HomeMy WebLinkAboutcc min 1958/08/26 MINUTES OF AN ADJOURNED REGULAR M[ETING OF THE CITY COUNCIL OF THE CITY of Chula Vista, California Held Tuesday August 26, 1958 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McAllister, Smith, McMains Absent: Councilmen Menzel, DeGraaf Also present: City Administrator Fulwiler, City Engineer Floyd, City Attorney Kugler, Planning Secretary Stonehouse Mayor pro-tem Smith led the salute to the Flag PUBLIC HEARING - Rezoning of newly annexed lands This being the time and place, as advertised, for a public hearing on the zoning of the newly annexed areas known as First Baptist Church and Nazarene Church Annexations; the Judson Reservoir Lands and Industrial Lands Annexations, Mayor pro-rem Smith declared the hearing open. There being no one in the audience wishing to be heard, either for or against the rezoning and no written communications, Mayor Smith declared the hearing closed. ORDINANCE No. 592 - Amending zoning ordinance to zone newly annexed lands- First reading It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that Ordinance No. 592 be placed on its first reading. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Smith, McMains Noes: None Absent: Councilmen Menzel, DeGraaf The Ordinance was thereupon read in full. REPORT ON APPLICATION FOR CARDROOM LICENSE Keith Atherton, Attorney-at-Law, representing Nate Peters, applicant for a cardroom license, requested that his client be granted a cardroom license, and that he be given a copy of the report of the Chief-of-Police recommending that the license be denied. Mr. Atherton also requested copies of the cardroom license ordinance. ~/REQUEST FOR PERMISSION TO BID ON TRASH COLLECTION Ed McNulty, Attorney-at-Law, representing Tommy Hudson, requested that his client be permitted to bid on the trash collection for Rohr Air- craft Corp. Mayor pro-rem Smith advised Mr. McNulty that City Attorney Kugler had ruled that Mr. Hudson could not bid on a trash collection contract in the City limits as long as the present franchise is in effect. ~/REQUEST FOR STREET DANCE A letter was read from St. John's Church requesting permission to hold a street dance on the evenin~of September 5th and 6th on the cul de sac at the Easterly end of Millan Street; also to have mechanical rides on the Church property at the same time. It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that the request for the dance and amusement center be granted. APPLICATION FOR CARl)ROOM LICENSE An application was read for a cardroom license at 349 Broadway for Mrs. Vera Rose. Mayor pro-tem Smith referred the application to the Chief-of-Police for investigation. ~/~EQuEST FOR ACCEPTANCE OF 29 FOOT STREET Mr. J. D. Peters asked if the Council would go on record as being willing to accept a 29 foot street, which would be a continuation of King Street between First and Second Avenues, if he were to improve the 29 feet to City specifications. It was suggested that he prepare a plan as to how he planned on developing the property which would be served by the street, and present it to the Planning Commission. The matter was referred to the Planning Commission. ~,~ COMMITTEE REPORT ON ADULT RECREATION A report was read from the Adult Recreation Committee recommending for consideration three possible sites for an adult recreation center and recommending that an Adult Recreation Association be formed. No action taken° ORDINANCE No. 593 - Setting tax rate - 1958-1959 It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that Ordinance No. 593 be placed on its first reading. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Smith Noes: None Absent: Councilmen Menzel, DeGraaf The Ordinance was thereupon read in full. ORDINANCE No. 587 - Approving Kile Morgan No. 2 Annexation- 2nd reading It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that Ordinance No. 587 be placed on its second reading; that reading of the text be waived, and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Smith, McMains Noes: None Absent: Councilmen Menzel, DeGraaf ORDINANCE No. 588 - Approving Kile Morgan No. 3 Annexation- 2nd reading It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that Ordinance No. 588 be placed on its second reading; that reading of the text be waived, and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Smith, McMains Noes: None Absent: Councilmen Menzel, DeGraaf ORDINANCE No. 589 - Approving Stewart Annexation - 2nd reading It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that Ordinance No. 589 be placed on its second reading; that reading of the text be waived and the ordinance adopted. Street with First Avenue] Fourth Avenue and Oaklawn Ave., and at the intersections of Fifth Avenue with F. Street and ~~}'~'~/~i and that the guards be Paid $1.00 per hour for two hours a day, at an estimated cost of $1800 for the year. · -3- It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that guards be placed at the five intersections as recommended at $1.00 per hour, and that $2500. be appropriated from the unappropriated surplus of the General Fund, in case it is found that additional guards are needed in the near future. