HomeMy WebLinkAboutReso 2020-210RESOLUTION NO. 2020-210 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING EMERGENCY CONTRACT CHANGE ORDERS WITH SANCON TECHNOLOGIES, INC. FOR THE CMP REHABILITATION INSIDE THE RIGHT-OF- WAY PROJECT (CIP NOs. DRN0205/DRN0212); AND TRANSFERRING $1,450,000 IN TRANSNET APPROPRIATIONS FROM STM0402, MAJOR PAVEMENT REHABILITATION, TO DRN0205 WHEREAS, on January 23, 2020, the Director of Finance awarded a construction contract to Sancon Technologies, Inc. for the CMP Rehabilitation Inside the Right-of-Way project, CIP No. DRN0205/DRN0212; and WHEREAS, Chula Vista Municipal Code section 2.56.100.A authorizes the City Manager or Purchasing Agent to purchase supplies, equipment, or contractual services in cases of an emergency which poses an immediate threat to public health, safety or welfare; and WHEREAS, Chula Vista Municipal Code section 2.56.100.A further provides that where an emergency purchase of supplies, equipment, or contractual services is made, City staff is to provide the City Council with an explanation of the circumstances of such emergency which shall be entered in the minutes of the Council at the first available meeting following the commitment to the expenditure and shall be open to public inspection; and WHEREAS, due to pipe failures and resulting sinkholes at 4619 Main Street, 855 Energy Way, and Broadway and J Street, the City contracted with Sancon Technologies, Inc. through emergency contract change orders to repair the sinkholes and prevent further damage to public infrastructure and abutting private property, and to avoid potential risks to public health and safety; and WHEREAS, extensive repairs were required to repair the sinkholes resulting in cost increases to the DRN0205/DRN0212 project for labor and materials, exceeding the approved contingencies; and WHEREAS, the work for DRN0205/DRN0212 is in progress and additional funds are required to complete the sinkhole repairs and prevent failure of the public infrastructure and abutting private property, which would necessitate significantly more costly repairs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it approves emergency contract change orders with Sancon Technologies, Inc. for the CMP Rehabilitation Inside the Right-of-Way Project (CIP Nos. DRN0205/DRN0212); and transferring $1,450,000 in TransNet appropriations from STM0402, Major Pavement Rehabilitation, to DRN0205.
