No~r_2~_~60 The Council met in the Council Chambers at the City Hall on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, Smith, McAllister~ DeGraaf, Menzel Absent: None Also present: Associate Civil Engineer Phillips, City Attorney Kugler, City Administrator Fulwiler, City Planner Fretz, Chief Building Inspector Grady Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of prayer. STATEMENT: The City Clerk hereby states that he did post within 24 hours of adjournment, as provided by law, the order of adjournment of the City Council for the adjourned regular meeting of November 22, 1960 S_~F_E~.~U~NC_~I~ RECOMMENDATION ON LOADING ZONE AT METHODIST CHURCH A letter was read from the Safety Council recommending the establish- ment of a "no parking zone" on the South side of "J" Street from Third Avenue West to the first driveway leading into the Methodist Church property and that a temporary loading zone for use by the Church be estab- lished, by means of portable signs, from the West side of the driveway to the West property line of the Church. After discussion, it was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the curb on the South side of "J" Street from Third Avenue to a point 160 feet West of Third Avenue be painted red for "no parking", and the remaining 90 feet to the Easterly line of the Methodist Church driveway be painted white for a loading zone. Mr. Kenneth Eaton, representing the Board of Trustees of the Methodist Church, arriving late, requested that the "J" Street curb on both sides of the Church driveway be painted red for a distance of 15 feet in each direction for safety purposes. Also that the 160 feet already authorized for "no parking" be cut down 15 feet accordingly. I.t was moved by Councilman DeGraaf, seconded by Councilman McMains and carried, that the curbing be painted red for 15 feet on each side of the Church driveway, and that the 160 feet "no parking" already authorized be cut by 15 feet as requested. ~O~LU~TIO~ No~._25$_~-Approving revised final map-Sweetwater Valley Industrial Park Offered by Councilman Smith, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf~Menzel,McMains Noes: None Absent: None . /PUBLIC HEARING - On changes and modifications-Sweetwater Valley Industrial Park This being the time and place, as advertised, for a public hearing on proposed changes and modifications in the proceedings under Resolution of Intention No. 2469 as it pertains to the Sweetwater Valley Industrial Park project No. 60-1, Mayor McAllister declared the hearing open. There being no written protests and no one in the audience wishing to be heard either for or against the changes and modifications, the Mayor declared the hearing closed. RESOLUTION No. 2535-Ordering Changes & Modifications-Sweetwater Valley Industrial Park PrOject No. 60-1 Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None /'~gU~ F-9~ A__MENDM~N~T~ TO TRAILER PARK ORDINANCE A petition was read from residents of the Brentwood Mobile Home Park, 1100 Industrial Avenue requesting that the Trailer Park ordinance be amended to permit the use of painted aluminum or alsonite for two sides of their trailer cabanas. Building Inspector Grady stated that the State Trailer Park Act requires that awning drops shall consist solely of rolled or drop curtains of fabric or other flexible materials, and not be permanently fastened down. Mpc Grady stated the City could net enforce provisions of an ordinance if they were not equal or greater than those imposed by the State law. Mr. R. WoLOCkhart, of the trailer park urged thattthe Council consider the request of the petitioners. It was brought out by some that trailer parks in other cities in the County and State permit awnings of solid material, Inasmuch as there was a question on provisions of the State law concerning this matter, it was held over until the meeting of December 6th, in order that the City Attorney could check the law and report to the Council° ~., ~Q_U~T ?_O_R_.~_X?.E__NSI~O~_OF TIME ON ROBINUOOD No. 5 I~PROVEMENT CONTRACT Associate Civil Engineer phillips read a letter requesting a 60 day extension of time on the public works improvements contract for Robinhood No0 5 Subdivision. The Engineer's recommendation was that they be granted an extension of 15 working days. It was moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that an extension of time to December 15, 1960 be granted, ORDINANCE No. 736-Relating to training of law enforcement officers- first reading It was moved by Councilman Smith, seconded by Councilman McMains and carried, that Ordinance No. 736 be placed on its first reading, and that reading of the text be waived. The motion carried by the follow- ing vote~ to-wit: AYES: Councilmen Smith,McAllister,McMains Noes: Councilmen DeGraaf,Menzel Absent: None ORDINANCE No. 733- Rezoning property at 175 "E" Street- second reading It was moved by Councilman DeGraaf, seconded by Councilman McMains and carried, that Ordinance No. 733 be placed on its second reading; that reading of the text be waived and the ordinance adop~e~. