HomeMy WebLinkAboutcc min 1960/08/02 MINUTES OF AN ADJOURNED HEGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday August 2, 1960 The Council met in the Council Chambers at City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, DeGraaf, Menzel Absent: Councilman Smith Also present: City Engineer Floyd, City Attorney Kugler, City Administrator Fulwiler, City Planner Fretz Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of silent prayer. ~PUBLIC HEARING 1913 Act- Sweetwater Valley Industrial Park This being the time and place, as advertised, for a public hear- ing on the 1913 Act as it pertains to the Sweetwater Valley Industrial Park, Mayor McAllister declared the hearing open° Attorney William Hill, representing Vernon Brizendine and Robert Channon, owners of the Valley Liquor Store protested the proposed improvement of Sweetwater Valley Industrial Park on the grounds that a roadway is proposed over the site where the building of the valley Liquor store presently stands. If the roadway is realigned, the protest will be withdrawn. City Planner Fretz stated that the Planning Commission at their meeting of August 15th, will consider the realignment of the street in question. No one else wished to be heard on the proposed 1913 Act proceedings. It was moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that the hearing be continued until August 16th at 7:00 PoMo ~3JBLIC HEARINg- Rienstra appeal to Planning Commission decision deny- ~n~-{H~-~z6~lng from R-3 to C-2-P of property at the Northwest corner of Fourth Avenue and E. Street. Mayor McAllister declared the hearing open. Thomas Ackerman, Attorney for the E. Melville Estate, owners of the property, read the Planning Commission resolution now recommending that the corner be rezoned to C-2-P. Councilman Smith took his seat at the Council table at 7:25 PoMo In view of the fact that the Planning Commission is in the process of amending the zoning ordinance in order that a service station may be permitted in a C-1-P zone on a conditional use permit, Councilman DeGraaf was of the opinion the property should be rezoned C-i-P. Paul Miller, Realtor, negotiating for sale of the property, stated the C-i-P zone would be satisfactory. No others in the audience wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried~ that the City Attorney be directed to draft an ordinance rezoning from R-3 to C-i-P the Northwest corner of Fourth Avenue and E. Street. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf, Menzel,McMains,Smith,McAllister Noes: None Absent: None ' PUBLIC HEARING - Whittington appeal to Planning Commission decision ........... denying rezoning at Hilltop Drive and J. Street This being the time and place, as advertised, for a public hearing on the appeal of Frank Whittington to the Planning Commission decision in denying the rezoning from R-1 to C-2 of property at the Southwest corner of Hilltop Drive and J. Street, Mayor McAllister declared the hearing open. James Edwards, Attorney representing Frank Whittington, spoke on behalf of Mr. ~nittington's appeal. Mr. Robert Mudd, spoke in opposi- tion to the rezoning and submitted a petition slgned by eighty-five (85) persons opposing the rezoningo Others speaking in opposition were Jo H. Hodson and Max Candiotti. Speaking in favor of the rezoning were Mrs. Schmidt, Mrs° DeVine, Mr. Fletcher, Mrs. Biggs, Mr° Olson, A1 Cox, and Frank Whittington. Councilman DeGraaf stated that in his opinion a need for the rezoning of this corner had not been presented or established. No action was taken on the appeal. ORDINANCE No. 722 - Rezoning property North of Go Sto West of .................. Hilltop Drive - Second reading It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that Ordinance No. 722 be placed on its second reading; that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen I)eGraaf, Menzel,McMains, Smith,McAllister Noes: None Absent: None FEES AUTHORIZED FOR PLANS AND SPECIFICATIONS City Engineer Floyd asked that the City Attorney be directed to draft a resolution establishing fees to be paid by prospective bidders on plans and specifications for public works projects. It was moved by Councilman Smith, seconded by Councilman McMains and carried, that the City Attorney be directed to draft the necessary resolution as requested. BIDS AUTHORIZED ON GAS TAX PROJECT NOo 37 It was moved by Councilman Menzel, seconded by Councilman Smith and carried, that the City Engineer be authorized to call for bids at the prevailing minimum wage scale on Gas Tax project NOo 37, Unit 2 (Fourth Avenue, C. Street to E. Street.) BIDS AUTHORIZED ON GAS TAX PROJECT No. 41 