RESOLUTION NO. 2021-023
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING THE FIRST AMENDED AND
RESTATED AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND SCG SPICER CONSULTING GROUP, LLC.
FOR SPECIAL TAX CONSULTANT SERVICES FOR
ASSESSMENT DISTRICTS, COMMUNITY FACILITIES
DISTRICTS, OPEN SPACE DISTRICTS AND ANNUAL
SEWER ASSESSMENT ADMINISTRATION SERVICES
WHEREAS, the City has utilized the services of SCG Spicer Consulting Group, LLC.,
to perform the necessary tasks in the administration of the Citys Assessment Districts,
Community Facilities Districts, Open Space Districts, and Sewer Assessment District including
delinquency management and apportionment services; and
WHEREAS, the current maximum contract amount is $400,000.00 for a three-year
period ending March 31, 2021; and
WHEREAS, during this three-year period, continuing disclosure and arbitrage calculation
services were also needed for Non-Land Based Bond Issues; and
WHEREAS, during this 3-year period, District formation and modification services were
also requested; and
WHEREAS, the City wishes to amend and restate the current contract to: (i) include
continuing disclosure and arbitrage calculation services for non-land-based bond issues, and
District formation and modification services; (ii) extend the initial term through June 30, 2022,
with a maximum contract amount of $760,000; and (iii) provide for a one-year option to extend
through June 30, 2023, for an amount not to exceed $240,000; and
WHEREAS, the total maximum contract amount for the original Agreement, the
Amended and Restated Agreement and the one-year option to extend, if exercised by the City,
would be $1,000,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista, that it approves the Amendment and Restated Agreement between the City of Chula Vista
and SCGSpicer Consulting Group, LLC. for the Special District Apportionment, Delinquency
Monitoring Administration, and Other Services, in the form presented, with such minor
modifications as may be required or approved by the City Attorney, a copy of which shall be
kept on file in the Office of the City Clerk, and authorizes and directs the Mayor to execute the
same.
