HomeMy WebLinkAboutcc min 1966/05/03 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday May 3, 1966 A regular meeting of the City Council was held in the Council Chambers on the above date at 7:00 P.M. with the following Councilmen present: Councilmen Sylvester, Anderson, McAllister, McCorquodale, Sparling Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Planning Director Warren Mayor McAllister led the pledge of allegiance to the Flag, followed by a moment of silent prayer. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the minutes for the Council meeting of April 26, be approved, copies having been sent to each Councilman. PUBLIC HEARING - Proposed rezoning of certain properties from R-1 and C-1-D to C-N This being the time and place, as advertised, for a public hearing on the proposed rezoning of certain properties from R-1 (single-family residence) and C-1-D (light commercia~,Mayor McAllister declared the hearing open. Mr. Henry Rienstra, 1560 Max Avenue~ owner of the three and one-half acres at the southeast corner of Hilltop Drive and Rienstra Street, objected to the rezon- lng on the basis that he feels it impractical and would be a hardship on the little person. Planning Director Warren explained the provisions of the new C-N zoning ordinance as it will apply in the future. No others wishing to be heard and there being no other communications, the Mayor declared the hearing closed. ORDINANCE NO. 980 - Approving proposed rezoning of certain properties from R-1 and C-1-D to C-N - First reading It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that Ordinance No. 980 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None ORDINANCE NO. 981 - Amending City Code relating to control of display of political signs - First reading It was moved by Councilman Anderson, seconded by Councilman Sparling, and carried that Ordinance No. 981 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Anderson, McAllister, Sparling, Sylvester Noes: Councilman McCorquodale Absent: None ~/PUBLIC HEARING - Proposed rezoning of property at southeast corner of Bonita Road and Sandalwood Drive - R-3-D to C-1-D This being the time and place, as advertised, for a public hearing on the proposed rezoning of property at the southeast corner of Bonita Road and Sandalwood Drive from R-3-D (multiple-family residential) to C-1-D (light- cormmercial), also for reduction in setback from 25 feet to 15 feet, the Mayor declared the hearing open. Mr. Ray Powell, representing the Shell Oil Com- pany, described the construction of the proposed service station, and also spoke in favor of the reduction in setback. Mr. Frank Ferreira, 3715 Putter Drive, Bonita, owner of the property in question, spoke in favor of the pro- posed rezoning and quoted from the General Plan. He also stated that 21 of the 22 property owners within the required area have supported this rezoning and he presented a signed petition to this effect. No others wishing to be heard and there being no other corm~unications, the Mayor declared the hearing closed. ORDINANCE NO. 982 - Approving rezoning of property at southeast corner of Bonita Road and Sandalwood Drive - R-3-D to C-1-D - First reading Mayor McAllister stated although he did not have any vested interest in this property, he wished to abstain from voting. It was moved by Council- man Sparling, seconded by Councilman Anderson, and carried that Ordinance No. 982 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale Noes: None Abstaining: Coumcilman McAllister Absent: None ORDINANCE NO. 979 - Prezoning Sweetwater Valley Annexation No. 1 - Second reading and adoption It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that Ordinance No. 979 be placed on its second reading, that read- ing of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister Noes: Councilman McCorquodale Absent: None RESOLUTION NO. 4062 - Approving Planning Commission action granting conditional use permit to Shell Oil Company for service station at southeast corner of Bonita Road and Sandalwood Drive Mayor McAllister stated he wished to abstain from voting for the same reason as before. The resolution was offered by Councilman Sylvester, passed and adopted by the following vote, to-wit: AYES: Councilmen Sylvester, Anderson, McCorquodale, Sparling Noes: None Abstaining: