SUMMARY
Effective August 18,2011,the City of Chula Vista,under Chula Vista Municipal Cede(CVMC) Section 9.50.030,
established an Administrative Fee to be assessed upon all eligible mobilehome residents receiving benefits
and services under CVMC 9.150 ("Chapter 9.150" or the "Ordinance") Molbile ohne Park(Space Rent Review..
Chapter 91.50, requires that the Administrative Fee be established annually by action of the City Council. on
May 28,2020,the City Council voted to lower the fee to$12. At this time,staff recommends retaining the fee
at 12 for Fiscal Year 2021-I22 "F"Y 22").

On January 21, 2021, the Mobilehome Rent Review Commission recommended retaining the fee at 1$12 for
Fiscal Year 2021.22 (TY 22").
DISCUSSION
On.July 19,2011,City Council approved an amendment to CVMC Chapter 9.50 Mobilehoe Park Space Rent
Reviewestablishing an Administrative Fee to provide funding for implementation of the Ordinance.Chapter
9.50 offers unique benefits and services solely to eligible mobilehome residents. As part of the annual
Administrative Fee update process, staff is reporting out on prior year revenues and expenditures to
establish the amount necessary to recover the costs of administering Chapter 9.50. This report provides an
update on revenues and expenditures for FY21 and recommends the fee for FY I.

Fiscal Year 2 012-21 ("FY 211 Proiected Revenues and Expenditures
Revenues for FY 21 were anticipated to total $55,0�O�O based on 2,20residents paying a fee of$25. Per City
Council direction, due to the economic hardships many within the community were facing and continue to
experience as a result of the COVID-19 Pandemic, the fee was reduced to $12 per space for FY 21. Actual
payments were received from 2,390 eligible spaces,for a total of$28,680 in collected revenues.The increase
in residents paying the fee was 9 percent (9%) or 190 additional residents. A summary of revenues and
projected expenditures,is provided in Table 1,followed by a description of related activities.

Administration of Chapter 9.50 is projected to result in staff charges of$45,691 for FY 21. Staff provided the
following services-.
0 Ombudsman Activities(Office Visits&Mobileh,ome Information Line)-The increase in staff charges was
the result of the need to develop and implement new customer service practices in response to the
closure of public offices due to COVID-19. The City responded with additional services to the residents
which included: informational mailers, a new convenient on-line payment option; and continuous
phone line updates;thus,increasing staff hours dedicated tot e program. These new practices allowed
the City to continue and improve on the services to mobilehome residents. Public inquiries are
particularly high the months, leading up to the billing of the Administrative Fee until October when all
billing and eligibility issues are resolved.
• Resident Invoicing Preparation - A June 1st billing and/or ineligible notice was sent to all
mobilehome/trailer residents and in August,reminder notices were sent to all residents with a balance
due and to those residents determined ineligible.
• Fee Collection -Collection and processing of fee payments received.
• Database Maintenance - Maintained the database with current resident information. Fees associated
with reconciling a new financial system and existing database were incurred this year resulting in
higher than expected administrative costs.
• Mobilehom,e Rent Review Commission ("MHRRC')Educational Meetings- Provided general ombudsman

related activities to residents.Due to COVID-19,the MHRRC's regularly scheduled meeting for April 16,
2020 was canceled. The MHRRC did meet virtually on January 21, 2021 to consider the Mobilehome
Administrative Fee and to receive updates on relevant housing and mobilehome issues.
Annual Permissive Rent Calculations - Twice a year, the Consumer Price Index (CPI) is released and
notification was sent to all park owners and managers of the annual permissive rate, as calculated
under Section 9.50.050.
Rent Review In Administration - Staff coordinated inquiries regarding rental increases
between residents and park management as needed.
Experts
No rent review hearings or hiring of experts was necessary during F'Y 21.. Funds collected remain in the fund
balance and are available to appropriate in FY 22 for hiring of experts if a rent review case is required

In FY 21,the billing of the administrative fee continues to be contracted out.Additional annual administrative
costs,including CPI notices and publication of this hearing notice were incurred.

Staff recommends the annual fee be retained at$12 dollars (equating to $1 per month) for FY 22 due to the
current fund balance,lack of recent rent review hearing activity,and the continuing financial impacts to the
community as a result of COVID-19. Important factors taken into consideration include the following:
• Since the Ordinance amendments in 2012, no rent review cases were considered by the MI IAC.
However,two rent review cases began the process (Rancho Bonita in FY15 and El Mirador in FY18),
which in turn required a higher level of staff resources during these time frames to work through the
rent review process until final resolution. Eventually a voluntary agreement was reached in both cases.,
Therefore,staff continues to forecast expenditures with one case every other year,should a need arise.
While California recently passed statewide rent control for residential tenants effective January 1,
2020, mobilehome residents are exempt from this law. Therefore, mobilehome residents rely solely
on the City's Mobilehome Rent Review Ordinance for protection on related rent increases.
• Staff anticipates costs to administer the fee and rent review services have stabilized. 'This was achieved
through updating the Housing website to include additional resources and information, providing an
on-line option for payments, and providing a helpful resource list with last year's billing of the
Administrative Fee mailing.
0 Given the economic impact of COVID-19,programs providing a level of rent protection are needed and
the lower fee may encourage additional residents to participate in the program.Therefore,projections
are kept consistent with last year at approximately 2,200 residents paying the Administrative Fee for
the coming year.
Table 2 provides a summary of the FY 22 budget totaling$65,000,which anticipates one rent review case,if
required, and a contingency of$25,000 for expert time. Even with a reduced administrative fee of$12 per
year,there is a sufficient existing fund balance available for implementation of the Ordinance.The estimated
ending fund balance for FY 21 is anticipated at$208,315.

Conclusion
Given current workload,the lack of recent rent review cases,and adequate fund balance,maintaining the fee
at $12 per year for eligible mobilehome residents is recommended to maintain administrative services for
implementation of Chapter 9.50. Should a rent review case be initiated during FY 22, the existing fund
balance and the Administrative Fee is sufficient to cover the associated and anticipated heavy administrative
costs and still maintain a high level of service to mobilehome residents.
At the conclusion of the program year,staff will again reevaluate the revenues and expenditures to determine
if a reduction in the fees is feasible at that time. This determination will be presented by May of 2022.

WHEREAS, California State Mobilehome Residency Law allows local jurisdictions to
establish rent control; and.
WHEREAS, in 1982, the City adopted Chula vista Municipal Code (CVMC") Chapter
.50, "Mobilehome Park Space Rent Review," as allowed by Mobilebome Residency Law, and
amended it to its current state on.July 19, X111; and
WHEREAS, these amendments took effect August 18, 2011 and established an.
administrative fee to provide a limited segment of the public, specifically mobilehome residents,
per CVMC Section 9.50.030, the ability to obtain unique services and benefits available to them.
only under Chapter 9.50, including,but not limited to, a rent calculation (via the annual permissive
rent increase and exceeding the annual permissive) which results in reduced rents and related
ombudsman services; and
WHEREAS, on February 14, 2012, the City adopted "Mobilehome Park Space - Rent
Review Administrative Fee Regulations" establishing a process for determining and collecting
such fee; and
WHEREAS, the proposed fee does not exceed the estimated reasonable cost of providing
the associated services and the fund balance of the fee and estimated revenues for fiscal year 2021
22 are sufficient to warrant maintaining the fee rate at $12 for the coming year; and
WHEREAS, Article XIII C of the + a.li.fomia. Constitution requires a.vote of the electorate
to increase any levy, charge, or exaction imposed by a local government, unless specifically
exempted; and
WHEREAS,pursuant to the provisions of Article XII C,the proposed fees are exempt from
the vote requirement; and
WHEREAS, the proposed amendment to the blaster Fee Schedule Chapter 1
(Mobi,lehomes) shall.become effective upon adoption of this Resolution by the City Council.

SIJMMARY
Staff recommends approval of a second amendment to the City's on:-call consultant agreement with Kimley-
Horn.and associates, Inc. (KHA) for engineering services to allow the City to proceed with necessary design,
alternative analysis,right-of-way acquisition,and environmental permitting in furtherance of'the Telegraph
Canyon Drainage Channel project CIP No. DRNo o8). In order to fund the proposed second amendment,
City Staff recommends appropriating$3,927,518 from the Drainage DIF Fund to DRN02,08.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance with the California
Environmental Quality pct (CEQA) and has determined that the activity is not a "Project" as defined under
Section 15378 of the State CEQA Guidelines because the activity consists of a funding/administrative activity
which does not result in a physical change in the environment;therefore,pursuant to Section 1500c) 3) of
the State CEQA Guidelines the activity is not subject to CEQA. Although environmental review is not
necessary at this time, once projects have been defined, environmental review will be required and a CEQA
determination completed prior to commencement of the projects.In addition,notwithstanding the foregoing,
the Director of Development Services has also determined that the activity qualifies for an Exemption
pursuant to Section 15 061(b)(3) of the California Environmental Quality Act State Guidelines. "thus, no
environmental review is required.

