HomeMy WebLinkAboutcc min 1965/04/27 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA~ CALIFORNIA Held Tuesday April 27, 1965 An adjourned regular meeting was held in the Council Chambers by the City Council on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Anderson, McCorquodale, Sparling Absent: None Also present City Engineer Cole, City Attorney Lindherg, Administrative Officer Ross, Director of Planning Warren, Assistant Administrative Officer Stenberg Mayor Andersnn led the pledge of allegiance to the Flag. Invocation by Rev. Jack Wilson of the Bay View Baptist Church Statement: The City Clerk hereby states that he did post within twenty-four hours of adjournment, as provieded by law, the order of adjournment of the adjourned regular meeting of April 27, 1965 ~$OLU~ION: No. 3690 - Proclaiming week of May 1 through May 8, 1965 as "Correct Posture Week" Offered by Councilman McCorquodale, passed and adopted by the following vote to-wit: AYES: Councilmen McCorquodale, Sparling, McMains, McAllister, Anderson Noes: None Absent: None I~O~UTION~ No. 3691 - Proclaiming May 1, 1965 as "Law Day U.S.A." Offered by Councilman Sparling, passed and adopted by the following vote to-wit: AYES: Councilmen Sparling, McMains, McAllister, Anderson, McCorquodale Noes: None Absent: None PUBLIC HEARING - (continued) - Amendment to zoning ordinance, Sections 33.3 and 33.16 - Definition of "Family" and area requirements minimum floor in R-1 zones. This being the time and place, as designated, for the continuation of the public hearing on an amendment to the zoning ordinance relating to the definition of a "family" and the minimum floor area required for single family dwellings in R-1 zones, Mayor Anderson declared the hearing open. Mr. Ray Rainwater, repre- senting Princess Park Estates suggested that the Council leave the ordinance as it now is, which requires a minimum of 1300 square feet in a single family dwelling. No others wishing to be heard the Mayor declared the hearing closed. ORDINANCE NO. 932 - Amending zoning ordinance, Sections 33.3 and 33.16 - First reading It was moved by Councilman Sparling, seconded by Councilman McMains, and carried, that Ordinance No. 932 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling~ McMains, McAllister, Anderson Noes: Councilman McCorquodale Absent: None - 1 - It was moved by Councilman McAllister, seconded by Councilman McCorquodale, and carried, that the staff be directed to pursue the question of dwelling size further, with emphasis on room size, lot size and arch£tectural control. BLIC HEARING - Considering amendment to Ordinance No. 398 relating to signs and advertising displays in residential zones This being the time and place, as advertised~ for a public hearing on a proposed amendment to the code relating to signs and advertising displays per- mitted in residential zones, Mayor Anderson declared the hearing open. Mr. Rainwaters representing Princess Park Estates, recormnended that the proposed size for directional advertising signs be increased from three square feet to a minimum of four and one-half square feet, and that a conditional use permit for a directional sign must be objected to by fifty per cent or more of the property owners in the area before being denied instead of the twenty-five per cent now proposed in the ordinance. Mr. Frank Ferreira concurred with statements made by Mr. Rainwater. No others wishing to be hegrd, the Mayor declared the hearing closed. It was moved by Councilman Sparling and seconded by Councilman McCorquodale, that the following be deleted from sub-section 7, Section I of the proposed ordinance: "an unlighted sign not exceeding a total of three (3) square feet serving as a directional sign to properties for sale or rent may be placed upon private property in the R-1 zone, provided~ however, that such signs may not be maintained at any location for more than forty-eight (48) hours and may not be replaced at any location after the expiration of forty-eight (48) hours for a period of not less than five (5) days"; also that "25% or more of the property owners" in line 15 b, subsection 2 of Section II be changed to "50% or more of the property owners. It was moved by Councilman McAllister, seco~d~d~by Councilman McMains, and carried~ that Councilman Sparling's motion be amended to include a change in 2 c, subsection 2, Section II to read "four and one-half square feet in area"~ rather than the proposed" three square feet in area." Councilman Sperling voted no. The amendment having been incorporated into the original motion, the Mayor called for the ayes and nays and the motion carried. OtLDINANCE NO. 933 - Amending Ordinance No. 398 relating to signs and advertis- %~ggdisplays in residential zones - First reading It was moved by Councilman McCorquodale, seconded by Councilman Sparling, and carried, that Ordinance No. 933 be placed on its first reading, and that reading of the text be waived. The motion carried by the following vote, to wit: AYES: Councilmen McCorquodale, Sparling, McMains, McAllister, Anderson Noes: None Absent: None PUBLIC HEARING - Appeal of Princess Park Estates to action of