Declaration (IS-02-006), for the Chula Vista Auto Park North Specific
Plan adopted in June 2003. Thus, no further environmental review is

Staff Recommendation:

ITEM TITLE
Consideration of a Design Review for a two-story, 54,400 square foot building and a detached 1,200
square foot carwash for a Mossy automobile dealership with automotive repair services and
associated carwash on approximately 6.51 acres within the Auto Park North Specific Plan
Location: 1875 Auto Park Avenue
Recommended Action
Conduct a public hearing and adopt Resolution DR20-0025 approving the project, based on the
findings and subject to the conditions contained therein.
SUMMARY
The proposal includes the construction of a two-story, 54,400 square foot building and a 1,200 square
foot carwash building with 333 parking spaces for a Mossy auto dealership with auto repair services
and associated carwash. The first floor of the main building includes an interior vehicle showroom,
offices, parts storage, service reception, service bays, tire storage and other associated amenities. The
second floor includes a mezzanine with additional administration offices, training room, breakroom,
and a parts storage area. Access to the mezzanine will be provided via an internal stairwell and
elevator.
HOUSING IMPACT STATEMENT
The proposed project is located within an area with an Industrial land use designation and zoning,
which does not allow housing; therefore, no housing is proposed as a part of this project.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project was adequately
covered in previously adopted Mitigated Negative Declaration (IS-02-006), for the Chula Vista Auto
Park North Specific Plan adopted in June 2003. Thus, no further environmental review is required
(See Attachment 4, Mitigated Negative Declaration and Mitigation Monitoring and Reporting
Program IS-02-006).

DISCUSSION
PROJECT SITE CHARACTERISTICS:
The subject property is 6.51-acres, zoned Precise Plan Industrial (IP) and is in the southwestern
portion of Chula Vista within the Auto Park North Specific Plan. The Auto Park North Specific Plan
was adopted in June 2003 and consists of 11 parcels. The project site is Parcel 11 and is located at
the northeast corner of the intersection of Main Street and Auto Park Avenue, east of the Interstate
805 freeway. The site is undeveloped and is mostly flat with a steep slope toward the rear of the
property. The site is surrounded by automotive uses, consisting of an automotive retail use to the
west across Auto Park Avenue, automotive rentals to the north, an existing industrial building to the
east and directly south across Main Street is a vacant parcel (Attachment 1).

Project Description
The proposed two-story building is approximately 250 feet long by 165 feet wide with an overall
height of 29-feet. The building will be constructed of concrete tilt-up panels with exterior finishes
consisting of aluminum clad metal panels, stucco and decorative concrete masonry unit finishes. The
design maintains an enhanced fenestration along Main Street and a portion of the side along Auto
Park Avenue. The main entrance to the building is located at the southside of the building and is
complemented by an extension of a service canopy to the west and a new car delivery space to the
east.
The detached carwash building, located at the rear of the property, is 1,200 square feet and will be
used to wash vehicles for sale and vehicles in for service. The remainder of the parcel would be
improved with associated landscaping, access and circulation, including a designated fire lane, and
parking for customers and employees. A total of 333 parking spaces (139 standard spaces including
5 accessible spaces and 194 vehicle display spaces) would be provided for the dealership.
Architecture
The modern style architecture incorporates textural and natural materials with a combination of
stucco, decorative concrete masonry walls and aluminum clad metals. The color of the stucco and
decorative concrete masonry unit will alternate between Pelican Gray, Medium Sand and Rock Gray
paint color. The Aluminum Clad Metal Panels will vary in color from Grey, Harvest Bamboo, and
Polished Aluminum. The fenestration is a clear anodized glass with clear energy glazing along the
front and a portion of the sides of the building. Other architectural features include a flat roof with
vertical variations and recessed horizontal wall planes, and metal roll up doors for the service area
located at the center and rear of the property.

