HomeMy WebLinkAboutcc min 1960/11/01 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday November 1, 1960 The Council met in the Council Chambers at City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, Smith, McAllister, DeGraaf, Menzel Absent None Also present: City Engineer Floyd, City Attorney Kugler, City Administrator Fulwiler, City Planner ~retz, Administrative Analyst Ross Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of prayer. PRELIMINARY PLANS FOR ADULT RECREATION PROJECT APPROVED Recreation Director Jas~nek introduced Mr0 James Bird, architect for the adult recreation center to be built on the old library site on "F" Street. Mr. Bird presented for Council approval the preliminary plans for the recreation center. It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that the preliminary plans for the adult recreation center be approved. .pu~C_~E~RING (cqn~d~__- Alpine Annexation This being the time and place, as designated, for the continuation of the public hearing on the proposed Alpine Annexation, Mayor McAllister declared the hearing open. No one in the audience wished to be heard. The Clerk reported that written protest had been made by the owners of more than one-half of the value of the territory proposed to be annexed as shown by the last equalized assessment roll. It was moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that further proceedings on the Alpine Annexation not be taken° ,,~UBLIC HEARING - Amending zoning ordinance to prohibit parking of ~/- trailers and boats in set-backs This being the time and place, as advertised, for a public hearing on a proposed amendment to the zoning ordinance prohibiting the parking of trailers and boats in set-backs, Mayor McAllister declared the hearing open. G.M.Willbanks, representing the Federal Employees Rod & Gun Club opposed the ordinance, stating that alleys and access to rear of lots should be provided in the planning of future subdivisions, and welcomed the opportunity to work with any group to see to it that trailers do not become an eyesore. Eugene Wade, representing the Lemon Grove Rod & Gun Club spoke in opposition to the ordinance, but asked that if the Council sees fit to adopt it, that the effective date be held in abeyance for at least six months. Lucky Miller, representing the Border Travel Trailer Clubs of America asked that adoption of the ordinance be dropped and the matter taken care of on a personal basis. Elmer T. Worthey, Attorney for the Travel Trailer Clubs of America stated that the proposed ordinance had so many faults, it should be returned to Committee for study. Others speaking in opposition to the ordinance were ~alter Schawe, John Russell, Mrs. Stuart Clancy, Mrs. John DeJarnett, Louis Gerken, Homer Davis, and Mrs. Dan Gould. A letter of opposition was read from Charles House. Speaking in favor of the proposed ordinance were Frank Carter, Sallie Wall, John Monteen, Robert Otson and Clarence Knight who asked that the ordinance be made more stringent to cover earth moving equipment and trucks. After discussing the pros and cons presented, it was moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that the hearing be continued until January 10, 1961, and that the Mayor and City Administrator be directed to appoint a committee to further study the proposed ordinance and make recommendations to the Council. ORDINANCE - Regulating dancing in licensed premises Discussion on the proposed dance hall ordinance centered around Section 15 which covers minimum square footage requirements° Councilman McMains stated he was opposed to the requirement that a business wherein a dance is conducted must be on a parcel of land not less than five acres° Letters were read from the Chula Vista Ministers Association, First Baptist Church, and First Presbyterian Church opposing any change in the present ordinance. Charles Kopeland, representing the Downtown Association read a letter urging the Council to reconsider No. I of Section 15, and asking more time to study the requirements of the ordinance° It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that the ordinance be referred to the City Planner for a revision of Section 15, with the original intent of the Council for ample square footage being maintained. Re~ubmission to the Council was set for the meeting of November 15tho SWEETWATER VALLEY INDUSTRIAL PARK REVISED FINAL MAP APPROVED It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that the revised final map of Sweetwater Valley Industrial Park be approved, subject to all requirements of the City Engineer and the Planning Department. RESOLUTION No, 2525-Approving improvement agreement-Sweetwater Valley Industrial Park Offered by Councilman Menzel, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Menzel,McMains,Smith,McAllister,l~eGraaf Noes: None Absent: None RESOLUTION No. 2526- Intention to make changes and modifications- Sweetwater Valley Industrial Park Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None RESOLUTION No. 2527- Calling for sealed bids-Sweetwater Valley Industrial Park Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None b/ REQUEST FOR LIGHTS ON PARKING LOTS City Administrator Fulwiler asked if the Council were interested in installing permanent light standards on the City parking lots. The City Administrator and City Engineer were directed to call for bids on light standards for the parking lots. APPEAL OF RALPH'S SUPERETTE~ INCe to decision of Planning Commission ~/ An appeal was read from Ralph's Superette Inc. to the decision of the Planning Commission in denying them a use variance for the enlargement of their market at 303 Hilltop Circle. The report of findings of the Planning Commission was read to the Council. Mr. Bill Doss, owner of the property at 303 Hilltop Circle, spoke in support of his appeal. It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that the decision of the Planning Commission in denying a use variance at 303 Hilltop Circle be sustained. