HomeMy WebLinkAboutReso 2021-010RESOLUTION NO. 2021-010 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA WAIVING THE COMPETITIVE BID PROCESS AND AUTHORIZING THE USE OF VARIOUS ORIGINAL EQUIPMENT MANUFACTURERS AND AUTHORIZED REPAIR SHOPS THROUGH DECEMBER 31, 2026 WHEREAS, the Citys equipment and vehicle fleet consists of different pieces which at times require varying repairs; and WHEREAS, the City utilizes the services of various Original Equipment Manufacturers (OEMs) and authorized repair shops for the repair of the Citys fleet vehicles and equipment to ensure that the Citys equipment and fleet is available for use; and WHEREAS, in accordance with Chula Vista Municipal Code 2.56.070 (B)(3) the City Council may waive the competitive bidding requirements if determined that the competitive bidding requirements as applied are impractical, impossible, or that the City interest would be materially better served by applying a different purchasing procedure approved by the Citys Purchasing Agent as being consistent with good purchasing practices; and WHEREAS, during its normal course of business, it is impossible to predict what repairs may be necessary in a Fiscal Year; and WHEREAS, due to the limitations in the number of OEMs and authorized repair shops in the area with specialized knowledge and expertise, it is impractical to obtain three competitive quotes on any individual repairs, especially those of a time sensitive nature; and WHEREAS, the use of authorized OEMs and repair shops allows City vehicles and equipment to retain their warranties, while servicing outside of these authorized OEMs and repair shops could invalidate these warranties; and WHEREAS, the OEMs and authorized repair shops provide greater knowledge and experience in the repair of the specialized equipment and fleet thereby guarantee that necessary repairs will be completed in a timely and thorough manner, and at a competitive cost; and WHEREAS, based on the foregoing recitals, the Purchasing Agent has approved the proposed purchasing procedure for OEMs and authorized repair shops as consistent with good purchasing practices. Resolution No. 2021-010 Page No. 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it determines that the competitive bidding requirements for procuring services through authorized OEMs and repair shops are impractical, impossible, or that the City interest would be materially better served by applying the different purchasing procedure approved by the Purchasing Agent. BE IT RESOLVED by the City Council of the City of Chula Vista that it waives the competitive bid process and authorizes the use of the following Original Equipment Manufacturers and Authorized Repair shops for the term of five (5) years ending December 31, 2026. \[SIGNATURES ON THE FOLLOWING PAGE\] Resolution No. 2021-010 Page No. 3 Presented by Approved as to form by Kelly G.