Pedestrian/Vehicle Access
There are two main vehicle ingress and egress areas and one pedestrian access on and off the site at
the northwest intersection of Auto Park Avenue. The main pedestrian link is provided from the Auto
Park Avenue cul-de-sac at the project site. Enhanced paving is provided at the main and secondary
entrance along Auto Park Avenue.

Compliance with the Auto Park North Specific Plan, Chula Vista Municipal Code and Chula
Vista Design Manual
Site Planning and Building Placement/Orientation
The Chula Vista Design Manual includes guidelines and standards for commercial uses. The
guidelines promote site planning and building placement, access, site design, building orientation,
setbacks, and enhanced building elevations along publicly visible street frontages. The proposed
features throughout the site meet the intent of the Commercial Design Guidelines as described below.

The project provides a building that is setback 142 feet from Main Street and provides an enhanced
landscape buffer to include drought tolerant ground cover, boulders and decorative gravel. The front
of the building consists of enhanced fenestrations of aluminum clad metal panels with variation in
horizontal wall planes along with enhanced fenestration design along Main Street and part of Auto
Park Avenue. The building architecture complements the adjacent auto dealerships within the area
in terms of the design and the use of materials and finishes for a cohesive modern design.
Circulation and Access
Internal access is designed to promote vehicle displays along the frontage of Main Street and Auto
Park Avenue with customer parking along the northern section of the property. The project provides
two vehicular access points to the site along Auto Park Avenue on the west side of the parcel and one
main pedestrian path located at the main entrance. The southern-most entrance provides access to
the parking area closest to the building’s main entrance; the northern entrance provides access to
the employee service and storage yard. Internal circulation is provided by a series of two-way
driveways that provide access to all points of the site. A fire lane has been designated over these
driveways surrounding the building and provides adequate access for fire and emergency
equipment.
Building Design
The Chula Vista Commercial Design Guidelines promote: A high quality innovative and imaginative
architecture. Buildings should be designed to employ variations in form, building details and siting in
order to create visual interest.
The project’s architecture is consistent with the policies of the Chula Vista Design Manual Guidelines.
The proposed modern style architecture includes variations in stucco color and decorative concrete
masonry walls, a flat roof, and enhanced fenestration along the front and portions of the sides of the
building.
According to the Chula Vista Design Guidelines, enhanced elevations should include: Varying building
elements, roof pitches, and setbacks to avoid monotony. Distinctive building elements shall be oriented
toward the street intersection. Street facing facades are required to incorporate a range of scale-
defining elements that relate larger building masses to the scale of the pedestrian. Entrances to
buildings shall be enhanced.
The proposed roofline will maintain one consistent horizontal plane at the highest point of the
building along the southside of the building and include a protruding entrance at the center of the
building, adding variation in vertical planes fronting along Main Street and Auto Park Avenue. The
proposed fenestration and modern architecture will provide distinctive visual interest to the
surrounding area.
Landscaping
The Auto Park North Specific Plan requires that at least 20% of the specific plan site be landscaped,
and the proposed project will exceed this requirement by providing a 24% landscaped area of 70,170
square feet. The parcel will be landscaped along all property lines to a depth of 11 feet with enhanced
materials to include drought tolerant ground cover with boulders and decorative gravel and paving
at the site’s street frontage, corners, entrances, and parking areas. The proposed landscape design is
consistent with the proposed streetscape.

