HomeMy WebLinkAboutcc min 1960/01/19 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFOKNIA Held Tuesday January 19, 1960 The Council met in the Council Chambers at City Hall on the above date at 7~00 PoM. with the following Councilmen present: Councilmen Smith, McMains, Menzel Absent: Councilmen McAllister, DeGraaf Also present: City Engineer Floyd~ City Administrator Fulwiler, City Planner Fretz, Chief Building Inspector Grady Mayor McMains led the pledge of allegiance to the Flag and asked for a moment of prayer. ~BLIC HEARING ~Proposed building line on North side of "L" Street between First Avenue and Country Club Drive This being the time and place, as advertised, for a public hearing on a proposed building line of ten feet on the North side of "L" Street between First Avenue and Country Club Drive, Mayor McMains declared the hearing open° The Clerk having received no written protests and no one in the audience wishing to be heard either for or against the proposed building line, the Mayor declared the hearing closed° ORDINANCE No. 690- Establishing building line on p~rtion of "L" Street- --- First reading It was moved by Councilman Smith~ seconded by Councilman Menzel, and carried, that Ordinance No° 690 be placed on Sts first reading, and that reading of the text be waived. The motion carried by the following vote~ to-wit: AYES: Councilmen Smith, McMains, Menzel Noes: None Absent: Councilmen McAllister, DeGraaf ~UBLIC HEARING-~Proposed interim zoning-Pylant Annexation NOo 3 This being the time and place~ as advertised~ for a public hearing .on the proposed interim zoning of R-3 for Pylant Annexation No. 3, mayor McMains declared the hearing open° The Clerk having rec&ived no written protests~ and no one in the audience wishing to be heard either for or against the proposed zoning~ the Mayor declared the hearing closed~ ORDINANCE No~ 691-Interim zoning-Pylant NOo 3-~ntroduction and adoption It was moved by Councilman ~enzel, seconded by Councilman ~mith, and carried~ that Ordinance No. 691 be placed on its first reading; that reading of the text be waived and the ordinance adopted as an emergency ordinance. The motion carried by the following vote, to-wit: AYES: Councilmen Menzel, Smith, McNains Noes: None Absent: Councilmen ~cAllister, DeGraaf ~UBLIC HEARING-Proposed precise zoning-Palomar Annexation This being the time and place~ as advertised~ for a public hearing on the proposed precise zoning of R-3 and C-2 for Palomar Annexation~ Mayor McMains declared the hearing open. The Clerk having received no written protests, and no one in the audience wishing to be heard either for or against the proposed zoning~ the mayor declared the hearing closed° Action on the proposed precise zoning of Palomar Annexation was held up pending establishment of set-backs by the Planning Commission. ORDINANCE NOo 687 - Amending Zoning Ordinance-Northeast corner-Third Avenue and D~ Street-Second reading It was moved by Councilman Smith, seconded by Councilman Menzel, and carried~ that Ordinance No. 687 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following votes~ to-wit: AYES: Councilmen Smith~ McMains, Menzel Noes: None Absent: Councilmen McAllister~ DeGraaf ORDINANCE NOo 688-Amending Zoning Ordinance-Southeast corner-Third Avenue and Do Street-Second reading It was moved by Councilman Menzel~ seconded by Councilman Smith~ and carried~ that Ordinance No~ 688 be placed on its second reading; that reading of the text be waived and the Ordinance adopted° The motion carried by the following votes~ to-wit: AYES: Councilmen Menzel, Smith, McMains Noes; None Absent: Councilmen McAllister~ DeGraaf ORDINANCE No. 689-Amending Zoning Ordinance-K° Street West of Third Ave° Second reading It was moved by Councilman Smith, seconded by Councilman Menzel~ and carried~ that Ordinance NOo 689 be placed on its second reading; that reading of the text be waived and the Ordinance adopted. The motion carried by the following votes~ to-wit: AYES: Councilmen Smith~ McMains, Menzel Noes: None Absent: Councilmen McAllister, DeGraaf ORDIN~ N~o~._pg_2-Interim zoning-Pylant Annexation No° 4-Introduction and - Adoption It was moved by Councilman Menzel~ seconded by Councilman Smith, and carried, that Ordinance No~ 692 be placed on its first reading; that reading of the text be waived and the Ordinance adopted as an emergency ordinance° The motion carried by the following vote, to-wit: AYES: Councilmen ~enzel, Smith~ McMains Noes: None Absent: Councilmen MoAllister~ DeGraaf OFF-STREET PARKING ORDINANCE Date for public hearing on the proposed