OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA,
California
Held Tuesday February 9, 1960
The Council met in the Council Chambers at the City Hall on the
above date at 7:00 P.M. with the following Councilmen present:
Councilmen McAllister, Smith, McMains, DeGraaf, Menzel
Absent: None
Also present: City Engineer Floyd, City Attorney Kugler, City
Administrator Fulwiler, City Finance Officer Grant,
City Planner Fretz
Mayor McMains led the pledge of allegiance to the Flag, and asked for a
moment of prayer
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman DeGraaf, seconded by Councilman Smith,
and carried, that the Minutes of Council meetings for January 12, 19, 26,
and February 2nd be approved, copies having been mailed to each Councilman.
~UBLIC HEARING - Adoption of National Electrical Code
This being the time and place, as advertised, for a public hearing
on the adoption of the National Electrical Code 1959 Edition, Mayor McMains
declared the hearing open. The Clerk having received no written protests
and no one wishing to be heard either for or against adopting the Electrical
Code by reference, the Mayor declared the hearing closed.
ORDINANCE No. 693- Adopting National Electrical Code-Second reading
It was moved by Councilman DeGraaf, seconded by Councilman Menzel,
and carried, that Ordinance No. 693 be placed on its second reading; that
reading of the text be waived and the Ordinance adopted° The motion
carried by the following vote, to-wit:

Absent: None
City Administrator Fulwiler reported that after having inspected the
premises at 731 G. Street in regard to the owner's application that their
swimming pool be exempt from the provisions of Ordinance No. 670, he was
of the opinion the pool was definitely not a hazard, and recommended that
the terms of the ordinance be modified for the pool at 731 Go St.
RESOLUTION No. 2390-Modifying terms of Ordinance No. 670 for 731 G. St.
Offered by Councilman Smith, passed, adopted, and approved by the
following vote, to-wit:

~i~DINANCE l~b. 700-Off-street parking Ordinance- Second reading
It was moved by Councilman DeGraaf, seconded by Councilman Menzel,
and carried, that Ordinance No. 700 be placed on its second reading; that
reading of the text be waived and the Ordinance adopted. The motion
carried by the following vote, to-wit:

~EQUEST FOR SURVIVORS BENEFITS FOR POLICE & FIREMEN
Attorney John O'Loughlin, on behalf of the Police and Fire
employees asked that the Council follow the recommendations of the
Civil Service CommisSion and approve addition of the Widows Clause to
the pension plan for members of the police and fire departments, effective
July 1, 1960. Mr. O'Loughlin asked for the opportunity to meet with any
committee which might be appointed to study the matter, and asked that a
report be presented to the Council prior to the election in April.
The Council took the request under consideration, and asked that
the City Administrator place the matter on some future agenda that is
not too lengthy.
.,,~.0POSED TRUCK ROUTE ORDINANCE
City Engineer Floyd reported that a total maximum gross weight
limit of ten tons has been tentatively established in the proposed truck
route ordinance for trucks using City streets. He reported that the
Safety Counkil will study the proposed ordinance at a meeting to be held
February 18th at 3:00 P.M.
~GINEER AUTHORIZED TO CALL FOR BIDS ON NAPLES STREET DRAINAGE AND
STREET IMPROVEMENTS
City Engineer Floyd asked authority to call for bids on the
installation of a new storm culvert under Naples St,, West of Hilltop
Drive and the excavating and filling of a portion of Naples Street to
accommodate the larger culvert. Estimated cost of the project was
$9,552.95. It was moved by Councilman Smith, seconded by Councilman
Menzel, and carried, that the City Engineer be authorized to call for
bids on the proposed drainage project on Naples Street as requested°

It was moved by Councilman Smith, seconded by Councilman DeGraaf
and carried, that the City Engineer also call for bids on improvements
to 'L" Street~ West of Third Avenue.
~9~LANNING COMMISSION RECOMMENDATION - rezoning Southeast corner of
Broadway and K. Street
A letter was submitted from the Planning Commission recommending
that a portion of property at the Southeast corner of Broadway and
Street be rezoned from R-1 to C-2.
March 1, 1960 at 7:00 Po¥. was set as the time for a public
hearing on the proposed rezoning.
P~NING COMMISSION RECOMMENDATION- Building lines in Palomar Annexation
~ and Industrial Lands Annexation
A letter was submitted from the Planning Commission recommending
building lines on streets within the Palomar Annexation and a portion
of the Industrial Lands Annexation°
March 1, 1960 at 7:00 P.Mo was set as the time for a public
hearing on the proposed set-backs.
RESOLUTION No. 2391-Approving agreement with State for census
Offered by Councilman DeGraaf, passed, adopted and approved by the
following vote, to-wit:

RESOLUTION No. 2392-Ordering consolidation of School Bond Election with
City Election
Offered by Councilman Smith, passed, adopted and approved by the
following vote, to-wit:
AYES: Councilman Smith,McMains,DeGraaf,Menzel,McAllister
Noes: None
Absent: None
RESOLUTION No. 2393AAppointing election officers and consolidating precincts
for General Municipal Election
Offered by Councilman McAllister, passed adopted and approved by the
following vote, to-wit:
AYES: Councilman McAllister,Smith,McMains,DeGraaf,Menzel
Noes: None
Absent: None
~EDUCTION IN PROVISIONS OF CONCESSIONAIR CONTRACT REQUESTED
City Finance Officer Grant recommended that some of the provisions
of the contract with the concessionairs of the swimming pool concession
be reduced, as requested by the Recreation Department, because of the
lack of attendance at the pool. Mrs. Jean Sanguinetti, operator of the
concession, stated that since the schedule of open hours for the pool had
been drstically cut, it was not even possible to break even on the venture°
The matter was referred to the City Attorney for study and report
at the next meeting.
~PPROPRIATION MADE TO HARBOR COMMISSION BUDGET
A letter was read from the Harbor Commission requesting that $2500 be
appropriated to the Harbor Commission budget to cover the expense of
consulting services during the balance of this fiscal year; said consultants
to be hired at an hourly rate.
It was moved by Councilman DeGraaf, seconded by Councilman Smith, and
carried, that $2500 be appropriated from the unappropriated surplus of the
General Fund to the Harbor Commission budget as recommended. The motion
carried by the following vote, to-wit:
AYES: Councilmen DeGraaf,Menzel,McAllister,Smith,McMains

OTEST USE OF 'L" STREET AND FIRST AVENUE AS TRUCK ROUTES
Mr. Gus Gehl, 103 "L' St. protested the proposed use of 'L' St. as a
truck route, and submitted a petition with 232 signatures protesting the
proposed use of "L' St. and First Ave. as truck routes. Mr. Ralph Wickman
also spoke in protest to using 'L' St. for a truck route.
Mayor McMains informed the protestants that the proposed new truck
ordinance did not include 'L' St. and First Ave. in the truck route, and
that a meeting on the subject would be held by the Safety Council on
February 18th at 3:00
ADJOURNMENT 8:15 P.M.
It was moved by Councilman Menzel, seconded by Councilman DeGraaf
and carried, that the meeting adjourn until February 16th at 7:00 PoM.