DISCUSSION
In 1990, a Telegraph Canyon Drainage Channel Plan (Plan) identified drainage facilities necessary to
accommodate the surface and storm water runoff resulting from development of properties within the basin.
The Plan and Telegraph Canyon Drainage Development Impact Fee (DIF') were adopted and established
respectively by the City Council on August 7, 1990 by adoption of Ordinance 2384., Most of the drainage
facilities identified in the Plan have been completed. A Plan update was needed to verify the remaining
improvements using current hydrologic data. The updated"Telegraph Canyon Channel Nexus Study" (Study)
was completed on November 2,4, 2015. The Study identified the remaining drainage improvements needed
within the Telegraph Canyon Drainage DIF. These improvements were identified as being insufficiently sized
to convey 100-,year design storm flows.
On September 8, 2020, the Department of Engineering and Capital Projects" staff issued a Request for
Proposal to the City's Civil Engineering on-call consultants for the validation of the 30%design,an alternative
analysis and to further the design of the DI No project. Kimley Horn and Associates was selected as the
design consultant for the project and the parties negotiated a proposed price of$793,631 to complete design
services for the project. It is preliminarily estimated that it will cost more than $12 million to complete
design, acquire right of way, perform environmental studies, attain permits, and to construct the project.
Staff is planning on submitting several grant applications to supplement the cost for constructing the
improvements in the Telegraph Canyon Channel. Due to limited funding for construction and the trend to
award grants in smaller amounts, staff anticipate a need to prioritize and phase the construction of the
project into segments.
Current available funds(approx.$343,329)are only sufficient to perform an alternative analysis and manage
grant applications, but not enough to further design and carry the required tasks into construction.
Appropriating the available Drainage DIF funds ($3,927,518) would allow City Staff to complete the design,
right-of-,way coordination/acquisition, environmental clearance, and would allow staff to submit grant
applications since many require a local match in funds.
Furthermore, in order to award the design for the DRN0208, project to, Kimley Horn and Associates, Inc.
(KHA ,the annual not-to-exceed limit of$500,000 under the KHA's on-call contract will need to be increased.
As such, in addition to the recommended appropriation of funds, staff recommends approving a second
amendment to the City),s on-call agreement with ITA to allow the City to proceed with the necessary design,
alternative analysis, right-of-way acquisition, and environmental permitting in furtherance of the project.
The amendment would also clarify that the project work could be completed beyond the current term and
would allow additional subconsultants to provide services and perform work on the project.

Staff has reviewed the property holdings of the City Council members and has found no property holding S
within 1,00O feet of the boundaries of the property which is the subject of this action.Consequently,this item
does not present a disqualifying real property-related financial conflict of interest under California Code of

Regulations Title 2, section 18702.2(a)(7) or (8), for purposes of the Political Reform Act (Cal. Gov't Code
§87100,et seq.).

CURREN'T-YE,AR FISCAL IMPACT
Approval of Resolution A will appropriate $3,927,518 from the Drainage DIF to RN0208 for design,
environmental permitting, right of way acquisition,, and construction costs associated with theTelegraph
Canyon Channel. Sufficient funds are available for said appropriation; therefore, this is no direct impact to
the Drainage DIF Fund.
For Resolution B,, all fees for Consultant's services will be paid from funds in CIP DRN0208., The two-year
agreement is eligible for two one-year extensions upon mutual agreement and is currently in the second
extension. The preliminarily estimated cost of DR 0208 is over $12 million and City Staff will need
assistance from the Consultant for planning and coordinating grant applications to supplement available
funds.
ONGOING FISCAL IMPACT
Upon completion of the project,the improvements will require routine maintenance.

WITH;KIMLEY-HORN AND ASSOCIATES, INC.
TO PROVIDE.CIVIL ENGINEERING CONSULTING SERVICES FOR VARIOUS CAPITAL
IMPROVEMENT PROGRAM PROJECTS
This Agreement is entered into effective as of November 1, 2017, or when approved by the City Council of the
City of Chula Vista, whichever is later ("Effective Date") by and between the City of Chula Vista, a chartered
municipal corporation ("City") and Kimley-Horn and Associates, Inc., a North Carolina corporation)
("Consultant") (collectively, the"Parties" and, individually, a"Party")with reference to the following facts:
RECITALS
WHEREAS, the City desires to procure qualified civil engineering services to assist the City's civil
engineering design staff due to the current number and pace of Capital Improvement Program projects and the
proposed large infrastructure effort associated with the recently voter approved Measure P in Chula Vista; and
WHE RE AS,on June 9, 2017, the City issued a Request for Proposal (RFP) for Civil Engineering
Consulting Services; and,
WHEREAS,the City of Chula Vista received thirteen (13) proposals from firms interested in providing
Civil Engineering services; and,
WHE RE AS,after the City completed its review of the proposals seven (7) firms were selected for
interviews in July 2017; and,
WHEREAS, after the interview process for all seven (7) firms, the consultant selection committee
determined KIMLEY-HORN AND ASSOCIATES, INC., as one of the four best qualified Consultants to
provide the services described in the Agreement; and,
WHEREAS,the consultant selection process has been conducted in accordance with Section 2.56.1100
of the Chula Vista Municipal Code; and
and
WHEREAS, Consultant warrants and represents that it is experienced and staffed in a manner such that
it can deliver the services required of Consultant to City in accordance with the time frames and the terms and
conditions of this Agreement.

OBLIGATORY PROVISIONS
NOW, THEREFORE, in consideration of the above recitals, the covenants contained herein, and other
good and valuable consideration, the receipt and sufficiency of which the Parties hereby acknowledge, City and
Consultant hereby agree as follows:
1. SERVICES
1.1 Required Services. Consultant agrees to perform the services, and deliver to City the "Deliverables"
(if any) described in the attached Exhibit A, incorporated into the Agreement by this reference, within the
time frames set forth therein, time being of the essence for this Agreement. The services and/or Deliverables
described in Exhibit A shall be referred to herein as the "Required Services."
1.2 Reductions in Scope of work. City may independently, or upon request from Consultant, from time
to time, reduce the Required Services to be performed by the Consultant under this Agreement. Upon doing
so, City and Consultant agree to meet and confer in good faith for the purpose of negotiating a
corresponding reduction in the compensation associated with the reduction.
1.3 Additional Services. Subject to compliance with the City's Charter, codes, policies, procedures and
ordinances governing procurement and purchasing authority, City may request Consultant provide
additional services related to the Required Services ("Additional Services"). If so, City and Consultant
agree to meet and confer in good faith for the purpose of negotiating an amendment to Exhibit A, to add the
Additional Services. Unless otherwise agreed, compensation for the Additional Services shall be charged
and paid consistent with the rates and terms already provided therein. Once added to Exhibit A, "Additional
Services" shall also become "Required Services" for purposes of this Agreement.
1.4 Standard of Care. Consultant expressly warrants and agrees that any and all Required Services
hereunder shall be performed in accordance with the standard of care exercised by members of the
profession currently practicing under similar conditions and in similar locations.
1.5 No Waiver of Standard of Care. Where approval by City is required, it is understood to be
conceptual approval only and does not relieve the Consultant of responsibility for complying with all laws,
codes, industry standards, and liability for damages caused by negligent acts, errors, omissions,
noncompliance with industry standards, or the willful misconduct of the Consultant or its subcontractors.
1.5 Security for Performance. In the event that Exhibit A Section 4 indicates the need for Consultant to
provide additional security for performance of its duties under this Agreement, Consultant shall provide
such additional security prior to commencement of its Required Services in the form and on the terms
prescribed on Exhibit A, or as otherwise prescribed by the City Attorney.
1.7 Compliance with Laws. In its performance of the Required Services, Consultant shall comply with
any and all applicable federal, state and local laws, including the Chula Vista Municipal Code.
1.8 Business License. Prior to commencement of work, Consultant shall obtain a business license from
City.
1.9 Subcontractors. Prior to commencement of any work, Consultant shall submit for City's information
and approval a list of any and all subcontractors to be used by Consultant in the performance of the
Required Services. Consultant agrees to take appropriate measures necessary to ensure that all

subcontractors and personnel utilized by the Consultant to complete its obligations under this Agreement
comply with all applicable laws, regulations, ordinances, and policies, whether federal, state, or local. In
addition, if any subcontractor is expected to fulfill any responsibilities of the Consultant under this
Agreement, Consultant shall ensure that each and every subcontractor carries out the Consultant's
responsibilities as set forth in this Agreement.
1.10 Term. This Agreement shall commence on the earlier to occur of the Effective Date or Consultant's
commencement of the Required Services hereunder, and shall terminate when the Parties have complied
with all their obligations hereunder; provided, however, provisions which expressly survive termination
shall remain in effect.
2. COMPENSATION
2.1 General. For satisfactory performance of the Required Services, City agrees to compensate
Consultant in the amount(s) and on the terms set forth in Exhibit A, Section 4. Standard terms for billing
and payment are set forth in this Section 2.
2.2 Detailed Invoicing. Consultant agrees to provide City with a detailed invoice for services performed
each month, within thirty (30) days of the end of the month in which the services were performed, unless
otherwise specified in Exhibit A. Invoicing shall begin on the first of the month following the Effective
Date of the Agreement. All charges must be presented in a line item format with each task separately
explained in reasonable detail. Each invoice shall include the current monthly amount being billed, the
amount invoiced to date, and the remaining amount available under any approved budget. Consultant must
obtain prior written authorization from City for any fees or expenses that exceed the estimated budget.
2.3 Payment to Consultant. Upon receipt of a properly prepared invoice and confirmation that the
Required Services detailed in the invoice have been satisfactorily performed, City shall pay Consultant for
the invoice amount within thirty (30) days. Payment shall be made in accordance with the terms and
conditions set forth in Exhibit A and section 2.4, below. At City's discretion, invoices not timely submitted
may be subject to a penalty of up to five percent(5%) of the amount invoiced.
2.4 Retention Pol�cy�. City shall retain ten percent (10%) of the amount due for Required Services
detailed on each invoice (the "holdback amount"). Upon City review and determination of Project
Completion, the holdback amount will be issued to Consultant.
2.5 Reimbursement of Costs. City may reimburse Consultant's out-of-pocket costs incurred by
Consultant in the performance of the Required Services if negotiated in advance and included in Exhibit A.
Unless specifically provided in Exhibit A, Consultant shall be responsible for any and all out-of-pocket
costs incurred by Consultant in the performance of the Required Services.
2. Exclusions. City shall not be responsible for payment to Consultant for any fees or costs in excess
of any agreed upon budget, rate or other maximum amount(s)provided for in Exhibit A. City shall also not
be responsible for any cost: (a) incurred prior to the Effective Date; or (b) arising out of or related to the
errors, omissions, negligence or acts of willful misconduct of Consultant, its agents, employees, or
subcontractors.
2.7 Payment Not Final-App oval. Consultant understands and agrees that payment to the Consultant or
reimbursement for any Consultant costs related to the performance of Required Services does not constitute
a City final decision regarding whether such payment or cost reimbursement is allowable and eligible for