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Smith, McMains Noes: None Absent: Councilmen Menzel, DeGraaf ~AUTHORIZATION TO ATTEND BUILDING CONFERENCE IN IDAHO A request was received from Building Inspector Grady to attend the International Conference of Building Officials in Sun Valley, Idaho on October 6th thru lOth, 1958o It was moved by Councilman McMains, seconded by Councilman McAllster and carried, that Mr. Grady be authorized to attend the confprence, and that $220. be appropriated from the unappropriated surplus of the General Fund for his expenses. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Smith, Noes: None Absent: Councilmen Mencal, DeGraaf ~/~SITIONS OF ASSISTANT TO ADminISTRATIVE OFFICER AND PLANNER DRAFTSMAN AUTHORIZED City Administrator Fulwiler asked that the Council approve the establishing of the positions of Assistant to the Chief Administrative Officer and Planning Draftsman, It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that the City Administrator notify the Civil Service Commission to set up the positions of Assistant to the Chief Administrative Officer and Planning Draftsman, and establish an eligible list as soon as possible° ~//~AFETY COIJNClL RECOmmENDATIONS A letter was read from the Safety Council urging that curbs, gutters and sidewalks be installed on Ko Street and on Fourth Avenue in the vicinity of the Chula Vista High School, and that a four-way stop be placed at the intersection of Fourth Avenue and Jo Streets. The matter was referred to the City Administrator and Engineer Department for study and report at the next meeting° ~//ApPOINTMENT OF MEMBER TO THE PARK & RECREATION COMMISSION It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that Mrs. Vanitta Olinger be reappointed a member of the Park & Recreation Commission for a term of four years. ORDINANCE AUTHORIZED ON OFF-STREET PARKING IN SETBACKS City Administrator Fulwiler asked if the Council was ready to have the attorney draw up on ardinance prohibiting off-street parking in certain setbacks as recommended by the Planning Commission. The City Attorney was directed to prepare such an ordinance ~$th an emergency clause included. ORDINANCE No. 596 - Amending sewer Ordinance No. 405 (sewer repayments) First reading It was moved by Councilman McMains, seconded by Councilman McAllister and carried, that Ordinance No. 596 be placed on its first reading. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Smith Noes: None Absent: Councilmen Menzel, DeGraaf The ordinance was thereupon read in full. -4- RESOLUTION No. 2101 - Authorizing City Administrator to work toward Unified Civil Defense Plan Offered by Councilman McMains, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Smith Noes: None Absent: Councilmen Menzel, DeGraaf ~/STREET EQUIPMENT AUTHORIZED USED FOR FIESTA A letter was read from the Fiesta de la Lune Committee requesting the use of certain City equipment and operators prior to and during the Fiesta de la Luna September 17 through the 21st. It was moved by Councilman McAllister, seconded by Councilman McMains and carried, that the request be granted, and that the City Administrator work out the details. NO PARKING REQUESTED FOR CERTAIN HOURS ON JEFFERSON AVENUE A petition was read from property owners in the 500 block on Jefferson Avenue requesting "No Parking" on that street between 7:00 and 9:00 A.M. and 4:00 to 6:00 PM. The letter was referred to the Safety Council for recommendation. ~i~ETITION FOR SIDEWALKS AND CURBS A petition was read from property owners on the South side of "G" Street in the zero hundred block requesting that the City install side- walks and curbs at the two remaining unimproved properties in the block. T~e petition was referred to the City Administrator for investigation. EQUEST FOR PAVING ON ELM AVENUE A petition was received from property owners in the 400 block on Elm Avenue requesting that the City pave this block. City Administrator stated that this street would be added to the regular list budgeted for paving this year and improved as soon as possible. /~EQUEST FOR USE OF TRAILER AT LEGION HALL -A read from the Chula Vista American Legion requesting that the Legion caretaker be permitted to continue living in his trailer at the rear of the Legion grounds. The Building Inspector had requested that he vacate within thirty days from August 18, 1958. The Council recommended that the caretaker be given an extension of time, and the ~tter be held over until the next meeting. ~/ATTENDANCE AUTHORIZED to the League of California Cities Convention It was moved by Councilman Smith, seconded by Councilman McMains, and carried, that Councilmen McMains, McAllister, Menzel, DeGraaf~ as well as the City Administrator and City Attorney be authorized to attend the League of California Cities Convention if they so desire. /8~ER BETWEEN Go STREET AND E. STREET Mr. Ed Culnan, Planning Commission Member, asked what action the Council planned on taking to extend the sewer from G. Street North to E. Street along Woodlawn Avenue. The Council requested that the Planning Commission be notified that it is the intention of the Council to run the sewer from G. Street to E. Street, and that funds for the project will probably be appropriated at the next Council meeting. ADJOURNMENT Mayor pro-rem Smith adjourned the meeting at 8:30 P.M. sine die.
