HomeMy WebLinkAboutcc min 1965/01/05 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday January 5, 1965 An adjourned regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Planning Director Warren, Assistant Administrative Officer Stenberg Mayor Sparling led the pledge of allegiance to the Flag and asked for a moment of silent prayer. ~/FUBLIC HEARING - Prezoning to C-I-D of Bonita Village Annexation No. 2 This being the time and place, as advertised, for a public hearing on the proposed prezoning to C-1-D of the Bonita Village Annexation No. 2, Mayor Sparling declared the hearing open. No one wishing to be heard either for or against the prezoning and the Clerk having received no written protests~ the Mayor declared the hearing closed. ORDINANCE NO. 916 - Prezoning to C-1-D of Bonita Village Annexation No. 2 - First reading and adoption It was moved by Councilman McMains, seconded by Councilman Anderson, and carried that Ordinance No. 916 be placed on its first reading, that reading of the text be waived and the ordinance adopted as an emergency ordinance. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None ~,,PUBLIC HEARING - Appeal of Don E. Norman to Planning Cormnission action denying him zone change for property on Otay Lakes Road This being the time and place, as advertised, for a public hearing on the appeal of Don E. Norman to Planning Cormnission action denying him a zone change from R-1 to C-2 for his property 660 feet north of Southwestern Junior College on the west side of Otay Lakes Road, Mayor Sparling declared the hear- ing open. Attorney James Bear, representing Mr. Norman, stated that his client was abiding by the City's General Plan and would be favorable to a zone control- ling architecture. He urged that the Council overrule'the decision of the Plan- ning Commission. Mr. Richard Kelton, representing Bollenbacher & Kelton, Inc.~ urged that Planning Cor~nission action be sustained and the appeal denied. Mr. Robert Miles spoke in favor of the rezoning. No others wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman McAllister, seconded by Councilman McMains~ and carried that the City Attorney be directed to prepare an ordinance for rezoning the property in question and that the Administrative Officer be directed to negotiate with the developer for an easement for street purposes across his property. CEARTERHEVIEW COMMITTEE REPORT Mr. Lorenz Koester, Chairman of the Charter Review Cormnittee, read the Committee's written report to the Council. The report recommended charter amend- ments which would provide for the election by the people of a full-time Mayor at a salary of $6,000.00 per year, enlarging the Civil Service Cormnission from three to five members and restricting Council and Mayor interference in administrative procedures. It was moved by Councilman Anderson, seconded by Councilman McMains, and carried that the matter be referred to the Administrative Officer and City At- torney for a report in one week on the proper procedure for going ahead with the Committee recommendations. ~/~PORT ON APPLICATION OF VIDEO CABLE SYSTEM FOR T,Vo ANTENNA FRANCHISE Administrative Officer Ross, after giving a report on progress of Mission Cable T.V., Inc., in exercising their franchise with the City for T.V. Antenna service, recormmended that a franchise not be granted to Video Cable Systems at this time and that Mission Cable T.V., Inc., be given until May 4, 1965 to place their system in operation. If Mission Cable T.V. is not in operation by that time, it was recormnended that consideration for a franchise be given to Video Cable Systems. Mr. David Verdusco, representing Video Cable Systems, asked that his company be given an opportunity to compete with Mission Cable T.V. It was moved by Councilman McAllister, seconded by Councilman McMains, and carried that thc recommendations of the Administrative Officer be accepted. ~z.zREPORT OF FINDINGS - Appeal of San Diego Trust & Savings Bank to Planning Com- mission action A Planning Commission report of findings was read on the appeal of the San Diego Trust and Savings Bank to action of the Planning Commission denying them a zone change from R-2 and R-3 to C-1. It was moved by Councilman Ander- son, seconded by Councilman McMains, and carried that January 26, at 7:00 P.M. be set as the time for a public hearing on the appeal. RESOLUTION NO. 3601 - Approving conditional use permit for Chula Vista Doctors' Medical Park Offered by Councilman McAllister, passed and adopted by the following votes to-wit: AYES: Councilmen McAllister, Sperling, McCorquodale, Anderson, McMains Noes: None Absent: None RESOLUTION NO. 3602 - Approving conditional use permit for convalescent hospital Offered by Councilman McAllister, passed