MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF CHULA VISTA, CALIFORNIA
January 17, 1967
A regular meeting of the City Council of the City of Chula Vista was held
in the Council Chambers on the above date at 7:00 P.M. with the following Coun-
cilmen present: Councilmen Sylvester, Anderson, McAllister, McCorquodale, Sparling
Absent: None
Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer
Ross, Planning Director Warren, Assistant Administrative Officer
Stenberg, Administrative Assistant Sullins
Mayor McAllister led the pledge of allegiance to the Flag. Rev. Earl Kernahan
of the First Methodist Church gave the invocation.
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman Sparling, seconded by Councilman Sylvester,
and carried that the minutes for the me~ting~of January 10, 1967, be approved,
copies having been sent to each Councilman.
PUBLIC HEARING - Establishment of~flo0d plain zoning in Lower Sweetwater Valley
This being the time and pla~e, as advertised, for a hearing on the estab-
lishment of flood plain zoning in the Lower Sweetwater Valley, Mayor McAllister
declared the hearing open.
Mr. B. H. Hoffmaster, County Flood Contrel Engineer, reviewed briefly
the flood plain study made by the State Department of Water Resources, for the
County of San Diego, on the Sweetwater River.
Mr. Peter DeGraaf, land owner in the proposed rezoning area, requested
that his property be deleted from the proposed rezoning due to the fact that it
was not adjacent to any of the property the City would have to condemn for the
proposed flood control channel.
It was the recommendation of the City Attorney that the hearing be con-
tinued until February 21~ 1967~ in order for him to receive an opinion from the
State Department of Water Resources on his proposal to amend the proposed flood
plain ordinance to provide that areas rezoned could revert back to their previous
z~nes whenever a governmental agency acquires the property for flood control pur-
poses.
It was moved by Councilman Sparling, seconded by Councilman Sylvester,
and carried that the hearing be continued until February 21, 1967, at 7:00 P.M.,
as recommended by the City Attorney.
PUBLIC HEARING - Proposed permanent zoning for Elks-Telegraph Canyon Road
Annexation
This being the time and place, as advertised, for a hearing on the pro-
posed permanent zoning to R-1-D for the Elks-Telegraph Canyon Road Annexation,
Mayor McAllister declared the hearing open. No one wishing to be heard and the
Clerk having received no written communications, the Mayor declared the hearing
closed.
ORDINANCE NO. 1035 - Approving permanent zoning for Elks-Telegraph Canyon Road
Annexation - First reading
It was moved by Councilman Sparling, seconded by Councilman Anderson,
and carried that Ordinance No. 1035 be placed on its first reading and that read-
ing of the text be waived. The motion carried by the following vote, to-wit:

~UBLIC HEARING - Proposed vacation of drainage easement at Fourth Avenue and
Shasta Street
This being the time and place, as advertised, for a hearing on the pro-
posed vacation of a drainage easement at the southwest corner of Fourth Avenue
and Shasta Street, Mayor McAllister declared the hearing open. No one wishing
to be heard and the Clerk having received no written co~nunlcations, the Mayor
declared the hearing closed.
RESOLUTION NO. 4299 - Ordering the vacation of drainage easement at Fourth
Avenue and Shasta Street
Offered by Councilman McCorquodale, passed and adopted by the following
vote, to-wit:

ORDINANCE NO. 1036 - Prezoning the Poggi Canyon Annexation No. 2 as R-1 - First
reading and adoption as an emergency ordinance
It was moved by Councilmam McCorquodale, seconded by Councilman Sylvester,
and carried that Ordinance No. 1036 be placed on its first reading, that reading
of the text be waived, and the ordinance adopted as an emergency ordinance. The
motion carried by the following vote, to-wit:

ORDINANCE NO. 1032 - Amending City Code relative to control of drainage areas
and water courses - Second reading
It was moved by Councilman Sparling, seconded by Councilman Anderson,
and carried that Ordinance No. 1032 be placed on its second reading, that read-
ing of the text be waived and the ordinance adopted. The motion carried by the
following vot~, to-wit:

RESOLUTION NO. 4300 - Giving notice of intention to vacate a portion of Senna
Way - Setting February 7, 1967 as date for hearing

RESOLUTION NO. 4301 - Approving agreement guaranteeing off-site improvements -
Chula Vista Gardens Subdivision No. 2 - East Oxford Street
Offered by Councilman Sylvester, passed and adopted by the followimg vote,
to-wit:

RESOLUTION NO. 4302 - Approving improvement agreement for Chula Vista Gardens
Subdivision No. 2 ~
Offered by Councilman Sparling, passed and adopted by the following vote,
to-wit:

