OF CHULA VISTA~ CALIFORNIA

The Council met in the Council Chambers at the City Hall on the
above d~te at 7:00 P.M. with the following Councilmen present:
Councilmen McMains, Smith~ DeGraaf~ Menzel
Absent: Councilman McAllister
Also present: City Engineer Floyd~ City Attorney Kugler~ City Planner
Fretz~ City Administrator Fulwiler
In the absence of Mayor McAllister~ Mayor pro-rem Smith presided and led
the pledge of allegiance to the Flag~ asking for a moment of prayer.
STATEMENT: The City Clerk hereby states that he did post within
24 hours of adjournment~ as provided by law~ the order
of adjournment of the City Council for the ~ regular
a~meeting of July 12,1960.
APPROVAL OF COUNCIL MINUTES
It was moved by Councilman DeGraaf~ seconded by Councilman Smith~
and carried, that the minutes for the Council meetings of June 14,21,
24~28 and July 5th be ~pproved, ~opies having been sent to each
Councilman.
~UBLIC HEARING - Interim zoning - Cresta Way Annexation
This being the time and place~ as advertised~ for a public hearing
on the proposed interim R-l-B-20 zoning of the Cresta Way Annexation~
Mayor pro-rem Smith declared the hearing open. No one in the audience
wishing to be heard either for or against the proposed zoning, the
Mayor declared the hearing closed.
ORDINANCE NO. 720 - Interim zoning of Cresta Way Annexation
It was moved by Councilman Menzel, seconded by Councilman DeGraaf,
and carried~ that Ordinance No. 720 be placed on its first reading~
that reading of the text be waived, and the ordinance be adopted as an
emergency ordinance. The motion was carried by the following vote~
to-wit:
AYES: Councilmen Menzel, McMains, Smith,DeGraaf
NOES: None
ABSENT: Councilman McAllister
PUBLIC HEARING CONTINUED - Assessment report on 1911 Act projects
This being the time and place set for the continuation of a public
hearing on the report of the Street Superintendent~ ~etting forth work
done~ and assessments levied against property at 451 Casselman~ 198 First
Avenue, 241 "E' Street, and 529 "J" Street, Mayor pro-rem Smith declared
the hearing open. Administrative Officer Fulwiler explained that the
work done at 241 "E" Street was done~ in full compliance with Engineering
requirements, and recommended that the assessment report be approved.
No one in the audience wishing to be heard, either for or against the
assessments, the Mayor declared the hearing closed.
RESOLUTION NO. 2482 Confirming assessment for certain 1911 Act projects
Offered by Councilman DeGraaf, passed, adopted and approved by the
following vote, to-wit:
AYES: Councilmen DeGraaf, Menzel, McMains, Smith
NOES: None
ABSENT: Councilman McAllister
pLANNING COMMISSION REPORTS OF FINDINGS
A report of findings of the Planning Commission to the appeal of
Henry Reinstra on the Planning Commissions denial of his application for
a zone change from R-3 to C-2 at the NE corner of 4th and "l" Street
was submitted to the Council. Attorney Albert Boyer, representing Mr.
Rienstra,asked that the matter be set for a public hearing° August 2nd
at 7:00 P.M. was the time set for a public hearing on the appealo
A ~lanning Commission report of findings to the appeal of
FoL. Whittington~ on the Planning Commissions denial of his application
for a zone change from R-1 to C-2 at the SW corner of Hilltop and
Street, was submitted to the Council. Mr~ Jim Edmunds asked for a review
of the Planning Commissions judgement° August 2nd, at 7:00 PoMo, was
the time set for a public hearing on the appeal.
A Planning Commission report of findings to the appeal of Oliver
Underwood on the Planning Commissions deniel of his application for
C-iP zoaiag of seven acres on the south side of Naples, between Melrose
and Neptune, was submitted to the Council. August 16th, at 7:00 P.M.,
was the time set for a public hearing on the appealo
ORDINANCE NO. 719 - Rezoning rear of 350 "K" Street and South side of
"K" Street, West of Third Avenue - 2nd reading.
It was moved by Councilman McMains, seconded by Councilman DeGraaf~
and carried, that Ordinance No. 719 be placed on its second readingl
that reading of the text be waived and the ordinance adopted° The
motion carried by the following vote, to-wit:
AYES: Councilmen McMains, Smith, DeGraaf, Menzel

