HomeMy WebLinkAboutcc min 1965/09/14 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Tuesday September 14, 1965 A regular meeting of the City Council was held in the Council Cham- bers on the above date at 7:00 P.M. with the following Councilmen present: Councilmen McMains, McAllister, Anderson, McCorquodale, Sparling Absent: None Also present: City Engineer Cole, City Attorney Lindberg, Administrative Officer Ross, Director of Planning Warren, Assistant Admin- istrative Officer Stenberg Mayor Anderson led the pledge of allegiance to the Flag. Invocation was given by Rev. Loren Rumsch of the Pilgrim Lutheran Church. APPROVAL OF COUNCIL MINUTES It was moved by Councilman McAllister, seconded by Councilman Sparling, and carried that the minutes for the Council meeting of September 7 be ap- proved, copies having been sent to each Councilman. ~PUBLIC HEARING - Proposed permanent zoning and setbacks for certain properties now interim zoned This being the time and place, as advertised, for a public hearing to consider permanent zoning and the establishment of setbacks for ten properties now interim zoned, Mayor Anderson declared the hearing open. No one wishing to be heard and the Clerk having received no written cormnunications, the Mayor declared the hearing closed. ORDINANCE NO. 952 - Approving proposed permanent zoning and setbacks for certain properties now interim zoned - First reading It was moved by Councilman McAllister, seconded by Councilman Sparling, and carried that Ordinance No. 952 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McAllister, Anderson, McCorquodale, Sparling, McMains Noes: None Absent: None %/'PUBLIC HEARING - Proposed rezoning at northeast corner of Fifth Avenue and "H" Street from R-3 to C-1-D This being the time and place, as advertised, for a public hearing to consider an application for the rezoning of the northeast corner of Fifth Avenue and "H" Street from R-3 to C-i-D, Mayor Anderson declared the hearing open. Paul D. Engstrand, Jr., Attorney for the petitioners, spoke in favor of the rezoning but stated plans for development of the property have not been finalized. Walter Wencke, one of the petitioners, also stated that plans and specifications were tentatively scheduled for completion by January 1, 1966. No others wishing to be heard and the Clerk having received no written communications, the Mayor declared the hearing closed. ORDINANCE NO. 953 - Approving proposed rezoning at northeast corner of Fifth Avenue and "H" Street from R-3 to C-1-D - First reading It was moved by Councilman Sparling, seconded by Councilman McMains, and carried that Ordinance No. 953 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen Sparling, McMains, McAllister, Anderson, McCorquodale Noes: None Absent: None ORDINANCE NO. 954 - Regulating food vending vehicles and food handler registration cards - First reading Administrative Officer Ross suggested that in Section 15.86 of this proposed ordinance the words "and the City of Chula Vista" be inserted after County of San Diego. It was moved by Councilman McMains, seconded by Coun- cilman Sparling, and carried that Ordinance No. 954 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Anderson, McCorquodale, Sparling Noes: None Absent: None ORDINANCE NO. 955 - Relating to the regulation of traffic on public streets and highways in the City of Chula Vista and providing for installation and fees of parking meters and parking meter zones - First reading It was moved by Councilman McMains, seconded by Councilman McAllister, and carried that Ordinance No. 955 be placed on its first reading and that reading of the text be waived. The motion carried by the following vote, to-wit: AYES: Councilmen McMains, McAllister, Anderson, McCorquodale, Sparling Noes: None Absent: None RESOLUTION NO. Offered vote,-to-wit: AYES: Noes: Absent: 3847 - Granting appeal of Dorothy Davis from Planning Commission denial of a request for zone variance for nursery home in R-2 zone - 570 Otis Street by Councilman McAllister, passed and adopted by the following Councilmen McAllister, Anderson, Sparling, McMains Councilman McCorquodale None RESOLUTION NO. Offered vote, to-wit: AYES: Noes: Absent: 3848 - Encouraging recognition of and citizen cooperation with law enforcement agencies by Councilman Sparling, passed and adopted by the following Councilmen Sparling, McMains, McAllister, Anderson, McCorquodale None None RESOLUTION NO. 3849 - Proclaiming National Public Works Week - September 26 through October 2, 1965 Offered by Councilman McCorquodale, passed and adopted by the follow- ing vote, to-wit: AYES: Councilmen McCorquodale, Sparling, McMains, McAllister, Anderson Noes: None Absent: None RESOLUTION NO. 3850 - Waiving Section 1109 of the City Code and allowing the Public Works Department to perform reconstruction work on Orange Avenue, from Broadway to Oaklawn Avenue Offered by Councilman Sparling, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, McMains, McAllister, Anderson, McCorquodale Noes: Absent: None The subject of the change of name of Orange Avenue, due to its con- flict with Orange Street in the south part of the City, was discussed with Councilman McMains suggesting that the matter be referred to the Chief Ad- ministrative Officer for a later report to the Council. RESOLUTION NO. 3851 - Accepting bids, awarding contract and approving expenditure of funds for Second Avenue culvert extension Offered by Councilman Sparting, passed and adopted by the following vote, to-wit: AYES: Councilmen Sparling, McMains, McAllister~ Anderson, McCorquodale Noes: None Absent: None REPORT ON POLICE FACILITY ACQUISITION Administrative Officer Ross, reporting on the Police Facility location, stated that after much study a site had been located on Third Avenue between "K" and "L" Streets which would meet their needs now and in the future and at a price fair and reasonable; four acres for $110,000.00. It was moved by Councilman McAllister, seconded by Councilman Sparling, and carried that the City Attorney be authorized to prepare the necessary resolution appropriating funds and to refer the matter to the Planning Commission for their recommen- dations to the Council. L/~TTER FROM SANDIEGO CHAMBER OF COI~W~RCE REGARDIIqG STUDY ON AREA'S ECONOMY A letter from John F. Botchers, General Manager of the San Diego Chamber of Commerce, was read pertaining to the study on the area's economy to be made in San Diego County, with the invitation for all the area cities to participate. Letter referred to Administrative Officer Ross. ~ISCUSSION ON ARCHITECTURAL CONTROL SUPPORT Councilman McMains stated he does not know the answer to the question, but feels some type of architectural control should be maintained in the City. Director of Planning Warren stated they are going ahead without the support they would like to have from the advocates and after the Planning Commission hearing next Monday night, hopes to have the ordinance ready to present to the Council. Councilman Sparling stated that various officials throughout the State are watching to see what the City of Chula Vista does in this case and suggests "we be the leader once". Councilman McCorquodale remarked that there is confidence in the staff even though Councilmen are not always in attendance at the Commission meetings. The Director of Plan- ning included in his final remarks that unless they do hear from both the advocates and objectors, they cannot satisfy the needs and desires of the community. INTERSECTIONS DISCUSSED WITH REGARD TO CONGESTION AND ACCIDENTS Councilman McCorquodale stated there had been another accident at Palomar Street and Industrial Boulevard. Councilman McMains suggested an investigation into the traffic congestion at Hilltop Drive and "L" Street. Administrative Officer Ross stated another look at both locations would be taken and report back to the Council. SUGGESTION MADE TO RECONSIDER ACTION TO BE TAKEN ON MELROSE AVENUE Paul Yeager, 414 "J" Street, speaking in regard to action taken on Melrose Avenue at the Council meeting of September 7, suggested that the Councilmen reconsider this resolution when it comes before them next week. He also suggested that the Council follow more of the recommendations of the staff. ADJOURNMENT Mayor Anderson adjourned the meeting at 7:57 sine die. for Kenn~h Campbell, City Clerk
