HomeMy WebLinkAboutcc min 1960/01/12 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday January 12, 1960 The Council met in the Council Chambers at the City Hall on the above date at 7:00 PoM~ with the following Councilmen present: Councilmen McAllister~ Smith, McMains, DeGraaf Absent: Councilman Menzel Also present: City Attorney Kugler, City Engineer Floyd, City Administrator Fulwiler, City Planner Fretz~ Administrative Analyst Ross Mayor McMains led the pledge of allegiance to the Flag and asked for a moment of prayer APPROVAL OF COUNCIL MINUTES It was moved by Councilman McAllisterv seconded by Councilman Smith and carried, that the Minutes of Council meetings for December 8, 15, 18~ 22, and January 5th be approved, COllies having been sent to each Council- /~IC HEARING -Rezoning of Northeast corner of Third Ave° & Do Sto This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-1 to R-3 of a lot at the Northeast corner of Third Avenue and Do Street, Mayor McMains declared the hearing open° The Clerk having received no written protests and no one in the audience wishing to be heard either for or against the proposed rezoning, the Mayor declared the hearing closed° ORDINANCE No° 687 - Amending zoning Ordinance-Northeast corner of Third Avenue and Do ~treet- First reading It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that Ordinance No. 687 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,McAllister Noes: None Absent: Councilman Menzel /BLICHEARING - of Southeast of Third & Rezoning corner Ave° Do St. This being the time and place~ as advertised~ for a public hearing on the proposed rezoning from H-1 to R-3 of a lot at the Southeast corner of Third Avenue and D. ORDINANCE No. 688- Amending zoning Ordinance -Southeast corner of Third Avenue and Do Street-First reading It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that Ordinance No. 688 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Smith, McMains Noes: None A~ent: Councilman Menzel pUBLIC HEARING - Rezoning of Ko Street - West of Third Avenue This being the time and place~ as advertised, for a public hearing on the proposed rezoning from M-1 and R-1 to C-2 of property on the South side of K. Street~ West of Third Avenue and the establishment of a five foot building line on K~ Street within the area~ Mayor McMains declared the hearing open. The Clerk having recieved no written protests and no one in the audience wishing to be heard either for or against the proposed rezoning, the Mayor declared the hearing closed. ORDINANCE NOo 689 - Amending zoning Ordinance- Ko Street-West of Third Avenue - First reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried~ that Ordinance NOo 689 be placed on its first reading~ and that reading of the text be waived° The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister~ Smith, McMains Noes: None Absent: Councilman Menzel ORDINANCE NOo 682- Amending zoning Ordinance-Fifth Avenue and Davidson Street - Second reading It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that Ordinance No. 682 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, McAllister Noes: None Absent: Councilman Menzel ORDINANCE No. 683-Amending zoning Ordinance-Pylant No° 1 & 2 Annexations Second reading It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that Ordinance No° 683 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Smith, McMains Noes: None Absent: Councilman Menzel ORDINANCE No. 684-Amending Ordinance No° 405(Sewer Repayments)-Second reading It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried~ ~hat Ordinance No° 684 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McMains~ DeGraaf~ McAllister Noes: None Absent: Councilman Menzel ORDINANCE No° 68S-Use or being under influence of dangerous drugs- Second reading It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that Ordinance No. 685 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Smith, McMains Noes: None Absent: Councilman Menzel ~ASSISTANCE TO LITTLE LEAGUE IN LAND LEVELING AUTHORIZED City Engineer Floyd reported that the total cost to the City to level a piece of land the Little League has leased would be $362°52° For this amount~ the City could level the land but not grade it for final use as a ball diamond. It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that the City Administrator be autho~ ized to direct the Street Department to proceed with the leveling of the land for the Little League° ~ODIFICATION OF ORDINANCE No° 670 AUTHORIZED - Rohr Manor Motel A letter was read from Rohr Manor Motel requesting modification of the terms of Ordinance No. 670 as it affects the fencing of their swimming pool at 580 Broadwaye It was moved by Councilman DeGraaf, seconded by Councilman Smith~ and carried, that the Council finds that strict compliance with the terms of Ordinance No. 670 would not materially benefit or safeguard the public, and that to fence the pool in question would result in undue hardship to the owners or occupants or persons in possession or in control of the property. ~IfNT~RIM