RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A THREE-PARTY
AGREEMENT BETWEEN THE CITY OF CHULA VISTA,
RECON (CONSULTANT), AND MCMILLIN ROLLING HILLS
RANCH, LLC (APPLICANT), FOR BIOLOGICAL
MITIGATION MONITORING AND ENVIRONMENTAL
SERVICES TO BE RENDERED FOR THE ROLLING HILLS
RANCH SECTIONAL PLANNING AREA (SPA) PLAN, AND
AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT
WHEREAS, on September 25, 1990,~ the City Council certified FEIR-89-03 and adopted
the accompanying Mitigation Monitoring and Report'mg Program (MMRP), and on March 24,
1992 certified FSEIR-91-03 and adopted the accompanying MMRP; and
WHEREAS, the implementation of the MMRP's and project Area Specific Management
Directives (ASMD's) necessitates the expertise of an Environmental Monitor Specialist
(biological) and requires the hiring of a Consultant; and
WHEREAS, it was determined by the Director of Planning and Building that staff has
neither the available time or expertise to perform the subject work; and
WHEREAS, the Applicant has deposited or will deposit funds necessary for the
biological mitigation monitoring services; and
WHEREAS, a request for proposal was distributed to 19 qualified consulting finns in
accordance with the City's informal bidding process, and four proposals were received by the
City that were responsive to the request; and
WHEREAS, the City is in immediate need of an experienced California Environmental
Quality Act (CEQA) Consultant that is familiar with the City's policies and procedures; and
WHEREAS, the Consultant is uniquely qualified to serve as the Consultant for this
project based on their projects of a similar nature, their experience with the resource agencies,
their grasp of the project's complexities, and the firm's project experience within this region; and
WHEREAS, the Environmental Review Coordinator has negotiated the details of this
agreement in accordance with procedures set forth in Section 6.5.2 of the Environmental Review
Procedures; and
WHEREAS, the proposed contract with RECON to provide biological mitigation
monitoring services would be in an amount not to exceed $49,936.
NOW, THERERFORE BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve a three-party agreement between the City of Chula Vista, RECON
("Consultant") and McMillin Land Development ("Applicant") for consulting services related to
biological mitigation monitoring for McMillin Rolling Hills Ranch Sectional Planning Area
(SPA).

BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby
authorized and directed to execute said agreement on behalf of the City of Chula Vista.