Planning Cormnission denying them variance for reduction in garage size in Princess Manor No. 7 This being the time and place, as advertised, for a public hearing on the appeal of Princess Park Estates to action of the Planning Commission in denying them a variance for a reduction in garage sizes for Princess Manor No. 7, Mayor Anderson declared the hearing open. The findings of the Planning Commission were read. Mr. Ray Rainwater, representing Princess Park Estates spoke on the justification of the appeal. Mr. Paul Yeager= 414 "J" Street, spoke in opposition to the appeal. No others wishing to be heard either for or against the appeal~ Mayor Anderson declared the hearing closed. It was moved by Councilman Sparling, seconded by Councilman McMains, and carried, that the action of the Planning Commission be sustained and the appeal denied. Councilman McAllister voted no. - 2 - ~PUBLIC HEARING - Appeal of Princess Park Estates to action Planning of the Commission denying reduction in floor area for dwellings in Princess Manor No. 8 This being the time and place, as advertised, for a public hearing on the appeal of Princess Park Estates to action of the Planning Commission in denying them a variance for a reduction in floor area for two and three bedroom, single family dwellings~ from 1006 to 1280 square feet, and,~one and two car garages containing from 336 to 468 square feet, Mayor Anderson declared the hearing open. The findings of the Planning Cormmission were read. Mr. Ray Rainwater, repre- senting Princess Park Estates, spoke in support of the appeal. A letter was read from Mr. Henry Rienstra in support of the appeal. No others wishing to be heard, the Mayor declared the hearing closed. It was moved by Councilman McMains, seconded by Councilman McAllister, and carried, that the action of the Planning Commission be sustained and the appeal denied. The mottion carried by the following vote, to-wit: AYES: Cou~ci~muncilmen McMains, McAllister, Sparling Noes: Councilmen McCorquodale, Anderson Absent: None ORDINANCE - Pertaining to pawnbrokers and secondhand dealers It was moved by Councilman McMains, seconded by Councilman McAllister, and carried, that the City Clerk place this item on the agenda for the next meeting. ORDINANCE NO. 934 - Amending Chapter I of the City Code relating to the City Council organization and procedures - First reading It was moved by Councilman McAllister, seconded by Councilman Sparling, and carried, that Ordinance No. 934 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote to-wit: AYES: Councilman McAllister, Anderson, McCorquodale, Sparling, McMains Noes: None Absent: None ORDINANCE NO. 935 - Amending the City Street Code relating to the designation of fire zones - First reading It was moved by Councilman McCorquodale, seconded by Councilman Sparling, and carried, that Ordinance No. 935 be placed on its first reading and that reading of the text be waived. It was moved by Councilman McAllister~ seconded by Councilman McMains, and carried, that the Council approve use of a portion of the building as requested and that the Administrative Officer be authorized to contact the Board of Supervisors for their permission. ~///{EQUEST TO JOIN ECONOMIC DEVELOPMENT CORPORATION A letter was read from Mayor Frank Curran of San Diego requesting that the City consider becoming a member of the Economic Development Corporation dedi- cated to fostering general economic growth throughout the San Diego Area. Councilman Sparling asked that this matter be discussed at the next Council conference session and that the Executive Committee of the Chamber of Con~nerce be asked to attend. Referred to Administrative Officer Ross. Mayor Anderson ~cheduled a Council conference for 4:00 P.M. on Tuesday, May 4, 1965. ~R~UEST THAT CITY TAKE OVER BENCH A letter was read from Mrs. Madge Miller, 180 "K" Street requesting that the bench she placed at the corner of "K" Street and Second Avenue be taken over by the City and be left there for the convenience of bus riders. The bench being in violation of the code, it was recommended that it be removed by the Public Works Department. ~ETTER OF RESIGNATION A letter was read from James Millar tendering his resignation from the Library Board. Mayor Anderson suggested that a letter be sent to Mr. Millar expressing appreciation for his service on the Board and that the matter of his replacement be placed on a future agenda. CENSUS A letter was read from the State Department of Finance advising that the estimated population for the City of Chula Vista on March 1, 1965 was 53,800. ACQUISITION OF ROHR RECREATION FACILITY RECOMMENDED A letter was read from the Park and Recreation Commission recommending that the City acquire the Rohr Corporation recreation facility and that it be dedicated as a park. REQUEST FOR PITCH AND PUTT GOLF COURSE A letter was read from Ted F. Smith, 134 Second Avenue recommending that should the City acquire the Bonita Golf Course, that a nine or eighteen hole Pitch and Putt Golf Course be created. ADJOURNMENT Mayor Anderson adjourned the meeting at 9:10 P.M. until May 4, 1965 at 7:00 P.M. ....... 5 - ~--City Clerk ~