off-street parking ordinance was set for February 2nd at 7:00 PoMo RESOLUTION No. 2381-Accepting Sewer Easement - Buford Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, Menzel Noes: None Absent: Councilmen McAllister, DeGraaf RESOLUTION No° 2382-Limiting parking on portion of Garrett Ave0-Two Hours Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, Menzel Noes: None Absent: Councilmen McAllister, DeGraaf LIMITING PARKING ON PORTION OF NAPLES STREET It was suggested that this Resolution be held over one week until property owners in the area can be notified of the proposed restriction on parking on a portion of Naples Sro -2- RESOLUTION NO. 2383-Authorizing Registrar of Voters to render specified election services Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith, McMains, Menzel Noes: None Absent: Councilmen McAllister, DeGrnaf RESOLUTION No. 2384-Accepting dedication of property for "L" St. (Booth) Offered by Councilman Menzel, passed adopted and approved by the following vote, to-wit: AYES: Councilmen Menzel, Smith, McMains Noes: None Absent: Councilmen McAllister, DeGraaf ORDINANCE No. 693-Adopting National Electrical Code-First reading It was moved by Councilman Menzel, seconded by Councilman Smith, and carried,' that Ordinance No. 693 be placed on its first reading; that reading of the text be waived and that February 9th at 7:00 P.M. be set as the time for a public hearing on the proposed Code adoption.The motion carried by the following vote, to-wit: AYES: Councilmen Menzel, Smith, McMains Noes: None Absent: Councilmen McAllister, DeGraaf PARKING - West side of Hilltop Drive City Administrator Fulwiler stated that the Hilltop Drive project between J. Street and Telegraph Canyon Road was done with Gas Tax Funds with the request from the State that Hilltop Drive be a four lane street with no parking on the ~est side. Property owners on the ~est side are requesting that the no parking order be lifted, in order that their guests etc. will be able to park. Action on the request was held over until all Councilmen are present. DS RECEIVED FOR ~{AIN LINK FENCE AT EUCALYPTUS PARK City Engineer Floyd submitted the seven following bids received for construction of a chain link fence at Eucalyptus Park: Atlas Fence Co. $4,984.05 Cyclone Fence Co. 5,430.66 Desert Fence Const. Co. 5,352.72 B & W. Fence Co. 5,563.20 Western Fence COo 6,013.10 San Diego Fence Co° 7,335.28 Aztec Fence Coo 6,345.94 Mr~.'Floyd recommended that the low bid of the Atlas Fence Co. be accepted. ~ceptance of the bid on the fence was held over until a full Council /~as pre~ent. OTEST TO LITTLE LEAGUE p~SEBALL PARK A letter was read from Leason G. Harris objecting ~o the proposed Little League Baseball Park on the property between J. Street and Sierra Way West of Fifth Avenue. Mr. Dan Lawson representing the Little League spoke in rebuttal to any protests received in opposition to the Little League. Mr. Gerber, resident in the area ~djacent to the proposed Little League ball park spoke in opposition to the park and stated a petition had been circulated and thirty-five signatures obtained in opposition to the ball park, Representatives of the Little League were instructed to make application to the Planning Commission for a zone variance for their ball park, in order that a public hearing could be held on the matter° A letter was read from E0 R. Sinram, 399 "J" Street, requesting that the City install the sidewalk under the drain as shown on plans in the office of the City Engineer in order that a drain can be installed to carry off the run-off from a portion of the Cortez Manor Subdivision, Mro John Wilburn, 395 J. Mtreet~ stated his property was flooded every time it rained ever since the development of Cortez Manor, and requested that something be done about the situation. The City Engineer pointed out that Mr. Lee Raitt, developer of Cortez Manor had offered to pay for the cost of the drainage installation at the time he developed his property, but that Mro Sinram refused to cooperate. The City Administrator was directed to get together with Mr. Sinram, Mr0 Raitt, and Mr. Wilburn to work out a solution to the problem. ~IDENING OF PARKWAY DISCUSSED Mr. John Murphy asked if anything was being done to widen Parkway East of Broadway. The City Administrator was directed to contact the new owners of the property in that area to see if they are willing to dedicate land for the widening of Parkway. It was moved by Councilman Smith, seconded by Councilman Menzel~ and carried~ that the meeting adjourn until January 26th at 7:00 P.Mo
