HomeMy WebLinkAboutcc min 1966/06/28 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday June 28, 1966 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chambers on the above date at 7:00 P.M. with the following Coun- cilmen present: Councilmen Sylvester, Anderson, McAllister, McCorquodale, Sparling Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Planning Director Warren, Assistant Administrative Officer Stenberg, Purchasing Agent Stanley, Personnel Director Foss Mayor McAllister led the pledge of allegiance to the Flag, and invocation was given by Rev. F. A. Fenton, St. Johns Episcopal Church. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sparling, seconded by Councilman McCorquodale, and carried that the minutes for the meeting of June 21, be approved, copies having been sent to each Councilman. PUBLIC HEARING - Intention to annex First Avenue Annexation No. 3 This being the time and'place, as advertised, for a public hearing on the proposed First Avenue Annexation No. 3, Mayor McAllister declared the hear- ing open. M~. Don McLane, owner of property in the proposed annexation, spoke in favor of the annexation. No others wishing to be heard and the Clerk having received no written communications, the Mayor declared the hearing closed. ORDINANCE NO. 989 - Approving First Avenue Annexation No. 3 - First reading It was moved by C~uncilman Sparling, seconded by Councilman Sylvester, and carried that Ordinance No. 989 be placed on its first reading and that read- ing of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister, McCorq~odale Noes: None Absent: None PUBLIC HEARING - Appeal of Antoinette Tavolacci to Planning Commission action denying conditional use permit for office use in R-3 zone - 421-423 "E" Street This being the time and place, as advertised, for a public hearing on the appeal of Antoinette Tavolacci to Planning Con~nission action denying her a con- ditional use permit for conversion of a duplex into a real estate office at 421- 423 "E" Street, Mayor McAllister declared the hearing open. Mrs. Tavolacci spoke in support of her appeal. No others wishing to be heard, and the Clerk having received no written communications, the Mayor declared the hearing closed. The findings of the Planning Commission were read. It was moved by Councilman McCorquodale, seconded by Councilman Sylvester, and carried that the action of the Planning Con~nission be sustained and the ap- peal denied. Councilman Anderson voted no. STUDY REQUESTED ON POSSIBLE REZONING OF "E" STREET It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried that a thorough study be made by the Planning Conmaission on the possible rezoning of "E" Street on both sides from Fourth Avenue to Broadway. Councilman McCorquodale voted no. ORDINANCE NO. 987 - Prezoning of "C" Street Annexation - Second reading It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried that Ordinance No. 987 be placed on its Second reading, that reading of the text be waived and the ordinance adopted. The motion carried by the follew- ing vote, to-wit: AYES: Noes: Absent: Councilmen Sparling, Sylvester, Anderson~ McAllister, McCorquodale None None ORDINANCE NO. 988 - Establishing permanent zoning and setbacks, both sides of Melrose Avenue~ south of Princess Manor Unit No. 3, north of Otay Valley Road, to M-i-D, C-1-D and R-1 - Second reading It was moved by Councilman Sylvester, seconded by Councilman McCorquodale, and carried that the second reading of this ordinance be deferred for 120 days and the matter sent back to the Planning Commission for reconsideration with the proviso that it be considered under the proposed new zoning ordinance. PLANNING COMMISSION RECOMMENDATION ON REQUEST OF ROHR CORPORATION - Approval of Antenna Division office and parking lot in "T" zone A letter was submitted from the Planning Commission recommending that the request of the Rohr Corporation for the location of a new building to house its antenna division offices on the east side of Tidelands Avenue~ south of "G" Street, and an employee parking lot for the southwest corner of "G" Street and Tidelands Avenue, all in the "T" zone, be approved subject to their conditions. It was moved by Councilman McCorquodale, seconded by Councilman Sparling, and carried that the recommendations of the Planning Commission be approved. ~/P~PORT ON MELROSE AVENUE Administrative Officer Ross gave a report on the present status of the construction of Melrose Avenue between Rienstra Street and Quintard Street. Prin- cess Park Estates obviously not having lived up to the terms of their agreement with the City, Mr. Ross asked the City Attorney to recommend steps to be taken. City Attorney Lindberg recormmended that under the circumstances, that as of June 30, 1966, he be authorized to bring an action for breach of contract for money damages an~ that an injunction be secured to prevent any further building or move-ins in the Princess Manor Subdivision until Melrose Avenue has been com- pleted either by the City or by Princess Park Estates,-Inc. Mr. Lindberg stated that the City has fulfilled its part of the agreement. It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the City Attorney be instructed to carry out, as of June 30, 1966, his plans to file suit against Princess Park Estates, Inc., as he has outlined, and particularly to get an injunction preventing the issuance of any more building permits for Princess Manor Subdivision and stopping of any further occupancy until Melrose Avenue has been completed. