containing approximately 3200 persons. There would be no cost at any time to the City. It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that the matter be directed to the City Administrator for action and compliance. b~EPORT ON REQUEST FOR FORTY-FIVE FOOT DRIVEWAY City Administrator Fulwiler, in reporting on the request for a forty-five foot driveway to facilitate parking at 590 Casselman Street, asked that the Council direct the City Engineer to meet with the owner of the property to work out a solution to the parking problem at the address stated. It was moved by Councilman Menzel, seconded by Councilman Smith, and carried, that the matter be referred to the City Administrator for actkn. ORDINANCE No. 577 - Amending Zoning Ordinance NOo 398 - Second reading It was moved by Councilman Smith, seconded by Councilman DeWolfe, and carried, that Ordinance No. 577 be placed on its second reading; that the reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, DeGraaf, Menzel, DeWolfe, Rader Noes: None Absent: None t//~ROPOSED AMENDMENT TO CHARTER Mayor DeGraaf opened general discussion on the proposed Charter amendment to be submitted to the voters, as prepared by the City Attorney. Mayor DeGraaf left the meeting at this time (7:45 PoMo), and Mayor Pro-rem Smith presided for the remainder of the meeting. Otto Hahn, Union representative of those City Employees' belonging .to the Union, spoke briefly on the desires of his members to obtain Federal ~/'Social Security benefits. George Lee, City Fire Chief, spoke on the desires of members of the Police and Fire departments to receive survivors benefits for Safety personnel now available under the State Employees' Retirement System. ORDINANCE NOo 578 - Proposing and submitting Charter Amendment to Electors It was moved by Councilman Rader, seconded by Councilman Menzel, amd carried, that Ordinance No. 578 be placed on its first reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Rader, Smith, Menzel, DeWolfe Noes: None Absent: Councilman DeGraaf It was the general opinion of the Council that the Survivors benefits for Safety personnel would be carefully considered, probably at the coming budget sessions. City Finance Officer Grant was directed to request a verification on the actuarial report he received from the State Retirement System pertaining to the cost to the City for the additional benefits requested by the Safety personnel° SALARY OF CITY ATTORNEY It was moved by Councilman Menzel, seconded by Councilman DeWolfe, and carried, that Manuel Kugler be appointed City Attorney commencing March 1, 1958, and that during the break in period, Mr. Xugler receive $50~ per month and Attorney Boyer $400. per month as outlined in Mr. Fulwiler's letter on the subject to the Council. The motion carried by the following vote, to-wit: AYES: Councilmen Menzel, DeWolfe, Rader, Smith Noes: None Absent: Councilmen DeGraaf /.~URCHASE OF CODES AUTHORIZED City Administrator Fulwiler recommended that the City purchase the necessary volumes of Municipal codes for use of the new City Attorney, total cost not to exceed $130. It was moved by Councilman DeWolfe, seconded by Councilman Rader, and carried, that an amount not to exceed $130. be appropriated from unappropriated surplus of the General Fund for purchase of the Municipal Codes, as recommended. The motion carrled by the follow- ing vote, to-wit: AYES: Councilmen DeWolfe, Rader, Smith, Menzel Noes: None Absent: Councilman DeGraaf SAFETY COUNCIL RECOMMENDATION A letter was read from the Safety Council recommending that for safety sake, the curb in front of Dr. Frank J. Ragen's office at 492 Third Avenue remain painted red. It was moved by Councilman Rader, seconded by Councilman De~olfe, and carried, that the City Administrator be directed to send a copy of the Safety Council's findings to Doctor Ragen, and notify him that the Council concurs with said findings. OLD LIBRARY SITE Councilman DeWolfe stated that in his opinion it was time something was done to get the dispute over the old Library site settled once and for all. City Administrator Fulwiler and Attorney Boyer and City Attorney Kugler were directed to draft a letter to the School Board relating decisions on similar cases, and requesting that the Board take definite action at their next meeting.