The proposed plant palette includes a variety of palm trees, shade trees and accent trees. The Mexican
Palm trees are proposed to be located along Main Street and Auto Park Avenue; the Brisbane Box is
located internally and along the edges of the site; and the New Zealand Christmas Tree and the
Peruvian Pepper are located along the eastern and northern portions of the site. Ground covers are
distributed along the entire site combined with medium and short shrubs.
The proposed landscape design complies with the Master Landscape Plan included in the Auto Park
North Specific Plan and complies with the City Design Manual and the City Landscape Manual.
Parking
The Chula Vista Municipal Code requires 1 space per 400 square-feet for every automobile sales
facility and 1 space per 400 square-feet for every auto/repair service. With a 54,400 square-foot
automotive sales area and automotive repair and service and a 1,200 sq. ft. carwash, a total of 139
parking spaces are required. The project proposes to provide 333 open parking spaces to include 139
spaces for patrons and employees with 5 accessible spaces and 194 spaces for vehicle display.
Lighting
The Auto Park North Specific Plan requires the submittal of a lighting plan that complies with the
conditions of the Mitigated Negative Declaration Monitoring Program. The conditions of the lighting
plan require that the proposed lighting be consistent with the City’s lighting regulations and the light
does not spill onto the neighboring properties. The Applicant submitted a Photometric Plan reviewed
by staff and found to be consistent with the regulations.
Signage
The Auto Park North Specific Plan contains sign requirements. All signage must be in compliance
with the City’s sign regulations found in Chula Vista Municipal Code Section 19.60.580 as it relates to
size, height, location, and number of signs. The project proposes to include: a monument, wall,
informational and directional signage. The Applicant submitted a conceptual sign proposal for
review. Any proposed deviations from the City’s sign regulations at the time of a sign permit
submittal will require a Planned Sign Program. The Planned Sign Program will require approval by
the Planning Commission in accordance with Chula Vista Municipal Code Section 19.60.050(J).
Trash Enclosures & Recycling
Plans and specifications should be reviewed with the City’s Conservation Coordinator in order to ensure
compatibility with current refuse and recycling collection practices and to ensure compliance with
applicable waste management requirements. (Chula Vista Design Manual p. IV-7)
Staff has reviewed and approved the proposed location and size of the trash enclosures.
CONCLUSION
Staff recommends that the Planning Commission approve the Design Review based on the findings and
subject to the conditions contained in the attached Planning Commission Resolution.

DECISION-MAKER CONFLICT
Staff has reviewed the property holdings of the Planning Commission members and has found no
property holdings within 1,000 feet of the boundaries of the property which is the subject of this
action. Consequently, this item does not present a disqualifying real property-related financial
conflict of interest under California Code of Regulations Title 2, section 18705.2(a)(11), for purposes
of the Political Reform Act (Cal. Gov’t Code §87100, et seq.).
Staff is not independently aware and has not been informed by any Planning Commission member,
of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.
FISCAL IMPACT
All processing costs are borne by the Applicant, resulting in no net fiscal impact to the General Fund
or Development Services Fund.

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION APPROVING A DESIGN REVIEW PERMIT, DR20-0025,
TO CONSTRUCT A TWO-STORY, 54,400 SQUARE FOOT BUILDING
AND A DETACHED 1,200 SQUARE FOOT CARWASH FOR A MOSSY
AUTO DEALERSHIP WITH AUTO REPAIR SERVICES AND
ASSOCIATED CARWASH ON APPROXIMATELY 6.51 ACRES
LOCATED AT 1875 AUTO PARK AVENUE
WHEREAS, on December 18, 2020, a duly verified application for a Design Review
Permit was filed with the City of Chula Vista Development Services Department by the 160 Calle
Magdalena, LLC (the “Applicant”); and
WHEREAS, the application requests approval of a Design Review Permit to allow
construction of a two-story, 54,400 square foot building for a Mossy auto dealership with auto
repair services and associated 1,200 square foot carwash on approximately 6.51 acres (the
“Project”); and
WHEREAS, the area of land which is the subject of this Resolution is an existing parcel
located at 1875 Auto Park Avenue (the “Project Site”); and
WHEREAS, the Director of Development Services has reviewed the Project for
compliance with the California Environmental Quality Act (CEQA) and has determined that the
Project was adequately covered in previously adopted Mitigated Negative Declaration (IS-02-
006), for the Chula Vista Auto Park North Specific Plan. Thus, no further environmental review
is required; and
WHEREAS, the Director of Development Services set the time and place for a hearing on
the Design Review Permit application, and notice of the hearing, together with its purpose, was
given by its publication in a newspaper of general circulation in the City and its mailing to property
owners and residents within 500 feet of the exterior boundaries of the property at least 10 days
prior to the hearing; and
WHEREAS, pursuant to the California Governor’s Executive Order N-29-20 and the City
of Chula Vista Director of Emergency Services’ Emergency Order 002-B-2020, in the interest of
the public health and safety, members of the Planning Commission and staff held a hearing via
teleconference. In accordance with the orders, the public was able to view and participate in the
meeting online and not at the Council Chambers, 276 Fourth Avenue, and said hearing was
thereafter closed.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Chula Vista that it hereby makes the following findings:

