HomeMy WebLinkAboutcc min 1959/08/04 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA HELD Tuesday August 4, 1959 The Council met in the Council Chambers on the above date at 7:00 P.M. with the following Councilmen present: Councilmen Smith, McMains, DeGraaf, Menzel Absent: Councilman McAllister Also present: City Attorney Kugler, City Administrator Fulwiler, City Engineer Floyd M~/~r McMains led the salute to the Flag and asked for a moment of prayer PRESENTATION OF TRAFFIC SAFETY AWARD Mro Richard Swart, representative of the Public Safety Council of the American Automobile Association, presented the City with a Traffic Safety Award for having no pedestrian traffic fatalities during the year 1958. ~UBLIC HEARING - Proposed rezoning from R-1 to R-2 of five lots on West side of Ash Avenue below James Street This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-1 to R-2 of five lots on the West side of Ash Avenue below James Street, Mayor McMains declared the hearing open. Mro Louis Klein stated he was in favor of rezoning the property R-2, but not R-3o He was assured the advertisement proposing an R-3 zone was a typo- graphical error. No others wishing to be heard either for or against the rezoning, the Mayor declared the hearing closed° ORDINANCE No. 649- ~nending Zoning Ordinance Nee 398-First reading (Ash Ave°) It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that Ordinance No. 649 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote: AYES: Councilmen Smith, McMains, DeGraaf, Menzel Noes: None Absent: Councilman MeAllister ORDINANCE NO. 644-Establishing building line on Landis Avenue between E, Street and F. Street- Second reading I£ was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that Ordinance No. 644 be placed on its second reading and that reading of the text be waived and the Ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, Menzel Noes: None Absent: Councilman McAllister POSED TIDELANDS BOND ELECTION City Administrator Fulwiler reviewed the calendar for the proposed tidelands bond election as prepared by O'Melveny & Myers and submitted a report from the Harbor Commission recommending that the bond election be held. It was moved by Councilman DeGraaf, seconded by Councilman Menzel, and carried that the report of the Harbor Commission be accepted and items regarding the bond election be placed on the next Council Agenda for action. MEETING WITH THE SOUTH BAY IRRIGATION DISTRICT Wednesday, August 12, 1959 at 7:30 P.M. in the City Council Chambers was the time and place set for a meeting of the Council with Directors of ~he South Bay Irrigation District. BID REJECTED ON GAS TAX PROJECT No. 34 City Engineer Floyd recommended that the bids received on gas tax project 34 (improvements at Fourth Ave. and F. St. and Broadway and F. St.) be rejected and a call made for new bids on separate items. Mr. Floyd recommended using City crews to remove trees and existing concrete, and to install pavement. It was moved by Councilman Menzel, seconded by Councilman Smith, and carried, that the City Engineer be directed to call for bids on the traffic signals and installation of sidewalks, curbs, gutters and drainage struc- tures only, as the rest of the work can be done more economically by City cr~ws, GINEER DIRECTED TO PROCEED WITH "L" STREET GAS TAX PROJECT Upon inquiry of Councilman Smith as to why the "L" Street project had bogged down, it having been placed No. 1 on the gas tax project priority list, City Engineer Floyd was directed to proceed immediately with the ~oject. CLEARING OF FIESTA GROUNDS APPROVED ~pon recommendation of City Administrator Fulwiler, it was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the City participate in the annual Fiesta to the extent of clearing the site for the Fiesta with City crews as time permits. RESOLUTION No. 2288- Accepting and dedicating property for Telegraph Canyon Road Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilman DeGraaf, Menzel, Smith, McMains Noes: None Absent: Councilman McAllister RESOLUTION No. 2289-Accepting sewer eas~ent- Mylo Ocean View Estates No. 2 Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, Menzel Noes: None AbSent: Councilman McAllister QUESTS FOR PAYMENT OF PLUMBERS BILLS DENIED A letter was read from H. W. Karpowicz, Manager of the Trailer village 288 Broadway, requesting that the City pay a $72. plumbers bill. A plumber was called to clear a sewer at the Trailer Village, only to find that the stoppage was in the City Street. It was moved by Councilman Smith, seconded by Councilman Menzcl, and carried, that the request for payment be denied. A letter was read from Dr. Lloyd Ellis, Church of C~rist, requesting that the City pay a $49. plumbers bill for opening a sewer at 265 Fifth Avenue, the stoppage having been caused by Pepper Tree roots located on the City's parkway. It was moved by Councilman Smith, seconded by Councilman Menzel, and ca~ried, that the request for payment be denied. ~EQUEST FOR SEWER REPAYMENT CONTRACT A letter was read from A. B. Ellington requesting a sewer repayment contract on his Elder Avenue cul-de-sac. It was moved by Councilman Smith seconded by Councilman DeGraaf, and carried, that the City Attorney draft the necessary agreement. ~ETITION FOR ALLEY A petition was read from property owners in the three hundred block on the East side of Third Avenue, requesting that the twenty foot all&y in the rear of their properties be completed. City Administrator Fulwiler was directed to look into the matter and report back to the Council. 2 i1 authorized for property on Casselman Street Act City Administrator Fulwiler requested that the 1911 Act be used for installation of curb and gutter at 451 Casselman Street. It was moved by Councilman DeGraaf, seconded by Councilman Menzel, and c~arried, that the City Administrator proceed as requested° ? UARD RAIL AT COUNTRY CLUB DRIVE AND K. Street Mayor McMains stated a request had come in for a guard rail on the sidewalk over a culvert at Country Club Orive and K. Street. City Engineer Floyd stated the rail was on the street department agend to be installed as soon as they could get to ito 'VACATION - Administrative Officer City Administrator Fulwiler was granted permission to leave on vacation fro~ August 17the through August 28tho ~OINT MEETING WITH PARK AND RECREATION COMMISSION The Council met in joint session with the Park and Recreation Commis- sion for discussion. After discussion on the Eucalyptus Park Develop- ment program, it was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that the Park and Recreation Commission be authorized to proceed with plans for Eucalyptus Park as presented, and that $10,600. of the unappropriated surplus in the Park and Recreation Fund be trans- ferred to the 12-80-D! account. ADJOURNMENT Mayor McMains adjourned the meeting at 9:30 P.M. sine die.
