OF TBE CITY COUNCIL OF THE CITY OF CHULA VISTA,
CALIFORNIA
Held Tuesday December 8, 1959
The Council met in the Council Chambers at the City Hall on the above
date at 7:00 P.M. with the following Councilmen present:
Councilmen McAllister, McMains, DeGraaf, Menzel
Absent: None
Also present: City Engineer Floyd, City Attorney Kugler, City A~inistrator
Fulwiler, City Planner Fretz, Administrative Analyst Ross
STATEMENT The City Clerk hereby states that he did post within
24 hours of adjournment, as provided by law, the order
of adjournment of the City Council for the Regular
Meeting of December 8, 1959.
Mayor McMains led the pledge of allegiance to the Flag and asked for a
moment of prayer
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman DeGraaf, seconded by Councilman Menzel
and carried, that the Minutes of Council meetings for November 10th, 17th,
24th, and December 1st be approved, copies having been sent to each
Councilman.
~BLIc HEARING - Proposed rezoning of property at Third Ave. & Lo Sro
This being the time and place, as advertised, for a public hearing on
the proposed rezoning from R-1 to C-2 of property on the Northeast corner
of Third Avenue and Lo Street, Mayor McMains declared the hearing open°
No one wishing to be heard either for or against the proposed rezoning,
the Mayor declared the hearing closed.
ORDINANCE No. 673- Amending zoning Ordinance -(Third Avenue and Lo Street)
First reading
It was moved by Councilman DeGraaf, seconded by Councilman Menzel
and carried, that Ordinance NOo 673 be placed on its first reading and
that reading of the text be waived. The motion carried by the following
vote, to-wit:
AYES: Councilmen DeGraaf, Menzel, McAllister, McMains
Noes: None
Absent: None
~UBLIC HEARING._Precise zoning of Pylant No. 1 and 2 Annexations
This being the time and place, as advertised, for a public hearing on
the proposed precise zoning of Pylant No. 1 and 2 Annexations, Mayor
McMains declared the hearing open. No one in the audience wished to be
heard either for or against the proposed zoning. Councilman DeGraaf
questioned the advisability of zoning the Northerly lot of Pylant No. 1
to R-~ instead of R-2 as recommended for the rest of the annexation. City
Planner Fretz explained the proposed R-S zone for the Northerly lot was
recommended at the request of the owner and as a possible buffer zone for
the property at the North of the lot which might be zoned commercial°
Mr, Fretz stated that due to the fact the proposed zone had been approved
at three previous public hearings, the owner of the lot was not present at
this hearing, and suggested the matter be held over until the owner could
be notified of the possible change on the part of the Council.
It was moved by Councilman DeGraaf, seconded by Councilman Menzel,
and carried, that the hearing be continued until the next Council meeting.
RESOLUTION No. 2358-Approving agreement with Library Consultant (Castagna)
Offered by Councilman McMains, read in full, passed, adopted and
approved by the following vote, to-wit:
AYES: Councilmen McMains, DeGraaf~ Menzel, McAllister
Noes: None
Absent: None
~/~ETTLEMENT OF SUITS AND REFUND OF TAXES TO BOHR AIRCRAFT CORP.
City Attorney Kugler stated that the County Counsel has prepared a
proposed stipulation for judgment in the actions brought by Rohr Aircraft
Corp. against the County, Chula Vista and other governmental agencies in
which Bohr Aircraft Corp. requested a refund of taxes paid on the possessory
interest that Rohr Aircraft Corp. held in government-owned property over
certain years. Mr. Kugler advised that the City enter into the settlement
as proposed by the County Counsel.
It was moved by Councilman DeGraaf, seconded by Councilman Menzel
and carried, that the City Attorney be authorized to enter into the proposed
stipulation for judgment in settlement of the actions brought against the
C/~ty by Rohr Aircraft Corp.
~//ENDORSEMENT OF J. C. CRAIN ~) FII.l, C~)UNCIL VACANCY
A letter was read from the B~oSxiway Association urging the Council to
give serious consideration to the appointment of J. C. Crain to fill the
vacancy on the City Council. The letter was filed.