1. That the proposed Project is consistent with the development regulations and design
guidelines of the Auto Park North Specific Plan and other applicable regulations
contained in the Chula Vista Municipal Code.
The Project Site is parcel 11 within the Auto Park North Specific Plan. Under the permitted
uses section of the specific plan automotive sales and ancillary automotive repairs and services
are permitted uses. The Project complies with the Auto Park North Specific Plan and Chula
Vista Municipal Code. The Applicant is proposing to build a two-story, 54,400 square foot
building for a Mossy auto dealership with auto repair services and associated 1,200 square foot
detached carwash.
Enhanced architectural features are proposed along the Main Street frontage with distinct
fenestrations. The site planning was designed to provide an accessible layout of the Project
Site for pedestrian and vehicle circulation between the Project Site and adjacent auto
dealership. The Project proposes a total of 333 parking spaces for the dealership, which
includes 194 vehicle display spaces and 139 parking spaces which are required for the
dealership and repair services. The total building height is 29 feet; the maximum building
height in accordance with the guidelines is 45 feet. The lot coverage in the Specific Plan allows
a maximum of 50% and the project is proposing a 20% lot coverage. The total floor area ratio
for a dealership within the specific plan shall not exceed 130,000 square feet, and the proposed
buildings will total 55,600 square feet. In addition, the setback requirements are in accord with
the development standards of the Auto Park North Specific Plan and the requirements of the
zone.
2. That the proposed Project is consistent with the design requirements and
recommendations contained in the Auto Park North Specific Plan and Chula Vista
Design Guidelines.
The Project proposes architectural features with a modern design by incorporating materials
with a combination of stucco, decorative concrete masonry unit, aluminum clad metal panels,
and decorative clear energy glazing glass. The building mass is articulated by horizontal and
vertical plane offsets, which provide variety and interest and are highlighted by accent colors
and materials that break up the roof line. The overall design, form and scale of the building fit
within the guidelines of the Chula Vista Design Guidelines and are complementary to adjacent
auto dealerships along Main Street.
The modern style architecture incorporates textural and natural materials with a combination
of stucco, decorative concrete masonry walls and aluminum clad metals. The color of the
stucco and decorative concrete masonry unit will alternate between Pelican Gray, Medium

