HomeMy WebLinkAboutcc min 1960/03/01 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday March 1, 1960 The Council met in the Council Chambers in the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McAllister, Smith, McMains, DeGraaf, Menzel Absent: Councilmen None Also present: City Engineer Floyd, City Attorney Kugler, City Administrator Fulwiler, City Planner Fretz Mayor McMains led the pledge of allegiance to the Flag, and asked for a moment of prayer ~PUBLIC HEARING -Rezoning of Southeast corner of Broadway and Ko Street This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-1 to C-2 of a portion of property at the Southeast corner of Broadway and K. Street, Mayor McMains declared the hearing open. The Clerk read a petition signed by 55 individuals representing 27 properties opposed to the proposed rezonlng. Mrs. Marion Bartlett, representing Mr. Dockstader, owner of the property proposed to be rezoned, spoke in favor of the rezoning. No others wishing to be heard, either for or against the proposed rezoning, the Mayor declared the hearing closed. ORDINANCE No. 703-Rezoning Southeast corner of Broadway and K. Street- First reading It was moved by Councilman DeGraaf, seconded by Councilman Menzel, and carried, that Ordinance No. 703 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, Menzel, McAllister, Smith, McMains Noes: None Absent: None ~UBLIC HEARING set-backs in Palomar & Industrial Lands Annexations ~ This being the time and place, as advertised, for a public hearing on the establishment of building lines on streets within the Palomar Annexation and a portion of the Industrial Lands Annexation, Mayor McMains declared the hearing open. The Clerk having received no written protests and no one in the audience wishing to be heard, either for or against the proposed set-backs, the Mayor declared the hearing closed. ORDINANCE No. 704- Amending Ordinance No. 398 and establishing certain building lines within the Industrial Lands & Palomar Annexations-First reading It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that Ordinance No. 704 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,Menzel,McAllister Noes: None /Absent: None ~/ PUBLIC HEARING- Cresta Way Annexation This being the time and place, as advertised, for a public hearing on the proposed Cresta Way Annexation, Mayor McMains declared the hearing open. Mr. Ralph Keithly spoke in favor of the Annexation. No others. wishing to be heard, either for or against the annexation and the Clerk having received no written protests, the Mayor declared the hearing closed. OP, DINANCE No. 705- Setting date for election on Cresta Way Annexation Introduction & Adoption It was moved by Councilman McAllister, seconded by Councilman DeGraaf and carried, that Ordinance No. 705 be placed on its first reading and adopted. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister,Smith,McMains,DeGraaf,Menzel Noes: None Absent: None ,,COUNCIL FAVORS EXTENDING FIRE & POLICE PROTECTION TO CRESTA WAY RESIDENTS PRIOR TO ANNEXATION City Administrator Fulwller stated that he had been approached by residents of the Cresta Way area~ requesting that they be granted Police and Fire protection from the City~ pending completion of Annexation proceedings. City Attorney Kugler stated that the City has no authority to extend this protection to the area prior to its becoming a part of the City. It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that the Council looks with favor upon these services being extended the residents of the proposed Cresta Way Annexa- tion by our Police and Fire Departments. ORDINANCE No. 706-Establishing building line along portion of Lo Street and Third Avenue It was moved by Councilman Smith, seconded by Councilman DeGraaf~ and carried~ that Ordinance No. 706 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,Menzel,McAllister Noes: None Absent: None RESOLUTION No. 2398-Giving notice of intention to vacate portion of Telegraph Canyon Road Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,Menzel,McAllister NOES: None Absent: None The Council directed that the entire portion of Telegraph Canyon Road as shown on the tentative map of Robinhood No. 5 Subdivision be vacated. RESIGNATION OF MEMBER FROM THE HAP, BOR COI~/ISSION A letter was read from Kenneth M. Brown ~endering his resignation as Chairman of the Harbor Commission. It was moved by Councilman Smith, seconded by Councilman McAllister and carried~ that the resignation be accepted~ with regret, and a letter b~ written Mr. Brown, expressing appreciation of the Council for his service while with the Commission. ,EMPLOYMENT OF CALIFORNIA MUNICIPAL STATISTICS~ INC. AUTHORIZED City Administrator Fulwiler stated it would be necessary to prepare a bond brochure for presentation to bonding houses in order to sell the Tidelands