HomeMy WebLinkAboutcc min 1967/05/23Held Tuesday MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA May 23, 1967 A regular meeting of the City Council of the City of Chula Vista was held in the Council Chambers on the above date at 7:00 P.M. with the following Councilman present: Councilmen Sylvester, Anderson, McCorquodale, McAllister, Sparling Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Planning Director Warren, Administrative Assistant Sullins Mayor McCorquodale led the pledge of allegiance to the Flag. The invocation was given by Rev. Earl Kernahan of the First Methodist Church. APPROVAL OF COUNCIL MINUTES It was moved by Councilman Sparling, seconded by Councilman McAllister, and carried that the minutes for the meeting of May 16, 1967, be approved, copies having been sent to each Councilman. ~,RECOMMENDATION OF CIVIL SERVICE COMMISSION REGARDING VETERANS' PREFERENCE Administrative Officer Ross stated a letter has been received from the Civil Service Com~nission recommending that an amendment to include Vier Nam veterans under the provision of Rule IV, Section 8 (veterans' credit preference in civil service competition) be approved. The Commission also recommended that the amendment in- clude a five-year limitation clause for the use of preference credits. L. C. Vinson, Chairman of the San Diego Area Veterans' Employment Committee, stated the committee is inalterably opposed to any limitation or discontinuance of veterans' preference points in civil service competition. He expressed the opinion that veterans are entitled to a five-point preference. It was moved by Councilman McAllister, seconded by Councilman Sylvester, and carried that veterans of Viet Nam be included under the provision of Rule IV, Section 8. RESOLUTION NO. 4410-A - Amending Rule IV, Section 8, of the rules of the Civil Serv- ice Commission relating to veterans' preference Offered by Councilman Sparling, read in full, passed and adopted by the fol- lowing vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister~ Noes: None Absent: None Mr. Ray Rainwater, National Inspector General for the Veterans of Foreign Wars, speaking on behalf of all veterans, commended the Council on action taken ex- tending the veterans' preference to veterans of the Viet Nam conflict with no limi- tation as to time. ~PRESENTATION OF CERTIFICATES OF COMPLETION ON COURSE IN TURF MANAGEMENT Mayor McCorquodale presented certificates of course completion, provided by San Diego Junior College, to Eugene Palmer, Earl Markert, Paul Besser, Dean Wayson, Horace Wright, Merrill Maple, John C. Poneleit and John A. Poneleit for having suc- cessfully completed a course in Turf Management.  BLIC HEARING (continued) - Establishment of Flood Plain Zoning in Lower Sweetwater Valley This being the time and place, as designated for the continuation of a hearing on establishment of Flood Plain Zoning in Lower Sweetwater Valley, Mayor McCorquodale declared the hearing open. City Attorney Lindberg stated that at the last hearing an ordinance with cer- tain modifications was proposed and the hearing continued at that time in order to check out advisability of those modifications. .Therefore, he was of the opinion it would be advisable to send cop~s of the modified ordinance to all property owners affected and notify them that ~e hearing is being continued until June 20, 1967. It was moved by Councilman McAllister, seconded by Councilman Anderson, and carried that the hearing be continued until June 20, 1967 at 7:00 P.M., and that all property owners affected be so notified. BLIC HEARING - Intention of City to vacate a portion of Whitney Street This being the time and place, as advertised, for a hearing on the proposed vacation of a portion of Whitney Street, east of First Avenue, Mayor McCorquodale declared the hearing open. Because a major property owner has objected to the closing, since the hear- ing by the Planning Commission, it was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the hearing be continued until Oune 20, 1967 at 7:00 P.M., and the matter referred back to the Planning Commission for further consideration and in order that the objector may be heard. ~/~'~BLIC HEARING ~ Consideration of a Specific Plan Line - Portion of "H" Street ex- tension at intersection of Otay Lakes Road to a point 6,800 feet west This being the time and place, as advertised, for a hearing on the proposed Specific Plan Line for a portion of "H" Street extension, Mayor McCorquodale declared the hearing open. City Engineer Cole submitted a map showing two possible routes for the exten- sion of "H" Street to the east of the City. Route No. 1 would run easterly along the south boundar~ of the Bonita Vista High School and Route No. 2 would run easterly along the north boundary of the high school. Estimated cost of Route No. 1 would be $583,000. Estimated cost of Route No. 2 would be $834,200. Mr. Dick Chase, owner