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McAllister, McCorquodale Noes: None Absent: None Attorney Robert Bergan, representing Princess Park Estates, Inc., stated his client could go ahead if given permission to do so but to date they did not know who owned the land, that they have been given no easements in order to trespass on the land and that they have not been informed what to do with the terrific amount of excess dirt. Mrs. Mary Hoffman, 1550 Melrose Avenue, asked that the contract between the City and Princess Park Estates, Inc., for improvement of Melrose Avenue be read. City Attorney Lindberg complied. Mrs. Hoffman was critical of the fact that the public had not been informed that Princess Park Estates, Inc., had not posted a bond, as required in the contract, to assure the completion of Melrose Avenue. Mr. Robert Hastings, 1475 Max Avenue, and Mr. K. J. Hoffman, 1550 Melrose Avenue, were also critical of the Council on the manner in which the proceedings for completion of Melrose Avenue have been handled. ~,REPORT ON SEWER SERVICE CHARGES BEING PAID BY PRINCESS PARK ESTATES, INCo Administrative Officer Ross in giving a report on the number of dwellings connected to the sewer in Princess Manor Subdivisions for which there are no sewer service charges paid, stated that all homes or dwelling units that are covered under the sewer service charge provisions of the City Code are being billed as they should be. Mr. Paul Yeager, 414 "J" Street, maintained there are empty homes in the area, connected to the water main, which were not paying the sewer service charge. REQUEST FOR FUNDS - Citizens Interracial Committee A letter was read from the North San Diego Council of United Church Women urging the Council to consider providing financial assistance to the Citizens Interracial Con~nittee before July 1, 1966. Mrs. Kifk Abbey, member of the Board and Executive Committee, spoke to the Council on the work of the committee and urged their financial support. Referred to Administrative Officer Ross for study. CLAIMS FOR DAMAGES DENIED It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried that the claim of Ralph L. Reaves in the amount of $8.50 for damages al- leged to have been received when his car hit a rut in the street, and the claim of Emerson R. Powell in the amount of $43.15 for sewer line stoppage, be denied. SAFETY COUNCIL RECOI~BNDATIONS A letter was read from the Safety Council recommending that the pepper tree on the northeast corner of Halsey Street and Fifth Avenue be removed, that the County be contacted and advised that a hazardous situation exists on Bonita Road west of Glen Abbey Boulevard which endangers motorists traveling eastward on Bonita Road and exiting from Glen Abbey Boulevard, and that a raised median be installed for 150 feet north of "H" Street on Third Avenue to prevent danger- ous northbound turns from the Third Avenue driveway exit of the Heavenly Donut Shop. It was moved by Councilman McCorquodale, seconded by Councilman Sparling, and carried that recommendations of the staff on the Safety Council recommenda- tions be brought back to the Council in two weeks. REQUEST FOR LIGHTING OF PALM TREES A letter was read from the Chamber of Commerce requesting that the Coun- cil investigate the feasibility of lighting the palm trees in the center strip in front of the Civic Center. Referred to Administrative Officer Ross for re- port at an early date. LETTER OF COMMENDATION A letter was read from the Chamber of Commerce commending members of the Park and Recreation Con~nittee, Park Department staff, Planning and Engineering Departments for the landscaping and clean-up done at the Municipal Golf Course. REPORT ON STUDY PERTAINING TO ACQUISITION OF WATER SYSTEM Councilman Anderson brought the Council up-to-date on the study being made in connection with acquisition by public ownership of the water system. She announced that the study committee for public ownership of the water system has set July 11, 1966 at 7:00 P.M, as the time for a meeting, in the Chula Vista Council Chamber, for members of the National City Council and the Board members of the South Bay Irrigation District and members of the Chula Vista City Council to meet and discuss the recommendations of the study committee. It was the hope of Councilman Anderson that if the National City Council and the Board of the South Bay Irrigation District take action on the study committee's recon~nenda- tion, that they reaffirm that public ownership of the water system is in the best interest of the public, that Chula Vista have a resolution ready for adop- tion at the next meeting concurring along this line. REQUEST TO PAINT HOUSE NUMBERS ON CURBS Mr. Greg Mellon, 873-D Woodlawn Avenue, requested permission to paint house numbers on curbs. He was told to discuss his request with Administrative Officer Ross for Council action at the next meeting. ~BIDS 0N/~.BUI~NCE SERVICE Mr. Steve Ballard, owner of Bay Cities Ambulance Service, stated that he and Crawford Ambulance Service had submitted bids for ambulance service in the City and asked when they would be considered. He was informed that the City Attorney was preparing an ordinance which would set forth the manner in which bids would be submitted to the Council, said ordinance to be ready for Council act±on at an early date. It was moved by Mayor McAllister, seconded by Councilman McCorquodale, and carried that the Council send requests to our State Legislators. to exercise their office to the fullest extent to explore the question of the possibility of asking the P.U.C. to take the ambulance problem under their jurisdiction. Mr. Lowell Crawford, owner of Crawford Ambulance Service, requested that at the time of the next conference on ambulance matters, a member of the State Highway Patrol be asked to attend.