payment under this Agreement, nor does it constitute a waiver of any violation by Consultant of the terms of
this Agreement. If City determines that Consultant is not entitled to receive any amount of compensation
already paid, City will notify Consultant in writing and Consultant shall promptly return such amount.
3. INSURANCE
3.1 Required Insurance. Consultant must procure and maintain, during the period of performance of
Required Services under this Agreement, and for twelve months after completion of Required Services, the
policies of insurance described on the attached Exhibit B, incorporated into the Agreement by this reference
(the "Required Insurance"). The Required Insurance shall also comply with all other terms of this Section.
3.2 Deductibles and Self-Insured Retentions. Any deductibles or self-insured retentions relating to the
Required Insurance must be disclosed to and approved by City in advance of the commencement of work.
3.3 Standards for Insurers. Required Insurance must be placed with licensed insurers admitted to
transact business in the State of California with a current A.M. Best's rating of A V or better, or, if
insurance is placed with a surplus lines insurer, insurer must be listed on the State of California List of
Eligible Surplus Lines Insurers (LESLI) with a current A.M. Best's rating of no less than A X. For
Workers' Compensation Insurance, insurance issued by the State Compensation Fund is also acceptable.
3.4 Subcontractors. Consultant must include all sub-consultants/sub-contractors as insureds under its
policies and/or furnish separate certificates and endorsements demonstrating separate coverage for those not
under its policies. Any separate coverage for sub-consultants must also comply with the terms of this
Agreement.
3.5 Additional Insureds. City, its officers, officials, employees, agents, and volunteers must be named as
additional insureds with respect to any policy of general liability, automobile, or pollution insurance
specified as required in Exhibit B or as may otherwise be specified by City's Risk Manager.. The general
liability additional insured coverage must be provided in the form of an endorsement to the Consultant's
insurance using ISG CG 2010 (11/85) or its equivalent; such endorsement must not exclude
Products/Completed Operations coverage.
3.6 General Liability Coverage to be "Primary." Consultant's general liability coverage must be primary
insurance as it pertains to the City, its officers, officials, employees, agents, and volunteers. Any insurance
or self-insurance maintained by the City, its officers, officials, employees, or volunteers is wholly separate
from the insurance provided by Consultant and in no way relieves Consultant from its responsibility to
provide insurance.
3.7 No Cancellation. No Required Insurance policy may be canceled by either Party during the required
insured period under this Agreement, except after thirty days' prior written notice to the City by certified
mail, return receipt requested: Prior to the effective date of any such cancellation Consultant must procure
and put into effect equivalent coverage(s).
3.8 Waiver of Subrogation. Consultant's insurer(s) will provide a Waiver of Subrogation in favor of the
City for each Required Insurance policy under this Agreement. In addition, Consultant waives any right it
may have or may obtain to subrogation for a claim against City.
3.9 Verification of Coverage. Prior to commencement of any work, Consultant shall furnish City with
original certificates of insurance and any amendatory endorsements necessary to demonstrate to City that

Consultant has obtained the Required Insurance in compliance with the terms of this Agreement. The
words "will endeavor" and"but failure to mail such notice shall impose no obligation or liability of any kind
upon the company, its agents, or representatives" or any similar language must be deleted from all
certificates. The required certificates and endorsements should otherwise be on industry standard forms.
The City reserves the right to require, at any time, complete, certified copies of all required insurance
policies, including endorsements evidencing the coverage required by these specifications.
3.10 Claims Made Policy Requirements. If General Liability, Pollution and/or Asbestos Pollution
Liability and/or Errors & Omissions coverage are required and are provided on a claims-made farm, the
following requirements also apply:
a. The "Retro Date" must be shown, and must be before the date of this Agreement or the
beginning of the work required by this Agreement.
b. Insurance must be maintained, and evidence of insurance must be provided, for at least five (5)
years after completion of the work required by this Agreement.
c. If coverage is canceled or non-renewed, and not replaced with another claims-made policy form
with a "Retro Date" prior to the effective date of this Agreement, the Consultant must purchase "extended
reporting" coverage for a minimum of five (5) years after completion of the work required by this
Agreement.
d. A copy of the claims reporting requirements must be submitted to the City for review.
3.11 Not a Limitation of Other Obligations. Insurance provisions under this section shall not be
construed to limit the Consultant's obligations under this Agreement, including Indemnity.
3.12 Additional Coverage. To the extent that insurance coverage provided by Consultant maintains
higher limits than the minimums appearing in Exhibit B. City requires and shall be entitled to coverage for
higher limits maintained.
4. INDEMNIFICATION
4.1. General. To the maximum extent allowed by law, Consultant shall protect, defend, indemnify and
hold harmless City, its elected and appointed officers, agents, employees and volunteers (collectively,
"Indemnified Parties"), from and against any and all claims, demands, causes of action, costs, expenses,
(including reasonable attorneys' fees and court costs), liability, loss, damage or injury, in law or equity, to
property or persons, including wrongful death, in any manner arising out of or incident to any alleged acts,
omissions, negligence, or willful misconduct of Consultant, its officials, officers, employees, agents, and
contractors, arising out of or in connection with the performance of the Required Services, the results of
such performance, or this Agreement. This indemnity provision does not include any claims,. damages,
liability, costs and expenses arising from the sole negligence or willful misconduct of the Indemnified
Parties. Also covered is liability arising from, connected with, caused by or claimed to be caused by the
active or passive negligent acts or omissions of the Indemnified Parties which may be in combination with
the active or passive negligent acts or omissions of the Consultant, its employees, agents or officers, or any
third party.
4.2. Modified Indemnity where Agreement Involves Design Professional Services. Notwithstanding the
forgoing, if the services provided under this Agreement are design professional services, as defined by

California Civil Code section 2782.5, as may be amended from time to time, the defense and indemnity
obligation under Section 1, above, shall be limited to the extent required by California Civil Code section
2782.8.
4.3 Costs of Defense and Award. Included in Consultant's obligations under this Section 4 is
Consultant's obligation to defend, at Consultant's own cost, expense and risk, any and all suits, actions or
other legal proceedings that may be brought or instituted against one or more of the Indemnified Parties.
Subject to the limitations in this Section 4, Consultant shall pay and satisfy any judgment, award or decree
that may be rendered against one or more of the Indemnified Parties for any and all related legal expenses
and costs incurred by any of them.
4.4. Consultant's Obligations Not Limited or Modified. Consultant's obligations under this Section 4
shall not be limited to insurance proceeds, if any, received by the Indemnified Parties, or by any prior or
subsequent declaration by the Consultant. Furthermore, Consultant's obligations under this Section 4 shall
in no way limit, modify or excuse any of Consultant's other obligations or duties under this Agreement.
4.5. Enforcement Costs. Consultant agrees to pay any and all costs City incurs in enforcing Consultant's
obligations under this Section 4.
4.6 Survival. Consultant's obligations under this Section 4 shall survive the termination of this
Agreement.
5. FINANCIAL INTERESTS of CONSULTANT.
5.1 Form 700 Filing. The California Political Reform Act and the Chula Vista Conflict of Interest Code
require certain government officials and consultants performing work for government agencies to publicly
disclose certain of their personal assets and income using a Statement of Economic Interests form (Form
700). In order to assure compliance with these requirements, Consultant shall comply with the disclosure
requirements identified in the attached Exhibit C, incorporated into the Agreement by this reference.
5.2 Disclosures; Prohibited Interests. Independent of whether Consultant is required to file a Form 700,
Consultant warrants and represents that it has disclosed to City any economic interests held by Consultant,
or its employees or subcontractors who will be performing the Required Services, in any real property or
project which is the subject of this Agreement. Consultant warrants and represents that it has not employed
or retained any company or person, other than a bona fide employee or approved subcontractor working
solely for Consultant, to solicit or secure this Agreement. Further, Consultant warrants and represents that it
has not paid or agreed to pay any company or person, other than a bona fide employee or approved
subcontractor working solely for Consultant, any fee, commission, percentage, brokerage fee, gift or other
consideration contingent upon or resulting from the award or making of this Agreement. Consultant further
warrants and represents that no officer or employee -of City, has any interest, whether contractual, non-
contractual, financial or otherwise, in this transaction, the proceeds hereof, or in the business of Consultant
or Consultant's subcontractors. Consultant further agrees to notify City in the event any such interest is
discovered whether or not such interest is prohibited by lave or this Agreement. For breach or violation of
any of these warranties, City shall have the right to rescind this Agreement without liability.
6. REMEDIES

