The Council met in the Council Ghambers at the City Hall on the above date at 7:00 P.Mo
with the following Councilmen present:

Mayor McAllister led the pledge of allegiance to the Flag, and asked for a moment of
prayer·
~GR~KMENT WITH SAN DIEGO HARBOR DEPARTMENT APPROVED
A letter was read fr~he Chula Vista Harbor Cou~nission recommending that a joint
powers agreement be entered into with the City of San Diego for technical services by the
San Diego Harbor Department to help in the proper development of the tidelands.
It was moved by Councilmah DeGraaf, seconded by Councilman Menzel and carried,
that the recommendations of the Harbor Com~ission be accepted and the City Administrator
directed to negotiate a joint powers agreement with the City of San Diego for technical
services by the San Diego Harbor Department.
UBLIC HEARING - Proposed rezoning of property at the Southwest corner of Fourth
Avenue and "E" Street
This being the time and place, as advertised, for a public hearing on the proposed
rezoning from R-1 and R-3 to C-2-P of property on the Southwest corner of Fourth Avenue
and "E" Street, Mayor McAllister declared the hearing open. No one in the audience
wishing to be heard either for or against the proposed rezoning, and the Clerk having
received no written protests, the Mayor declared the hearing closed.

This being the time and place, as advertised, for a public hearing on the proposed
rezoning from R-1 and R-3 to C-2-P of property at 416 "E" Street, Mayor McAllister
declared the hearing open. No one in the audience wishing to be heard either for or
against the proposed rezoning and the Clerk having receiwed no written protests, the
Mayor declared the hearing closed.
ORDINANCE No. 740 - ~ezoning property at 416 "E" Street- First reading
It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that
Ordinance No. 740 to rezone the property at 416 "E" Street to C-I-P be placed on its
first reading, and that reading of the text be waived° The motion carried by the
following vote, to-wit:

Third Avenue
This being the time and place, as advertised, for a public hearing on the proposed

McAllister declared the hearing open. No one in the audience wishing to be heard either
for or against the proposed rezoning, and the Clerk having received no written protests,
the Mayor declared the hearing closed.
ORDINANCE No. 741 - Rezoning certain property North of "K" Street, West of Third Avenue
First reading
It wa.s moved by Councilman Smith, seconded by Councilman McMains and carried, that
Ordinance No. 741 be placed on its first reading, and that reading of the text be waived°
The motion carried by the following vote, to-wit:

PUBLIC HEARING - Amending zoning Ordinance- Agricultural zone and certain changes in
R-1 zone requirements
This being the time and place, as advertised, for a public hearing on a proposed
amendment to the rezoning ordinance to provide for an agricultural zone, a I~emental
B-15 zone and certain changes in R-1 zone requirements, Mmyor M~Allister declared the
hearing open. N= one in the audience wishing to be heard either for or against the
proposed rezoning and the Clerk having received no written protests, the Mayor declared
the hearing closed.
ORDINANCE No, 742 - Amending zoning ordinance - Agricultural zone,~tc.- First reading
It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that
Ordinance Ncc 742 be placed on its first reading and that reading of ~he text be waived.

~BIOS. ON SWEETWATER VALLEY INDUSTRIAL PARK..
Associate Civil Engineer Phillips stated four bids were received for construction
of improvements in Sweetwater Valley Industrial Park, the low bid being that of Paul C.
Pullaro in the amount of $246,979.80.
City Attorney Kugler called the Council's attention to the fact that the bond money
was not on hand, and since they were'entering into a contract for these improvements,
there was a possibility, though not great, that the City might be subject to liability to
the contractor if the money did not for some reason, come forth as scheduled°

ORDINANCE No. 736- Relating to training of law enforcement Officers- second reading

ORDINANCE No. 737 - Repealing Section 33 of Ordinance No. 505 (Admission tax)
Second reading
It was moved by Councilman Menzel, seconded by Councilman McMains and carried,
that Ordinance No. 737 be placed on its second reading; that reading of the text be
waived and the Ordinance adopted. The motion carried by the following vote, to-wit:

%WNING DROPS ON TRAILER CABANAS
A letter from Chief Building Inspector Grady stated that after a meeting with
Joe Harris of the State Division of Housing and the City Attorney, it was determined that
the City is obligated to enforce the stricter requirements of canvas awning drops as set
forth in the State Trailer Park Act. City Attorney Kugler concurred in Mr. Grady's
report. Charles McCutcheon of the Board of Governors, State Trailer Parks Association,
stated there are now bills pending before the State Legislature which may change the
State Trailer Park Act and permit solid awning drops on trailer cabanas.
It was moved by Councilman Smith, seconded by Councilman DeGraaf and carried,
that action on the matter of amending our ordinance to allow solid drops on trailer cabanas
be held in abeyance until a report is ev~tlable from the State Division of Housing.
j//,REqUEST FOR EXTENSION OF TIME ON FIRE STATION No. 3 CONTRACT DENIED
In his report on the request of Walt Selph for a fifteen day contract extension
for completion of Fire Station No. 3, City Administrator Fulwiler recommended acceptance
of the report of the City Engineer and Chief Building Inspector. Their recommendation
was that the request be denied.
It was moved by Councilman Smith, seconded by Councilman McMains and carried,
that the request of Walt Selph for an extension of fifteen days to complete the
qonstruction of Fire Station No. 3 be denied.
FINAL PAYMENT TO ARCHITECT FOR FIRE STATION No. 3 APPROVED
It was moved by Councilman Smith~§econded by Councilman DeGraaf and carried, that
$539.28 be appropriated from the unappropriated surplus of the General Fund as final
payment to Wulff and Fifield, architects for Fire Station No, 3. The motion carried by
the following vote, to-wit:

~LES STREET "Dumping"
City Administrator Fulwiler stated calls have been received from people in the
Seaview Estates area on East Naples Street complaining that the public is using a vacant
lot in the area for dumping their garbage and trash. Mr, Fulwiler asked permission to
enforce City Ordinance No. 347 and No. 430 in order to clean up the area.
it was moved by Councilman Smith, seconded by Councilman Menzel and carried,
that the City Administrator be directed to proceed with having the area cleaned under
propulsions of the City Ordinances.

