Held Friday October 9, 1959 The Council met at 4:30 P.M. on the above date in the Council Chambers of the City Hall pursuant to notice of consent to hold a Special Neeting for the purpose of considering adoption of an Ordinance to prohibit racing of midget racers and any other action deemed necessary in connection with prohibiting such racing with the following Councilmen present: Councilmen McAllister, Smith, McMains, Menzel Absent: Councilman DeGraaf Also present: City Attorney Kugler, City Administrator Fulwiler, Chief-of-Police Quinn, Administrative Analyst Ross Mayor McMains led the salute to the Flag and asked for a moment. of prayer. -~ RESTRAINING ORDER ON MIDGET RACES City Attorney Kugler stated that the Council and Chief-of- Police had been served with a temporary restraining order which would allow the quarter midget auto races to continue at least until October 15, 1959. It was moved by Councilman Smith, seconded by Councilman M~Allister, and carried, that the City Attorney be directed to .~..'g ther affidavits from those distressed by the midget races, and prepare a cross complaint for an injunction against the operators of the quarter midget auto races; and that Thirty ($30.00) Dollars be authorized from the fund for outside legal services (1-15-BO 5) for filing fees. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains, Menzel, McAllister Noes: None Absent: Councilman DeGraaf Mr. Jerry Stone asked why the Council should spend the taxpayers money to do the leg work for the property owners professing to be distressed, and stated the quarter midget races were going to operate until they got out of debt or were stopped by the Courts. ORDINANCE No. 660- Prohibiting the operation of vehicular races It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that Ordinance No. 660 be placed on its first reading and adopted as an emergency. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains, Menzel, ~cAllister Noes: None Absent: Councilman DeGraaf The Ordinance was thereupon read in full. ADJOURNMENT 5:15 P.M. It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that the meeting adjourn sine die.