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None ORDINANCE No. 734-Changing name of portion of Itighland Avenue-second reading It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried~ that Ordinance No. 734 be placed on its second reading; that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilmen Smith,McAllister,DeGraaf,Menzel,McMains Noes: None Absent: None ORDINANCE No. 737-Repealing Section 33 of Ordinance 505 (Admission Tax) first reading It was moved by Councilman Menzel, seconded by Councilman Smith and carried, that Ordinance No. 373 be placed on its first reading, and that reading of the text be waived. The motion carried by the following votes to-wit: AYES: Councilmen Menzel,McMains,Smith,McAllister,DeGraaf ~$es: None Absent: None DISCUSSION ON PROPOSED DANCE tIALL ORDINANCE A letter was read from the Broadway Association of the Chula Vista Chamber of Commerce reco~kmending that the dance hall ordinance, as proposed~ be adopted with the exception of any mention of required acreage. A letter was read from the Seaview Property Owners Assn. Inc. opposing the 3 acre land requirement proposed in Section 15 of the ordinance. Councilman DeGraaf was still of the opinion that the dancing area requirement should be 800 square feet, and Counc±lman ~c~ains was opposed to the 3 acre requirement. Mrs. Santo expressed opposition to the proposed ordinance in that it was discriminatory. In her opinion the areas required in the ordinance would prohibit the type of establishment which could be patronized by the average person for dining and dancing. James Hayden, President of the Seaview Property Owners Assn. spoke in opposition to the ordinance for reasons as stated in the Association letter° Charles Kopeland~ speaking for the Downtown Assn. stated the association was in favor of the proposed ordinance, but that a compromise'might be made requiring 600 square feet for the dancing area. Reverend Wayne Reed urged the Council to change the ordinance to require 800 square feet. for dancing. It was moved by Councilman Smith that the Ordinance be placed on its first reading. The motion died for lack of a second. It was moved by Councilman DeGraaf, seconded by Councilman Menzel and carried, that Section 15 (c) of the proposed ordinance be amended to require that at least 800 square feet be devoted exclusively to dancing The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf~Menzel,McAllister Noes: Councilmen McMains, Smith Absent: None ORDINANCE Noo 738-Regulating dancing in licensed premises-first reading It was moved by Councilman DeGraaf~ seconded by Councilman Smith and carried, that Ordinance No. 738~ as amended, be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen DeGraaf~enzel,Smith~McAllister Noes: Councilman McMains Absent: None RESOLUTION No. 2536-Accepting dedication of easement for street purposes- East "J" St. School site Offered by Councilman DeGraaf, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen DeGraaf,Menzel,McMains,Smith,McAllister Noes: None Absent: None -3- APPOINTMENT OF MEMBER TO LIBRARY BOARD Councilman Menzel nominated Mrs. Eleanor Averill for appointment to the Library Board. It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the nominations be closed. The Clerk was directed to east a unanimous ballot for Mrs. Eleanor Ay,rill to fill the unexpired term of Winn Kinmore on the Library Board~ said term to expire June 30, 1962o ONE-WAY TRAFFIC AUTHORIZED It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that one-way traffic be permitted on Whitney and Mankato Streets between First Avenue and Second Avenue for the Christmas season, to take care of the increased traffic at that time. VOLUNTEERS OF AMERICA GRANTED PERMISSION TO SOLICIT FUNDS It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that The Volunteers of America and all other volunteer charitable groups be allowed to solicit in the City for donations to the needy, providing they first clear through the City Administrative Officer as to their respective locations for operation. REQUEST FOR CHANGE IN DANCE HALL ORDINANCE Mr. Frank Balistrieri of the Palomar Inn stated he does not object to the 800 square feet required for dancing as outlined in the new Dance Hall Ordinance, but would like to see a change in the 3 acre site require- ments considered at a future date. REQUEST FOR CHRISTMAS KETTLE Rev. Wayne Reed requested that his Mission of Hope be permitted to have one Christmas kettle for donations to the needy, located in Chula Vista for the Christmas season. It was moved by Councilman DeGraaf, seconded by Councilman Smith and carried, that the request be granted, subject to clearing of the location through the City Administrator. ~Q~U~_T~O~_O_~y CA_~H BOND FOR SEWER PROJECT Mre Reid of Reid's Plumbing Companyp low bidder on the Garrett Ave. sewer project, requested permission to deposit a certified check in the full amount of the bid to guarantee compliance with terms of the contract. City Attorney Kugler stated that State law requires fifty percent of the amount of the bid for labor and material and one hundred percent of the amount of the bid for faithful performanc~ so in lieu of furnishing bonds. 150% of the amount of the bid should be deposited in cash by the Reid Plumbing In view of the fact that cash bond deposits in the amount of the bid have been accepted by the City in the past, and seems to be general practice among other governmental agencies~ it was moved by Councilman Menzel, seconded by Councilman DeGraaf, and carried, that the cash bond deposited by Mr. Reid in the amount of 100% of the job cost be accepted to satisfy the bond requirements. Councilman Smith voted "no". REQUEST FOR EXTENSION OF TIME ON FIRE STATION No. 3 COMPLETION Mr. Walt Selph, contractor on the No. 3 Fire Station project~ asked that he be given consideration on steps taken to withhold $50. per day from his final payment, due to his failure to complete the contract within the specified time. He asked for a 15 day extension of time for completion of the contract. City Administrator Fulwile~ was directed to study the request and report ~ack at the next meeting. ~-"AMERICAN MUNICIPAL ASSOCIATION CONGRESS Mayor McAll±ster asked if it was the desire of the Council to send one member of the Council to New York next month to attend the American Municipal Association CongressQ It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried, that the Mayor send his regrets that none will be able to attend the Congress from this City. ADJOURNMENT - 9:25 P.M It was moved by Councilman Menzel, seconded by Councilman DeGraaf and carried, that the meeting adjourn until Monday~ November 28th at 7:00 PoMo at which time the Council will sit in on a meeting of the Harbor Commission°
