Members of the public participated remotely and were not present in Council Chambers. All votes were taken by roll call and public comments were submitted electronically or otherwise in writing. The City Council minutes are prepared and ordered to correspond to the City Council Agenda. Agenda items may be taken out of order during the meeting. The agenda items at this meeting were considered in the order presented. CALL TO ORDER A regular meeting of the City Council of the City of Chula Vista was called to order at 5:07 p.m. via teleconference and in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL: Present: Councilmember Diaz, Deputy Mayor Galvez, Councilmember McCann, Councilmember Padilla and Mayor Casillas Salas Also Present: City Manager Halbert City Attorney Googins, City Clerk Bigelow, and Assistant City Clerk Turner PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Councilmember Galvez led the Pledge of Allegiance. B. 20-0183 PRESENTATION OF A PROCLAMATION TO DIRECTOR OF PUBLIC WORKS IRACSEMA QUILANTAN AND DIRECTOR OF ENGINEERING AND CAPITAL PROJECTS WILLIAM VALLE, PROCLAIMING THE WEEK OF MAY 17 THROUGH MAY 23, 2020 AS NATIONAL PUBLIC WORKS WEEK IN THE CITY OF CHULA VISTA City of Chula Vista Page 1 City Council Meeting Minutes - Final May 12, 2020 Mayor Casillas Sa/as read the proclamation. Public Works Director Quilantan spoke regarding the item and presented a video. CONSENT CALENDAR (Items 1 - 7) Councilmember McCann stated he would abstain from voting on Item 7 due to a potential business-related conflict of interest. Maximilliano Ramirez, Chula Vista resident, submitted comments in support of staffs recommendation on Item 7. 1. 20-0155 APPROVAL OF MINUTES of October 15, 2019. Recommended Action: Council approve the minutes. 2. 20-0193 ORDINANCE NO. 3488 OF THE CITY OF CHULA VISTA REQUIRING ALL BUSINESSES OPERATING WITHIN THE CITY TO PREPARE AND POST CITY -APPROVED SOCIAL DISTANCING AND SANITATION PROTOCOLS (SECOND READING AND ADOPTION) Recommended Action: Council adopt the ordinance. 3. 20-0194 RESOLUTION NO. 2020-094 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RATIFYING AND CONFIRMING EMERGENCY ORDER 002-C-2020 (EFFECTIVE MAY 8, 2020) OF THE CHULA VISTA DIRECTOR OF EMERGENCY SERVICES ESTABLISHING TERMS FOR A LIMITED OPENING OF CITY PARKS AND TRAILS AND UPDATING FACE COVERING REQUIREMENTS TO CONFORM WITH COUNTY -WIDE STANDARDS Recommended Action: Council adopt the resolution. 4. 20-0018 RESOLUTION NO. 2020-095 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A NEW 3.2 -ACRE BIKE SKILLS PARK FACILITY IN THE OTAY VALLEY REGIONAL PARK, RECREATION AREA 6 Recommended Action: Council adopt the resolution. 5. 20-0051 RESOLUTION NO. 2020-096 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2020/21 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 Recommended Action: Council adopt the resolution. 6. 20-0140 RESOLUTION NO. 2020-097 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE THIRD AMENDMENT TO THE MEDICAL DIRECTOR AGREEMENT BETWEEN THE REGENTS OF THE UNIVERSITY OF CALIFORNIA AND THE CITY OF CHULA VISTA Recommended Action: Council adopt the resolution. City of Chula Vista Page 2 City Council Meeting Minutes - Final May 12, 2020 7. 20-0152 RESOLUTION NO. 2020-098 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA (1) APPROVING AN AMENDMENT TO THE FISCAL YEAR 2019/20 HUD ANNUAL ACTION PLAN TO RE -PROGRAM $1,036,425 OF HOME INVESTMENT PARTNERSHIP ACT FUNDS; (2) APPROPRIATING HOME INVESTMENT PARTNERSHIP ACT FUNDS IN THE AMOUNT OF $1,036,425 TO A TENANT -BASED RENTAL ASSISTANCE PROGRAM IN RESPONSE TO COVID-19; (3) AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND SOUTH BAY COMMUNITY SERVICES FOR THE MANAGEMENT AND IMPLEMENTATION OF A TENANT -BASED RENTAL ASSISTANCE PROGRAM; AND (4) AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL RELATED DOCUMENTS NECESSARY TO OBTAIN THE HUD FUNDS (4/5 VOTE REQUIRED) Recommended Action: Council adopt the resolution. PUBLIC COMMENTS 8. 