6.1 Termination for Cause. If for any reason whatsoever Consultant shall fail to perform the Required
Services under this Agreement, in a proper or timely manner, or if Consultant shall violate any of the other
covenants, agreements or conditions of this Agreement (each a "Default"), in addition to any and all other
rights and remedies City may have under this Agreement, at law or in equity, City shall have the right to
terminate this Agreement by giving five (5) days written notice to Consultant. Such notice shall identify the
Default and the Agreement termination date. If Consultant notifies City of its intent to cure such Default
prior to City's specified termination date, and City agrees that the specified Default is capable of being
cured, City may grant Consultant up to ten (10) additional days after the designated termination date to
effectuate such cure. In the event of a termination under this Section 6.1, Consultant shall immediately
provide City any and all "work Product" (defined in Section 7 below) prepared by Consultant as part of the
Required Services. Such work Product shall be City's sole and exclusive property as provided in Section 7
hereof. Consultant may be entitled to compensation for work satisfactorily performed prior to Consultant's
receipt of the Default notice; provided, however, in no event shall such compensation exceed the amount
that would have been payable under this Agreement for such work, and any such compensation shall be
reduced by any costs incurred or projected to be incurred by City as a result of the Default.
6.2 Termination or Suspension for Convenience of City. City may suspend or terminate this Agreement, or
any portion of the Required Services, at any time and for any reason, with or without cause, by giving
specific written notice to Consultant of such termination or suspension at least fifteen (15) days prior to the
effective date thereof. Upon receipt of such notice, Consultant shall immediately cease all work under the
Agreement and promptly deliver all "work Product" (defined in Section 7 below) to City. Such Work
Product shall be City's sole and exclusive property as provided in Section 7 hereof. Consultant shall be
entitled to receive just and equitable compensation for this Work Product in an amount equal to the amount
due and payable under this Agreement for work satisfactorily performed as of the date of the
termination/suspension notice plus any additional remaining Required Services requested or approved by
City in advance that would maximize City's value under the Agreement.
6.3 waiver of Claims. In the event City terminates the Agreement in accordance with the terms of this
Section, Consultant hereby expressly waives any and all claims for damages or compensation as a result of
such termination except as expressly provided in this Section 6.
6.4 Administrative Claims Requirements and Procedures. No suit or arbitration shall be brought arising
out of this Agreement against City unless a claim has first been presented in writing and filed with City and
acted upon by City in accordance with the procedures set forth in Chapter 1.34 of the Chula Vista Municipal
Code, as same may be amended, the provisions of which, including such policies and procedures used by
City in the implementation of same, are incorporated herein by this reference. Upon request by City,
Consultant shall meet and confer in good faith with City for the purpose of resolving any dispute over the
terms of this Agreement.
6.5 Governing Law/Venue. This Agreement shall be governed by and construed in accordance with the
laws of the State of California. Any action arising under or relating to this Agreement shall be brought only
in San Diego County, State of California.
6.6 Service of Process. Consultant agrees that it is subject to personal jurisdiction in California. If
Consultant is a foreign corporation, limited liability company, or partnership that is not registered with the
California Secretary of State, Consultant irrevocably consents to service of process on Consultant by first
class mail directed to the individual and address listed under "For Legal Notice," in section I.B. of Exhibit
A to this Agreement, and that such service shall be effective five days after mailing.

7. OWNERSHIP AND USE OF WORK PRODUCT
All reports, studies, information, data, statistics, forms, designs, plans, procedures, systems and any other
materials or properties produced in whole or in part under this Agreement in connection with the
performance of the Required Services (collectively "work Product") shall be the sole and exclusive
property of City. No such Work Product shall be subject to private use, copyrights or patent rights by
Consultant in the United States or in any other country without the express, prior written consent of City.
City shall have unrestricted authority to publish, disclose, distribute, and otherwise use, copyright or patent,
in whole or in part, any such Work Product, without requiring any permission of Consultant, except as may
be limited by the provisions of the Public Records Act or expressly prohibited by other applicable laws.
With respect to computer files containing data generated as Work Product, Consultant shall make available
to City, upon reasonable written request by City, the necessary functional computer software and hardware
for purposes of accessing, compiling, transferring and printing computer files.
8, GENERAL PROVISIONS
8.1 Amendment. This Agreement may be amended, but only in writing signed by both Parties.
8.2 Assignment. City would not have entered into this Agreement but for Consultant's unique
qualifications and traits. Consultant shall not assign any of its rights or responsibilities under this
Agreement, nor any part hereof, without City's prior written consent, which City may grant, condition or
deny in its sole discretion.
8.3 Authorit . The person(s) executing this Agreement for Consultant warrants and represents that they
have the authority to execute same on behalf of Consultant and to bind Consultant to its obligations
hereunder without any further action or direction from Consultant or any board,principle or officer thereof.
8.4 Counterparts. This Agreement may be executed in counterparts, each of which shall be deemed an
original, but all of which shall constitute one Agreement after each Party has signed such a counterpart.
8.5 Entire A eement. This Agreement together with all exhibits attached hereto and other agreements
expressly referred to herein, constitutes the entire Agreement between the Parties with respect to the subj
p Y ect
matter contained herein. All exhibits referenced herein shall be attached hereto and are incorporated herein
by reference. All prior or contemporaneous agreements, understandings, representations, warranties and
statements, oral or written, are superseded.
8.6 Record Retention. During the course of the Agreement and for three (3) years following completion
of the Required Services, Consultant agrees to maintain, intact and readily accessible, all data, documents,
reports, records, contracts, and supporting materials relating to the performance of the Agreement, including
accounting for costs and expenses charged to City, including such records in the possession of sub-
contractors/sub-consultants.
8.7 Further Assurances. The Parties agree to perform such further acts and to execute and deliver such
additional documents and instruments as may be reasonably required in order to carry out the provisions of
this Agreement and the intentions of the Parties.
8.8 Independent Contractor. Consultant is and shall at all times remain as to City a wholly independent
contractor. Neither City nor any of its officers, employees, agents or volunteers shall have control over the
conduct of Consultant or any of Consultant's officers, employees, or agents ("Consultant Related

Individuals"), except as set forth in this Agreement. No Consultant Related Individuals shall be deemed
employees of City, and none of them shall be entitled to any benefits to which City employees are entitled,
including but not limited to, overtime, retirement benefits, workers compensation benefits, injury leave or
other leave benefits. Furthermore, City will not withhold state or federal income tax, social security tax or
any other payroll tax with respect to any Consultant Related Individuals; instead, Consultant shall be solely
responsible for the payment of same and shall hold the City harmless with respect to same. Consultant shall not at any time or in any manner represent that it or any of its Consultant Related Individuals are employees
or agents of City. Consultant shall not incur or have the power to incur any debt, obligation or liability
whatsoever against City, or bind City in any manner.
8.9 Notices. All notices, demands or requests provided for or permitted to be given pursuant to this
Agreement must be in writing. All notices, demands and requests to be sent to any Party shall be deemed to
have been properly given or served if personally served or deposited in the United States mail, addressed to
such Party, postage prepaid, registered or certified, with return receipt requested, at the addresses identified

in this Agreement at the places of business for each of the designated Parties as indicated in Exhibit A, or
otherwise provided in writing.

2. Required Services
A. General Description:
Consultant shall provide general civil engineering consultant services at the direction and to the satisfaction
of the City Engineer or designee during the planning, design, and construction phases of projects.
Tasks may include but are not limited to: Construction Support, Floodplain Management, Engineering
Studies, Hydraulic 1 Hydrology Modeling, Wastewater Flow Metering, Wastewater Rate Case, Traffic
Engineering & Analysis, Grant Writing and Grant Submittal, Studies/Designs/ Specifications/cost estimates/
for Pump Station, Street, Structural, Drainage, Wastewater infrastructure, and other duties as assigned by
City it its sole discretion.
B. Detailed Description:
1. The number and scope of such civil engineering consultant service projects (each a "Project",
collectively, the "Projects"') will vary at the sole discretion of the City from year-to-year. The City, in
many cases, will provide the Consultant with Land Surveying data that has been prepared by City staff
and/or by other firms. Additionally, the City may provide Geotechnical and pothole services/data.