~/~LOSING OF A PORTION OF EAST "I" STREET REQUESTED
A letter was read from six property owners in the 600 block on
Gretchen ~ad requesting that East "r' Street from the entrance to the
Hilltop High School playing field to the East be closed until the City is
ready to improve it as a street. City Administrator Fulwiler was directed
to look into the matter.
QUEST FOR MODIFICATION ON FENCING OF SWIMMING POOL
A letter was read from the Bohr Manor Motel, 580 Broadway, requesting
that the Council modify terms of Ordinance No. 670, as provided in Section
6, so that they will not be forced to fence in their swimming pool. It was
moved by Councilman McAllister, seconded by Councilman Menze~ and carried,
that the letter be ~eferred to the Safety Council for reco~endation.
LETTER OF APPKECIATION
A-l~%er was read from William Miller, Camp Executive of the YMCA
Camps, expressing appreciation for the beds, springs and garbage cans
donated by the City Council to the YMCA Camp Department.
ID AWARDED ON SALE OF VISTA SQUARE UNITS
City Administrator Fulwiler reported the three following bids had
been received on sale of ten units in the Vista Square Housing Project:
H.E.Holtzapple -$~01.25; CoF. Schumaker -$1000.00; and Valley Lumber and
Salvage Coo -$1025.00. It was moved by Councilman McAllister, seconded by
Councilman DeGraaf, and carried, that the high bid of the Valley Lumber
& Salvage Co. in the amount of $1025. be accepted.
~/~iD RECEIVED ON LIBRARY DEMOLITION
City Engineer Floyd reported that the following two bids had been
received for demolition of the old Library: Littlepage and Sjol~ $2,095.00;
United Builders $1993.00 providing the City furnishes the use of its crane
and operator for about a day and one-half. Action on accepting a bid was
held over until the next meeting, while the City Administrator considers
w~ch is the best proposal.
\ ~EQUEST TO LIFT FOUR TREE STUMPS APPROVED
'~/ City Administrator Fulwile~ re~0~%-6d the Chula Vista High School has
requested permission for City crews to enter the School property and lift
from their holes, four tree stumps that have been already dug up by students.
It was moved by Councilman DeGraaf, seconded by Councilman Menzel, and
carried, that the permission be granted as requested.

City Administrator Fulwiler stated a report from the State Lands
Commission showed that title survey NOo 17, taken out in 1888 on the
tidelands had never been cancelled, and suggested that the Council authorize
a title search to clear the title°
It was moved by Councilman McMains, seconded by Councilman Menzel,
and carried, that the City Administrator contact the Title Company for a
title search on Tidelands Title Survey No. 17.
~COME TAX EXEMP__T_ION ON MUNICIPAL BONDS
Mayor McMains stated that the Mayor's Association was urging all
cities to contact their representatives in opposition to the proposal to
remove from Federal tax exemption, interest received from Municipal and
State Bonds°
It was moved by Councilman DeGraaf, seconded by Councilman McMains~
and carried, that the City Administrator contact Representative Wilson
and the State Senators in oppgsition to the proposal to remove from
Federal Tax exemption, interest received by holders of State and Municipal
Bondso
,~TRAFFIC CONGESTION AT FIRST AVENUE AND F. STREET
Mayor McMains opened discussion on the traffic problem at First
Avenue and F. Street, and also at Fourth Avenue and J. Street, and asked
if a solution had been reached.
City Engineer Floyd stated no solution had been reached. He was
directed to keep the Safety Council working on the problem.
~A~DITIONAL. · COMPENSATION FOR CITY ATTORNEY DISCUSSED
Mayor McMains stated he was of the opinion that the City Attorney
should be entitled to extra compensation when in Court on such matters
as the Highland Avenue Annexation suit. Mr. Kugler was directed to bring
in a schedule of attorney's fees as set by the Bar Association, at the
next meeting°

and carried, that the meeting adjourn until December 15, 1959 at 7:00 P.Mo
