The Council asked for a thorough vetting process to ensure that Chula Vista gets the best operators. It’s important for the city not omit the costs of a thorough employee background review for each marijuana business. Having an accurate cost to permit a marijuana business will have to the city is vital. There are direct and in-direct costs, such as administrative and enforcement costs for regulating these high-risk businesses. These are the realities a city needs to consider before allowing these businesses to operate in the community. I ask this in reference to my 4/5 year experience living next to a STVR. My concerns are Safety, Noise Nuisance, Health & Wellness. Safety: My 2 minor daughters have been approached on our property on 3 separate occasion by male STRV guests and asked if they want to come "party" with them. Guests come to my home, indicating it's per the owner's request, to let us know they're having a party & not to call the police. Guest sleep in their cars & in tents as overflow. STVR advertised & booked as an event space. Owner of STVR shares my noise complaint text message to him with the guests via screenshots, leaving me to personally feel vulnerable to retaliation & retribution. I no longer feel safe in my neighborhood or in my home. Noise Nuisance: Event space rental; large crowds; loud music, talking, shouting heard all hours of the day. CVPD come to the STVR multiple times a week. Health & Wellness: Guests urinate in my yard, throw trash, cigarette butts, beer cans. Little to no COVID precautions seen: no masks, no social distancing. Guests comments indicate vector issue. Current collaboration with Code Enforcement, Mayor's Office, CVPD, Vector Control. We need collaboration with City Attorney for an Ordnance; COVID, no event rentals, no gatherings larger than 6 people, no outdoor music, no parties. Suzanne Olvera Location: Submitted At: 12:51pm 08-24-20 I would like to request the Mayor, City Council and the City Attorney to taking into consideration the need for a short term rental ordinance that puts restrictions against single family homes being rented out as event venues for more than 6-10 people. My husband and I moved to our home in Chula Vista because it was a quiet family neighborhood. We had no idea that in a few years we would be living next door to a "loud event venue". It is very difficult to feel safe and enjoy my home when there are constant parties. I have to keep my windows closed due to the noise and my doors locked because I do not always feel safe. Our Neighborhood is not set up to hold large events. Parking is at a premium and Melrose and Windsor Circle are not wide streets and can become a safety hazard that puts everyone in danger. I no longer feel safe in my neighborhood. There are different people living next to me every 1-3 days. I have had a renters walk into my home; jump into my backyard; shooting bb's in the front yard; walk on my roof; throw drug paraphernalia in our yard; urinate in our yard. It makes me feel uneasy that the owner feels the need to hire security guards to stand outside his property. We continually call the police and have contacted code enforcement but it is now time for the City of Chula Vista to issue an ordinance regarding short term party rentals. In the event of an emergency (or in normal times work commuting) how will 141 vehicles be able to exit quickly? Project also ignores required distances from property lines, 45 foot required easement for underground pipes,, Balanced Community Policy, State Solar law, and plans building on a public street. .Have Allied Waste and the fire department seen these plans? Where are the 5 monitoring wells required by MND? Where are the three inlets? Several homes are next to trolley fence causing wasteful use of energy for AC needed to keep windows closed because of noise and vibration from trolley and nightly freight train another General Plan violation (3.5.1, EE21, 3.1.7 & EE 7.1, efficient energy use). This plan needs to be redone or another larger location for it found. The city's existing horrendous traffic problems in morning and evening during normal times shows how unbalanced CV is., Ignoring the General Plan again will only make the situation worse. With the COVID-19 crisis going on this is the worst possible time to uproot essential businesses-some of whom have been here for between 20 and 30 years. Kleen Abrasives needs the rail. The owner brings in renters constantly, the turnover is usually every 2-3 days. Some parties I have seen are weddings, baby/bridal showers, birthday/graduation/college frat/bachelor & bachelorette parties, some with strippers. I have heard the most explicitly demoralizing versions of music. I've seen trash cans full of used whippets & large quantities of alcohol. I once saw 5-6 guys urinating on the fence. Parties have been broken up by CVPD where 40-60 extremely upset people get evicted, making me often afraid for my property, vehicles & family; even