HomeMy WebLinkAboutcc min 1965/03/16 MINUTES OF AN ADJOUR/qED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday March 16, 1965 An adjourned regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P. M. with the following Councilmen present: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Absent: None Also present: City Engineer Cole~ City Attorney Lindberg, Administrative Officer Ross, Director of Planning Warren, Assistant Administrative Officer Stenberg Mayor Sparling led the pledge of allegiance to the Flag. Invocation by John Woolheather of the Harbor Missionary Church Statement: The City Clerk hereby states that he did post within twenty-four hours of adjournment, as provided by law, the order of adjourn- ment of the adjourned regular meeting of March 16, 1965. ~/IRBPORT FROM PORT COMMISSIONER Mr. Robert Campbell, representative from Chula Vista on the Unified Port District Commission summarized the highlights of his ten months on the Commission. He introduced Port Director John Bate who reviewed the proposal to extend the deep water channel to the South Bay area and urged Council assistance in bringing this to reality. . //PUBLIC HEARING - Appeal to Planning Commission action denying rezoning to R. H. Woodward for property at Third Avenue, 150 feet north of "D" Street. This being the time and place, as advertised, for a public hearing on the appeal of R. H. Woodward to the Planning Commission action denying him a rezoning from R-1 to R-3 for his property on the east side of Third Avenue, 150 feet north of "D" Street, Mayor Sparling declared the hearing open. The findings of the Planning Commission were read. Mr. Jack Brewer, spokesman for property owners in the area stated they were emphatically opposed to rezoning the property to R-3. Mr. Walter Temple, speaking in opposition to the rezoning was of the opinion the absence of Mr. Woodward at the hearing indi- cated his apparent loss of interest. Ne others wishing to be heard the Mayor declared the hearing closed. The clerk reported that a petition in opposition to the rezoning and representing 45 properties~ which was submitted at the Planning Commission hearing on the matter, has been forwarded to the Council for consideration at their hearing. It was moved by Councilman McAIlister, seconded by Councilman McCorquodale~ and carried that the action of the Planning Commission be sustained and the appeal denied. V/ PUBLIC HEARING -Amendment to Zoning Ordinance - definition of "family" and mini- mum floor area requirements for single family dwellings in R-1 zones. This being the time and place, as advertised, for a public hearing on proposed amendments to the zoning ordinance, Sections 33.3 and 33.16, relating to the definition of a "family" and the minimum floor area required for single family dwellings in R-1 zones, Mayor Sparling declared the hearing open. Mr. Victor Wulff spoke in favor of a proposed ordinance which would control architecture in the City. Mr. Richard Kelton was of the opinion it would be a more realistic approach to providing effective residential needs to the community if provision were made for minimum room sizes rather than minimum requirements for the entire area of a dwelling. Also, he expressed the opinion the area differential between the two and three bedroom house, as proposed by the Planning Cormnission, was too great and suggested a 1100 square foot require- ment for a three bedroom dwelling be incorporated in the ordinance. No others wishing to be heard it was moved by Councilman McAllister, seconded by Councilman Anderson, and carried, that the hearing be continued until April 27th at 7:00 P. M. and the matter referred back to the Planning Cormnission with the thought toward increasing the minimum floor area and incorporating architectural control. ~BLIC HEARING- Appeal to Planning Commission action denying part of variance request to Bollenbacher and Kelton - Reduction of dwelling size in Southwestern College Estates This being the time and place, as advertised= for a public hearing on the appeal of the firm of Bollenbacher and Kelton to action of the Planning Commission denying them a reduction in house area from 1300 to 1100 square feet for certain houses in Southwestern College Estates, Mayor Sparling declared the hearing open. The findings of the Planning Cormnission were read to the Council. City Planning Director Warren stated that the Planning Cormnission had granted the firm a variance allowing the construction of 1200 square foot dwellings. Mr. Richard Kelton spoke in favor of his appeal. No others wishing to be heard and the Clerk having received no written commnnications, the Mayor declared the hearing closed. Councilman McAllister asked how many of the 34 dwellings proposed for immediate construction would be less than the 1200 square foot area agreed upon by the Planning Cormnission,were the Council to grant the appeal. Mr. Kelton being unable to answer the question stated his firm would be willing to cormnit themselves to building not more than half of the houses at less than 1200 square feet. Mr. J. L. Duquesnay~ Sales Agent for Bollenbacher and Kelton spoke in support of his firm's appeal. After discussion~ it was moved by Councilman McMains~ seconded by Council- man McCorquodale, and