RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A JOINT USE AGREEMENT
BETWEEN THE CITY OF SAN DIEGO AND THE CITY OF
CHULA VISTA FOR THE COLOCATION OF AN EXISTING
CITY OF SAN DIEGO SOUTH METRO INTERCEPTOR
SEWER PIPELINE IN A SEGMENT OF E STREET
WHEREAS, the City of San Diego is engaged in the activity of conveying wastewater to
the environs of the City of San Diego, State of California; and
WHEREAS, the City of San Diego owns, operates, and maintains the existing 78-inch
San Diego South Metro Interceptor Sewer Pipeline, commonly known as San Diego South Metro
, located, in part, within a new segment of E Street between Bay Blvd and
I-5 Interchange as part of the Costa Vista RV Resort development project; and
WHEREAS, Sun Communities, Inc. (Sun) is the developer of the Costa Vista RV Park
Resort development and Sun wishes to develop the project as approved on September 18, 2019
pursuant to the San Diego Unified Port District Coastal Development Permit, Document No.
70332, which includes construction of the E Street segment; and
WHEREAS, Sun has substantially constructed the E Street segment over the City of San
Diego easement descB of the Joint Use
Agreement (Attachment 2); and
WHEREAS, Chula Vista will operate and maintain the E Street segment, and related
facilities, as a public transportation facility; and
WHEREAS, will continue to operate and
maintain the SDSMI and associated facilities and appurtenances for such purpose, under and
across this segment of E Street; and
WHEREAS, the proposed Joint Use Agreement between the parties is intended to set
forth each partys respective rights and obligations for the construction, operation, and
maintenance of their respective facilities within the Joint Use Area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
that it approves the Joint Use Agreement By and Between the City of Chula Vista and the City of
San Diego (E Street and Bay Boulevard), in the form presented, with such minor modifications
as may be required or approved by the City Attorney, a copy of which shall be kept on file in the
Office of the City Clerk, and authorizes the City Manager or designee to execute the agreement.
