The Council met in the Council Chambers at the City Hall on the above date at
7:00 P.N. with the following Councilman present:
Councilmen NcAll£ster, Smith, Menzel, DeGraaf, McNains
Absent None
Also present: City Attorney Kugler, City Administrator Fulwiler, City Engineer Floyd,
City Planner Fretz, Administrative-Analyst Ross, City Finance Officer Grant
Mayor Menzel led the salute to the Flag, and asked for a moment of prayer
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman McAllister, seconded by Councilman Smith, and carried
that the Council Hinutes for meetings of February 10th, l?th, 24th, and March 3rd be
apRroved, copies having been sent to each Councilman.
BLIC HEARING - Proposed rezoning of property at Woodlawn & E. Streets
This being the time and place, as advertised, for a public hearing on the proposed
rezoning from R-3 to C-2 of approximately ten acres on the Southeast corner of Woodlawn
Avenue and E. Street, Mayor Manzel declared the hearing open.
Reco~endatione of the Planning C~ission were read. No one in the audience wish-
ing to be heard, either /or or against the proposed rezoning, the Mayor declared the
hearing closed. There were no written protests received.
~/~BLIC HEARING-Establishing set-backs in Industrial Annexation
This being the time and place, es advertised, for · public hearing on the establish-
ment of set-backs in the Industrial Lands Annexation, Mayor Nenzel declared the hearing
open. No one in the audience wishing to be heard, either [or or a~inst the proposed
set-backs, as recommended by the Planning Co~mission, Mayor Nenzel declared the hearing
closed. No written protests were received.
ORDINANCE No. 621-Amending zoning ordinance No. 398- First reading
It was moved by Councilman DeGraaf, seconded by Councilman NcNains, and carried,
that Ordinance No. 621 be placed on its first reading, with the deletion of subsection
"B" of Section 2 pertaining to zero set-backs in the N-2 zone, and that reading of the
text be waived. The motion carried by the following vote, to-wit:

This being the time and place, as advertised, /or e public hearing on the proposed
Telegraph Canyon No. 2 Annexation, Mayor Henzel declared the hearing open. There being
no protests either oral or written from property owners within the territory proposed to
be annexed or otherwise, the Mayor declared the hearing closed.
ORDINANCE No. 622-Approving Telegraph Canyon Annexation No. 2-First reading
It was moved by Councilman McMains, seconded by Councilman McAllister and carried,
that Ordinance No. 622 be placed on its first reading, a~ that reading of the text be
waived. The motion carried by the followini vote, to-wit:

OPOSED VACATION OF A PORTION OF THIRD AVENUE NORTH OF S~AVALE STREET
A letter was read from the Planning Co~ission recm~mending that that portion of
Third Avenue between SeaVele Street and C. Street be vacated. Mr. Frank Dawson submitted
a plat showing a possible development of the area if the street is closed. Mr. Rudolph
at 289 SeaVale Street requested that the street be closed.

~TITION ON ~OISE NUISANCE AT CHULA VISTA SPEEDWAY
A petition was presented by property ovners living in the vicinity of the Chula
Vista Speedway declaring the noise caused by the loud speaker syscom and race cars at
the Speedway to be a public nuisance. In support of their petition Hrs. Ceo. Windrum,
liartin Nurlbut, Dorothy Rudolph, Steven Vetrecin, Russell Bish and others asked that
some relief be given to the property ovners from the unbearable noise ominating from
the Speedway in Sweetwater Valley.
Alvin Setup, President of the San Oiego Quarter Nidget Racers said all possible
was being done to relieve the noise situation. Attompts to find other locations for the
races had failed. Jerry Stone, Dr. Oran Smith, Warner Dryfus and others in s~npathy with
the youth racing program spoke on the benefits the program offers the youth of the
C~a~uunicty, and asked that a trial be given the anti-noise romedies they were proposing.
It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that
the matter be taken under advisoment, and a consultation held with parties from both
sides. The motion carried by the following vote, to-wit:

It was moved by Councilman McNains, seconded by Councilman Nclllister, and carried,
that the Hayor appoint two mombers of the Council to meet with t~o members of the
SeaVale group and two mombers of the Optimist Club to arrive at some recou~endations to
be~resented to the Council at their meeting on April 14, 1959.
ITIONFOR PARI[IN~ RELIEF
AVENUE
Attorney Herbert Solomon. representing o~mers of Woodlawn Gardens Apar~nents,
sub~itted a petition askinS that the Council attempt to solve the parking problom near
the apartments caused by Rohr Aircraft vorkers parking all day on the unposted side of
the street. He suggested that the signs reading no parking from 4 to 6 P.M. now on one
side of the street be changed to "no parking" from 3;00 to 5:00 P.M. on both sides of
the street. It was moved by Councilman DeOraaf, seconded by Councilman McMains, and
carried, that the matter be referred to the City Administrator for study and report at
the meeting of liarch 24th.

City Ad~inietrator Fulwtler reported that steps were being taken to alleviate the
drainage proble~ on Parkway in the five hundred block as reported to the Council at their
Iasc meeting by Hr. John Nurphy.