20-0195 PUBLIC COMMENTS RECEIVED for May 12, 2020 Theresa Acerro, Chula Vista resident, submitted comments expressing concern regarding illegal cannabis activities. Peggy Walker, Chula Vista resident, submitted comments in opposition to legalizing commercial cannabis activities. Jose Cabalo, Chula Vista resident, submitted comments expressing concerns regarding problems in the City. City of Chula Vista Page 3 City Council Meeting Minutes - Final May 12, 2020 The following Chula Vista residents submitted comments opposing contact tracing: - Stacy Domer - Heavenly Daniel - Naomi Kehs - Alicia Ornelas - Priscilla Pasimio - Judy Gunnon - Mariah Ahmad ACTION ITEMS 9. 19-0503 RESOLUTION NO. 2020-099 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE 2020 ACTIVE TRANSPORTATION PLAN Principal Civil Engineer Rivera and Monique Chen and Andrew Prescott, consultants, representing Chen Ryan, gave a presentation on the item. Randy Torres -Van Vleck, representing Bike Walk Chula Vista, submitted comments in support of staffs recommendation. Matthew Lowery, Chula Vista resident, submitted comments in appreciation of staffs work and recommended additional connectivity between west Chula Vista and the Bayfront. Councilmember Diaz inquired about the public safety response times, Principal Civil Engineer Rivera responded. Deputy Mayor Galvez questioned the J Street corridor lighting and street signal changes for bike lanes, Principal Civil Engineer Rivera and consultant Prescott responded. ACTION: A motion was made by Mayor Casillas Salas, seconded by Councilmember McCann, to adopt Resolution No. 2020-099, heading read, text waived. The motion carried by the following roll call vote: Yes: 5 - Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 10. 20-0166 RESOLUTION NO. 2020-100 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING DONATIONS FROM THE LUCKY DUCK FOUNDATION AND THE STATE OF CALIFORNIA TO FURTHER SUPPORT THE CITY'S RESPONSE EFFORTS TO THE COVID-19 EMERGENCY Mayor Casillas Salas announced that Items 10 and 11 would be heard concurrently. A revised resolution for Item 10 was distributed to the Council and action on the item was with respect to the revised document. Housing Manager Hines, Police Chief Kennedy, Homeless Outreach Team Captain Sergeant Pinedo, and Sr. Management Analyst Davis presented the item. Council discussion ensued. Sr. Management Analyst Davis responded to questions of the Council. Chief Geering announced that a revised resolution for Item 12F had been distributed to the Council. Action taken on the item was with respect to the revised document. Fire Chief Geering and Human Resources Director Chase answered questions of the Council. The motion carried by the following roll call vote: Yes: 5 - Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 CITY MANAGER'S REPORTS City Manager Halbert expressed gratitude to Director of Information Technology Chew and the IT Department for the improvement in sound quality of the meeting. He gave an update on the COVID-19 cases from data received by Scripps and Sharp Hospitals in Chula Vista. MAYOR'S REPORTS Mayor Casillas Salas made reference to the importance of continuing to take the proper precautions in social distancing. COUNCILMEMBERS' COMMENTS Deputy Mayor Galvez expressed her deep sorrow to learn of the passing of MTS CEO Paul Jablonski. Councilmember Diaz spoke regarding social distancing and staying safe. Councilmembers McCann and Padilla recognized mothers in honor of Mothers Day and asked all to stay safe. CLOSED SESSION City Attorney Googins announced that Items 13 and 14 were continued to a future meeting. Pursuant to Resolution No. 13706 and Council Policy No. 346-03, Official Minutes and records of action taken during Closed Sessions are maintained by the City Attorney. 13. 20-0145 CONFERENCE WITH LEGAL COUNSEL --ANTICIPATED LITIGATION Significant exposure to litigation pursuant to Government Code Section 54956.9d)(2) [or](3): [1] Case re Notice of Potential Liability, Request for Information, Request for Payment, and Request for Performance of Work Associated with Releases and Threatened Releases of Hazardous Substances at the San Diego Bay National Wildlife Refuge Site in Chula Vista and National City, California. Item 13 was not heard and was trailed to a future meeting. 14. 20-0165 CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(d)(1) City of Chula Vista v. Monsanto Company, et al., United States District Court, Case No. 18-CV-01942-WQH-AGS Item 14 was not heard and was trailed to a future meeting.
