HomeMy WebLinkAboutItem 01 - Resolution RESOLUTION NO. __________ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN THIS CITY ON NOVEMBER 3, 2020, DECLARING THE RESULTS THEREOF, AND OTHER MATTERS AS ARE PROVIDED BY LAW WHEREAS, a special municipal election was held and conducted in the City of Chula Vista, California, on Tuesday, November 3, 2020, as required by law, for the purpose of electing two (2) members of the City Council, representing Districts 3 and 4, each for a full term of four years, commencing in December 2020; and WHEREAS, notice of said election was duly and regularly given in the time, form, and manner as provided by law; and in all respects the election was held and conducted, and the votes cast at the election received and canvassed, and the returns made and declared, in the time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in charter cities; and WHEREAS, pursuant to Resolution No. 2020-069, adopted April 7, 2020, the election was consolidated with the statewide general election, and the Registrar of Voters canvassed the returns of said election and has certified the results. The results are received and made a part hereof, attached as Exhibit 1. NOW, THEREFORE, BE IT RESOLVED, DECLARED, AND DETERMINED by the City Council of the City of Chula Vista, that: 1. The City of Chula Vista had 46,464 registered voters eligible to vote in District 3 and 35,202 registered voters eligible to vote in District 4 in the November 3, 2020 election. There were 19 voting precincts established in District 3 and 12 voting precincts established in District 4 for the purpose of holding the election. 2. The total number of votes received by each candidate is as follows: a. FOR MEMBER OF THE CITY COUNCIL, DISTRICT 3 (four-year term) STEVE PADILLA 19,359 VOTES (56.32%) HENRY A. MARTINEZ II 15,016 VOTES (43.68%) The City Council does hereby declare and determine that Steve Padilla, having received a majority of all votes cast, is elected to the office of District 3 City Council Member, to be sworn into office on December 8, 2020. b. FOR MEMBER OF THE CITY COUNCIL, DISTRICT 4 (four-year term) ANDREA CARDENAS 12,179 VOTES (52.00%) MIKE DIAZ 11,241 VOTES (48.00%) The City Council does hereby declare and determine that Andrea Cardenas, having received a majority of all votes cast, is elected to the office of District 4 City Council Member, to be sworn into office on December 8, 2020. 3. The number of votes given at each precinct and the number of votes given in the City to the candidates named above for the offices for which they were candidates, are listed in Exhibit 1, attached to this Resolution and incorporated by this reference. 4. The City Clerk shall enter on the records of the City Council of the City of Chula Vista a statement of the results of the election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted; (4) The number of votes given at each precinct to each person; and (5) The total number of votes given to each person. 5. That the City Clerk shall immediately sign and deliver to each of the persons so elected a certificate of election; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in California Constitution and shall have them subscribe to it and file it in the office of the City Clerk. The term for each person so elected shall then commence. 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
