HomeMy WebLinkAboutItem 5 Resolution RESOLUTION NO. __________ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DESIGNATING A HEARING OFFICER TO CONDUCT A PUBLIC HEARING REGARDING THE ISSUANCE, SALE AND DELIVERY OF MULTIFAMILY HOUSING REVENUE BONDS OF THE CHULA VISTA HOUSING AUTHORITY WHEREAS, the Chula Vista Housing Authority (the “Authority”) intends to issue not to exceed $35,000,000 aggregate principal amount of multifamily housing revenue notes (the “Notes”) to finance the costs of developing a 175-unit multifamily rental housing project known as Otay Ranch Apartments located east of La Media Parkway and bounded by Main East Street and Main West Street within the Otay Ranch Escaya master planned community (the “Project”) in the City of Chula Vista, California (the “City”); and WHEREAS, the Project will be owned and/or operated by Otay Affordable I V8, LP, or another limited partnership affiliated with Meta Housing Corporation (the “Owner”); and WHEREAS, pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), the Bonds are required to be approved, following a public hearing (the “TEFRA Hearing”), by an elected representative of the governmental unit having jurisdiction over the area in which the Project is located; and WHEREAS, the Project is located wholly within the geographic jurisdiction of the City; and WHEREAS, the City Council is the elected legislative body of the City; and WHEREAS, in accordance with State Guidelines issued regarding COVID-19 pandemic, the City has modified its operations, per Emergency Order 002-D-2020 of the Chula Vista Director of Emergency Services, to conduct all City Council meetings via teleconference until further notice; WHEREAS, 26 C.F.R. sec.1.147(f)-1 [“Section 1.147(f)-1”] permits the requisite public hearing to be conducted by any individual appointed or employed by the City, its agencies, or the issuer, pursuant to procedures established by the City that allow interested individuals a reasonable opportunity to express their views; and WHEREAS, in the interest of the health and safety of the community, the City desires to designate an individual to conduct a TEFRA Hearing, in accordance with Section 1.147(f)-1 during such states of emergency. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Chula Vista, as follows: Resolution No. _________ Page 2 Section 1. The City Council does hereby find and declare that the above recitals are true and correct. Section 2. Pursuant to Section 147(f)-1, the City Council hereby designates the City Manager as the hearing officer appointed to conduct TEFRA Hearings during such times designated as a state of emergency, at the time, date and location of their selection and to publish all notices and take all other actions required in connection therewith. All persons who wish to participate in a TEFRA hearing and desiring to speak at the hearing must make a written request to speak at least 24 hours before the hearing by coordinating with the City Clerk’s Office and must limit their oral remarks as prescribed in Chula Vista Municipal Code Section 2.04.230.