Councilman McAllister Absent: None RESOLUTION NO. Offered vote, to-wit: AYES: Noes: Absent: 4072 - Modifying City Code section for excess driveway - 496 Third Avenue by Councilman Sparling, passed and adopted by the following Councilmen Sparling, Sylvester, Anderson, McAllister, McCorquodale None None RESOLUTION NO. 4073 - Notice of Intention to hold public hearing on unsafe swimming pool - Hearing May 17, 1966 Offered by Councilman Anderson, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McAllister, McCorquodale, Sparling, Sylvester Noes: None Absent: None GRANTING AUTHORIZATION TO CALL FOR BIDS - AC resurfacing program, fiscal year, 1966-67 It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the Engineering Division be granted authority to call for bids at the prevailing minimum wage scale for the AC resurfacing program for the fiscal year, 1966-67. GRANTING AUTHORIZATION TO CALL FOR BIDS - Tree removal on Fourth Avenue, '~" to "L" Streets It was moved by Councilman Anderson, seconded by Councilman Sparling, and carried that the Engineering Division be granted authority to call for bids at the prevailing minimum wage scale for the tree removal on Fourth Avenue between "H" and "L" Streets, in preparation for the widening of Fourth Avenue in this area. ACTION ON TAXI CAB HEARINGS A letter was read from the Downtown Association stating they were in favor of additional taxi cabs being granted permission to operate in the City. After reviewing evidence that more taxi cabs are needed, it was moved by Coun- cilman Sparling, seconded by Councilman Sylvester, and carried that six more cabs be authorized, three to Diamond Cab Company and three to Carnation Cab Company. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, McAllister Noes: Councilmen Anderson and McCorquodale Absent: None ACTION ON AMBULANCE RATE INCREASE AND/OR SUBS IDY Because of the new Federal Labor law, ambulance service employees have been placed under the minimum wage law, which provides for payment of $1.25 per hour, plus overtime. This, according to Mr. Steve Ballard, owner of Bay Cities Ambulance, and Mr. Lowell Crawford, owner of Crawford Ambulance Service, when they appeared at the meeting of April 26, will necessitate a substantial increase in their cost of operations and consequently are requesting a new rate schedule plus a subsidy from the City. Administrative Officer Ross stated that it would be necessary to hold a public hearing, to be held on May 17, 1966 at 7:00 P.M. Also at the same time, Mr. Ross stated he had requested a report from the Police Department in the event the City would take over the emergency ambulance coverage. It was moved by Councilman Sparling, seconded by Council- man Sylvester, and carried that May 17, 1966 be set for a public hearing on this matter. 'NOTIFICATION OF 1966 ANNUAL CONFERENCE OF MAYORS - June 11-15, 1966, in Dallas, Texas Administrative Officer Ross stated that notification had been received of the 1966 Annual Conference of Mayors in Dallas, Texas, June 11-15, 1966. It was moved by Councilman Anderson, seconded by Councilman Sparling, and carried that authorization be given for the Mayor to attend this conference, with the necessary resolution for the appropriation of funds to be presented at the next Council meeting. STUDENTS RECOGNIZED Mayor McAllister stated he wished to recognize the student delegation present from Marian High School and thanked them for coming to the Council meeting. /cLAIMFOR DAMAGES DENIED It was moved by Councilman Sparling, seconded by Councilman McCorquodale, and carried that the claim for damages in the amount of $396.00 from Ries Con- struction Company be denied. PROGRESS ON BOWLING GREEN REQUESTED Councilman McCorquodale asked about the progress on the bowling green being constructed in General Roca Park. Administrative Officer Ross stated that, due to the recent heavy rains, work had been delayed but was hopeful that by June 1, results would be shown. EXCLUSIVE OPERATION OF CABS IN CITY REQUESTED DURING CERTAIN PERIODS Councilman Sylvester questioned if it were possible to have all the cabs licensed for Chula Vista to operate in the City exclusively between the dates of December 23 and January 1, inclusive. Attorney Lindberg stated that the ordinance does not require that they operate only in the City of