HomeMy WebLinkAboutReso 2003-345RESOLUTION NO. 2003-345 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE FINAL "B" MAPS OF CHULA VISTA TRACT NO. 98-06B, OTAY RANCH, VILLAGE ONE WEST SOUTH, NEIGHBORHOODS R-59C, AND R-60. ACCEPTING ON BEHALF OF THE CITY OF CHULA VISTA THE ASSIGNABLE AND IRREVOCABLE GENERAL UTILITY AND ACCESS EASEMENTS AND WALL EASEMENTS, GRANTED ON SAID MAPS WITHIN SAID SUBDIVISIONS, APPROVING THE SUBDIVISION IMPROVEMENT AGREEMENTS FOR THE COMPLETION OF IMPROVEMENTS REQUIRED BY SAID SUBDIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS WHEREAS, on December 17, 2002, by Resolution No. 2002-533, the City Council approved a Tentative Subdivision Map for Chula Vista Tract 98-06B, Otay Ranch, SPA One, Village One West South; and WHEREAS, the project is located south of East Palomar Street and west of Heritage Road within the area of Otay Ranch SPA One designated as Otay Ranch Village One West South; and WHEREAS, the final map for R-59C consists of 43 numbered lots and 9 lettered lots with a total of 24.881 acres; and WHEREAS, the final map for R-60 consists of 49 numbered lots and 7 lettered lots with a total of 7.364 acres; and WHEREAS, the final maps have been reviewed by the Engineering and Planning Departments and found to be in substantial conformance with the approved tentative map; and WHEREAS, approval of the maps constitutes acceptance by the City of all assignable and irrevocable general utility and access easements, and all wall easements within the subdivision as shown on the maps; and WHEREAS, the developer has secured its share of the development portion of the Park Acquisition and Development (PAD) fees for SPA One neighborhood and community parks; and WHEREAS, the developer has provided an Irrevocable Offer of Dedication of Fee Interest for its portion of the land acquisition obligation for community parks with the approval of the "A" Map for Village One West South; and WHEREAS, the developer has bonded for and agrees to complete all street improvements required for the approval of these "B" Maps within two years following map approval, or sooner if construction permits for the required improvements have been issue; and Resolution 2003-345 Page 2 WHEREAS, these maps have a preserve conveyance obligation which is met through a conveyance of open space land and the Conveyance Settlement Agreement approved on August 27, 2002 by Resolution No. 2002-343; and WHEREAS, there are no fiscal impact to the City and Developer has paid all costs associated with the proposed "B" Maps agreements. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby approves the Final "B" Maps of Chula Vista Tract No. 98-06B, Otay Ranch, Village One West South, Neighborhoods R-59C and R-60. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista accepts on behalf of the City of Chula Vista, the assignable and irrevocable general utility and access easements, and wall easements granted on said maps within said subdivisions. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista approves the Subdivision Improvement Agreements for the completion of improvements required by said subdivision. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby authorized to execute said agreements for and on behalf of the City of Chula Vista.