It was moved by Councilman McMains, seconded by Councilman Menzel and carried, that the City Engineer be authorized to call for bids, at the prevailing minimum wage scale on Gas Tax project No. 41, Unit 1 (L. Street from Third Avenue to Fourth Avenue, and East L. Street from Mission Avenue to Monserate Avenue.) CALL FOR BIDS ON Ho STREET RELIEF SEWER HELD OVER The Council requested that authorization for the calling of bids on H. Street relief sewer be held over one week in order that the City Engineer can figure what the City can expect in the way of reimbursements. RESOLUTION No. 2488- Giving notice of proposed Huntington Annexation Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None APPOINTMENT OF COMMITTEE FOR FEASIBILITY STUDY ON AIRPORT PURCHASE RECOM-~E~D~D-- ...................... A letter was read from the Chamber of Commerce recommending that the Council appoint a three member committee to meet with a committee from National City to review the advisability and feasibility of a twiR-city airport owned and operated by National City and Chula Vista. Jack Lester, Don Norman, Dale Farris, and Walter Hodge all spoke in favor of appointing the committee for the feasibility study, and hoped for the ultimate purchase and operation of the airport in Sweetwater Valley by both cities. Mr. Hodge stated that the City Manager of National City~ and two Councilmen had been put on the Committee. Councilman Menzel suggested that William Eckhart of the Bank of America be appointed to the Committee. 2 and Mayor McAllister appointed Councilmen DeGraaf and McMains, ~ity Administrator Fulwiler as a committee to meet with the National City committee to study the feasibility of purchase and operation of the National City Airport as a joint venture. ~EqU~S~ ~9R_~O~I~T~0N OF Ordinance No. 670 (Fencing Swimming Pools) Letters were read from Frank H. Robinson, 365 Hilltop Dr., Ro So Seabrook, 385 Hilltop Dr., and Ralph Keithley, 19 E. Cresta Way, requesting that they be exempt from the provisions of Ordinance No. 670 requiring them to fence their swimming pools. The letters were referred to the City Administrative Officer. ~'APPEAL TO DECISION OF PLANNING COMMISSION-Use Variance at rear of ............. 478 Second Avenue An appeal was read from David Lively and Andrew Henry to the Planning Commission decision denying them a use variance for property at the rear of 478 Second Ave. and adjoining property at 215 H. St. The application was for use of R-1 property for a parking area° The report of findings of the Planning Commission were submitted by Planning Director Fretzo It was moved by Councilman Smith, seconded by Council- man McMains, and carried that August 23rd at 7:00 P.M. be set as the time for a public hearing on the appeal° ~Y~E~T A~U_TH~R!Z~D TO SOUTH BAW IRRIGATION DISTRICT It was moved by Councilman Menzel, seconded by Councilman McMains and carried, that $42.41 be appropriated from the unappropriated surplus of the General Fund for remitting to the South Bay Irrigation District for a bill due the Bay Cities Publishing Co. for publication of Notice of Filing Inclusion pertaining to the election establishing the boundaries of the South Bay Irrigation District and the Otay Water District. The motion carried by the following vote, to-wit: AYES: Councilmen Menzel,McMains,Smith,McAllister,DeGraaf Noes: None Absent: None AUTHORIZING PAYMENT TO AT~RNEY SORENSON (/~ ...... ~as'~-'by Councilman McMains,seconded by Councilman DeGraaf and carried, that $320. be appropriated from the unappropriated surplus of the General Fund for payment to Attorney Royal Sorenson, retained by the City for consultation on the Hodge Bros. vs. Chula Vista case° The amount was for eight hours at $40. an hour. The motion carried by the following vote, to-wit: AYES: Councilmen McMains,Smith,McAllister,DeGraaf,Menzel Noes: None Absent: None REQUEST TO KEEP BRICKS IN PARKING ~/~ ..... ~7-A~--~KIe~k~i~-t~j-~-MKria stated that he had been notified to rip out the bricks he had laid down in the parking in front of his house because it was in violation of City Ordinance No. 696. Mr. Galecki asked that he be permitted to keep his brick walk. The Council was of the opinion perhaps the ordinance is too stringent, and should be looked into. The motion carried by the following vote, to-wit: AYES: Councilmen Smith, McAllister, Menzel, McMains Noes: Councilman DeGraaf Absent: None DIRECTIONAL SIGNS SUGGESTED Councilman DeGraaf suggested the install- K~iSH-~i~xon~i~or incoming traffic at Telegraph Canyon Road and Hilltop Drive and Hilltop Dr. & J. Street. The City Administra- tor was directed to study the suggestion.