2. Consultant will provide personnel that are experienced in all areas of Civil Engineering which is
required to satisfy the Agreement. Knowledge of City codes, procedures, and regulations is required.
The City shall have the right to make a determination as to the qualifications of individual personnel and
shall have the right to require substitution of personnel.
3. Consultant will provide Civil Engineering services in response to the City's request for such services.
Consultant acknowledges and agrees that service requests from the City under this Agreement will be on
an "as-needed" and/or per Project basis at the sole discretion of the City. Each Project will include a
not-to-exceed fee for all time, materials, and costs permitted to be incurred for that Project. Consultant
acknowledges and agrees that the City is not required to request any services from Consultant under this
Agreement. Consultant acknowledges and agrees that it is not entitled to any compensation under this
Agreement until such time that it has provided Required Services as explicitly authorized and approved
by the City pursuant to the process identified herein
4. Consultant will identify software and methodology to be used, which shall require approval of the
City.
5. Consultant will provide all original field notes, data, reports, records, etc. of field and office tasks to
the City. Further, the Consultant shall maintain copies of all records related to the project tasks
performed for a period of five years. This period may be extended when requested by the City at no
additional cost to the City.
6. Consultant will provide the digital files for each project in Civil 3D format (City AutoCAD template),
furnish digital photos and all other records or material related to each Project to the City.
7. Consultant will submit billing forms and comply with all procedures acceptable to the City.
Consultant shall provide separate invoices for each City Project identified. Every invoice will list all
work performed on Project. Each invoice shall show total amount billed to date for Project, payments
received, and amount due. All work elements shall be itemized. Consultant shall only be paid for work
done at the request of the City's Project Manager. If additional work is requested by others, Consultant
shall obtain a written authorization from the Project Manager.
The Consultant shall forfeit and will not receive payment for work performed and billed to City more
than sixty(60) calendar days after performance of the Required Services.
S. Scoping meeting
At the beginning of each Project, Consultant shall be required to meet with the City Project Manager and
identify the scope of the Project and deliverables for the Project. Consultant shall provide the City with a
costro osal per section 4 below and schedule for work no more than 10 working days after the scope

meeting unless otherwise agreed upon by the City. Said cost proposal shall set a not-to-exceed price and
break down hoursp er task and personnel doing the work. Schedule shall include 3O%, 60%, 90%, Final
product, begin construction, end construction milestones and as-builts. In said scope meeting, the City
shall decide'how the topographic survey and the boundary survey will be obtained. Land Survey limits
shall bero osed by Consultant and approved by the City. All as-built, utility and field research

required shall be the responsibility of the Consultant and coordinated by the City. The Consultant shall
identify all other test, permits, reports or other information needed to complete the Project in proposed
scope (i.e. Geotechnical and Pothole).

Pro'ect. Environmental permitting shall be done by the Consultant, coordinated by the City and shall be

9. Progress checks
Consultant shall submit a Professional Engineer (P.E.) reviewed complete package at each of the
milestones identified that include but is not limited to studies, reports, plans, specifications and
engineering cost estimate (PSE). The number of copies shall be determined prior to submittal.

Consultant shall estimate a two-week turnaround time (ten working days) for the City review (actual
time may vary). All City comments will be addressed by the Consultant and accepted by the City

Project Manager in writing.
10. Final product
All Projects shall be in CCS 83 and NAVD 88 unless otherwise approved by City in writing. All
Projects shall also be drafted in Civil 3D (City template) using City style standards unless otherwise
approved b City in writing. Drawings with pertinent notes and details consistent with the current City

standards and the current accepted standards of practice for the professions involved. Consultant shall
utilize the current City adopted Edition of the Greenbook Standard Specifications for Public Works
Construction, Chula Vista Standard Special Provisions, Regional Standards, and Chula Vista
Construction Standards. Consultant shall also provide details and specifications to successfully construct
the
J ro'ect. Said specifications shall also conform to the City's standards for each funding source. The

findings and recommendations from any and all reports and studies for the Project appropriately
incorporated. The topography, property lines, right of way lines, easement limits, existing utilities, and

andspecifications shall be in compliance with all applicable State, Local and Federal requirements and

11. Construction support and for the As-built.
Consultant shall compile As-builts on final plans.
12. Plan Review
Consultant will also be requested to review PSE, Studies and general engineering documents prepared

price of providing this work shall be negotiated in good faith between the City and the Consultant. The

Consultant acknowledges and agrees that it shall not be entitled to any additional compensation without further
authorization issued in writing and approved by the City. Nothing herein shall preclude Consultant from
providing additional Services at Consultant's own cost and expense.

Consultant and each of its subconsultantslsubcontractors will comply with the State of California's prevailing
wage rate requirements in accordance with California Labor Code, and all Federal, State, and local laws and
ordinances applicable to persons employed by them for public works in a covered work classification. when
payment of prevailing wages apply to the Required Services the wage rates and transportation and subsistence
costs shall be reimbursed at the minimum rates set by the Department of Industrial Relations, State of California
(DIR). The State's prevailing wage rates determinations are available from the DIR home page at
www.dir.ca.gov/oprl/. The City has ascertained that general prevailing wage rates may be applicable to all or a
portion of the work to be performed for the Required Services. To verify compliance with State prevailing
wage requirements, the DIR maintains an online registry of contractors to which Consultant and./or its
subconsultantslsubcontractors will be required to submit certified payrolls. Subject to the exceptions provided
in the California Labor code, no Consultant or any of its subconsultantslsubcontractors shall be qualified to bid
on be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or
a

engag in the performance of any contract for public work unless currently registered with the DIR and
qualified to perform public work pursuant to California Labor Code section 1725.5. When payment of

1.Required Filers

This FIRST AMENDMENT ("Amendment") is entered into effective as of July g, 2019
("Effective Date") by and between the City of Chula Vista (`City") and Kimley-Horn and
Associates, Inc ("Consultant") with reference to the following facts:
RECITALS
WHEREAS, City and Consultant previously entered into the City of Chula Vista
Consultant Services Agreement With Kimley-Horn and Associates, Inc. to Provide Civil
Engineering Consulting Services for Various Capital Improvement Program Projects, ,Agreement
Control Number 17116 and Resolution Number 2017-178, on November 1, 2017 ("Original
Agreement"); and
WHEREAS, the City has identified additional services that it desires to have Consultant
perform pursuant to the terms of the Original Agreement; and
WHEREAS, the Parties anticipate that the performance of the additional services will
require payment to Consultant in excess of the annual not-to-exceed amount of$500,000 as set
forth in Section 4.B of the Original Agreement; and
WHEREAS, Section 8.1 of the Original Agreement provides that the parties are permitted
to modify the Agreement by means of a written amendment executed by both Parties; and
WHEREAS, the Parties wish to increase the Original Agreement's annual not-to-exceed
amount as shown in Exhibit A, Section 4 of the Original Agreement, from $500,000 to $750,000
and total contract maximum not-to-exceed amount from $2,000,000 to $212501000.
NOW, THEREFORE, in consideration of the above recitals and the mutual obligations of
the parties set forth herein, City and Consultant agree as follows:
1. Exhibit A. Scope of Work and Payment Terms, Section 4.B of the Original Agreement
is amended as follows:
"Limitation without Further Authorization on Time and Materials Arrangement.
Each Project assigned will set a not-to-exceed fee for all time, material, and costs
permitted to be incurred for that Project. In addition, the combined total for all
time, materials, and costs on all assigned Projects from the Effective Date through
October 31, 2018 shall not exceed$500,000.00 and the combined total for all time,
materials, and costs on all assigned Projects from November 1,2018 to October 31,

4. Exhibit A. Scope of Work and Payment Terms, Section 3 of the Agreement is amended
and restated as follows:
Term: In accordance with Section 1.10 of this Agreement,the term of this Agreement shall
begin November 1, 2017 and end on October 31, 2021. If work on one or more Projects
are in progress on the expiration date of this Agreement, the terms of the Agreement shall
be extended by administrative amendment prior to the expiration of the Agreement to
extend the time as needed to complete the in-progress Projects.
5. Except as expressly provided herein, all other terms and conditions of the Agreement
shall remain in full force and effect.
6. Each party represents that it has full right, power and authority to execute this Second

design of the Telegraph Canyon Channel Improvements (DRN0208)project ("Project"); and
WHEREAS, Kimley Horn and Associates, Inc. HA) was selected as the design.
consultant for the Project and the parties negotiated a proposed price of $793,631 to complete
design services for the Project; an
WHEREAS, the proposed prise to complete the design services by KHA and additional
expenses tied to the design and construction would exceed funds available in the Project; and
WHEREAS, staff recommends an appropriation of $3,927,518 from the existing
"Drainage IIF (542)" fund to "Telegraph CCanyon. Channel Improvements (DRN0208)"' to

TO THE CONSULTING SERVICES AGREEMENT BETWEEN
THE CITY OF CHULA VISTA AND KIMLEY-HORN AND
ASSOCIATES, INC. INCREASING TME NOT-T -EXCEED
AMOUNTS AND ADDING SUBCONSULTANTS
WHEREAS, It of Chula Vista (City) and Kimley-Horn and Associates (KHA are
parties in the City of Chula Vista Consultant Services Agreement with Kimley-Horn and
Associates, Inc. to Provide Civil Engineering Consulting Services for Various Capital
Improvement Program Projects, dated November 1, 2017 ("Agreement"); and
WHEREAS, the Agreement is an on-call contract with an original term of two (2) years
with options to extend the Agreement for two (2) additional one-year periods; and
WHEREAS, KHA is currently in the second option term under the Agreement, which has
an annual not-to-exceed dollar limit of$500,000; and
WHEREAS, on September 8, 2020,Department of Engineering and Capital Projects' staff
issued a Request for Proposal to the City's Civil Engineering on-call consultants for the design of
the Telegraph Canyon Channel Improvements (DRNo2o,8)project("Project"); and
WHEREAS, KHA was selected as the design consultant for the Project and the parties
negotiated a proposed price of$793,631 to complete design and related services for the Project,
which is in excess of the annual not-to-exceed limit of $500,000 for the current to of the
Agreement; and
WHEREAS, in order to allow the City to proceed with necessary design, right-of-way
acquisition, environmental permitting, and grant application submissions for the Project, City staff
recommends approving the second amendment to the Agreement to increase the annual not-to-
exceed amount for the current term of the Agreement by$80o,000, for a new annual not-to-exceed
amount for the current term of $1,3oo,000, and increasing the total Agreement not-to-exceed
amount to $3,050,000; and
WHEREAS, the proposed second amendment to the Agreement would also allow
additional subconsultants to perform services necessary for the design, right-of-way acquisition,
environmental permitting, and grant application submissions for the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
that it approves the Second Amendment to the Consultant Services Agreement between the City
of Chula Vista and Kimley-Hom and Associates, inthe form presented, with such modifications
as approved or required by the City Attorney, and authorizes and directs the Mayor to execute the
same, a copy of which shall be kept on file in the office of the City Clerk.