BAD DRAINAGE AREA REPORTED
Mr. James Hayden, President of the Seaview Property Owners Association reported a
~// stagnant lake had been created in the 300 block on East Moss Street by the danm%ing up of
a natural canyon by subdivision development. It was his opinion the Council should
take steps to rectify the hazard. The City Administrator was directed to look into
the matter.

ORDINANCE No. 743 - Adopting Plumbing Code by reference- First reading
It was moved by Councilman Smith, seconded by Councilman Menzel and carried, that
Ordinance No. 743 be placed on its first reading and that reading of the text be waived°

~z/~BANNING COMMISSION RECOMMENDATION- Conditional Use Permit
A letter was read from the Planning Commission recomm~ending approval of the applica-
tion of Fo R. Oberschulte, J. C. Tam and E. A. Kemler to construct and operate a dental
building at the Northeast corner of "F" Street and Del Mar Avenue.
RESOLUTION No. 2540- Granting conditional use permit- Northeast corner of "F" Street
and Del Mar Avenue

CHANGES IN BUILDING LINES P~COM~NDED
A letter was read from the Planning Commission recommending the establishment of
five foot building lines in commercial zones where the building lines are now 10, 15, and
20 feet. Date for public hearing on the matter was set for January 3, 1961 at 7:00 P.M.
PLANNING COMMISSION RECOM2~ENDATION OF CLOSING OF PORTION OF HILLTOP ORIVE
A letter was read from the Planning Commission recommending that a portion of the
old Hilltop Drive right-of-way adjacent to two lots at the Southwest corner of
Quartersection 113, be vacated as requested by Mr. Charles Kokai.
The City Attorney was directed to prepare the necessary resolution for presenta-
tion at the next meeting. The City Planner was asked to have a plot plan showing the
entire area around the section of Hilltop Drive proposed to be vacated.
POLICING OF HIGHWAY 101 BY STATE APPROVED
City Administrator Fulwiler reported that if it is the Council's desire, policing
of Highway 101 in Chula Vista could be turned over to the State Highway Division by so
requesting. It was moved by Councilman McMains, seconded by Councilman OeGraaf and
carried, that the City enter into an agreement with the State for the policing of Highway
101 in Chula Vista.
RESOLUTION No. 2541- Providing for marking of portions of "J" Street curb
Offered by Councilman DeGraaf, passed, adopted and approved by the following vote,
to-wit:

..,RJ~qUEST FOR COUNCIL TO PURCHASE PARKING LOTS
Letters were submitted from 32 different property owners in the proposed Third
Avenue Parking District requesting that the Council purchase parking lots with parking
meter revenues as outlined in Council Resolution No. 1929, adopted July 1, 1957. No
action taken.
REQUEST FOR EXTENSION OF TIM~ ON COM~PLETION OF IMPROVEMENTS
A letter was read from the Syracuse Development Co. requesting an extension of time
of ninety days for the completion of improvements in Seaview Estates Unit No. 5. The
City Administrator was directed to submit a recommendation at the next meeting.
~EqUEST FOR EAS4~MENT FOR PARKING ON FIFTH AVENUE
A letter was read from John Keeley requesting that the Council give him an easement
for use of the now dedicated parkway area on the Fifth Avenue side of his property on the
Sou~Rast corner of Fifth Avenue and "H" Street° Use of this property is requested for
parking.

City Attorney Kugler stated that the portion of the parkway requested would have to be
vacated as an easement could not be granted on a public street for private use. The
matter was held over until the next meeting for a report from the City Attorney on the
legality of granting such a request.
LETTER OF APPRECIATION A letter was read from Joseph Rindone, District Supto of
Sweetwater Union High School District, expressing appreciation for the Council's interest
in endorsing a Junior Gollege District.
REQUEST FOR SLOPE RIGHTS A letter was read from Trailerancho Corp. asking that the
condition under which they were granted a conditional use permit requiring them to dedicate
a forty foot strip of unimproved property on the East side of their trailer site, North
of "C" Street and East of Highland Avenue, be rescinded. It was their contention the
property was needed for slope rights for the proper~ development of their trailer park.
At the request of Associate Civil Engineer Phillips the matter was held over one week
while the Engineers make a study on the slope right request.
~,~UBST FOR DELAY ON IMPROVEMENT OF Glover Avenue
Representatives of the Trailerancho Corp. asked permission to postpone development
of the half of Glover Avenue in their proposed trailer park development until property
owners on the other half of the street are ready to improve their side. They were directed
to get together with the City Attorney and report back at the next meeting.
TREES BEING NEGLECTED
Councilman McMains stated that the trees required by City Ordinance, to be planted
in the parking of new subdivisions, were dying in front of those prop~ties which were
not being sold. It was suggested that the matter be brought to the attention of the
Park Director.

Councilman Smith asked if a need still prevailed for the present number of employees
in some departments in light of the current building slump. City Administrator Fulwiler
stated a report was forthcoming.
