OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held Tuesday February 16~ 1960
The Council met in the City Hall Council Chambers on the above
date at 7:00 P.Mo with the Following Councilmen present:
Councilmen DeGraaf~ Smith~ McMains
Absent: Councilmen McAllister, Menzel
Also present: City Attorney Kugler~ City Administrator Fulwiler,
City Planner Fretz, Principal Civil Engineer Harshman
Mayor McMains led the pledge of allegiance to the Flag~ and asked for a
moment of prayer
PUBLIC HEARING - Establishing building line- East of Highland~ North
j' of Co Street
This being the time and place, as advertised, for a public hearing
to consider the establishment of a five foot building line on the East
side of Highland Avenue, North of C. Street, Mayor NcNains declared the
hearing open. The Clerk having received no written protests, and no one
in the audience wishing to be heard either for or against the proposed
building line, the Nayor declared the hearing closed.
ORDINANCE No. 701 - Establishing building line on Highland Avenue-
North of C. Street-First reading
It was moved by Councilman Smith, seconded by Councilman DeGraaf,
and carried, that Ordinance No. 701 be placed on its first reading, and
that reading of the text be waived. The motion carried by the following
vote, to-wit:
AYES: Councilmen Smith, McMains, DeGraaf
Noes: None
Absent: Councilmen Menzel, McAllister
~4~BLIc HEARING - Proposed rezoning of property at 355-365 K. Street
This being the time and place, as advertised, for a public hearing
on the proposed rezoning from R-1 to C-2 for property at 355-365 K. Street
Mayor McMains declared the hearing open. The Clerk having received no
written protests, and no one in the audience wishing to be heard, either
for or against the proposed rezoning, the Mayor declared the hearing
closed.
ORDINANCE No. 702-Amending zoning Ordinance-Rezoning property at
355-365 Ko Sro-First reading
It was moved by Councilman DeGraaf, seconded by Councilman Smith,
and carried, that Ordinance No. 702 be placed on its first reading~ and
that reading of the text be waived° The motion carried by the following
vote~ to-wit:

RESOLUTION NOo 2393- Giving notice of proposed Broadway Annexation No. 2

RESOLUTION No. 2394 - Limiting parking on portion of First Avenue
Offered by Councilman Smith, passed, adopted, and approved by the
following vote, to-wit:

RESOLUTION No. 2395- Approving master agreement for expenditure of
Gas Tax Funds -Engineering allocation
Offered by Councilman DeGraaf, passed, adopted and approved by the
following vote, to-wit:

~UCTION OF PAYMENTS AUTHORIZED ON POOL CONCESSION
City Attorney Kugler, reporting upon the request of operators of
the pool concession for a reduction of payments to the City on their
contract, recommended a settlement based on the proportionate time the
pool was open following their last payment on September 25th. The
proposed settlement would amount to the paying for one-quarter for the
h of October of one-quarter of the $125. originally.due0 It w~s ~oved~by_

~f~S AUTHORIZED ON SEWER FROM J. STREET
It was moved by Councilman Smith, seconded by Councilman DeGraaf,
and carried, that the City Administrator be authorized to call for bids,
at the prevailing per diem wage scales, on a proposed sewer line from
the J. Street sewer plant South to K. Street along the Santa Fe right-
of-way. City Administrator Fulwiler stated the sewer would be installed
on a repayment basis, to be repaid as the area develops.
4~iD AUTHORIZED ON SEWER TO SERVE VISTA 5~ITARIUM AREA
It was moved by Councilman Smith, secoaded by Councilman DeGraaf,
and carried, that the City Administrator be authorized to call for b~ds
at the prevailing per diem wage scales, on a proposed sewer line on
Second Avenue, to service the Vista Sanitarium area° The sewer is to
be paid for by the Vista Square Sanitarium.
~VING OF SMITH STREET'~ETWEEN CASSELMAN STREET AND MclNTOSH STREET
City Administrator Fulwiler stated that property owners had
requested that the City pave the center of Smith Street from Casselman
Street to Mclntosh Street, and that they would pay for the cost of paving
the shoulders.
It was moved by Councilman Smith, seconded by Councilman DeGraaf,
and carried, that the matter be held over for study.
~LANNING COMMISSION RECOMMENDATIONS - Conditional use permit
A letter was read from the Planning Commission recommending the
approval of the application from George Trusty for a conditional use
permit to construct and operate a trailer park near the Southeast corner
of Palomar and Montgomery Freeway.

~j~ICATION CEREMONY FOR SHOPPING AREA NAME
A letter was read from the Downtown Association inviting the
Councilmen to attend the dedication of the shopping area~s new name
"Shoppers Square". The dedication will be held Friday, February 19th
at 7:00 P.M. at Third Avenue and F. Street.
~I~UEST FOR DIHECTIONAL SIGNS TO CITY
A letter was read from the Downtown Association urging that the
Council contact the proper State authorities pertaining to the installa-
tion of signs indicative of approaching the City limits.
It was moved by Councilman Smith~ seconded by Councilman DeGraaf~
and carried~ that the necessary action be taken to request from the State
Roads Com~ission~ directional signs on Montgomery Freeway at Eo Street~
H, Street~ and L. Street.
~<I~.~TER OF APPRECIiTION
A letter was read from the Southern California
Lawn Bowling Association expressing appreciation to the Council for having
selected a location for bowling greens and clubhouse.
[~.R~qUEST FOR RETAINING WALL
A letter was read from Mr. & Mrs. JoD.Peters
888 Country Club Drive, requesting that the City install a retaining wall
on their property. The Peters contend that the City is obligated because
of the cut made in their property when "L" Street was put through.
City Attorney Kugler stated that he was of the opinion that erection of a
retaining wall by the City for the Peters would be an invalid use of public
funds inasmuch as the Peters had already been compensated for the property
taken from them for improvement of "L' Street. The matter was turned over
to the City Administrator for study to see if the City is in any way liablae
~PLICATION FOR AUCTION LICENSE APPROVED
A letter was read from Chief-of-Police quinn
recommending that the Council approve the application of H. F. Kempton to
conduct an auction at 164 Broadway. It was moved by Councilman DeGraaf~
seconded by Councilman Smith~ and carried~ that the application of Ho Fo
Kempton for an auction license be approved.
~INION ON TRUCK ROUTES
City Administrator Fulwiler stated that Judge
Howe had rendered an opinion whereby trucks entering the City with their
destination in the City, may take the most direct route to thir destina-
tion~ but if going through the City~ must use truck routes only. The
City Administrator was directed to pass the information on to the Safety
Council.
~2~IGHTING OF PAl/KING LOTS
Mayor McMains stated that the lack of lights
on the City owned parking lots was becoming a problem. He stated that
several merchants had indicated that they would pay for the electricity
if the City would install lights on the back of their buildings overlooking
the parking lots. The City Administrator was directed to check into the
cost of temporary lighting for the parking lots.