carried, that action be held over one week in order for the subdivider to supply the Administrative Officer with information as to how many of the contemplated 34 houses they plan on building less than 1200 square feet in size. The motion carried by the following vote, to-wit: AYES: Councilm~n McMains, McAllister, McCorquodale, Anderson Noes: Councilman Sparling Absent: None PUBLIC HEARING- Greg Rogers Park Annexation This being the time and place, as advertised, for a public hearing on the proposed Greg Rogers Park Annexation~ Mayor Sparling declared the hearing open. No one wishing to be heard and the Clerk having received no written communications, the Mayor declared the hearing closed. ORDINANCE NO. 926- Approving Greg Rogers Park Annexation - First reading It was moved by Councilman Anderson, seconded by Councilman McCorquodale, and carried that Ordinance No. 926 be placed on its first reading~ that reading of the text be waived.~ ' . ~ . · The motion carried by the following vote~ to-wit: AYES: Councilm~n Anderson, McMains, McAllister, Sparling, McCorquodale Noes: None Absent: None ORDINANCE NO. 925- Establishing speed limits on certain sections of Otay Lakes Road and Allen School Lane - Second Reading It was moved by Councilman McM~ains, seconded by Councilman McCorquodale, and carried that Ordinance No. 925 be placed on its second reading, that reading of the text be waived and the ordinance adopted. The motion carried by the following vote, to-wit: AYES: Councilman McMains~ McAllister~ Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO. 3659- Accepting, dedicating and naming an easement at Fourth Avenue and "F" Street from San Diego Gas & Electric Company Offered by Councilman McMains, passed and adopted by the following vote~ to-wit: AYES: Councilm~n McMains, McAllister~ Sparling, McCorquodale, Anderson Noes: None Absent: None RESOLUTION NO~ 3660 - Approving Planning Commission action granting conditional use permit to Robinhood Homes, Inc.- 402 Telegraph Canyon Road - Service Station Offered by Councilman McMains, passed and adopted by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Sparling, McCorquodale, Anderson Noes: None Absent: None M/~OPPOSITION EXPRESSED TO PROPOSED AIRPORT A letter was read from Mr. Craig A. Starkey requesting that no further discussion be held on the locating of an airport in the Bonita area. ~/APPOINTMENT OF MAYOR'S COMMITTEE ON AIRPORT REQUESTED A letter was read from the Chamber of Cormnerce requesting that a Mayor's Committee be appointed to examine what plans San Diego has for rapid development of Brown Field and to study the feasibility for the City of Chula Vista to develop it~ own airport. Mayor Sparling stated that he would like to see such a committee appointed and would recommend the appointment of Otis Pemberton as chairman, Fred Ross, Hugh Christensen, John Peacock, Carl DeGour, J. D. Peters and Niek Slijk. The Mayor also asked that each Councilman serve as an ex-officio member of the committee. It was moved by Councilman McMains, seconded by Councilman Anderson~ and carried that the Mayor's appointments be approved. Councilman McCorquodale was of the opinion the City should continue to work with United Enterprises, Inc., owners of Otay Ranch to determine the possibility of acquiring a portion of their property for development of an airport. Councilman McMains suggested that Administrative Officer Ross write the United Enterprises people in an effort to determine their feeling on the subject. ~/RECOMMENDATION AGAINST BILLBOARD ORDINANCE A letter was read from the Chamber of Commerce recommending that no bill- board ordinance be passed by the City at this time. Referred to Administrative Officer Ross. LETTER OF RESIGNATION A letter was read from Mr. Ross M. Willhite tendering his resignation from the Planning Commission. It was moved by Councilman McMains~ seconded by Councilman Anderson, and carried, that the resignation be accepted and the Administrative Officer directed to write him a letter of appreciation for his service. APPOINTMENT OF MEMBER TO PLANNING COMMISSION The Clerk was directed to place the item of appointing a member to the Planning Commission on the agenda for the next meeting. REQUEST FOR ENDORSEMENT AND PARTICIPATION IN INSTITUTE ON GOVERNMENT A letter was read from C. L. t~ulbert, General Chairman of the 17th Institute on Government to be held on June 17~ 1965 at San Diego State College, requesting the Council to endorse by resolution and encourage participation by City officials and employees in this year% institute. Referred to Administrative Officer Ross. - 3- LETTER OF APPRECIATION A letter was read from John R. Marsh~ Master Councilor of the Chula Vista DeMolay Chapter thanking the Council for proclaiming March 14 to March 21 as DeMolay Week. ~/ COUNCIL CONFERENCE SET It was moved by Councilman McCorquodale that the next Council Conference be set for 6:00 PoM. on Mmrch 30th. The motion died for lack of a second. It was moved by Councilman McAllister, seconded by Councilman McMains, and carried, that the next Council Conference be set for 4:00 P.M. on March 30th. Councilman McCorquodale voted no. ADJOURNMENT Mayor Sparling adjourned the meeting at 9:30 P.M, until March 23~ 1965 at 7:00 P,M, City Clerk -4 -
