HomeMy WebLinkAbout2020-09-22 - Item 7 - PresentationEviction & Foreclosure Protections Sept 25, 2020 Timeline of Actions Date Action March 13 Declared State of Emergency March 16 California Governor’s California Executive Order N-28-20 •Allowing local jurisdictions ability to protect residential and commercial tenants and homeowners related to COVID-19; Extended through Sept 30, 2020 by EO N-71-20 •Stay at home to slow transmission rate March 17 Chula Vista adopted Ordinance 3483A (“Eviction Moratorium”) •Consistent with Governor’s Executive Orders; Extended through Sept 30, 2020 March 27 California Governor’s Executive Order N-37-20 •Banning the enforcement of eviction orders related COVID-19; Expired May 31, 2020 March 27 California Judicial Council’s Emergency Rules 1 & 2 •Suspends eviction of tenants for any cause, unless to protect public health and safety •Stays all actions for judicial foreclosures •Sunset Sept 1, 2020, except where a local ordinance provides protection August 31 AB 3088 Tenant, Homeowners, and Small Landlord Relief and Stabilization Act of 2020 Act •Covers residential tenant evictions from March 1, 2020 through January 31, 2021. •From August 31, 2020 through April 1, 2021 provides a process to allow eligible homeowners and small landlords post-mitigation loss options Key Components of Tenant Protection Ordinance 3489A (“Eviction Moratorium”) •Covered period March to Sept 30, 2020, unless extended •Residential/Commercial Tenants and Homeowners •Notice of COVID-19 financial impact and support documentation •Required each month w/in 7 days of rent due •Suggested payment schedule •Repay within 6 months of end of Moratorium (March 31, 2021) AB 3088 (“State Tenant Protection”) •Covered period March to Jan 31, 2021 •Residential Tenants •Declaration of COVID-19 financial impact and NO support documentation •Required each month w/in 15 days of rent due •Payment of 25% of rent due from Sept 2020 to Jan 2021 •Repayment of balance due begins March 1, 2021 •Considered “consumer debt” Inter-relationship of Local, State and Federal Protections •AB 3088 Goal: Statewide consistency and a pause on local measures. •Local jurisdictions are restricted from enacting, extending, or expanding local measures from August 19, 2020 and January 31, 2021. •CDC Order for the “Temporary Halt in Residential Evictions to Prevent Further Spread of COVID-19” •Effective September 4, 2020 through December 31, 2020 •Does NOT apply in any State, local, territorial, or tribal area with a moratorium on residential evictions that offers the same or greater level of public- health protection •Economically Vulnerable Residents •Residential Tenants are Protected BUT Homeowners are NOT •Homeowner Protection •CARES ACT: Forbearance for federally backed mortgages (e.g. Fannie Mae, Freddie Mac, FHA, VA, and USDA) •Options for payment at time of sale or refinancing •Small Businesses, the Core of our Economy •95% of businesses w/10 or less employees •Impacted by State mandated closures and restrictions on operations •Limitations on occupancy •Exhaustion of assistance and cash reserves Recommendations •No further protections for residential tenants or homeowners be enacted by the City •Staff to monitor •Provide direction on any actions that may be necessary for the protection of commercial tenants For more Information and to Contact Us: Need Help Right Away?