BE IT FURTHER RESOLVED that the Planning Commission, based on the findings
above, hereby approves the Design Review Permit subject to the following conditions:
I. The following shall be accomplished to the satisfaction of the Director of Development
Services, or designee, prior to issuance of Building Permits, unless otherwise specified:
Planning/Environmental Division
1. The Applicant shall implement, to the satisfaction of the Director of Development Services
and the City Engineer, the mitigation measures identified in the Mitigation Monitoring and
Reporting Program (MMRP) IS-02-006 for the Project, within the timeframe specified in
the MMRP.
2. The Project Site shall be developed and maintained in accordance with the approved plans
DR20-0025, which include a Site Plan, Landscape Plans, Floor Plan, and Elevation Plan
on file in the Development Services Department, Planning Division, the conditions
contained herein, and Chula Vista Municipal Code (the “Municipal Code” or “CVMC”)
Title 19.
3. Prior to, or in conjunction with the issuance of the first Building Permit, the Applicant shall
pay all applicable fees, including any unpaid balances of permit processing fees for deposit
account DDA-0804.
4. The colors and materials specified on the Building Plans must be consistent with the colors
and materials shown on the Project plans and material board approved by the Planning
Commission.
5. A graffiti resistant treatment shall be specified for all wall and building surfaces. This shall
be noted for any Building and Wall Plans. Additionally, the Project shall conform to
CVMC Section 9.20.055 regarding graffiti control.
6. All roof appurtenances, including air conditioners and other roof mounted equipment
and/or projections, shall be shielded from view and the sound buffered from adjacent
properties and streets. Such screening shall be architecturally integrated with the building
design.
7. All ground mounted utility appurtenances such as transformers, air conditioning
condensers, etc., shall be located out of public view and adequately screened through the
use of a combination of concrete or masonry walls, berming, and/or landscaping.
8. All exterior lighting shall include shielding to remove any glare from the adjacent property.
Details for said lighting shall be included in the Architectural Plans and shall be reviewed
and approved prior to the issuance of the first Building Permit.
9. The Applicant shall obtain approval of a Sign Permit for each sign. Signs shall comply
with all applicable requirements of the Municipal Code or the Applicant shall be required
to submit a Planned Sign Program for Planning Commission review and approval.

10. The existing Groundwater Monitoring Well (MW-04) located in the northern portion of
the property shall be protected and preserved in place during all construction activities.
MW-04 is included in San Diego – Regional Water Quality Control Board (SD-RWQCB)
Cleanup and Abatement Order R9-2003-0080. This shall be noted on the
construction/grading drawings, along with MW-04 being graphically shown on the
construction/grading drawings. 160 Calle Magdalena LLC (“Owner”) shall provide
reasonable access to the consultant of Otay Mesa Ventures II, LLC, for future sampling
events and ultimately for well destruction at such time that the release case is closed by the
SD-RWQCB in the future.

12. Additional deposits or fees in accordance with the City Subdivision Manual, and Master
Fee Schedule will be required for the submittal of the following items:
a. Grading Plans
b. Construction Permit
13. Carwashes are considered one of the industries regulated by the Metropolitan Industrial
Waste Program, since they are required to pre-treat their wastes before discharging to the
Sewerage System. These businesses are required to apply for an Industrial Waste
Discharge Permit which is regulated by the City of San Diego, Metropolitan Industrial
Wastewater Control Program. Applications for a permit should be obtained from
Metropolitan Industrial Wastewater Control Program.
14. Prior to the approval of the first Building Permit, the Applicant shall submit duplicate
copies of the Project plans in digital format, such as (DXF) graphic file, on a CD or through
e-mail based on California State Plane Coordinate System (NAD 83, Zone 6) in accordance
with the City’s Guidelines for Digital Submittal. DXF file shall include a utility plan
showing any and all proposed sewer or storm drain on site.
15. The Applicant shall obtain a Land Development Permit prior to beginning any earthwork
activities at the site and before issuance of Building Permits in accordance with Municipal
Code Chapter 15.04. The Applicant shall submit Grading Plans in conformance with the
City’s Subdivision Manual and the City’s Development Storm Water Manual
requirements, including, but not limited to the following:

