HomeMy WebLinkAboutReso 2021-086RESOLUTION NO. 2021-086 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE SECOND AMENDMENT TO THE CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND KIMLEY-HORN AND ASSOCIATES, INC. INCREASING THE NOT-TO-EXCEED AMOUNTS AND ADDING SUBCONSULTANTS WHEREAS, City of Chula Vista (City) and Kimley-Horn and Associates (KHA) are parties in the City of Chula Vista Consultant Services Agreement with Kimley-Horn and Associates, Inc. to Provide Civil Engineering Consulting Services for Various Capital Improvement Program Projects, dated November 1, 2017 (“Agreement”); and WHEREAS, the Agreement is an on-call contract with an original term of two (2) years with options to extend the Agreement for two (2) additional one-year periods; and WHEREAS, KHA is currently in the second option term under the Agreement, which has an annual not-to-exceed dollar limit of $500,000; and WHEREAS, on September 8, 2020, Department of Engineering and Capital Projects’ staff issued a Request for Proposal to the City’s Civil Engineering on-call consultants for the design of the Telegraph Canyon Channel Improvements (DRN0208) project (“Project”); and WHEREAS, KHA was selected as the design consultant for the Project and the parties negotiated a proposed price of $793,631 to complete design and related services for the Project, which is in excess of the annual not-to-exceed limit of $500,000 for the current term of the Agreement; and WHEREAS, in order to allow the City to proceed with necessary design, right-of-way acquisition, environmental permitting, and grant application submissions for the Project, City staff recommends approving the second amendment to the Agreement to increase the annual not-to- exceed amount for the current term of the Agreement by $800,000, for a new annual not-to-exceed amount for the current term of $1,300,000, and increasing the total Agreement not-to-exceed amount to $3,050,000; and WHEREAS, the proposed second amendment to the Agreement would also allow additional subconsultants to perform services necessary for the design, right-of-way acquisition, environmental permitting, and grant application submissions for the Project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it approves the Second Amendment to the Consultant Services Agreement between the City of Chula Vista and Kimley-Horn and Associates, in the form presented, with such modifications as approved or required by the City Attorney, and authorizes and directs the Mayor to execute the same, a copy of which shall be kept on file in the office of the City Clerk.