ZONING OF PYLANT NOo 4 ANNEXATION A letter was read from the Planning Commission recommending interim C-2 zoning for pylant No° 4 Annexation. The City Attorney was directed to draf~ the necessary Ordinance for action at the next Council meeting° ~TNT~RIM ZONING OF BROADWAY ANNEXATION NOo 1 A letter was read from the Planning Commission recommending interim zoning of R-3 and C-2 for the Broadway Annexation No0 lo Date for a public hearing was set for February 2nd at 7:00 PiMo ~._~v~Dy PARK NO. 2 - Approval of Final Map It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that the final map and improvement plans of Cindy Park No. 2 be accepted, subject to the recommendations of the Engineering Dept. and upon the execution by the owner of a contract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the performance thereof, which contract and bond shall be first approved by the City Attorney as to form and legality° RESOLUTION No. 2376-Approving agreement with Morgan Construction Co. for Improvement of James Court Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, McAllister Noes: None Absent: Councilman Menzel RESOLUTION No. 2377-Approving Improvement Agreement-Cindy Park No. 2 Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Smith, McMains Noes: None Absent: Councilman Menzel OFF-STREET PARKING ORDINANCE After discussing the proposed off-street parking ordinance, it was suggested that a date for the public hearing be set at the next meeting. RESOLUTION No. 2378-Urging the establishment of a Junior College in the Sweetwater Union High School District Offered by Councilman McAllister, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McAllister, Smith~ McMains, DeGraaf Noes: None Absent: Councilman Menzel RESOLUTION No° 2379-Accepting Deed from Security First National Bank- Church Avenue° Offered by Councilman DeGraaf, passed, ddopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, McAllister, Smith, McMains Noes: None A~b~ent: Councilman Menzel ~/CONDITIONAL USE PERMIT - 655 "R" Street A letter was read from the Planning Commission recommending that the application of the Morgan Cons~Zuction COo for a conditional use permit to allow construction of an office building at 655 "H" Street be approved. RESOLUTION No. 2380-Approving Conditional Use Permit for Morgan Constr. Co. Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, DeGraaf, McAllister Noes: None Absent: Councilman Menzel MODIFICATION OF ORDINANCE NOo 670 REQUESTED A letter was read from the Vagabond Motor Hotel at 230 Broadway requesting modification of the terms of Ordinance NOo 670 as it affects the fencing of' their swimming pool. The matter was referred to the City Administrator for investigation and recommendation at the next meeting. ~-~'~LETTER TO MAYOR HODGE OF NATIONAL CITY AUTHORIZED Upon announcement by Mayor McMains of the resignation of Mayor Hodge as Mayor and Councilman of National City, it was moved by Council- man DeGraaf, seconded by Councilman McAllister~ and carried, that the City Administrator be directed to write Mr. Hodge a letter of commenda- tion for his outstanding service to the community of National City. RM DRAIN - Rohr Aircraft City Administrator Fulwiler asked if there was anything the Council wished to do at this time to alleviate the flood threat to Rohr Aircraft Corp. caused by the inadequacy of a three foot by six foot box drainage culvert built under the plant prior to the City's tremendous growth° The Council was of the opinion the responsibility of enlarging or reloca~ lug the drainage culvert was not entirely that of the Citye The City ~ministrator was directed to make a further study of the matter° INTERIM COMMITTEE ON ANNEXATION LAWS City Administrator Fulwiler reported that a meeting would be held in San Diego this coming Thursday and Friday by an Interim Committee from Sacramento to study proposed changes in annexation lawso It was moved by Councilman ~ith~ seconded by Councilman McAllister, and carried, that City Planr, er Fretz, Administrative Analyst Ross and City Administrator Fulwiler be directed to attend the meeting. ~PROVEMENT OP MINOT AVENUE AUTHORIZED City Admin~st~or Fulwiler reqported that property owners on Minor Ave. were willing to cooperate 100% on the installation of shoulder paving but that there were seven property owners who were not able to install their curbs at this time. Mr. Fulwiler asked permission for the City to install, at the expense of the seven property owners, wooden headers, in order that the shoulder project for the entire street can be carried out. It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that the City Administrator be directed to proceed with the project, subject to the installation of the curbs either voluntarily or under the 1911 Act within one year° ~'~ANDONMENT OF THIRD AVENUE RAILROAD TRACK City Engineer Floyd reported that the San Diego and Arizona Eastern Railway was ready to make application to the Public Utilities Commission and Interstate Commerce Commission for abandonment of the tracks on Third Avenue.