a. Grading Plans shall be prepared by a registered Civil Engineer and approved by the
City Engineer.
b. Drainage Study and Geotechnical/Soils Investigations are required with the first
submittal of Grading Plans. The Drainage Study shall calculate the Pre-
Development and Post-Development flows and show how downstream properties
and storm drain facilities are impacted. Design shall incorporate detention of storm
water runoff if Post-Development flows exceed Pre-Development flows; analysis
shall include flows from 2 yr., 10 yr., and 50 yr. return frequency storms.
c. Drainage Study shall also demonstrate that no property damage will occur during
the 100-year storm event.
d. Drainage Study shall show any offsite flows.
e. All onsite drainage facilities shall be private.
f. Any offsite work will require Letters of Permission from the property owner(s).
16. On May 2013, the California Regional Water Quality Control Board for the San Diego
Region reissued (SDRWQCB) a municipal storm water, National Pollutant Discharge
Elimination System permit (Municipal Separate Storm Sewer Systems Order No. R9-2013-
0001 and as amended by Order Nos R9-2015-0001 & R9-2015-0100 [MS4 Permit]) that
covered its region.
17. All construction sites are required to implement Construction Best Management Practices
(BMPs) in accordance with the performance standards outlined in Appendix K of the BMP
Design Manual. In general:
a. For projects disturbing one (1) acre or more this requires coverage under and
compliance with the Construction General Permit (CGP), the construction BMPs
must be identified in a Storm Water Pollution Prevention Plan (SWPPP).
18. A complete and accurate Notice-of-Intent (NOI) must be filed with the State Water
Resources Control Board (SWRCB) for a project covered under the General Permit for
Storm Water Discharges Associated With Construction Activity (CGP). A copy of the
acknowledgement from the SWRCB that a NOI has been received for this Project shall be
filed with the City of Chula Vista when received. Further, a copy of the completed NOI
from the SWRCB showing the Permit Number for this Project shall be filed with the City
of Chula Vista when received.
19. The Applicant shall enter into a Storm Water Management Facilities Maintenance
Agreement to perpetually maintain all permanent BMPs located within the Project prior to
issuance of any Grading, Construction or Building Permits, whichever occurs first.
20. The Applicant shall submit a detailed Operation & Maintenance (O&M) plan for all
permanent BMPs as required by the City to preserve the intended pollution control and/or
flow control performance of the BMP. Upon completion of construction of BMPs/Project,
the Applicant shall update/finalize O&M Plan to reflect constructed structural BMPs with
as-built plans and baseline photos.

21. The Project shall comply with the requirements of the National Pollutant Discharge
Elimination System (NPDES) General Permit for Storm Water Dischargers Associate with
Industrial Activities (IGP) Order 2014-0057-DWQ.
22. Improvement Plans in conformance with the City’s Subdivision Manual and a Construction
Permit will be required prior to issuance of any Building Permits. The Improvement Plan
shall include but not be limited to:
a. Removal and replacement of any broken or damaged curb, gutter, and sidewalk per
SDRSD G-2, and G-7 along the project’s frontage to the satisfaction of the City
Engineer. Sidewalk shall be designed and constructed with proper transitions to
existing conditions.
b. Installation of driveways meeting design standards as shown in Chula Vista
standard detail CVCS-1A. Dedication of R/W as needed for the driveway to
comply with American Disability Act (ADA) requirements.
c. Utilities Trenching and Restoration per CVCS-3&4.
23. Separate permits for other public utilities (gas, electric, water, cable, telephone) shall be
required, as necessary.
24. The construction and completion of all improvements and release requirements shall be
secured in accordance with CVMC Section 18.16.180.
25. The onsite sewer and storm drain system shall be private. All sewer laterals and storm
drains shall be privately maintained from each building unit to the City-maintained public
facilities.
26. All proposed sidewalks, walkways, pedestrian ramps, and disabled parking shall be
designed to meet the City of Chula Vista Design Standards, Americans with Disabilities
Act (ADA) Standards, and Title 24 standards, as applicable.
27. Any private facilities within the public right-of-way or City easement will require an
Encroachment Permit prior to Improvement Plan or Building Permit approval.
28. Prior to the approval of the first Building Permit, the Applicant shall submit full
Landscaped and Irrigation Plans for review and approval by the City’s Landscape
Architect.
29. Prior to the second submittal of the Building Permit plan set, the Applicant shall submit to
the Landscape Division, complete Landscape Improvement Plans for review and approval
by the Director of Development Services or designee. Said plans shall conform to the
following City Documents:
a. Landscape Water Conservation Ordinance (LWCO), Chapter 20.12 of the City of
Chula Vista Municipal Code;
b. City of Chula Vista Landscape Manual;
c. Shade Tree Policy (576-19);