worse, worrying they might decide to return with a gun. The owner addresses complaints in his listing, and refers to the "yellow house", which is my house. I have a picture of the owner, while checking in a large group, pointing directly at my house. If anyone gets visited by the CVPD or evicted, it makes me fearful of retribution that a disgruntled guest might retaliate against us.The owner has told me he "is running a business" however I am trying to build a life and raise a family. Our street once was quiet & safe, it's not anymore. Since the STVR's been in operation, cars come & go all hours of the night with loud radios, people fighting in the street, even people that can't walk on their own & fall down in my driveway. I'm frustrated & concerned for the safety, well-being & mental health of my family. Prop 13 devastated educational funding in our state overnight in 1978. It was meant to protect individuals, but ended up giving tax breaks to large corporations. We are now 41st in per pupil spending, despite the fact that our economy is ranked 5th in the world, larger than Great Britain and France. Prop 15 keeps protections for individuals. Opponents use scare tactics to make people feel like this will affect them. Unless they are sitting on property worth over $3 million, it will not. As a PTA leader, I have seen firsthand how our underfunded educational system leaves districts having to make deep cuts to important programs and classroom supplies, and leaves teachers and PTAs to make up the difference. For the past 10 years I have worked at Alliance San Diego and trust me when I say we have seen the impact of budget shortfalls like the one on the horizon. We are always looking for the opportunities that produce the most change for the greatest number of people. It's time to take care of the people and make sure those profiting from our misery are held accountable! Prop 15 will maintain the current tax rate of 1%—one of the lowest property tax rates in the country. Prop 15 explicitly protects all residential properties from increased taxes. It also protects all agricultural properties. In addition, it not only exempts small businesses with properties valued at $3 million or less (indexed for inflation) from increased taxes, it also provides a tax cut to them by eliminating the business personal property tax on the first $500K on equipment/computers/machinery/furniture. This will help small businesses recover. Research shows that this will raise up to $12B every year in California when fully implemented. I am an educator and lived in San Diego for a long time. I grew up going to California public schools. It has been nothing short of tragic watching as schools have had programs cut statewide over the past couple of decades. Things have changed drastically since I was in school just over 10 years ago. I'm currently a school aide and have seen firsthand how everything from school supplies & technology to enrichment classes are stretched threadbare. California schools desperately need the funding that Prop 15 would provide. The idea of preventing schools from getting more funding is unacceptable to me. Prop 15 would raise $10-12 billion annually to support public education and social services. It is an efficient and extremely necessary way to expand revenues required to build and support sustainable public services. It's no surprise that the opponents to Prop 15 are those who prioritize corporate profits over literally everything else. Nor are they getting the city/county services they need.Prop 15 will require that all commercial/industrial properties valued at $3M or more be reassessed at fair market value, and pay taxes on that basis. This is how it is done in every other state. Prop 15 will maintain the current tax rate of 1%—one of the lowest property tax rates in the country. Prop 15 explicitly protects all residential properties from increased taxes. It also protects all agricultural properties. Our cities and counties have also suffered from chronic budget shortfalls—and we’ve been forced to “nickel and dime” our way to provide services through sales taxes, parcel taxes, fees. Prop 15 also gives a tax cut that would allow small businesses to grow. Developed in partnership with the small business community, it is supported by restaurants, construction & start-up companies & small business chambers of commerce. In addition, the resolution claims that administrative costs of Prop 15 would hurt the city. However, the City of Chula Vista would actually gain >$5M/year. It would also provide funding for community resources that have been underfunded for years, including schools, fire safety, health & other vital services. No other state in the US taxes commercial & industrial property as we do in California. Instead we have raised sales taxes & other fees to provide for basic services such as fire safety. These regressive forms of taxation have an unfair impact on low-income residents & workers.
