HomeMy WebLinkAboutcc min 1960/07/05 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday July 5, 1960 The Council met in the Council Chambers at the City Hall on the above date at 7:00 p.m., with the following Councilmen present: Councilmen McMains, Smith, McAllister. DeGraaf, Menzel Absent: None Also Present: City Engineer Floyd, City Attorney Kugler, City Administrator Fulwiler, City Planner Fretz Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of silent prayer. ~,..PUBLIC HEARING - Vacating portion of Telegraph Canyon Road (Dieterle) This being the time and place, as advertised, for a public hearing on the proposed vacating of a portion of Telegraph Canyon Road, (Quarter section 113) Mayor McAllister declared the hearing open. Attorney G. L. Bendickson, representing the Dietaries, reviewed the agreement between the City and Mr. Dieterle whereby the City agreed to initiate proceedings to vacate this portion of Telegraph Canyon Road, and asked that the land be vacated at this time. No others wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman DeGraaf and seconded by Councilman Smith, that no action be taken. The motion failed to carry by the following vote, to-wit: AYES: Councilmen DeGraaf, Smith Noes: Councilmen McMains, Menzel Mayor McAllister abstained from voting° No one caring to offer the Resolution of vacation, no action was taken. ~,~UBLIC HEARING - Vacating portion of Street Lying between Frontage Road & Walnut Avenue This being the time and place, as advertised, for a public hear- ing on the proposed vacating of a portion of street lying between Frontage Road and Walnut Avenue, Mayor McAllister declared the hearing open. Mr. Willis Richardson, petitioner for the closing, spoke in favor of the vacation, No others wishing to be heard, the Mayor declared the hearing closed, RESOLUTION No, 2480 - Ordering vacation of Portion of Street Lying between Frontage Road and Walnut Avenue Offered by Councilman McMains, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen McMains, Smlth, McAllister, DeGraaf, Menzel Noes: None Absent: None ]~/'PUBLIC HEARING - On~ Assessment Report on 1911 Act Projects This being the time and place, as advertised, for a public hearing on the report of the Street Superintendent, setting forth work done, costs of construction, and the assessment against each parcel pro- posed to be levied to pay the costs, at 451Casselman, 198 First Avenue, 241 "E" Street and 529 "J" Street, Mayor McAllister declared the hearing open. Mrs. Velma Neveu protested the assessment on the property at 241 "E" Street as being too high because the sidewalk was installed so high, the drop into her driveway caused the undercarriage on her car to drag. The City Engineer was directed to check the complaint and report back at the next meeting. The Mayor continued the public hearing until July 12th at 7:00 pom. 'PUBLIC HSARING Rezoning the Rear of 350 "K" Street This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-1 to C-2-P of property at the rear of 350 ~K" Street, Mayor McAllister declared the hearing open. ~r. 5arl ~everin stated the property was ~ll.under one ownership which would encourage its development if it were rezoned C-2-Po Mr. Barren spoke in favor of upgrading the property. No others wishing to be heard, either for or against the proposed re- zoning, the Mayor declared the hearing closed. /~OBLIC HEARING - Rezoning South Sic~e of "K" Street, west of Third Ave. This being the time and place, as advertised, for a public hearing on the proposed rezoning from R-1 and M-1 to C-2-P of pro- perty.on the south side of "K" Street, west of Third Avenue, Mayor ~cAlllster declared the hearing open. No one in the audience wish- ing to be heard, either for or against the proposed rezoning, the Mayor declared the hearing closed. OBDINANCE No~ 719 Rezoning the Rear of 350 "K" Street and the South side of "K" Street, west of Third Avenue- 1st Reading It was moved by Councilman DeGraaf, seconded by Councilman Smith, and carried, that Ordinance No. 719 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-w~t. AYES: Councilmen DeGraaf, Menzel, McMains, Smith, McAllister Noes: None Absent: None · SWEETWAT~R VALLEY INDUSTRIAL PARK SUBDIVISION MAP Mr. 5. A. Raulston, of the /rousdale Construction Company asked that, because of a misunderstanding, action on approval of the final map of Sweetwater Valley Industrial Park ~UDO~VlSl be rescinded until prop~4~ording on the map could be worked out. Mr. Raulston stated that the words "Subject to infrequent flooding or Subject to infrequent overflow" would be satisfactory to his firm in place of the words "Subject to Inundation" as ordered placed on the subdivision maps by the Council. ~r. Raulston