Chuta Vista, however, if at any time, the service is maintained at an inadequate level, then consideration could be given to suspending the certificates. Administra- tive Officer Ross stated that letters would be written to the cab companies, calling this to their attention. Councilman Anderson questioned if the new cab companies were being granted parking stalls. The Administrative Officer stated they were not but at such a time as the requests are received, they will come to the attention of the Council. Councilman McCorquodale suggested that they be allowed to park on the streets at the new permit-parking rates. Attorney Lindberg stated that taxi cab stands are provided for in the ordinance, after approval by the Council. ~//~INIBUS DEMONSTRATION REPORT Councilman Anderson stated the acceptance of the Minibus was far better than anticipated and promised that the City will have bus service at an, as yet, undetermined date. MAY TIME BAND REVUE AWARDS SUGGESTED FOR LOCAL SCHOOLS Councilman Anderson stated that the con~nunity should be very proud of all the schools in Chula Vista who participated in the May Time Band Revue held in National City, April 30. Councilman McCorquodale suggested awards should be made from the Council. It was moved by Councilman McCorquodale, seconded by Councilman Sparling, and carried that certificates of recognition be presented at the next Council meeting. ~ GRATITUDE ON MINIBUS EFFORTS OF COUNCIL EXPRESSED Mayor McAllister recognized efforts and expressed appreciation to the Chamber of Commerce and any others who had a part in the Minibus demonstration held in the City last week. U/ SAN DIEGO CHAMBER OF CO~MERCE MEETING ANNOUNCED Mayor McAllister announced he had received a notice of a special meet- ing to be held at the Grant Hotel, Tuesday, May 10, at 12 noon. The San Diego Chamber of Commerce is hosting the California State Chamber of Commerce dele- gation together with the State Division of Highway officials. Ail Councilmen are invited to attend. S/CONFERENCE BY NATIONAL~BSOCIATION OF HOUSING AND REDEVE~J)PMENTANNOUNCED Mayor McAllister announced he had received notification of a conference to be held by the Housing and Redevelopment officials in the E1 Cortez Hotel, beginning on SBnday, May 22. Ail Councilmen are invited to attend if possible. APPRECIATION EXPRESSED FOR GRANTING OF TAXI CAB PERMITS Mr. Clarence Stewart expressed his appreciation for granting of the additional permits for taxi cabs in the City. He suggested at this time that the Council take under advisement the need for granting of limited permits for certain times of the year. FURTHER. DISCUSSION ON LICENSE APPLICATION FOR PREMISES - 250 West Bay Boulevard Mr. Wayne Grizzell, general contractor, appeared before the Council on behalf of Mardell L. Benston, owner of the proposed restaurant to be con- structed at 250 West Bay Boulevard, and stated he had received notice from the Alcoholic Beverage Control Board that there was an objection placed by the City Council for the issuance of a license to serve beer in this estab- lishment, due to inadequate parking and objection to unrestrictive license. Mr. Grizzell stated that a restaurant was planned from the beginning and that he has already obtained the necessary building permit from the Building Depart- ment. Mayor McAllister stated it was the understanding of the Council, last week, that their application was being amended to the ABC Board, and, if true, then there was no objection. Attorney Lindberg stated a letter to the ABC Board to this effect had been forwarded and he would contact them further tomorrow in this regard. SERVICE STATION AND TOWING SERVICE ZONING QUESTIONED Mr. Roger Morey, 1152 Oasis, with the American Towing Service, stated he was looking for a site to locate his business and questioned the zoning in regard to service stations and towing service. He was advised to confer with the Director of Planning. APPRECIATION EXPRESSED Mr. Dusty Rhoades expressed his thanks to the Council on behalf of the Veterans Employment Committee for the proclamation "Hire A Veteran" week. Mrs. Lee Moore, representing Diamond Cab Company, expressed appreciation to the Council for their granting the permits to the taxi cab companies. ADJ OURNMBNT Mayor McAllister adjourned the meeting at 8:50 P.M. sine die.