ORDINANCE NO. 721 - Relating to regulation of closing-out sales-
1st readinge
It was moved by Councilman Menzel~ seconded by Councilman McMains~
and carried, that Ordinance No. 721 be placed on its first reading, and that
reading of the text be waived. The motion carried by the following vote~ to-
wit:
AYES: Councilmen Menzel, McMains, Smith~ DeGraaf
NOES: None
ABSENT: Councilman McAllister
Mr. Charles Kopeland, speaking on behalf of the Downtown Association~
said the Ordinance regulating closing-out sales had the unanimous
support of the Downtown Association°
RESOLUTION NO.2483 - Opposing State Legislation Pertaining to City
Employees' benefits
Offered by Councilman Menzel, passed, adopted and approved b$ the
following vote, to-wit~

RESOLUTION NO.2484 - Approving Contract with San Diego Gas & E~ectric
Company regarding Street Lights

RESOLUTION NO. 2485 - APPROVING GAS TAX AGREEMENT - 1960-1961
Offered by Councilman Menzel, passed, adopted and approved by the
following vote, to-wit:
AYES: Councilmen Menze!, McMains, Smith, DeGraaf
NOES: None
ABSENT: Councilman McAllister
APPOINTMENT OF MEMBERS TO FILL VACANCIES ON COMMISSIONS
It was moved by Councilman Menzel, seconded by Councilman McMains,
and carried, that appointment of members to fill vacancies on Commissions
be held over one week°
~/"VERIFIED CLAIMS FOR DAMAGES DENIED
A verified claim for damages in the amount of $4366.89, in the name
of Judine Humphrey, and a verified claim for damages in the amount of
$3535.00, in the name of Betty Briones, were submitted to the Council.
It was moved by Councilman DeGraaf, seconded by Councilman McMains,
and carried, that both the Humphrey claim, and the Briones claim be denied.
~j,.,.~OPPOSITION ~13 MOVING OF SCHOOL ADMINISTRATION BUILDING
Property owners in the vicinity of the site owned by the South Bay
Association for Retarded Children, and which site it is proposed to move
the School Administration Building from Vista Square, as approved by the
Council, appeared to protest the moving of the buildings into this area.
Mr. Harry Hock asked if the Council could recind their action giving
the buildings to the Association. Mro Hollen Jr., 740 Gretchen Road,
speaking for his father, asked if the conditions under which the buildings
were given to the Association could still be enforced when the buildings
were in the County. Mro Norman Peterson, 1230 Nolan, stated he had a
petition signed by 37 property owners in opposition to the moving of the
buildings into the area.
The property owners were informed that the buildings were given with
the conditions that they be made compatible to the surrounding area° That
in order to connect to the sewer the area would have to be annexed to the
City, which could not be done if compliance with conditions made in
granting the buildings to the Association were not adhered to° They
were told the County Board of Supervisors would have control over the
buildings until the area was annexed to the City. Mayor pro-tem Smith
suggested that the property owners appoint a spokesman to meet with the
Administrative Officer to iron out their differences°

Action held over one week.
AUTHORIZED FOR BAR SCREEN CLEANER
It was moved by Councilman Menzel, seconded by Councilman McMains,
and carried, that the City Engineer be authorized to call for bids at
the prevailing minimum wage scale for installation of a Sewage Treatment
Plant Bar Screen Cleaner.
ADJOURNMENT - 7:50 P.M.
It was moved by Councilman Menzel, seconded by Councilman McMains,
and carried, that the meeting adjourn until July 19,1960, at 7:00 P.M.
