RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A TWO-PARTY AGREEMENT
BETWEEN THE CITY OF CHULA VISTA AND
ENVIRONMENTAL SCIENCE ASSOCIATES TO SERVE AS A
PRESERVE STEWARD/BIOLOGIST, AUTHORIZING UP TO
TWO 1- YEAR EXTENSIONS TO THE AGREEMENT AND
APPROPRIATING FUNDS THEREFOR
WHEREAS, the City Council approved the City of Chula Vista Multiple Species
Conservation Program (MSCP) Subarea Plan on May 13, 2003; and
WHEREAS, the City of Chula Vista MSCP Subarea Plan identifies major policie s and
implementation measures to guide development and the protection of the biological and cultural
resources within the City MSCP Subarea Plan boundary; and
WHEREAS, the City of Chula Vista MSCP Subarea Plan’s overall management goal is to
ensure that the biological values of natural resources, where land is preserved as part of the MSCP
through acquisition, regulation, mitigation or other means, are maintained over time; and
WHEREAS, in accordance with the City of Chula Vista MSCP Subarea Plan, the City is
responsible for the maintenance and management of Preserve land owned in fee title by the City
within the City’s MSCP Subarea Plan as well as Otay Ranch preserve lands located within the
unincorporated County of San Diego; and
WHEREAS, the City of Chula Vista executed an Implementing Agreement between the
City, United States Fish and Wildlife Service, and the California Department of Fish and Game to
establish a MSCP for the Conservation of Threatened, Endangered and Other Species in the
Vicinity of Chula Vista, CA on January 13, 2005; and
WHEREAS, the Implementation Agreement contractually binds each of the Parties to
faithfully perform the obligations, responsibilities, and tasks assigned to it pursuant to the terms
of the City of Chula Vista Subarea Plan and the Implementation Agreement; and
WHEREAS, on March 2, 2020, a Request for Proposals was distributed to qualified
biological consultants in order to solicit candidates interested in serving as a MSCP Preserve
Steward/Biologist; and
WHEREAS, upon completing a competitive bidding process, the City has selected
Environmental Science Associates (ESA) to serve as a Preserve Steward/Biologist in order to
manage and monitor the biological resources within the City’s Preserve system in accordance with
the approved City of Chula Vista MSCP Subarea Plan and Implementing Agreement; and
WHEREAS, City may procure work on zero up to several Preserve projects of varying size
and complexity throughout the duration of the Two-Party Agreement; and

WHEREAS, funding source OD00014-880-DISBURS for the Shinohara Remediation
project is a deposit account with funds currently available for use and no appropriation is required.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista
does hereby approve the two-party agreement with ESA and the City of Chula Vista for biological
consulting services as a Preserve Steward/Biologist (the “Agreement”) and authorizes the City
Manager to execute the Agreement, and up to two 1 year extensions to the Agreement, on behalf
of the City.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it
appropriates $10,000 from the available fund balance of Community Facilities District 98-3
(Sunbow II).
