The Council met in the Council Chambers at the City Hall on the
above date at 7:00 PoMo with the following Councilmen present:
Councilmen McAllister, Smith, McMains~ DeGraaf~ Menzel
Absent: None
Also present: City Attorney Kugler, City Administrator Fulwiler, City
Planner Fretz~ City Engineer Floyd, Principal Civil Engineer
Harshman, Administrative Analyst Ross~ Building Inspector

Mayor McMains led the salute to the Flag and asked for a moment of prayer
ORDINANCE No. 631-Amending Zoning Ordinance- Map filing fees-2nd readiug
It was moved by Councilman McAllister~ seconded by Councilman Smith~
and carried~ that Ordinance No. 631 be placed on its second reading; that
reading of the text be waived and the Ordinance adopted. The motion
carried by the following vote~ to-wit:
AYES: Councilmen McAllister~ Smith~ McMains, DeGraaf~ Menzel
Noes: None
Absent: None
EPORT OF COMMITTEE ON SPEEDWAY NOISE
Councilman Smith reported that he and Councilman DeGraaf had met with
representatives of both groups involved in the Sweetwater Valley Speedway
noise problem, and after much deliberation, wished to recommend to the
Council that the track be permitted to operate until the first day of
October providing they install mufflers on each racer operating on the track.
It was moved by Councilman Smith~ seconded by Councilman DeGraaf, and
carried, that the operators of the Midget Auto Races in Sweetwater Valley
be informed that they should install mufflers immediately on all of their
equipment~ and cease operations at the track as of the first day of
October, 1959.
\ ~PoRT~./ ON DEDICATION OF McMILLIN PROPERTY FOR CONTINUATION OF FIRST AVENUE
City Administrator Fulwiler gave a report on the history of the
dedication by Macey McMillin of a portion of his property North of "D"
Street for the possible continuation of First Avenue through to C. Street.
Mr. McMillin was of the opinion when he deeded the property to the City
it was dedicated for street purposes~ and thus opened the way for him to
build a house on the fifty foot frontage of his property which was used
as frontage for a house previously moved in and set back from "D" Street,
but actually facing the proposed First Avenue.
The Council was of the opinion Mr. McMillin was in violation of the
zoning ordinance by placing two houses on an R-1 lot and suggested he
cease operations on the new dwelling until application has been made to
the Planning Commission for permission to split his lot.
RESOLUTION No. 2230- Approving agreement with Little League
Offered by Councilman Smith~ read in full, passed adopted and approved
by the following vote, to-wit:

RESOLUTION NOo 2231- Approving Lease agreement with Boys' Club
Offered by Councilman Menzel, read in full~ passed, adopted and approved

RESOLUTION Noo 2232- Giving notice of intention to vacate portion of
drainage easement
Offered by Councilman Smith; this Resolution was approved providing
it be amended to close only that portion of the easement extending from
Beech Avenue to the rear of the garage. Adopted by the following vote-to-~t~

RESOLUTION No. 2233-Accepting and dedicating one foot lot for James Sto
Offered by Councilman Smith, read in full, passed, adopted and approved
by the following vote, to-wit:

RESOLUTION No. 2234-Dedicating and naming previously accepted property
(James Street)

ORDINANCE No. 632- Changing name of a portion of Country Club Drive-
1st reading
It was moved by Councilman DeGraafs seconded by Councilman McAllister,
and carried, that Ordinance No. 632 be placed on its first reading, and
that reading of the text be waived. The motion carried by the following
vote, tow&t:
AYES: Councilmen DeGraaf, Menzel, MeAllister, Smith, McMains
Noes: None

ANNING COMMISSION RECOMMENDATIONS - Zoning
A letter was read from the Planning Commission recommending that the
North side of "H" Street between Broadway and Smith Avenue be rezoned from
R-2 to C-l; that all remainiN~ R-3 properties between "F" Street and Flower
Street and the Freeway and Broadway be rezoned C-2; and interim R-1 and M-1
zoning for the Russell Haas Industrial Park Annexation.
It was moved by Councilman McAllister, seconded by Councilman Smith,
and carried, that May 26th at 7:00 P.M. be set as the time for a public
he,ring on the Planning Commission recommendations.
EwER SYSTEM SURVEY
Harvey Ludwig~ President of Engineering Science, Inc. Consulting
Engineers~ discussed the highlights of his report, already submitted to
the Council, on a master plan for sewerage to guide the City in its future
activities relating to the collection, treatment and disposal of sanitary
and industrial sewage. No action was taken.
-~IDS AUTHORIZED FOR TELEGRAPH CANYON TRUNK LINE SE~ER
It was moved by Councilman McAllister~ seconded by Councilman Smith,
and carried, that the City Engineer be directed to call for bids on
the proposed Telegraph Canyon Trunk line sewer.

fSEMBLY BILL ON ADVERTISING WAGE SCALES
Councilman DeGraaf stated he had read that there was a bill before the
Legislature whereby it would not be necessary, if passed, for cities to
advertise wage scales when calling for the bids on proposed projects. He
thought perhaps it would be well for the City to go on record as being in
favor of this bil]o City Administrator Fulwiler stated he would comply.
Councilman DeGraaf was of the opinion proposed bills before the Legislature
affecting cities might be presented to the Council more systematically.
RESOLUTION No. 2235-Ascertaining prevailing rate of per diem wages in City
for proposed Telegraph Canyon Trunk Line Sewer
Offered by Councilman Smith, passed, adopted and approved by the £ollow-
ing vote, to-wit:

Noes: None

~E~NSION OF CUL-de-SACS
Mr. Lee Raitt asked that the Council establish a policy so that sub-
dividers, the Engineering Department, and any others concerned, might know
where the responsibility lies in the removal and aligning of a cul-de-sac
when a street is put through to serve an adjoining subdivision° The
matter was referred to the City Administrator for study and recommendation
t~ the Council at a later meeting.

~BROAD~AY ASSOCIATION REQUEST FOR STREET LIGHTS
Mr. Neal Laub, representing the Broadway Association, stated the street
lighting program for Broadway seemed to have bogged down, and asked that
funds for additional lights on Broadway be included in the coming budget.
City Administrator Fulwiler explained that because the street lighting
program had grown to such a large item in the City's budget, it would be
mandatory that a thorough study be made of the entire street lighting
picture before ~ further commitments.
