HomeMy WebLinkAboutReso 2021-009RESOLUTION NO. 2021-009 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE SECOND AMENDMENT TO THE CITY OF CHULA VISTA CONSULTANT SERVICES AGREEMENT WITH HARRIS AND ASSOCIATES TO PROVIDE HORIZONTAL DIRECTIONAL DRILLING CONSULTING SERVICES WHEREAS, Chula Vista Municipal Code section 2.56.110 authorizes the City to enter into contracts for professional services; and WHEREAS, Chula Vista Municipal Code section 2.56.110(H)(2) provides an exception to the competitive bidding requirements for professional services contracts where competitive bidding would be impractical and the Citys interests would be materially better served by applying a different purchasing procedure; and WHEREAS, the G Street Sewer Force Main Rehabilitation project, now referred to as the r Force Main a will replace approximately 1,300 linear feet of 54-year old asbestos-cement sewer force main pipe located along G Street on the Collins Aerospace (Collins) campus; and WHEREAS, City proposes to utilize Horizontal Directional Drilling (HDD) methods to install the proposed sewer force main pipe, in order to minimize disruption to existing soil conditions as well as to daily Collins operations; and WHEREAS, on January 1, 2018, Harris & Associates ) entered into the sultant Services Agreement with Harris and Associates to Provide Horizontal Directional Drilling Consulting Services Original Agreementwith the City to provide professional engineering services to support the Project design with respect to HDD technology, design, and constructability and to ensure the Project moves successfully through the design, bid, and construction phases of the Project; and WHEREAS, on January 8, 2019, per Resolution 2019-001, the City Council approved the First Amendment to the Original Agreement (First Amendment) to retain Consultant to provide additional services to address unforeseen complexities with respect to the HDD design and constructability, based on staffs determination that the Consultants expertise in HDD was required to complete the design; and WHEREAS, the First Amendment increased the total not-to-exceed amount of the agreement by $70,840, for a total agreement amount of $90,840; and Resolution No. 2021-009 Page No. 2 WHEREAS, staff recommends retaining the Consultant to provide further additional services during the bidding and construction phases of the Project due to their expertise and extensive familiarity with HDD and the Project, and because competitively bidding this additional work would be impractical given the scope and timing for the project and could also potentially result in delays to imminent improvements related to the Bayfront development; and WHEREAS, City and Consultant desire to amend the agreement to increase the contract amount by $57,120 to provide bid support and engineering services during construction, for a new total not-to-exceed agreement amount of $147,960. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it approves the Second Amendment to the City of Chula Vista Consultant Services Agreement with Harris and Associates to Provide Horizontal Directional Drilling Consulting Services, between the City and Harris and Associates, in the form presented, with such minor modifications as may be required or approved by the City Attorney, a copy of which shall be kept on file in the Office of the City Clerk and authorizes and directs the Mayor to execute same. \[SIGNATURES ON THE FOLLOWING PAGE\] Resolution No. 2021-009 Page No. 3 Presented by Approved as to form by William S.