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None -2- RESOLUTION No. 2528-Modifying terms of Ordinance No. 670 with respect to enclosing swimming pool at 472 "F" Street Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None RESOLUTION No. 2529-Extending Council appreciation for efforts of organizations on visit of President Eisenhower Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None SEWER COMMITTEE REACTIVATED At the request of the City Administrator, he was directed to reactivate the Sewer Coramittee to review the sewage disposal agreement between the City and City of San Diego. ~//~QUEST FOR REVISION IN BUSINESS LICENSE ORDINANCE A letter was read from Rubin~ Seltzer & Solomon representing the B & B Enterprises, requesting that the business license ordinance be reviewed with the thought in mind of lowering the fees on coin operated kiddie rides, The matter was taken under advisement. P~EQUEST FOR RETENTION OF NATIONAL CITY AIRPORT Letters were read from the ~.merican Legion Post No. 255 of National City, and Richard Anton of National City, urging that the City do some- thing to assure the continuation of the operation of the National City Airport. No action taken. SAFETY COUNCIL RECOMMENDATIONS FOR IMPROVEMENTS A letter was read from the Safety Council listing streets upon which, in their opinion, sidewalks and curbs should be installed either on a voluntary basis by the property owners, or under provisions of the 1911 Act. The City Administrator was directed to look into the matter to determine just what could be done to bring the streets listed up to standard. SAFETY COUNCIL REQUEST FPR $;DEWALKS ON KEARNEY STREET A letter was read from the Safety Council urging that steps be taken to install sidewalk on the South side of Kearney Street between First Avenue and Second Avenue. City Engineer Floyd was directed to contact the property owners on the street to determine to.what extent they would be willing to cooperate toward improvement of the street. PEP~ISSION TO SELL FORGET-ME-NOTS GRANTED It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that the Disabled American Veterans be granted permission to sell Forget-me-nots on the streets November 10, ll, and 12th, as per fheir request. REQUEST FOR SEWER LINE A letter was read from the Chula Vista Realty Co. requesting that the City call for bids to construct a sewer line to service their property at 920 Broadway. It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the City Engineer be directed to call for bids on the sewer line as requested. -3- PURCHASE OF BOOI~OBILE WELCOMED A letter was read from the Hilltop PoT.Ac going on record as being in favor of a Bookmobile in case the purchase of one is being considered. City Administrator Fulwiler informed the Council that the City Librarian had not included a bookmobile in the budget. CHILDREN'S LOADING ZONE REQUESTED A letter was read from the First Methodist Church requesting permission to mark the South side of "J" Street adjacent to the Church as a "Children's Loading Zone" for use on Sunday's only between the hours of 8:30 AcM. to 12:30 P.M. The request was referred to the Safety Council, .APPEAL TO TRAILER PARK AT HIGHLAND AVENUE AND C. STREET A letter was read from O. Elwood, 3 North Second Avenue~ appeal- ing the action of the Planning Commission in granting permission for the construction of a trailer park at Highland Avenue and C. Street. The City Attorney ruled that the appeal had no legal standing, in that it had been received too late~ IMPROVEMENTS ON GARRETT AVENUE AND CENTER STREET REQUESTED The City Administrator and City Engineer urged that the Council approve the installation by the City of curbs and gutters on the East side of Garrett Avenue between F. Street and Center Street and also the paving of the Southerly half of Center Street from Garrett Avenue to the railroad tracks. It was pointed out that the developers of the old "F" Street School property would pave the entire width of Garrett Avenue from "F" Street to Center Street if the City installed the curb and gutter on the East side as recommended by the City Engineer. The matter was held over for study. (j/-INVITATION EXTENDED TO HARBOR CO~ISSION MEMBERS TO ATTEND LEAGUE DINNERS At ~he suggestion of Councilman Smith, an invitation was extended to members of the Harbor Commission to attend the League of California Cities dinners, held each month0 INVESTIGATION REQUESTED ON SEWERAGE DUMPING V- Councilman Smith suggested that an investigation and report be made on the practice of certain contractors pumping cesspools in the County and dumping the sewage into the City system free of charge. APPRECIATION EXTENDED FOR WORE ON pRESIDENT'S VISIT Mayor McAllister extended his personal appreciation to all groups and individuals who participated in the making of the President Eisenhower visit a huge success. ~..~ RENAMING OF HIGHLAND AVENUE RECOMMENDED City Engineer Floyd stated that Highland Avenue in Sweetwater Valley should be renamed to Fourth Avenue to the North City limits, to correspond with the name of the street in the rest of the City. The Planning Director was directed to study the matter. /SIGNAL LIGHTS AT BROADWAY AND Co STREET Councilman Smith suggested that the Safety Council study the feasibility of installing traffic signals at Broadway and ~C" Street. ADJOURNMENT 10:35 It was moved by Councilman Menzel, seconded by Councilman Smith and carried, that the meeting adjourn until Wednesday November 9th at 7:00