and adopted by the following vote, to-wit: AYES: Councilmen McAllister~ Sparling, McCorquodale, Anderson Noes: Councilman McMains Absent: None RESOLUTION NO. 3603 - Accepting grant of easement for tree planting and sidewalk purposes Offered by Councilman Anderson~ passed and adopted by the following vote: to-wit: AYES: Councilmen Anderson, McMains, McAllister, Sparling~ McCorquodale Noes: None Absent: None RESOLUTION NO. 3604 - Establishing "No Parking" on west side of Jefferson Avenue from "E" to Flower Streets Offered by Councilman McCorquodale~ passed and adopted by the following vote: to-wit: AYES: Councilmen McCorquodale, Anderson, McMains, McAllister, Sparling Noes: None Absent: None RESOLUTION NO. 3605 - Establishing "No Parking" on 900 feet of 30th Street be- tween Edgemere Road and "L" Street Offered by Councilman McCorquodale, passed and adopted by the following vote, to-wit: AYES: Councilmen McCorquodale, Anderson, McMains, McAllister, Sparling Absent: None RESOLUTION NO. 3606 - Accepting bid, awarding contract and appropriating funds for paving at Greg Rogers Park Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None ORDINANCE NO. 917 - Establishing speed limit on "C" Street between Broadway and Fourth Avenue - First reading It was moved by Councilman McMains, seconded by Councilman Anderson, and carried that Ordinance No. 917 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote~ to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None ~PORT FROM PORT DISTRICT REGARDING PATROL OF SOUTH BAY WATERS Administrative Officer Ross read a report from Don L. Nay, Assistant Port Director, regarding their program of patrolling the South Bay. ~REPORT FROM PORT DISTRICT REGARDING ACQUISITION OF TRANSPORTATION SYSTEM Administrative Officer Ross reported that in response to a request from Councilman McCorquodale that the Port District be contacted to determine if they would be interested in taking over the San Diego Transit Systems he has received information that it is not legally possible for the Unified Port District to take over the Transit System. It was suggested by Councilman McCorquodale that the City Attorney might check on legislation needed to amend the Port Bill to include the acquisition of transportation facilities. Upon the suggestion of Councilman Anderson, Mayor $parling stated he would bring up the matter of transportation at the next Mayor's meeting. ~PPRECIATION EXPRESSED Mayor Sparling expressed his appreciation to the citizens of Chula Vista for their response to the Council action proclaiming Obscenity Control Activity Days in Chula Vista. ~z0RDINANCE CONTROLLING DRAINAGE INSTALLATIONS ON PRIVATE PROPERTY PROPOSED Upon the suggestion of Councilman McMains, City Attorney Lindberg was directed to study the legality of an ordinance regulating installation of drain- age facilities on private property and report back at a later date. REQUEST FOR STAND ON BAY BRIDGE A letter was read from the U. S. Army Engineer Corps requesting that the Council state in a resolution whether they favor or are opposed to the construc- tion of a toll bridge between the Cities of San Diego and Coronado. It was moved by Councilman McAllister, seconded by Councilman McCorquodale, and carried that a letter be written to the Corps confirming Council's past action. ~LETTERS OF AppRECIATION A letter was read from the Hilltop Band Boosters Club expressing appreci- ation to the Council for support of their band. Letter filed. A letter was read from the National City-Chula Vista Board of Realtors commending the joint action of the Councils of National City and Chula Vista in settling the issue of the boundary between the two cities. Letter filed. A letter was read from the Library Board expressing appreciation for the new addition to the Library building. Letter filed. A letter was read from Mrs. Hazel Goes Cook expressing appreciation to the Council for their Resolution of Commendation No. 3587. Letter filed. ~ACQUISITION OF BONITA VALLEY COUNTRY CLUB RECOMM]~NDED A letter was read from the Park and Recreation Con~nisslon recommending that the City continue to negotiate for the purchase of the Bonita Valley Coun- try Club. Letter filed. CCEPTANCE OF LIBRARY LANDSCAPING PLANS RECOMMENDED A letter was read from the Library Board recommending that the Council accept the plans and appropriate the necessary funds for landscaping and irri- gating of the Library grounds. Mr. Ross stated this matter would be on the agenda next week. .,~REQUEST FOR PUBLIC MEETINGS ON PROPOSED CHARTER CHANGES Mr. Paul Yeager requested that in the future when a cormnittee is appointed to study amendments to the charter that the cormnittee meeting be open to the citizens in order that they might express their views.