of property to the west of the high school~ stated that the southerly route would bisect his property which, on the proposed Master Plan, is proposed for a shopping center. Mr. Chase would like to know what position the School Districts are taking and if they would be dedicating amy property for the alignment. It was moved by Councilman McAllister, seconded by Councilman Sylvester, and carried that the hearing, be continued until June 27, 1967 at 7:00 P.M., in order for the School Districts to review the proposed routes and give definite statements as to their preference~ if any. ORDINANCE NO. 1059 - Adopting National Electric Code, 1965 Edition, and amendments - First reading It was moved by Councilman McAllister that Ordinance No. 1059 be placed on its first reading and that reading of the text be waived by unanimous consent. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Sparling~ Sylvester, Anderson, McCorquodale Noes: None Absent: None ORDINANCE NO. 1060 - Adopting an emergency interim amendment to the Zoning Ordinance regulating the use of the front setback for parking in resi- dential zones - First reading and adoption It was moved by Councilman Sparling that Ordinance No. 1060 be placed on its first reading and adopted as an emergency ordinance and that reading of the text be waived by unanimous consent. The ordinance was adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None RESQLUTION NO. 4410 - Giving notice of public hearing on budget for fiscal year 1967-1968 - Hearing set for June 6, 1967 Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None RESOLUTION NO. 4411 - Approving amendment to the agreement between the City of San Diego, County of San Diego, Montgomery Sanitation District and Chula Vista, allowing Chula Vista to serve additional areas Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None RESOLUTION NO. 4412 - Amending Schedule II of the Traffic Code to include boulevard stops on Fourth Avenue at Frontage Road and Trousdale Drive Offered by Councilman Sylvester, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sylvester, Anderson, McCorquodale, McAllister~ Sparling Noes: None Absent: None RESOLUTION NO. 4413 - Accepting petition for 1911 Act Improvement District and directing City Engineer to prepare plans and specifications Offered by Councilman McAllister, the reading of the text was waived by unani~ mous consent, passed and adopted by the following vote~ to-wit: AYES: Councilmen McAllister, Sparling~ Sylvester, Anderson, McCorquodale Noes: None Absent: None RBSOLUTION NO. 4414 - Supporting Assembly Bill 548 regarding painting standards Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None RESOLUTION NO. 4415 - Opposing Assembly Bill 804 regarding registration of municipal electrical inspectors Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None RESOLUTION NO. 4416 - Opposing Senate Bill 807 regarding registration of apprentice , and journeymen plumbers Offered by Councilman Anderson, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Anderson, McCorquodale, McAllister, Sparling, Sylvester Noes: None Absent: None RESOLUTION NO. 4417 - Revising greens fees at Chula Vista Municipal Golf Course Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None ~CALL FOR BIDS AUTHORIZED FOR CONSTRUCTION OF LINED DRAINAGE CHANNEL It was moved by Councilman McAllister~ seconded by Councilman Sylvester, and carried that the City Engineer be authorized to call for bids at the prevailing mini- mum wage scale for the construction of a lined drainage channel located on the San Diego and Arizona Eastern Railroad right-of-way between "G" and "H" Streets. fALL FOR BIDS AUTHORIZED FOR TENNIS COURT LIGHTING It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried that the City Engineer be authorized to call for bids at the prevailing min- imum wage scale for the installation of lighting facilities at two tennis courts in General Roca Park. ~/P~.QUEST FOR AUTHORIZATION TO AMEND CONTRACT BETWEEN CITY AND STATE - Zoning Ordinance program Administrative Officer Ross stated that the Director of Planning has received a request from the State Office of Planning and Williams~ Cook & Mocine, Planning Consultants, on the zoning ordinance, that the Council authorize an amendment to their contract to provide for changes of service that were necessary due to new membership on the Planning Commission. If approved by the Council, the State will send the amendments to the contract for execution. It ~as moved by Councilman Sylvester, seconded by Councilman McAllister, and carried that authorization to amend the contract be granted. CALL FOR BIDS AUTHORIZED FOR STRUCTURAL PEST CONTROL OF CIVIC CENTER AND FIRE STATION NO. 1 It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the City Engineer be authorized to call for bids at the prevailing min- imum wage scale for structural pest control of the Civic Center and Fire