SUMMARY
In accordance with the emergency provisions in the City's Municipal Code Section 2.56.1001, Emergency
Purchases, City staff contracted the services of Bert W. Salas, Inc. (General Engineering Contractor License
No. 275199) for the repair of failed storm drain facilities adjacent to 604 Melrose Avenue., A City Manager
informational item was submitted on August 11,2020 (Attachment 1) indicating that staff would report back
to the City Council after the full cost of the emergency repair was identified. All work associated with the
repair was completed on April 7,X021. This report presents the total expenditures for the emergency repair
work.
ENVIRONMENTAL REVIEW
This action is exempt from California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines
Sections 15269 (Emergency Projects) and 1.5359 (Emergency). This action is necessary to prevent furter
damage and threat to public infrastructure and private property.Notwithstanding the foregoing,the project
also qualifies for a Categorical Exemption pursuant to State CEQA Guidelines Section. 15301. Class 1. (Existing
Facilities), Section 15302 Class 2 (Replacement or Reconstruction), and Section 15304 Class 4 (Minor
Alterations to Land)because the proposed action would not result in a significant effect on the environment.,
create a cumulative impact, damage a scenic highway, or cause a substantial adverse change in the
significance of a historical resource.Thus,no further environmental tal review is required.

DISCUSSION
On April 11, 2020, Caltrans staff working on the Interstate 805 widening sound wall project notified
Engineering staff of a sinkhole in the open space area adjacent to the residential property at 604 Melrose
Avenue. The sinkhole and resulting slope failure were due to the collapse of a 24-inch corrugated metal pipe
(CMP).
On April 23, 2020, Public Works staff completed an assessment of'the storm drain piping upstream and
downstream of the failed area using closed-circuit television (CC'TV). Based on this evaluation and a review
of the as-built documents, Engineering staff identified approximately 75 feet of failed 24-inch CMP storm
drain in need of'replacement. An additional approximately 100 feet of 24-inch CMP needed to be cleaned
and evaluated to determine if additional replacement was required. A site exhibit showing the area of work
including the storm drain manhole next to 604 Melrose Avenue, sinkhole, and storm drain manhole in the
Caltrans right of way is included as Attachment 2.
Due to the extent of slope failure and expected storm drain replacement, Public Works staff was not able to
replace the pipe and restore the slope. Immediate action was required to avoid further damage to City
infrastructure and impacts to the Caltrans, infrastructure and private residential property. Staff
recommended removing and replacing the existing 24-inch CMP storm pipe immediately and restoring the
slope, on an emergency basis,due to the threat to public infrastructure and private property.
Staff solicited informal bids from three qualified contractors with experience performing this type of storm
drain replacement and slope stabilization work in accordance with the provisions in the City's Municipal
Code Section 2.56.100,Emergency Purchases. The Director of Engineering and the City Manager agreed with
the recommendation to take immediate action and award the contract to the lowest responsible,responsive
bidder, Pert' . Salas, Inc.to repair the storm drain facilities.
Contractor Selection Process
Staff prepared and solicited three informal bids from qualified contractors that had previously worked for
the City on storm drain rehabilitation projects. On May 7, 2020 the City received the following three
proposals:

The emergency work included replacing 184 lineal feet of 24-inch storm drain piping and a storm drain
cleanout and was completed on December 28, 2020. A Caltrans security fence that was removed to access
the failed storm drain facilities was replaced on April 7, 2021.

emergency replacement of failed CMP,storm drains outside the right of way.

SUMMARY
The Animal Care Facility has received two grant awards in the amount of $32,500 to use for low cost
Spay/'Ne�uter clinics for residents in our service area. These grant awards need to be appropriated in the
Fiscal Year 2022 Budget. staff requests that$3,2,500 be appropriated to the supplies & Services and other
expense categories in the other Grant Funds for the Animal Care Facility department budget; this
appropriaton is fully offset by grant revenues.

DISCUSSION
The Chula Vista Animal Care Facility received a grant in the amount of$7,500 from the State of California
Department of Food & Agriculture and $25,000 from the Petco Foundation. These funds will be used to
provide low cost Spay/Neuter Clinics for pet owners in Chula Vista, Lemon Grove and National City. 'This
funding will allow the CVACF to provide approximately low cost spay neuter services to approximately 500
animals.

DISCUSSION
Originally established in 1982, the blaster Fee Schedule (Schedule) is a centralized listing of the fees
charged by the City for administrative acts and lather legally required fees. The City has established user
fees to best ensure that those who use a proprietary service pays for that service in proportion to the benefit
received.
The target scot recovery levels for City Services related to the Animal Care Facility range depending on
whether the services are ancillary or mandatory, and to balance public benefit. For example, the City has
always offered love cost spar/neuter services to encourage animals be altered. our fee has always been
significantly low. Allowing for a higher fee for larger dogs allows the City to increase cost recovery rates
while Still offering a low-cost option.. Multiple items on the fee schedule are being recommended for a slight
increase to better reflect actual cost.

The proposed fee changes as identified in Attachment 1 allow for the City to recoup more of the Animal
Care Facility's costs while still offering incentives to encourage responsible pet ownership and adoption of
Shelter animals. Staff recommends that the City Council amend the Master Fee Schedule as outlined in this
report and the attachment.

WHEREAS, the City owns and operates the Chula Vista Animal Care Facility, a
municipal animal shelter providing animal care and control services to the community; and
WHEREAS, established in 1982, the Master Fee Schedule (Schedule) is a centralized
listing of the fees charged by the City for administrative acts and other legally required fees-, and
WHEREAS, the Master Fee Schedule is periodically updated to reflect changes in costs.
The City last amended Chapter 3 (Animal Control) of the City's Master Fee Schedule in 2013
and 2017; and
WHEREAS, the proposed fee does not exceed the estimated reasonable cost of providing
the associated services; and
WHEREAS, Article XIII C of the California Constitution requires a vote of the electorate
to increase any levy, charge, or exaction imposed by a local government, unless specifically
exempted; and
WHEREAS.
,, pursuant to the provisions of Article XII C, the proposed fees are exempt
from the vote requirement; and
WHEREAS, the proposed amendment to the Master Fee Schedule Chapter 3 (Animal
Control) shall become effective upon adoption of this Resolution by the City Council.

DISCUSSION
For decades, Chula Vista Police Department ent C P°D las partnered with the Sweetwater Union High School
District SUHSD) and Chula Nista Elementary School District CVESD to ensure the safety,welfare and best
possible educational opportunities of students and staff on school campuses in Chula vista. Campus security
is increased by the presence of police officers who proactively and positively interact with students. Police
officer presence on campus improves relations between the Police Department and the youth of the
community.
It is the goal of the Police Department's School Resource Officer (SRO) program to enhance the safety,
security and success of the District's scholastic institutions by maintaining close, consistent and productive

relationships with students,their families,and staff. This program was designed to help students to obtain
an equal opportunity to achieve academic,social and community success in a safe environment. On-campus,
School Resource Officers focus on maintaining a positive partnership with students and staff,providing early
intervention services to youth and overall improved community relations through partnership,prevention,
intervention, education and progressive enforcement strategies.
The entire SRO program currently consists of one,Police Sergeant,one Police Agent,ten (10) Police Officers,
and one Secretary. The SRO program provides service to 62 public schools (11 high schools,7 middle schools
and 44 elementary schools) in the City of Chula Vista and serves a student population of approximately
51,130 students.
Since 2010, a portion of the costs for the SRO program has been shared between the City of Chula Vista,the
LVESD, and the S,UHSD. The SUHSD originally provided funding for slightly less than the cost of one-half
(0.5) Police Agent and four (4.0) Police Officers. These four and one-half sworn personnel provided services
to 20 sites and scholastic institutions and more than 40,000 students within the SUHSD.,
Recent discussions between the Police Department and the SUHSD showed that the actual personnel costs
of the SRO program have been increasing since 2010/2011, while the cost reimbursed by SUHSD had
remained the same. In 2020/2021 the total cost for the SUHSD-portion of the SRO program was $834,391,
but the amount reimbursed by the District would remain $500,000 (the same amount since 2010/2011).
This means that non-reimbursed costs incurred to the City for that portion of the program have grown from
$79,863 in 2011/2012,to$334,391 in 2020/2021.
Both the Police Department and the District acknowledged that reduced funding, coupled with increased
community demand for emergency public safety services,would reduce the Police Department's capacity to
provide non-emergency services to the SUHSD. As a result of'reduced funding,the number of Police Officers
assigned to SUHSD will be reduced from four Police Officers to three Police Officers for 2020/2021 and
beyond.
On February 22,2021,the SUHSD School Board approved the Memorandum of Understanding(MOU)for the
SRO program during the 2020/2021 school year. The cost to SUHSD will remain $500,000 in 2020�/20�21.
The MOU covers a one-year period of July 1, 2020 to June 30, 2021, and may be extended for two (2)
additional one-year periods upon written approval of both parties.
The SRO MOLT with Chula Vista Elementary School District (CVESD) has already been executed for the
2020/2021 school year,covering a one-year period of July 1, 2020 to June 30, 2021. The Police Department
will seek Council approval before signing the SRO MOU with CVESD during the 2021/2022 school year.
DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and
consequently, the real property holdings of the City Council members do not create a disqualifying real
property-related financial conflict of interest under the Political Reform Act(Cal.Govt Code§87100,et seq.).