30. Prior to the issuance of a Certification of Occupancy for the Project, the Applicant shall
have installed Landscape Improvements per the approved Landscape Improvement Plans
to the satisfaction of the Director of Development Services or designee.
Fire Department
31. The Applicant shall apply for required Building Permits. Permits shall comply with
applicable codes and requirements, including but not limited to the current edition of the
Building Code (CBC) & Fire Code (CFC), as adopted and amended by the State of
California and the City of Chula Vista.
32. Where a portion of the building is more than 400 feet from a fire hydrant on a fire apparatus
access road, as measured by an approved route around the exterior of the building, on site
fire hydrants and water mains shall be provided. A building with this large of a footprint
will require fire hydrants be positioned around it along the fire apparatus access roads to
the satisfaction of the Fire Marshall.
33. Fire hydrants shall be located and spaced in accordance with California Fire Code,
Appendix C. The average spacing of fire hydrants shall not exceed 350 feet and the
maximum distance from any point on a fire access road to a fire hydrant shall not exceed
210 feet.
34. Fire apparatus access roads shall be provided for every facility or building and shall extend
to within 150 feet of all portions of the facility and all portions of the exterior walls of the
first story of the building as measured by an approved route around the exterior of the
building. A building with this large of a footprint will require a fire apparatus access road
all the way around it.
35. Fire apparatus access road dimensions shall be a minimum of 20 feet in width and have an
unobstructed vertical clearance of 13 feet 6 inches. Use the Chula Vista Fire Department
Auto Turn Data to transpose the route of the Chula Vista Fire Department fire apparatus
along designated fire apparatus access roads.
36. Dead end fire apparatus access roads in excess of 150 feet in length shall be provided with
an approved area for turning around fire apparatus.
II. The following on-going conditions shall apply to the Project Site as long as it relies on this
approval:
37. The Applicant shall install all landscaping and hardscape improvements in accordance with
the approved Landscape Plan.
38. Approval of the Design Review Permit shall not waive compliance with any sections of
Title 19 of the Municipal Code, nor any other applicable laws and regulations in effect at
the time of Building Permit issuance.

39. The Property Owner and Applicant shall and do agree to indemnify, protect, defend and
hold harmless City, its City Council members, Planning Commission members, officers,
employees and representatives, from and against any and all liabilities, losses, damages,
demands, claims and costs, including court costs and attorney’s fees (collectively,
liabilities) incurred by the City arising, directly or indirectly, from (a) City’s approval and
issuance of this Design Review Permit, (b) City’s approval or issuance of any other permit
or action, whether discretionary or non-discretionary, in connection with the use
contemplated on the Project Site and (c) any environmental determinations for the Project.
The Property Owner and Applicant shall acknowledge their agreement to this provision by
executing a copy of this Design Review Permit where indicated below. The Property
Owner’s and Applicant’s compliance with this provision shall be binding on any and all of
the Property Owner’s and Applicant’s successors and assigns.
40. This Design Review Permit shall become void and ineffective if not utilized within three
years from the effective date thereof, in accordance with CVMC Section 19.14.600.
III. GOVERNMENT CODE SECTION 66020(d)(1) NOTICE
Pursuant to Government Code Section 66020(d) (1), NOTICE IS HEREBY GIVEN
that the 90 day period to protest the imposition of any impact fee, dedication,
reservation, or other exaction described in this resolution begins on the effective date
of this resolution and any such protest must be in a manner that complies with
Government Code Section 66020(a) and failure to timely follow this procedure will bar
any subsequent legal action to attack, review, set aside, void or annul imposition. The
right to protest the fees, dedications, reservations, or other exactions does not apply to
planning, zoning, grading, or other similar application processing fees or service fees
in connection with this project; and it does not apply to any fees, dedication,
reservations, or other exactions which have been given notice similar to this, nor does
it revive challenges to any fees for which the statute of limitations has previously
expired.