Station No. /REQUEST FOR RATE INCREASE AND EXTENSION OF CO~TRACT Administrative Officer Ross stated a request has been received from the Chula Vista Sanitary Service for trash collection rate increases found necessary because of action by the County Board of Supervisors establishing charges for users of the County dump. Also requested was an extension of their contract for five years. It was moved by Councilman Sparling, seconded by Councilman Sylvester, and carried that the request for a five-year extension to their contract be referred to Administrative Officer Ross for further report. RESOLUTION NO. 4418 - Giving notice of intention to hold public hearing June 13, 1967, to consider revision of trash collection rates Offered by Councilman Sparling, the reading of the text was waived by unani- mous consent, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, Sylvester, Anderson, McCorquodale, McAllister Noes: None Absent: None V~SAFETY COMMISS ION RECOMMENDATION REGARDING VACATION OF ELM AVENUE BE~4EEN MADRONA AND CYPRESS STREETS Administrative Officer Ross ~eported that the letter of Louis Cotarelo, Jr., requesting the vacation of Elm Avenue between Madrona and Cypress Streets, was re- ferred t~ the Safety Commission, as requested by the Council at their meeting of March 14~967. The Safety Commission, after study, agreed the matter was not a safety proble~ or traffic hazard and referred it back to the Council for action. In the meantime~ a petition has been received from residents of Cypress and Madrona Streets objecting to the closing of Elm Avenue. It was moved by Councilman Sparling, seconded by Councilman McAllister, and carried that the matter be referred back to the Planning Cormnission for further study and report back to the Council. ~REQUEST FOR APPOINTMENT OF NEW MEMBER TO LIBRARY BOARD A letter was read from Bluma Levine, Librarian, requesting that the Council appoint a new member to the Library Board in place of Mrs. McDonald, who has been absent from three consecutive meetings. The Library Board submitted the names of Manny Kugler, Francis Drag, Paul Thompson and John Horn for consideration. It was moved by Councilman McAllister~ seconded by Councilman Sylvester, and carried that appointment of a member to the Library Board be held over until the next meeting. ~,-L~ETTER OF APPRECIATION A letter was read from B. L. Wilson, 930 Monterey Court, expressing appreci- ation for the attention the Council has given to the traffic hazard at the hill in the 300 block on East "L" Street. ~/I{EsOLUTION OF BOARD OF SUPERVISORS URGING APPOINTMENT OF SAN DIEGO COUNTY RESIDENT TO STATE HIGHWAY COMMISSION A resolution was read from the County Board of Supervisors urging that the Governor of California appoint a citizen of this County to serve on the State High- way Commission. It was moved by Councilman Sparling, seconded by Councilman Anderson, and carried that the City Attorney be directed to draw up for the next meeting a reso- lution supporting that of the Board of Supervisors. VREQUEST FOR DRIVEWAY EASEMENT OVER UTILITY EASEMENT Mr. Albert Ashkar, representing Mr. Jack Williams, submitted a letter request- ing an easement for a driveway to apartments he contemplates at 228 "G" Street. The easement would be over Lot "A" of Delro Tract which is an easement used for utilities. Referred to Administrative Officer Ross and City Engineer Cole to check out. ~}CAUTION CHILDREN" siRn requested Councilman Anderson stated that the parking lot which is shared by the Pony League and American Legion is a hazard to children riding bicycles and asked if a sign reading "Caution Children" could be installed at the entrance to the parking lot. Administrative Officer Ross stated he would take care of it. DATE SET FOR BUDGET SESSION It was moved by Councilman Anderson, seconded by Councilman Sylvester, and carried that June 1, 1967 at 9:00 A.M., be set as the time for another meeting on the budget prior to the public hearing. Councilman Sparling voted no. ~REPORT ON CONSULTANT FOR CLASSIFICATION AND C0~E~ATION PLAN STUDY Administrative Officer Ross reported that, as directed by the Council, he has contacted qualified firms and individuals in the field of private consultants for a special classification and compensation plan study. Contacted were Erile Golden, Griffenhagen-Kroeger, Inc., E.B.S. Management Consultants, Inc., and State Personnel Board's Cooperative Personnel Service. After interviewing each, it was the recom- mendation of the Administrative Officer that an agreement be negotiated with Grif- fenhagen-Kroeger, Inc., for presentation at the meeting of June 13, 1967. It was moved by Councilman McAltister, seconded by Councilman Sylvester, and carried that the matter be brought back for consideration at the meeting of June 6, 1967. ADJOURNMENT - 9:10 P.M. Councilman Sparling moved that the meeting adjourn until Thursday, June 1, 1967 at 9:00 A.M.