CURRENT-YEAR FISCAL IMPACT
The reimbursement from Sweetwater Union High School District partially covers the personnel costs, of one
Police Agent and three Police Officers in the SRO program. Since these personnel costs are already included
in the, Police, Department's baseline budget, no additional appropriations are, required by accepting this
Memorandum of Understanding.

MISSIONSTATEMENT: It is the mission of the Sweetwater Anion High School District
in concert with the Chula Nista Police Department to provide a safe, secure, orderly and
effective teaching and learning environment for all students and staff within the
Sweetwater Union High School District and the City of Chula Vista by protecting life and
property.
Ensuring the safety, welfare, and best possible educational opportunities of students and
staff on school campuses in Chula Vista is a priority to the school administration and the
Police Department. carpus security will be increased by the presence of police officers
who will interact with the students in both a positive and proactive ,runner. Police officers
on carpus will help improve relations between the Police Department and the youth of
the community.
On-campus, school Resource Officers will focus on maintaining a positive partnership
with students and staff, providing early intervention services to secondary school youth
and overall improved community relations through partnership, prevention, intervention,
education and progressive enforcement strategies.
The goal of the school Resource Officer program is to enhance the safety, security and
success of the District's scholastic and interscholastic institutions by maintaining close,
consistent and productive relationships with students, their families, and District staff.
As a result, the Sweetwater Union High School District and the City of Chula Vista Police
Department agree to undertake the following responsibilities and expectations to achieve
these mutual objectives:
A. SCHOOL DISTRICT'S ROLE AND RESPONSIBILITY:
1. Ensure student welfare portal to portal;
. Develop procedures to handle campus safety issues;
. Develop emergency response procedures;

foster positive relationships and to ensure the safety of students, their
families, and District staff. parties mutually intend to annually hold at least
one (1) jointly-planned District, student forum and two (2) Jointly-planned
District community forums regarding school safety, security and policing,
including review of relevant District, school, and community impact data as
agreed to by the parties, once meetings can be Feld in person.
c. When available assist Student Attendance review Board (S.A.R.B.)
,meetings by providing law enforcement 'intervention or action as needed in
collaboration with the District
d. Assisting the School District in scheduling security activities as needed.
e. When available, being the first response in all law-enforcement related

students and staff occurring during regular school hours.
f. When available attending various sporting events and school activities
during regular school hours as needed for proactive enforcement and
interaction to provide for a preventative presence, student and staff
interactions, and enforcement as appropriate.

regulations.
h. Assisting with developing and revising school security procedures and
emergency response drills as requested.
i. Assisting the school's safety committee in developing the School safety
Flan.
j. Comply with all student confidentiality requirements, including the Family

the laws and providing equal service to the public, regardless of immigration
status, race, ethnicity, gender, religious beliefs or any other protected class.

C. PERFORMANCE:
Either party may request an informal meeting to discuss any concern regarding
compliance with the Boles and responsibilities listed above. Parties agree to conduct
such meeting no later than 10 work days after the request.

D. TIME FRAME
This Memorandum of Understanding shall become effective July 1, 20 20 for a one
year period ending dune 30, 2021. This Memorandum of Understanding may be
extended for two(2)additional one-gear periods upon written approval of both parties.
Either party shall have the right to cancel this Memorandum of Understanding upon
90 days advance written notice during the term of this agreement.
E. SPAN of CONTRO UJ U RIS DICTION:
Prevention/education/training/proactive activities will take place at Alta Dista
Academy, Alternative Education, Bonita Vista High School, Sonata Dista Middle
School, castle Park High School, Castle Park Diddle School, Chula Vista Adult
School, Chula Vista High School, Chula Vista Middle School, Eastlake High School,
Eastlake Middle School, Hilltop High School, Hilltop diddle School, MAAC Community
Center, Olympian High School, Options Secondary, otay Ranch High School,
Palomar High School, Rancho Del Rey Diddle School, STEP and at public meeting
places within the respective communities as it relates to the Sweetwater Union High

In order to maintain the School Resource office- Program, in 2010 the Sweetwater
Union Highs School District agreed to pair for services of one Police Agent and four
Police officers who were assigned to the School Resource Officer program. The
Chula Vista Police Department funded a Police Sergeant who supervised the
program.
Recent discussions with the Police Department and School District showed that the
actual personnel casts of School Resource Officers has been increasing since 2010-

2011, while the cost reimbursed by the School District has remained the same. The
actual cost incurred by the Police Department for school resource Officers assigned
to the Sweetwater Union High School District in 2020-2021 will total $834,391, but the
costs reimbursed by the District remained $500,000 (the same amount since 010-
2011). This equates to a 8% reduction in funding for the District's School Resource
Officer Program (as outlined in Exhibit A, SUHSD SFO Financial Analysis FY1 - ).
Both parties acknowledge that reduced funding, coupled with increased community
demand for emergency public safety services elsewhere, will reduce the Police
Department's capacity to provide non-emergency services to the Sweetwater Union
High school District. As a result of reduced funding, the number of Police Officers
assigned to the Sweetwater Union High School District will be reduced from four
Police officers to three Police Officers for 2020-2021 and beyond.
To catch up with cost increases, the cost to the Sweetwater Union High School District
will remain $500,000 in 2020-2021, (as outlined in Exhibit B, SUHSD SRO Cost, 3
Officers F o- ).
Should the District desire to increase the number of dedicated School Resource
Officers, the Police Department can provide revised cost estimates for reimbursement
in accordance with the number of officers requested.
This Memorandum of Understanding shall be effective July 1, 2020. Upon execution
of this Memorandum, the Sweetwater Union High School District, upon invoicing, will
pay to the Finance Director of the City of Chula Nista, the agreed amount in quarterly
installments. If the agreement is canceled as herein permitted, the City shall return
forthwith to the District the portion of such payment allocable to the period of the terra
subsequent to the effective date of cancellation.
H, NO INDEPENDENT BASIS FOR LIABILITY;
Nothing herein shall create, by this or other Agreement between the parties, an
independent basis for liability of the City to either the District or to a third party for
failing to respond, for responding to a call for police services in an alleged dilatory or
negligent manner, or for any action or omission by a Police Department employee
pursuant to this Agreement. The City's liability, if any it may have, shall be that as
determined by lain without regard to the existence of this Agreement.
I. COMPLIANCE WITH APPLICABLE LAM
The City and the District, in the performance of the services to be provided herein,
shall comply with all applicable state and federal statutes and regulations, and all
applicable ordinances, rules, and regulations of the City whether now in force or
subsequently enacted. Similarly, the City shall comply with all applicable rules,
regulations, and policies of the District, including policies regarding student
confidentiality that are consistent with local, state, and federal law.

Approve/ratify renewal of Memorandum of Understanding between the Sweetwater Union High School District
(SUHSD) and the City of Chula Vista for School Resource Officer(SRO) services, for the 2020-2021 and 2021-2022
school years.
Analyte:
The Police Department of Chula Vista provides uniformed School Resource Officers for all district schools in their
Jurisdiction. The school resource officers under contract with SUHSD and their respective agency enable the district
to provide the necessary support to schools In Chula Nista. The presence and pro-active support of lava enforcement
has greatly enhanced school security. School Resource Officers provide campus security and police follow-up;
classroom presentations related to youth and the law; attendance at parent meetings and student events; and
participate on the School Attendance Review Board (SARB) and School Safety Committees, when available.
The Sweetwater Union High School District and the Chula Vista Elementary School District have agreed to jointly pay
the cost of one Police Agent and police Officers who are assigned to the School Resource Officer program. The Chula
Vista police Department will fund the Police Sergeant who supervises the program. The total cost to the Sweetwater
Union High School District for participation in the School Resource Officer program will remain $500,000, for the
2020-2021 school year, and $551,002, for the 2021-2022 school year. The resource officers will be assigned to
district schools located within the City of Chula Vista.
This Board Agenda Item supports LCAP Goal 2, safe and healthy learning environment, because it helps to provide
safer campuses for students and staff.