City Administrator Fulwiler stated he had received a request from the City Engineer
for an additional Associate Eugineer and EnsineerinS Aide.
It was moved by Councilman Smith, seconded by Councilman McAllister, and carried,
that two new positions be authorised for the EusinearinS Division, and referred to the
Civil Service Co~iesion for classification, and that ~3500 be appropriated from the
uuapproprimted surplus of the C, euaral ~umi to cover cost for the remainder of the fiscal

City Purchaser Stanley reported he had received t~o bids on the 27 two-story build-
inss in Vista Square Project, the hish bid beinS that of the Georgia Investment Co. in
the amount of $8,289.00.

BID ON PARKING LOT AUTRORIZED
City Administrator Fulwiler asked ~hat the Council's wish ~ould be on biddinS for
the property at the Northwest corner of Landis Ave. and Davidson St. now beinS used by
the City for a parkinS lot. The minimum bid acceptable by the County is

City Administrator Fulwiler submitted a map showing t~o possible park sites a~ Rice
Canyon which have bean approved by the Park and Recreation Commission. After study it
wa8 moved by Councilman Smith, seconded by Councilman McAllister, and carried, that the
City Administrator be directed to start preliminary nesotimtiona with the ugners for both
parcels, with e~phaais on obtaining the number one choice of ~he Fark and Recreation
C~ission.
DISFOSALOF SLUDGE FRCI(TREATHENT FLAHT
City Administrator Fulwtler asked that the Council authorize the PurchasinS Asent
to contact fertilizer companies and try to nesotiate an agreement whereby the coupany
would haul off the sludge at no cost to the City.
It was moved by Councilman acaains, seconded by Counciiman DeGraaf, and carried,
that the Furchasins Asent be authorized to nesotiate with fertilizer companies in an
effort to find one that will be interested in haulin$ off the sludge at no cost to the City.
RESENTATIVES AUTHORIZED TO SACRAMENTO ON LEGISLATION
City Administrator Fulwiler asked permission to attend the Committee hearin$ on
tideland Erants to be held in Sacramento on March 17th, and also suSSested that one
member of the Council $o, so that contact could be made on other legislation now pending
which mi~t affect the City.
It was moved by Councilman McMains, seconded by Councilman DeGraaf, and carried,
that Mr. Fulwiler be authoriaed to Es to Sacramento ohM arch l?th for the necessary time.
Funds are in the budget for the trip.
It was moved by Councilman Smith, seconded by Councilman McMains, and carried, that
one Councilman be authorized to go to Sacramento ohM arch l?th, and that $100. be appropri-
ated from the unappropriated surplus of the General Fund to cover the expenses of the

~/~FER TO DEDICATE PROPgRTY FOR STREET PURPOSES
A letter wes read from 6. O. McMillin offering to dedicate for street purposes the
Westerly 40 feet of his property extending Norlth from "D" Street some 900 feet, as an
extension of First Avenue.
It was moved by Councilman DeOraaf, seconded by Councilman HcAllister, and carried,
that the property be accepted as offered. The motion carried by the following vote%to-wit:

BTY COUNCIL RF~iE~)ATION
A letter was read from the Safety Council recommending that o~ners of two remaining
properties in the 100 block North side of "~ Street without;curbs and sidewalks be givam
a 60-day time limit in which to have same installed. If not installed by that time, the
City should do so under provisions of the 1~11 Act. It was moved by Councilman DeCraef,
seconded by Councilemn ~cAllister, and carried, that recommendations of the S~fety Council
be accepted and the City Administretor directed to proceed es recommended.
A claim was submitted from Carol &Roy Buddin~h for $~000. d~ges for injuries
received by Mrs. Buddingh when the sidewalk upon ~hich she was welking caved in. The
accident happened in the vicinity of 11g ~. St. It was moved by Councilman Smith,
seconded by Councilman NcNains, and carried, that the claim be denied.
0~ECTION TO SALE 0~ OLD LIBRARY SITE
A latter was read from the Board of Trustees of the Com~unity Congre~atioual Church
objecting to the proposed sale of the old library sits. City Attorney [ugler reported
he had presented to the School Board the City proposition to purchase park lands with
any money realiaed from the sale of the old library site, if the Board ~ould give the
City a Quit-Claim 9ced to the property. The Board took no ection on the matter.
It was moved by Councilman McAllister, seconded by Councilman McMains, and carried,
that the Council take no further action on the matter until the next meeting, at which
all Councilmen are present.
~ACTXON ON ~E~UEST FOR ALLEY CLOSING
Mr. Duke Ellington asked whet action the Council was going to take on his request
to close the alley in Kosebank Subdivision for 64 feet North of E. Street.
City Engineer Floyd reported the cash outlay to the City would be $1~0. for materials
needed to raise the manhole.
It was moved by Councilman McMains, seconded by Councilman DeGraaf, and cerried~
that the City Attorney be directed to draft the necessary resolution for closing the
alley as requested.

City Engineer Floyd asked what grade was to be established for "E" Street at this
location. He was coId Co leave the grade as it now stands.

Aztec Bus Line had petitioned the Public Utilities Co~aission for permission to serve
Brown Field over a route through Chula Vista.
