HomeMy WebLinkAboutReso 1986-12386 RESOLUTION NO. 12386 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DENYING CONDITIONAL USE PERMIT PCC-86-16 FOR MINI-MARKET AND SELF-SERVICE GAS STATION AT 495 TELEGRAPH CANYON ROAD The City Council of the City of Chula vista does hereby resolve as follows: WHEREAS, the Atlantic Richfield Corporation has appiied for a conditional use permit (PCC-86-16) for a mini-market and self- service gas station at 495 Telegraph Canyon Road, and WHEREAS, the mini-market and self-service gas station, if approved, would result in the conversion .of an existing service station located at the same address, and WHEREAS, on January 22, 1986, the Planning Commission considered the application of Atlantic Richfield during a public hearing and by a vote of 6 to 1 denied PCC-86-16, and WHEREAS, the Planning Commission's denial of Atlantic Richfield's proposal was based on the fact that no evidence had been presented to indicate that the proposed use was necessary or desirable to provide a service or facility which would contribute to the general well-being of the neighborhood, and WHEREAS, the Planning Commission also found that the proposed use would be detrimental to the general welfare of persons residing or working in the vicinity since a viable automobile station would be removed, and WHEREAS, the City Council conducted a public hearing on February 25, 1986 to consider the appeal of Atlantic Richfield. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby denies Conditional Use Permit PCC-86-16 for a mini-market and self-service gas station at 495 Telegraph Canyon Road and concurs with the decision of the Planning Commission based on the following findings: 1. No evidence has been presented to substantiate the statement by the applicant that the proposed mini-market would be a necessary or desirable service for the neighborhood or the community. A petition signed by 100 residents of the area states that the conversion would be detrimental to the neighborhood, adding congestion, noise, and traffic to the intersection. -1- 2. The proposed use will be detrimental to the general welfare of persons residing or working in the vicinity since a viable and needed automobile service activity will be eliminated in order to provide the mini-market operation.