Absent: None
In reply to questioning by City Attorney Llndberg, Mr. Robert Kolkey,
Vice President of Dass Construction Company, stated he was in agreement with
all conditions specified in the agreement.
RESOLUTION NO. 4303 - Approving final map - Chula Vista Gardens Unit No. 2
Offered by Councilman Sparling, passed and adopted by the following vote,
to-wit:

RESOLUTION NO. 4304 - Amending Schedule VI of the Traffic Code to include
limited parking on "H" Street east of Woodlawn Avenue
Offered by Councilman Anderson, passed and adopted by the following,vote,
to-wit:

~/~IDS REJECTED FOR PURCHASE OF PAINT TRUCK
Upon the recommendation of Administrative Officer Ross, it was moved by
Councilman Sparling, seconded by Councilman Anderson, and carried that all bids
on the purchase of a paint spray truck be rejected and the Purchasing Department
be ~lirected to prepare specifications for a lower horsepower requirement and re-
advertise for bids.
~/~GREEMENT FOR USE OF RESIDENCE AT ROHR PARK
It was moved by Councilman Sparling, seconded by Councilman McCorquodale,
and carried that this item be held over one week for further study by the Admin-
istrative Officer.
~iCALL FOR BIDS AUTHORIZED FOR AU(~MENTING TRAFFIC SIGNALS
It was moved by Councilman McCorquodale, seconded by Councilman Sparling,
and carried that the City Engineer be authoriz%d to call for bids at the prevail-
ing minimum wage scale for augmenting traffic signals on Third Avenue at David-
son, "F" and "G" Streets.
i,z-REPORT ON MELROME AVENUE
City Attorney Lindberg reiterated previous statements regarding the status
of action against Princess Park Estates, Inc., and Subdivision' Mortgages, Inc.,
regarding the breach of contract on the improvement agreement for Melrose Avenue
and the refusal on the part of Subdivision Mortgages, Inc., to honor their letter
of credit in the sum of $20,000.00 to guarantee the completion of Melrose Avenue.
Mr. Lindberg stated he intends to bring back concrete proposals on Febru-
ary 7, for Council consideration, two or three alternatives for the City to go
ahead and improve Melrose Avenue and rely upon the courts to recognize the jus-
tice of the demand to have it completed and recoup the money through the court.
F//~F. TTER FROM BOARD OF CORRECTIONS ON CITY JAIL FACILITIES
A letter was read from the State Board of Corrections complimenting the
City Administration and Police Chief on conditions in the City jail~ the facility
being in compliance with all State and local conditions and regulations.
~PETITION REQUESTING INVESTIGATION OF TRAFFIC HAZAPd)
A petition, signed by approximately thirty citizens, was read requesting
an investigation of the traffic hazard along East "L" Street between Melrose
and Nacion Avenues. Referred to Safety Council.
~/NOTICE OF FIESTA MEETING
A letter was read from Councilman McCorquodale, 1967 Fiesta General Chair-
man, giving notice of two meetings of all persons interested in the 1967 Fiesta.
One is to be held at La Bella's at noon, January 26, and the other at 7:30 P.M.
at the Chamber of Commerce office on the same date.
~W~TITION SUBMITTED FOR ALLEY IMPROVEMENT
A petition was submitted by K. A. Rothermel, 184 "J" Street~ requesting
that the Council institute proceedings under the 1911 Act for the installation
of alley improvements in Block 7, Chula Vista Villa Tract No. 3. Referred to
Administrative Officer Ross.
/REQUEST THAT TRAFFIC HAZARD BE AT.~.RVIATED AT EDGEMERE ROAD AND SWEETWATER ROAD
Mr. Peter DeGraaf requested that something be done about the hazardous
traffic condition at the intersection of Sweetwater Road and Edgemere Road.
City Engineer Cole stated that the intersection is under study.
~//~DATE OF JOINT COUNCIL-PLANNING CO~ISSION MEETING ANNOUNCED
Mayor McAllister announced that there would be a joint meeting of the
City Council and Planning Cou~ission in the Council Chambers on January 31~ 1967.
~,/~EQUEST FOR INFORMATION ON INTERSTATE 5 HIGHWAY
It was moved by Councilman Sparling, seconded by Councilman McCorquodale,
and carried that Administrative Officer Ross write a letter to Mr. Jacob Dekema,
on behalf of the Council, asking what the hold-up is on the improvement of Inter-
state 5 Highway through Chula Vista so that the Council can pursue the matter
with all diligence.
ADJOURNMENT
Mmyor McAllister adjourned the meeting at 8:46 P.M. sine die.