SUMMARY
In October 2017, City Council approved an update to Chapter 7 of the Master Fee Schedule to establish
program cost recovery targets basad on exclusivity and community benefit,as well as updated many facility
usage-fees. Field fees were not addressed in the October 2017 update and field fees have not been updated
since 2011. with a consistent increase in grater casts (the City has experienced a 10.8% increase in otayT
Water District rates just in the previous 2 fiscal years)and an increase in labor casts,the maintenance budget
for Parks a.n.d. Recreation is not sufficient to sustain quality playing fields and surfaces.Additionally, due to
behavioral change of'the community due to COVID-19 closures and restrictions,field use and outdoor sports
activities are increasing and becoming more important to residents of Chula Vista. Chula Vista Parks and
Recreation is proposing;to increase the recovery rate of fees for field usage and updating;policies and usage
fees for other amenities to allow continuation of services and to increase funding for necessary maintenance
improvements.
For the past 10, years, library book and CIS fines as a revenue source have consistently declined, with the
administrative costs of accepting library book and CIS fines exceeding the revenue from library fines.
Additionally,most library systems in San. Diie o County have discontinued fines for library books.Due to the
decline in revenue and best practices, the Chula Vista Public Library is proposing to eliminate library book
(Children and Adult) and.CLQ fines.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the California
Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under
Section 15378, of the State CEQA Guidelines because it will not result in a physical change in the
environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not
subject to CEQA. Thus,no environmental review is required.

The Parks and Recreation Commission met for on September 17, 2020, and recommended City Council
approve an Update to Chapter 7 (Recreation) of the Master Fee Schedule.
DISCUSSION
Parks and Recreation Fees
The current annual Chula Vista Parks Maintenance budget totals $6.,6 million., Sports field maintenance and
associated costs are roughly$1.6 million.The Chula Vista field system consists of'71 sports fields,68 of which
are available, to be allocated by Chula Vista nonprofit youth sports organizations. On average, each sports
field is allocated roughly 1,500 hours annually.
In October 2017, City Council approved an update to Chapter 7 of'the Master Fee Schedule. The update
established program cost recovery targets based on exclusivity and community benefit, as well as updated
many facility usage-fees.Field fees were not addressed in the October 2017 update and this recommendation
proposes a modest increase of fees for Chula Vista nonprofit youth sports organizations (previously listed
under"Youth Sports Council")using City-allocated sports fields,as well as identifies policies and procedures
for field use.
Current fees in the Master Fee Schedule for Chula Vista nonprofit youth sports organizations are $11 per
team. Cost recovery targets for Chula Vista department youth sports programs are 31%-70�%,. Revenues for
the previous full year from the recognized Chula Vista nonprofit youth sports organizations which were
allocated Chula Vista sports fields totaled$6,512,equaling a cost recovery rate of 0.,5%.Under an agreement
that was terminated last year, Chula Vista nonprofit youth sports organizations were, also paying an
$11/player "donation" that went into a Supplemental Maintenance Fund to,be used for maintenance above
and beyond basic maintenance of sports fields. With the inclusion of the donations, the cost recovery rate
would equal about 5.5%.Although the nonprofit sports organizations are not department programs and not
subject to the cost recovery targets established by City Council, it is the aim of the department to consider
the cost recovery percentages of the organizations when establishing usage fees. The proposed fees, when
fully implemented,would equal a cost recovery rate of about 20%.
The current Master Fee Schedule does not list any objective criteria to qualify for this rate. The following
language is proposed to be included in the Master Fee Schedule and would identify two separate tiers to
differentiate between organizations and teams providing open access/recreational offerings, and clubs that
are select/limit participation. Organizations aligning within a tier would pay the associated fee.
TIER 1
Organizations,or portions of organizations,that assign registrants to teams in an effort to make the teams in
each division of equal playing experience and talent (not assigned to teams of different talent levels), and
must be recreational in nature and have an "everyone plays, no child is turned away" philosophy requiring
that each player suited-up and able to play is entered into games for a significant period of time (i.e. 1/2 of
game or 2 of every 5 innings or 2 of 4 quarters, etc.). Organizations must show current proof of nonprofit
status and be in good standing,must be registered or affiliated with a recognized governing sports body and

maintain a local board of governance, and each participant roster must be comprised of'a minimum of 75%
residents of the City of Chula Vista.
TIER 2
Organizations or Individual Teams from Organizations that otherwise meet all Tier 1 requirements EXCEPT
one or more of the following: tryouts are held in order to place registrants according to their ability on
competitive teams (select, travel, etc.); applicants may be turned away; or not every player suited up
participates in significant playing time in every game; or organizations compensate local
executive/administrative staff and/or board members or coaches for their service to the league.

Chula Vista fields are constantly in high demand between Chula Vista nonprofit youth sports organizations,
local schools, adult teams,as well as the general public.The following field use priority levels are proposed
to establish criteria to assist in permitting field use.

consistent with City's amphitheaters. The pavilion does not have any installed tables or benches and is the
largest covered outdoor gazebo in the City. Additionally,we have reviewed and adjusted the permit fees for
Athletic Fields,Active Recreation Areas,and Tournament fees at Mt.San Miguel.

Library Fees
The current annual Chula Vista Public Library budget totals to$4 million. With 2020 revenues totaling to
$800,000 and library fines only being 3%of the revenue,. Since 2011,the Chula Vista Public Library,,has
seen a significant decline in library book and CD fines,with fine revenues previously totaling over$170,000
and drastically declining to less than$25,000 per year.
Since 2 011,the movement towards a digital collection has supported the elimination of library fines as card
holders are not charged late fines for digital materials. In the past three years,the library has increased its
digital collection,adding more titles into our digital collections through Overdrive and Hoopla. The Chula
Vista Public Library has circulated over 10,,000 titles in the past year in our digital collection.,
The recommendation to eliminate library book and CD fines aligns with industry trends toward removing
barriers to access and decrease the administrative work associated with the collection and enforcement of
library fines. With more than 40,000 library card holders blocked from checking out materials because of
delinquent library fines,the elimination of fines will allow the community access to the library.
DECISION-MAKER CONFLICT"
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and
consequently, the real property holdings of the City Council members do not create a disqualifying real
property-related financial conflict of interest under the Political Reform Act(Cal.Govt Code§87100,et seq.).
Staff is not independently aware, and has not been informed by any City Council member, of any other fact
that may constitute a basis for a decision-maker conflict of interest in this matter.
CURRENT-YEAR FISCAL IMPACT
There is no current year fiscal impact from this action.
ONGOING FISCAL IMPACT
There are no projected negative impacts to the general fund.Additional operating and maintenance costs for
Parks and Recreation will be offset by revenue generated by the approval of the resolution.Administrative
cost savings for the Library will be offset by the elimination of fine collections for books and CDs.

CHULA VISTA A Al' ENDING CERTAIN SECTIONS OF
CHAPTER I 7 (RECREATION) OF THE CITY'S MASTER FEE
SCHEDULE
WHEREAS, in October 20171 City Council approved an update to Chapter 7 of the
Master Fee Schedule; and
WHEREAS, the update established program cost recovery targets based on exclusivity
and community benefit, as well as updated many facility usage-fees; and
WHEREAS, field fees were not addressed in the October 2017 Master Fee Schedule
update; and
WHEREAS, field fees have not been updated since 2011- and
WHEREAS, field use and outdoors sports activities are increasing and becoming more
important to the community- and
WHEREAS, current fees in the Master Fee Schedule for Chula vista nonprofit youth
sports organizations are 1.1 per team and the current Master Fee Schedule does not list any
objective acriteria to qualify for this rate- and
WHEREAS, cast recovery targets for Chula vista department youth sports programs are
31%-70%; and
WHEREAS, revenues for the previous full year from the recognized Chula vista
nonprofit youth sports organizations which were allocated Chula vista sports fields totaled
,512, equaling a cost recovery rate of 0.5%; and
WHEREAS, Chula Nista Parrs and Recreation is proposing increasing the recovery rate
of fees for field usage and updating policies and usage fees for other amenities to allow
continuation of services and to increase funding for necessary maintenance improvements;is and
WHEREAS, Parks & Recreation is proposing a per player rate to allow for fired
expenses for the organizations; an
WHEREAS, the proposed fees, when collected for an entire year, and assuming
participation remains consistent, would equal a cost recovery rate of about 20% and
WHEREAS, language is proposed to be included in the master Fee Schedule and would
identify two separate tiers to differentiate between organizations and teams providing open
access"recreational. offerings and clubs that are select/limit participation; and

WHEREAS, additionally, staff have reviewed and adjusted the permit fees for Athletic

WHEREAS, Article XIII C of the California Constitution requires a vote of the electorate
to increase any levy, charge, or exaction imposed by a local government, unless specifically

WHEREAS, pursuant to the provisions of Article XIII C, the proposed fees are exempt

NOW, THEREFORE,, BE IT RESOLVED that the City Council of the City of Chula

WHEREAS, pursuant to the provisions of Article XIII C of the California Constitution,
the proposed fees are exempt from the vote requirement; and
WHEREAS, the proposed amendments to Chapter 5 of the Master Fee Schedule sball
become effective upon adoption of this Resolution by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
that it does hereby amend certain sections of Chapter 5 (Library) of the City's Master Fee
Schedule, in the form presented, with such minor modifications as the City Attorney may