IV. EXECUTION OF RESOLUTION OF APPROVAL
The Property Owner and Applicant shall execute this document signing on the lines
provided below, indicating that the Property Owner and Applicant have each read,
understood and agreed to the conditions contained herein, and will implement same. Upon
execution, this document shall be signed and returned to the City’s Development Services
Department.

V. CONSEQUENCE OF FAILURE OF CONDITIONS
If any of the foregoing conditions fail to occur, or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so implemented
and maintained according to their terms, the City shall have the right to revoke or modify all
approvals herein granted, deny, or further condition issuance of all future building permits,
deny, revoke, or further condition all certificates of occupancy issued under the authority of
approvals herein granted, institute and prosecute litigation to compel their compliance with
said conditions or seek damages for their violation. Failure to satisfy the conditions of this
permit may also result in the imposition of civil or criminal penalties.
VI. INVALIDITY; AUTOMATIC REVOCATION
It is the intention of the Planning Commission that its adoption of this Resolution is
dependent upon the enforceability of each and every term, provision and condition herein
stated; and that in the event that any one or more terms, provisions or conditions are
determined by a Court of competent jurisdiction to be invalid, illegal or unenforceable, this
resolution and the permit shall be deemed to be automatically revoked and of no further force
and effect.

REGULAR MEETING OF THE PLANNING COMMISSION
Meeting Minutes
May 26, 2021, 6:00 p.m.

Present: Commissioner Burroughs, Commissioner De La Rosa,
Commissioner Milburn, Commissioner Nava, Commissioner
Torres, Vice Chair Zaker, Chair Gutierrez
Also Present: Director Development Services Allen, Assistant Director Black,
Deputy City Attorney Shirey, Secretary Salvacion
Others Present Project Manager Kurz
Pursuant to the Governor of the State of California's Executive Order N-29-20, and in
the interest of public health and safety during the COVID -19 pandemic, members of the
Planning Commission and staff participated in this meeting via teleconference. All votes
were taken by roll call.

1. CALL TO ORDER
A regular meeting of the Planning Commission of the City of Chula Vista wa s
called to order at 6:01 p.m. via teleconference.
2. ROLL CALL
Secretary Salvacion called the roll at 6:02 p.m.
3. PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE
Vice-Chair Zaker led the Pledge of Allegiance.

4. PUBLIC COMMENTS
Chair Gutierrez called for a two-minute pause to allow members of the public to
submit any final electronic comments. Secretary Salvacion announced that no
electronic comments had been received and no comments had been received via
email.
5. PUBLIC HEARINGS
Notice of the hearing was given in accordance with legal requirements, and the
hearing was held on the date and no earlier than the specified in the notice.
5.1 Proposed Amendments to Otay Ranch Village 3 to Include the
“Flatrock” Parcel and Rezone Three Parcels of Land to Residential
Uses
Project Manager Kurz gave a presentation on the item and answered and
answered questions of the Commission.
Chair Gutierrez opened the public hearing and called for a four-minute
pause to allow members of the public to submit electronic comments on
the item. Secretary Salvacion announced that no electronic comments
had been received and no comments had been received via email
There being no members of the public who wished to submit a comment,
Chair Gutierrez closed the public hearing.

OTHER BUSINESS
7. STAFF COMMENTS
Development Services Director Allen mentioned that the first new project on the
Bayfront, Sun Communities RV Resort, is now open.
8. CHAIR'S COMMENTS
Chair Gutierrez mentioned that it would be beneficial if staff could inform the
Commission what trends are local as well as larger regional trends.
9. COMMISSIONERS' COMMENTS
The Commission asked that at a future meeting, if staff could provide an update
on the Bayfront development and other projects that have been approved by the
Commission.
10. ADJOURNMENT
The meeting was adjourned at 7:50 p.m.