bonds. It was his recommendation that the firm~ California Municipal Statistics~ Inc. be retained to prepare the brochure. It was moved by Councilman McAllister~ seconded by Councilman Menzel and carried~ that the City Administrator be authorized to employ the firm of California Municipal Statistics~ Inc. at a price not to exceed $1000. and thmt monies be allocated from the anappropriated surplus of the General Fund to the Harbor Fund budget~ to be repaid when the bonds are sold. The motion carried by the following vote~ to-wit: AYES: Councilmen McAllister~Smith~McMains,DeGraaf~Menzel Noes: None Absent: None -2- ~QUEST FOR MODIFICATION OF SWIMMING POOL FENCING ORDINANCE._ Terry Trailer Park A letter was read from the Manager of Terry's Trailer Park request- ing that they be exempt from previsions of Ordinance No. 670 requiring that they fence their swimming pool. It was moved by Councilman Smith, seconded by Councilman McAllister, and carried, that the request be referred to the City Administrator for his recommendation. ~/~ ACCEPTED ON CITY HOUSE AT 891 First Avenue The following bids were submitted by the Purchasing Agent on the sale of the City owned house at 891 First Avenue: A. A. Lockwood $14,100.70 Victor L. Wulff 14,001.00 Leo Zanier 14,001.00 Doreen M. Parmely 14,250.28 It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that the high bid of Doreen M. Parmely in the amount Of $14,250.28 be accepted. It was moved by Councilman DeGraaf, seconded by Councilman McAllister and carried, that the Purchasing Agent be authorized to enter into Escrow with the high bidder, and the Mayor be authorized to execute a Grant Deed for the buyer. It was moved by Councilman Smith, seconded by Councilman McAllister and carried, that the City Administrator be authorized to make arrangements for having the house treated for termites and other necessary incidentals, the expense of which is to come from money derived from the sale, with the remainder reverting to the Gas Tax Fund. RESOLUTION No. 2399-Accepting dedication of sewer easement from Sweetwater Union High School District Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,Menzel,McAllister Noes: None Absent: None RESOLUTION No. 2400-Authorizing execution of Quit-Claim Deed to Sweetwater Union High School District Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McMains,DeGraaf,Menzel,McAllister Noes: None Absent: None REQUEST FOR VACATION OF PORTION OF TELEGRAPH CANYON ROAD A letter was read from A.O.Dieterle requesting that the City initiate proceedings to vacate that portion of Telegraph Canyon Road which was re- placed by the new Telegraph Canyon Road as per agreement with City dated June 8, 1958. It was moved by Councilman Smith, seconded by Councilman DeGraaf, and carried, that the City Attorney be directed to investigate and determine if the City can maintain a clear title to the property and report at the ~,/~ext meeting. SAFETY COUNCIL RECOMMENDATIONS A letter was read from the Safety Council recommending that property owners on Fifth Avenue between F. Street and H. Street who do not now have curbs, gutters, and sidewalks, be given sixty days to install said improv~ ments, or have it done by the City under provisions of the 1911 Act. Also recommended was that a brochure outlining the City's truck routes be printed and given to local dealers for distribution to truckers. The City Administrator was directed to look into the first recommenda- tion, and to draft a rough brochure for presentation to the CounCil. -3- /~4~EPORT ON EXEMPTIONS TO ORDINANCE No, 670-Subject to Conditions City Attorney Kugler reported that it was possible to grant an exception to requirements of Ordinance NOo 670 (fencing of swimming pools) based upon certain conditions. It might be advisable, he said, to state in the original exemption that the exception can be revoked if, upon investigation by the Council, conditions are found to have changed since the original exemption was granted. ACCIDENTS AT DEL )/AR AVENUE AND DAVIDSON STREET Mayor McMains stated reports had been received of several accidents at the intersection of Del Mar Avenue and Davidson Street, and wondered if stop signals should be installed at the intersection. The matter was referred to the Safety Council. PERSONNEL MEETING Mayor McMains called a Personnel meeting for March 2nd at 4:30 P.M. SIDEWALK - Northwest corner Third Avenue and Lo Street City Engineer Floyd asked the Council if they would be willing to sell the small sliver of property on the Northwest corner of First Avenue and L. Street~ left over after Lo Street was extended through to First Avenuew to the property owner to the North~ for the cost of installation of sidewalko The Council was in favor of this recommendation, and directed the Engineer to call for bids on installation of the sidewalk.
