The Council met in the Council Chambers at City Hall on the above date at 7:00 PoMo with the following Councilmen present: Councilmen McAllister, Smith, McMains, DeGraaf, Menzel Absent: None Also present: City Attorney Kugler, City Administrator Fulwiler, City Egnineer Floyd STATEMENT The City Clerk hereby states that he did post within twenty-~r6U~ hours of adjournment, as provided by law, the order of adjournment of the City Council for the adjourned meeting of October 27, 1959o Mayor McMains led the salute to the Flag and asked for a moment of prayer ET AUTO PACES City attorney Kugler reported that Attorney Jones, representing the Optomist Club on the quarter Midget Auto Race litigation, was willing to compromise the case by agreeing to operate the quarter Midget Auto races for the balance of the year from ll:00 A.M. to 6:00 P.M. on Sundays only, and are willing to ask that the Court enter a decree to that effect. William Hummel, President of the Optomist Club verified Attorney Kugler's statement° It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that the City Attorney be authorized to enter into an agree- ment as outlined and agreed to by the Optomist Club. ORDINANCE No~._~6~lxAmending Zoning Ordinance (Ho Street, West of Broadway) ....... second reading It was moved by Councilman Menzel, seconded by Councilman Smith, and carried, that Ordinance No. 661 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following vote, to-wit: AYES: Councilmen Menzel, McAllister, Smith, McMains Noes: Councilman ~Graaf Absent: None ORDINANCE No. 662-Authorizing amendment to State Eetir~mm~t Contract First reading It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that Ordinance No° 662 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, Menzel, McAllister Noes: None Absent: None RESOLUTION No~_~33~5_xAccepting and dedicating property for Casselman ......... Street (Mitchell) Offered by Councilman DeGraaf, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, Menzel, McAllister, Smith, McMains Noes: None Absent: None RESOLUTION No. 2336-Accepting and dedicating property for Casselman Street (Milke) Offered by Councilman DeGraaf, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, Menzel, McAllister, Smith, McMains Noes: None Absent: None A letter was read from the Civil Service Commission recommending that Section 12 of Rule 2 of the Civil Service Rules be amended by deleting Class No. B6-Junior Planning Draftsman, and adding a new Class No. B5 entitled "Planning Draftsman", with salary at l~nge 26. It was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that the recommendation of the Civil Service Commission pertain~g to the Planning Draftsman be approved. ~S ON SURPLUS HOUSING FURNITURE ACCEPTED City Administrator Fulwiler reported three high bids had been received for various items of surplus furniture store~ at the Housing Project, the bids being those of Valley Furniture in the amount of $13.00; George's Surplus in the amount of $322.58, and ~rgain Barn in the amount of $1066.68. It was moved by Councilman Menzel, seconded by Councilman DeGraaf, and carried, that the Purchasing Agent be authorized to sell to the three highest bidders, those items upon which their respective bids were the highest. It was pointed out that no bids were submitted on 275 trash cans, 31 Hollywood beds, and 23 double springs. It was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that the beds and springs be given to the County YoMoC.A and to the Boy's and Girl's Scout Camps if they have any use for them. ID AWARDED ON BOX CULVERT - Broadway and I. Street City Engineer Floyd reported the following bids received for construc- tion of a box culvert at Broadway and I. Street; Frank Trujillo $ 8,151.00 Morey Steinman 10,700.00 W. Fo Nelson 10,500.00 Mr. Floyd explained the bid bond of the low bidder was short $15.10. It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the low bid of Frank Trujillo in the amount of $8,151.00 be accepted and the shortage of $15o10 on the bond be waived. ITION FOR IMPROYEMENTS ON MIN~T AVENUE A petition was received, signed by thirty-five property owners on Minot Avenue, requesting that the City install curb, gutter and shoulder paving in front of specified properties in the 100 block on Minot Avenue. It was moved by Councilman McAllister, seconded by Councilman Smith, and carried, that the City Administrator be directed to proceed with the project under the provisions of the 1911 Act. ~~FO_R~M~P~R~O~EMF~_C Broadway Association Mr. Neal Laub, President of the Broadway Association asked that the Council take whatever action is necessary to complete the improvement of Broadway, from City limits to City limits, with sidewalks, curbs, gutters and shoulder paving. It was also requested that the street lighting program for Broadway be completed as soon as possible. City Administrator Fulwiler was directed to proceed under provisions of the 1911 Act, with the installation of curbs, gutters, sidewalks and shoulder paving where it does not now exist on Broadway. Members of the Broadway Association were told by the Mayor that additional lighting for Broadway would have to wait its turn because of the high cost of lighting, but that consideration would be given to the installation of lights when possible. ~,~ENSUS Councilman Menzel suggested that it might be wise to have a Special Census taken prior to April 1, 1960, in order to benefit in the gas tax allocation, as the Federal Census would not be conclusive until the spring of 1961. No action taken. 2 Councilman Menzel asked that the City Administrator and City Attorney look into the methods whereby Council study meetings can be held without having a regular meeting. Ne stated that it was brought out at the League Conference that most all cities in the State held such ~etings which were considered both legal and advisable. ~/ MAYOR GRANTED PERMISSION TO LEAVE STATE At the request of Mayor McMains, it was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that Mayor McMains be permitted to leave the State from November 1st to November 5th, 1959. ~/'/CHARTER CHANGES Mayor McMains again asked the Council if they thought it advisable to appoint a Charter Study Conunittee. It was suggested the matter be brought up at the next meeting. ADJOURNMENT - 8:20 PoM. It was moved by Councilman Menzel~ seconded by Councilman DeGraaf, and carried, that the meeting adjourn until November 3~ 1959 at 7:00 P.M.