stated that no restrictions were printed on the maps, by the City of San Diego,~ for the Mission Valley Country Club, Town & Country, Rancho Presidio, ~ission Valley Inn and other major developments in the Mission Valley of San Diego. Councilman DeGraaf, pointed out that certain maps of the May Company development in Mission Valley were marked with "Subject to Inundation, that San Diego County demands the words 'subject to inundation' placed on maps ~re inundation is possible and that Los Angeles uses the words "Subject to damaging floods." ~ayor'~cAllister stated it would not be necessary to rescind former action approving the final map of the subd~vlslo , but agreed attempt to reach a to the holding ove~ the matter ~ne w~k in an compromise on wording to be useo on ~ne maps. ORDINANCE No, 718 - Providing that City Administrator be Director of Civil Defense Second reading Et was moved by Councilman ~enzel, seconded by Councilman Smith, and carried, that Ordinance No. 718 be placed on its second reading, that reading of the text be waived, and the Ordinance adopted. The motion carried by the following vote, to-wit~ AYES: Councilmen Menzel, ~cMains, Smith, McAllister, DeGraaf Noes: None Absent: None -2- CHILDREN ~'REQUEST OF SOUTH BAY ASSOCIATION FOR RETARDED Administrative Officer Fulwiler submitted a request from the South Bay Association for Retarded Children, for the old adminis- tration building of the Chula Vista School District. The building would be moved to a location near Fire Station No. 3, brought up to building code standards and made compatible with buildings in the surrounding area. It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the old Chul~Vista School District Administration building be donated to this Association, as requested, and that they be required to meet all recommendations of the Building Inspector. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McAllister, DeGraaf, Menzel, McMains Noes: None Absent: None Mr. Grizzle, President of the South Bay Shrine Club, stated that their club is backing the moving of the building and wanted to go on record that they would probably call on the Council, at a future date, to lend support. POOL CONCESSION CONTRACT TEP~INATED A letter was read from the Director of Recreation stating that Mrs. 3san Sanguinetti, operator of the concession at the swimming pool had consistently defaulted in her payments to the City as per agreement, and recommendin9 that the Council terminate the agreement immediately and authorize continuance of the operation by the Youth Center Division. It was moved by Councilman McMain$, seconded by Councilman Menzel, and carried, that the lease agreement with Mrs. Sanguinetti be terminated immediately because of their default in the lease agreement, and that all equipment at the concession at the time Mrs. San guinetti took over the lease, be returned immediately. ,~REQUESTS FOR USE OF OLD LIBRARY SITE A letter was read from the Recreation Director asking that re- quests for use of the old library site be cleared through the Recreation Department. It was moved by Councilman DeGraaf, seconded by Councilman Menzel, and carried, that requests for use of the old library site be cleared through the Recreation Department. RESOLUTION No, 2481 - Finding it Impractical to Undergo Competitive Bidding a second time for Procurement of Six Potable Graphic Traffic Counters Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf, Menzel, McMains, Smith, ~cAllister Noes: None Absent: None ]//BID APPROVED FOR INDUSTRIAL BLVD. GP~DING AND PAVING PROSECT City Engineer Floyd reported having received five bids on the Industrial Boulevard grading and paving project, the low bid being that of V. E. Posey in the amount of $4,513.85. Mr. Floyd explained that Mr. Carlin had deposited $2730.26 with the City as his share of the costs of the project leaving a balance of $1783.59 as the City's share. It was moved by Councilman Smith, seconded by Councilman ~cMains and carried, that the low bid of Vo E. Posey be accepted and that $1783.59 be appropriated from the unappropriated surplus of the general fund to pay the City's share of the cost for the project. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McAllister, DeGraaf, ~enzel, McMains Noes: None Absent: None -3- /AUTHORIZATION GRANTED FIREMEN TO PICK UP NEW TRUCK It was moved by Councilman Smith, seconded by Councilman McMains, and carried, that Fire Chief Lee and Fireman Haynes be authorized to go to Columbus, Ohio to pick up the new Fire truck; the trip to be made at the expense of the Seagraves Company. ADJOURNMENT It was moved by Councilman Smith, seconded by Councilman Menzel, and carried, that the meeting adjourn sine die. Clerk -4-
